So, you have no warrant. Get away from my house. Get away from my house or I'll sue your department. >> You'll do what? >> house. >> You'll do what? >> Sue our department is what he just said. >> I'll sue your department. >> Remember the guy who said that I'm going to sue you and the police said, "Oh, he said he's going to shoot us." And then they indicted this guy as making terrorist threats. I've got an update for you on this. Police went to his door because of there was this disagreement with his girlfriend. And they came to his door, banged on his door, and he yelled out, "I'm going to sue you." And they put in the police report, "Well, he said he's going to shoot us." He literally said, "I'm going to sue your department." Clearly, you can hear that he didn't say, "I'm going to shoot your department." But they said that he's going to shoot us. And then the judge signed a warrant to go to the guy's house the next day. They arrested him and then indicted him on terroristic threat charges. Well, we have an update on that and here it is. >> Five four metro Atlanta police officers face a new lawsuit after a man claims he was falsely arrested and detained for three days. >> man says those officers fabricated claims he vowed to shoot them when he actually warned he would sue. Investigative reporter Anna Prada broke this original story that led to a district attorney dropping charges against him. >> Yeah, guys, this is the lawsuit filed earlier this month against four Douglasville police officers. Homeowner Daniel Wallston threatened to sue them last year and earlier this month he made good on that promise. >> I just want to talk to you, man. >> You got a warrant? >> No, I just want to talk to you. >> When Douglasville police officers asked Daniel Wallston to open his door in May 2025, they were met with a warning. >> So, you have no warrant. Get away from my house. Get away from my house or I'll sue your department. >> That was so freaking clear. Get away from my house or I will sue your department, not shoot your department. And if you said I'm going to shoot your department, that's just weird to even say. It was clear as day, and if it wasn't on body cam, then the judge still wouldn't see sight unseen, the judge signed the warrant based on what the cop said without looking at the body cam evidence. Hey, you're telling me that the guy said he's going to shoot the department, which is a terroristic threat if he said that, but can you show me the proof? Let me review the body cam before I put pen to paper and sign this warrant is what he should have said. That's what the prosecutor should have said. And yet they they they bulldozed through with a prosecution to indict this guy. >> You'll do what? >> Sue your department. >> You'll do what? >> Sue our department is what he just said. >> Here, let's listen to it again. >> warrant. Get away from my house. Get away from my house or I'll sue your department. >> You'll do what? >> Sue our department. >> You'll do what? >> Sue our department is what he just said. >> Look at that guy over there. >> your department. >> He even highlighted and italicized and put the inflection on, I said I will sue your department. >> I said it as loudly and as clearly as I could. >> Yeah, I don't even say how you could say it more clearly. >> Look at that guy over there. your department. >> The officers were there to investigate a verbal argument that led to his wife's arrest. The next day, a judge signed an arrest warrant claiming Daniel threatened to shoot the police for being on his property. >> Why would he do that sight unseen? It seems like there should be some kind of chain of custody or chain of command or some kind of proof before any judge could sign any warrant taking a person's rights and livelihood away. The guy ends up losing his job over this. >> Now, YOU WANT TO COME TO THE FRONT DOOR WITH YOUR HANDS UP. YOU'RE UNDER ARREST. You got a warrant for terroristic threats, all right? For threatening to kill the officers last night. >> Well, a Douglas County grand jury indicted him for terroristic threats, a felony in Georgia that carries up to 5 years in prison. >> It's okay. I can prove I didn't do it, so >> Atlanta News First >> I love this guy's outlook. And I love that he's not begging, he's not pleading, he's not crying, he's just standing stone-faced toe-to-toe against the tyrants. And remember, tyranny is a mirror that reflects only one face while outlawing all others from daring to look into or even question the tyrant. That's how our system operates, and this guy right here is standing toe-to-toe with them, face-to-face. It's okay. I'm going to win this, you freaking liars. And if you think that this is the only time this police department has done this, abusing their authority, if you think this is the only time the judge did this, signing a warrant against an innocent person, you got your head in the sand. >> investigates proved he didn't do it. After recent body camera video to the Douglas County District Attorney's Office asking them to review the case, prosecutors dropped the charge against Daniel. >> But they never would have done that if this news station didn't step in. So, what if this news station didn't step in? What if it didn't become an outrage, a public outrage, and a PR nightmare for this department? They would have steamrolled over this guy. So, how many innocent people are in jail because a judge lied, a prosecutor lied, the cops lied, and he just got completely pummeled by the system? It happens every single day. No telling how many times a day. >> I'm so grateful for Atlanta News First. It's like, without you, I would be 100% still facing trial. >> About a year later >> That's sobering. >> later, Daniel followed through on his promise, filing a lawsuit in August against four Douglasville police officers for what he alleges was an unlawful arrest and malicious prosecution. Robert Kenner is Daniel's attorney. >> I I was shocked. Because you can clearly hear on on the body camera that he said and he repeats himself. >> He said >> Yes. >> We can back off. >> It wasn't until um you know, you broke the story. And >> This guy This attorney's like they literally gave me a Christmas gift. That's what he's really surprised about. It's like, what? They set it up. They gave me a layup and I'm just going to take this slam dunk. They handed this to me on a silver platter. My client said it twice. It's clear as day. This is an easy win. Of course, I'm going to take this case. I wish all these cases were like this. I'd take 12 cases a day. >> and and uncovered it. And that's when someone said, "Okay, let me take a look at this file and look at the video." And then they dismissed it. No apology. >> Yep, of course. >> it. >> The Douglasville Police Department declined to discuss the lawsuit's claims. The four officers in the lawsuit did not respond or declined to comment. >> Do you think >> If I was a cop and I was part of the Douglasville Police Department and they expected me to put my hands on this guy and arrest this guy for terroristic threats, I would have to demand proof before I did it. That's why I can't stand order followers. That's why I can't stand the lemmings who when they're part of a group, they lose their individual identity to the group and they just start doing what everybody else is doing. Well, we're going to arrest this guy. Okay, there's no time to ask questions. There's no time to review the evidence. There's no time to make an objective case of whether he said it or not. You just got to do it cuz that's what order followers do. That's why I can't stand cops. They are constantly involved in corruption and doing corrupt things and committing crimes against real people who are actually innocent. >> The district attorney's office even looked at the body camera video before presenting it to a grand jury. >> I would be shocked if they did not. And if they did look at the body camera and they still went forward with pursuing this these charges through the grand jury, then that's a real problem. >> Daniel spent three days >> And you know they do that all the time. It is a real problem. >> He's in jail and lost his job after the arrest. His attorney says the lawsuit seeks to hold the officers accountable for their actions. >> Yeah. >> I think that these officers were were upset that Daniel had the wherewithal to say, "Hey, get off my property if you don't have a warrant." And it frankly pissed them off. >> Yeah, this is nothing more and nothing less than retaliation by law enforcement. And you you guys know who Smedley Butler is? He was this major general back in the early 1900s that basically understood what war was. He said, "A patriot is disposable meat. He bleeds out in the mud purely so that fat cowards in suits can steal more oil." That same spirit resides inside the meat bags that are wearing uniforms that will gladly ruin your entire life. They don't care if it costs your life, your family's life, a beloved family member's life, a beloved pet. Remember Navarro and I can't What was the police department? Was it Mesa where that family was trying to rush their dog Stella to the vet because somebody had run over it and they had the dad and Neil on the hot pavement and they held the entire family at gunpoint while Stella was bleeding out and then come to find out that Navarro, the guy who was the cop who actually made the stop, just like less than a year later, he was arrested for abusing his girlfriend like that was some kind of shock or something. The system is completely filled with cancerous tumors and they welcome cancerous tumors. That's why at the beginning of this video I said that police equals people of low integrity criminalizing everyone and it's it's not even so much that they have a low IQ. I don't even care if you have a low IQ as long as you have high integrity cuz if you have high integrity, you're not just going to arrest anybody because your buddy said it. If you have high integrity and you're a judge or a prosecutor, if you're a judge, you're not going to sign that warrant. If you're a prosecutor, you're not going to prosecute without evidence. You're not going to bring an indictment against some guy who's completely innocent. I'll tell you what, if it wasn't for this guy being completely clear about and saying it twice, I will sue your department and if it wasn't for the fact that there was body cam and if it wasn't for the fact that that that this local news station brought it up to the police department and then they dropped the case, if all those factors weren't involved, this this guy, this innocent guy would be in jail right now. That's infuriating cuz that could be you, that could be me. And an injustice against one man anywhere is always going to be an injustice against all men everywhere. >> The Douglas County District Attorney's Office is not named in the lawsuit. A A D.A. spokesperson declined to respond about whether anyone in its office viewed the body camera video before filing charges. The four officers named in the lawsuit still work at the Douglasville Police Department. >> You're going to cost us a bunch of money, but we're going to keep you employed. And we're going to keep you employed knowing full well that you could lie against any other member of our community, get them in trouble, ruin their lives, throw them into a rape cage, have them lose their jobs. We're going to still keep you on the police department. That's how much the Douglas Police Douglasville Police Department cares or doesn't care about members in the community. I want to hear what you guys have to say about this. Do you think this guy would be free to go if the news channel didn't do what it did? If there weren't body camera videos? I'm telling you what, if we only had the cops' word that this guy said, "Oh, he said he would shoot the police department." This is why you always want to record anytime there's an interaction with cops. Cops lie, cameras don't. Best have a 360, make sure you got plenty of audio, make sure you record because it is your insurance policy. I guarantee you the cops will lie against you. And if you're believing those cops, you definitely need your head examined. >> [bell]
