So, I did a video once where I talked about how it was legal to video a police encounter. And I said, "If the police officer slaps the phone out of your hand, is that an assault?" And I talked about how that could be an assault, but it would depend on whether or not you put the phone right up in his face and he felt like you were invading his space. So, I had a follower, E. Roslin, that said, "Is invading the personal space a felony or a misdemeanor?" Kind of a smartass comment, but I won't go there. Certainly being close enough to smell the officer's bad breath isn't assault. So, he's being sarcastic here. Well, is invading the personal space of a police officer a felony or a misdemeanor? In truth, it could be a misdemeanor. You could have assaulted this officer by throwing the phone up in in his face because we have what's called a be misdemeanor offensive contact assault here in Tennessee or offensive conduct assault, which means you don't have to physically touch the person to assault them. So, the officer could allege that you committed a B misdemeanor assault and that's why he smacked the phone out of your out of his face. Now, I don't agree with that, but don't be stupid. If you're going to video the police, just do it safely from a safe distance, and you won't get your phone smacked out of your hand. So, I'm trying to teach people not to get in the police officer's personal space. And the commenter says, "Well, why? It shouldn't be a crime for me to get in his personal space." [music] Actually, it can be a crime for you to get in his personal space. Don't take that chance and don't leave that to fate. You You don't want to give this officer a reason to arrest you or to smack anything out of your hand. Cuz I promise you, if he smacks your phone out of your hand, you're about to be handcuffed. Cuz cops are taught in the academy, if you put your hands on somebody at all, you better have something to arrest them for. If you get in this cop's personal space, he's going to arrest you for assault. It's so funny. I read these comments a lot, and the keyboard warriors are so brave. E. Rosland is probably really brave behind the keyboard, but I doubt very seriously on the scene of a traffic stop, he's going to be getting in the personal space of a police officer. What do you think? [music] Who do you agree with? Do you agree with me that you should stay out of the officer's personal space, or do you agree with E. Rosland, who says you should tempt fate and throw caution to the wind and end up in the back seat? I've given you a little hint on who you should agree
