NBA player Tony Allen insists he had nothing to do with the drugs that were in the car. You think it's going to fly? Watch this video. >> Sir, I'm I'm asking you, sir. Can we talk? Can we Can we have a conversation? Sir, I promise I I don't do no cop Sir, that's I I'm not in possession. It's just a ride for me, sir. I promise to God, sir. On all five of my kids I wish I wouldn't have never got in the car, sir. I ain't have to come in no private I could have stayed at home. Yeah, I smoked this [ __ ] sir. Ain't none of that stuff mine, sir. It's going to hurt my image, sir. I don't have nothing to do with that, sir. I'm truly honest, sir. >> And I'm going to have an honest conversation with you when we get up there. I'm going to talk to both of y'all, okay? >> Man, please, sir. >> So, the cop here says, "I'm going to have an honest conversation with you up there, okay?" Does anybody out there believe that? I don't believe it. I don't believe the cop's going to have an honest conversation with him. I believe he's going to trick him into to telling things against himself or to basically talking without a lawyer. Now, this guy's already said, "I promise on my kids that's not my stuff. I should have stayed at home. I should not have come out here." He's all worked up about riding with this guy who apparently had some in the car. Now, raise your hand if you think that this NBA player should have been arrested for that. And do you think that his position at the NBA had anything to do with this arrest? Could this cop have been looking for some limelight that he arrested Tony Allen for possession of I mean, if he's in the car and he's not the driver of the car and he's not the owner of the car, I don't know the facts here. I don't know where this alleged was. I don't know if it was in the glove box or if it was under his seat or in the console. Wherever it was in the car, they believe that he was in possession of it and they've charged him with it. Here's how I would defend somebody like this. It's not his car. He's not the driver. Usually, the driver of the car is the owner of the car. It's not always the case, but most often the driver of the car is the owner of the car. And if this guy's just a passenger, I've pulled over hundreds of cars like this and found illegal substances inside where I didn't know who it belonged to. I wouldn't charge everybody in the car simply because I could, but you can charge everybody in the car if nobody admits up to it, but it's really based upon access and control. So, the cop here has to prove that Tony Allen was in possession of the not just that he was in the car with it. Being in the car with it might prove access, but it doesn't prove possession and control. You have to prove possession and control. Knowledge that it was there, possession and control. You have to prove those things in order to convict him of possession of this schedule two drug. He swears it's not. I believe him, but I'm a sucker for a good story. So, I'm a defense lawyer. I tend to believe people when they tell me they're not guilty and you might make fun of me for doing that, but I tend to believe Tony Allen here that it wasn't his. What do you believe?
