My client would be sitting in prison right now if I hadn't caught this one thing. My client was charged because he allegedly a worker in the street because he didn't slow down in a construction zone. My client was driving on a roadway and within a second or two he hit something in the road. But the state alleged that this was a construction zone and when I got the discovery, man, I had pictures of all these construction signs, slow down, workers in the road all the way up until the point of impact which were really really negative pieces of evidence for my client. But my client told me I didn't see any signs. So I got the first dash cam footage and the reason that I watched it wasn't for this but I noticed particularly the first sign that he came to was face down. The next sign, face down. Every sign on the approach to this traffic accident scene was face down on the pavement. So that one fact we were able to show that there was no signage and he wasn't speeding and he wasn't impaired. At the end of the day the punishment on a vehicular homicide can be 8 to 12 years. Had I not caught this crucial evidence, my client would be sitting in prison today.
