Do not touch me. >> Nope, you got to face that way. You have to face your door. >> So, this is in Bonner Springs, Kansas. Let's take a look and see how we got here. So, we're going to watch this car driving. We're going to watch the cop follow this guy for like three or four turns, and I want you to see if you see a violation of the law. Uses his turn signal there, and he turns on the first street. He's coming up on the second street. Let's watch and see if he uses turn signal. He's going slow. He's not speeding. So, at this point, the citizen knows this cop's behind him, okay? You can just feel it. You know when the cop's following you. And you know it's not just a coincidence cuz the cop's followed you for two or three turns at this point. Blinker comes on. Blinker's kind of last minute, but you know there's lots of streets here that he could have turned on. And then the cop blew lights at >> 20-23 traffic >> Hello. >> I was a car patrol with Bonner Springs Police Department. The reason I pulled you over is cuz when you made your right-hand turn, you didn't use your blinker right before you made your turn. So, I need your driver's license and insurance, please. >> You only used your blinker right before you made the turn. The code that he's citing is a Kansas code for using your turn signal. I'll put it up on the screen here. It says that within 100 ft, you have to use your signal no less than within 100 ft is what I believe the exact words are. If you turn your turn signal on within 50 ft, you're technically in violation of this law. I think it can be argued in a case of a neighborhood like this where there's multiple turns that you could make, it's not really a big deal that you didn't do it within 100 ft. This is a pretextual stop. You know what I mean by pretext? It means it's not the real reason that he stopped you. It is a reason, but not the reason. And the citizen just didn't like it. Let's watch it. >> So, I need your driver's license and insurance, please. >> Is there a reason you're following me today? Is there a reason you made four four turns around me is the reason you made it you turned down by the school to follow me. Do you have any of those reasons? >> I'm going to ask you this is the last time I'm going to tell you I need your driver's license and insurance. >> What crime did I commit again? >> 1523 can't get an 85 please. >> What crime did I commit again? >> Give me your driver's license and insurance. >> What crime am you What What crime am I asked? >> I'm going to have to get >> What crime am I suspected of committing? >> I need your driver's license. Sir, you're going to step out of the vehicle. Step out of the vehicle. >> I have it right here. >> No, you're going to have to step out of the vehicle now. >> For what? >> Cuz you pissed me off and I'm going to make you step out of the car because of Pennsylvania versus Mims which is on the tip of every officer's tongue. That case says that a cop can demand that you stay in the car or demand that you exit the car. It's a de minimis intrusion upon your rights according to the Supreme Court and the Supreme Court allows it. Use your words though officers. When I'm teaching police officers, I teach them to use your words. Be respectful. You don't have to have so much power and control that you keep things to yourself. You can tell him why you stopped him and tell him why you want him to get out of the car. >> Sir, I need you to step out of the vehicle. >> For what, sir? >> I already told you I needed your driver's license. You didn't want to give me your driver's license. And now I've asked you three times for your driver's license. You did not give it to me. So now you got to step out of the vehicle. >> For what, sir? >> All right. >> Can't be this freaking tiring. Tiring right here. Look, we've been recording We've been here for 1 minute and 30 seconds. You gave me 15 seconds to pull out my license. 15 seconds, okay? Give me your license. >> Sir, we need to we need to go ahead and get That's fine. But I still need you to step out of the vehicle. >> I'm going to step out of the vehicle because you're giving me a lawful command to step out, correct? >> Yes. >> I'm going to turn off my vehicle. >> Turn off your vehicle. >> Don't open my door, okay? >> Okay. I like the way this citizen does all that. Turning off my vehicle, opening my door, walking throughout loud what he's going to do so he's not making any furtive movements or quick movements or jerky movements and I mean you got a jumpy cop out here already. You don't want to make him reach for his taser. >> Do not touch me. >> Nope, you got to face that way. You have to face your door. >> You said to get out of the vehicle. >> Yes, and I'm telling you what you have to do. So go ahead and step out of the vehicle and face your face the crevice of your door. >> I can't fit in between. Can you step back where I can fit? >> Nope. This is where you That's it. That's all you get. >> Sir, I I just please don't touch me. >> Let him move out. Move out of the vehicle. >> to move out. What is your deal, man? >> Face the Face the Face the truck. Okay. Do you have any anything on you? >> No, sir. What is your deal, sir? >> So now he's putting cuffs on him because he can and he's detaining him. He's not under arrest yet. The cop hadn't said that, but usually they'll say, "These are for my safety. I'm not arresting you yet. I'm detaining you for investigative purposes and for officer safety reasons I'm going to put cuffs on you." He should have walked him through all that verbally. This cop's not very good at using his words. >> Why are you treating me like this? I didn't do anything to you. I didn't do anything wrong. >> Okay, let's go back over here. >> We're about to see the cop talk to his buddies and maybe one of his supervisors. Let's see if he tells the story correctly. >> This is what I have on Jennings. >> Uh-huh. >> Uh so I'm coming up Compton and then he made a turn here. Uh didn't use a blinker 100 feet before the turn. >> Didn't use his blinker before 100 feet before the turn. So that's really seriously why he's pulling him over. I just think that's so petty. You ought to call it what it is. I stopped him for a pretextual reason. I want to search his truck or whatever. Tell your lieutenant why you stopped him for real. >> I requested his driver's license. He started demanding and then I requested his driver's license again. And then the third time I told him like, "You're going to get out of the vehicle." So uh I I patted him down. I detained him and he's in the back of my car right now. >> Okay. >> He refused to give me his his uh driver's license. He didn't want to give it to me. >> Is that true? He didn't want to give him his license. I think he hesitated in giving him his license, but he was really quick about saying, "Hey, just give me 15 seconds. I'm going to give you my license. Here's my license." He tried to talk his way back out of having to get out of the car. He didn't refuse to give his license. >> So, you found it on the pat down there? >> He gave it to me. >> So, he finally gave it to you? >> Yeah. >> And the supervisor said, "So, you found it on the pat down there?" >> No, no, he actually gave me the license. >> Not using the turn signal 100 ft before a turn and then refusing to uh identify himself. Those two. >> Okay. Be kind of hard to prove that one because he finally did. >> Okay. >> Good for this supervisor. It'll be kind of hard to prove that one cuz he finally did identify himself. Let's not embellish this, officer. Just tell me what you really have the right to charge him with and that is not using your turn signal within 100 ft of the turn. That's a citation. It's not an arrestable offense. Let's see if the supervisor does the right thing here. No, no, we we can go ahead and uncuff him. All right. >> Um and then we was asking for the proof of insurance. If he's willing to do that, if he doesn't want to give it to us or if he doesn't can't, then then we'll take that next step. >> Okay. >> Great job, supervisor. And let's uncuff him. Ask him for the insurance. If he fails to provide it, then we'll take the next step then. What do you think? Was that the right call? I think it was the right call. >> I'm going to get you out of here. Okay. Okay. Come over here. >> You can stand by the patrol car here with my sergeant. >> All right. Do you have insurance? >> Yes. >> Are you willing to Where is it? >> It's on my phone. >> On your phone? I'll bring your phone to you, okay? >> So, this is what I like to call the walk of shame for the officer that has to uncuff the guy that he just cuffed and stuffed in the back of his car. >> Your phone is still recording, just to let you know. So, here you go. >> I'm going to change it. >> That's fine. I still need to see proof of insurance. >> Okay. >> Okay. You don't Are you Are you going to show me proof of insurance or not? >> I'll I guess I'll take care of it up at the station whenever you give me the ticket. >> Okay. You have an expectation for it, too, okay? >> That's fine. >> What's What's my citation for? >> For the turn here. So, you didn't have your You didn't put your You didn't place your turn signal 100 ft before the turn. You placed it and then you turned. Okay? >> So, that's your reason for pulling me over and following me for how many turns? >> Okay, I'm going to write the citation now, okay? >> I I want to know how why you followed me for so many turns. >> So >> You made an illegal U-turn to to speed without emergency lights to come and try to follow me up here to make >> Okay. >> me while I was And I didn't >> Right now Right now is not where you're going to be, all right? >> have 100 ft >> Right now is not where you're You can go ahead and talk to the judge. Me and you we're not going to be discussing this on the side, okay? >> not? >> It's not where this is. Not There's no where There's not where it happens. You just talk to the judge and the judge You talk to the judge. >> You're making it up. >> So, this not where this going to happen. We're not going to argue this on the street. Which is good. That's what >> I teach too. I teach both sides that. Don't argue it on the street. Cops don't have to explain themselves on the street. They have to explain themselves in court when it matters. I get the citizens angry. I mean, he's arguing his point to the supervisor here on the scene. Do you really think the supervisor's going to agree with you? Come on. >> I'm going to finish the citation and give you my badge name and badge number. It's also on the citation. >> number, sir? >> Officer Carpio, 591. >> When he asks for your name and badge number, officers say, "I'm Officer Ridings. My badge number's 223." Don't push back. Cops be really uber nice so that when the judge or jury looks at the video, they only see one and that's the citizen. >> Okay. Here you go. You take your You need to take the citation. Yeah. >> Touch him, drop it, and say you're served. You got to touch it. >> Did you hear the supervisor say, "Touch him, drop it, and say you're served."? That's what they do in civil cases. They touch you with it and drop it and consider you served. That's not the same thing with a traffic citation. He has to sign it and acknowledge receipt of it. And if he doesn't take it, you have the right to take a citizen to jail for not signing and not receiving the ticket. We just did a video on it where the lady flipped the ticket back outside and threw it on the ground. Guess what? She got arrested for that. >> I'm tired. That's all you are. Tired. Serve me. >> You're free to go, sir. And you also do not stand in the road or Don't stand in the middle of the road, please. >> Oh, yeah. You don't want to stand in the middle of the road with this cop. This cop will take you to jail for standing in the middle of the road. I'll call it jaywalking. He's just looking for any pretextual reason to take this guy to jail. And this guy's a smart aleck. He just is. I'm going to give the officer a B-. This officer could have used his words better. He could have tried to de-escalate the situation better. And he didn't. And I'm going to give this citizen a big fat D. He had the right to invoke his right to remain silent. He didn't do that well. I would give him better credit if he said, "I don't answer questions without a lawyer." He was a jerk. That doesn't play well on the video. If you're going to sue the police for this, you're never going to get a jury that's going to give you a dime cuz they're going to hate you. And rightfully so. Again, I'm going to give the officer a B- for all the reasons that I said earlier. And I'm going to give this citizen a big fat D. And that's my verdict. If you liked that video, you're going to love this video.
