B, get out of the car. >> Get out of the car now. >> What's going on? You're fixing to ride the lighting, sir. That right there, that tells you who we're dealing with as a cop. This guy's a soldier for our country. He's a soldier that was pulled over for a traffic violation. And this is what he did. He drove a little bit too far for this officer's liking. What he [music] was doing is driving to a gas station where it's well lit, where there are cameras and people safety. He did so for his safety and the safety of the officer. I think that's completely legitimate. I don't think there's anything wrong with doing that. I think everybody should be entitled to drive to a safe location. You got to stop in a reasonable time. Well, you can't drive for an hour, but this guy did. And he pulled into a lit gas station. Let's watch how it escalates quickly. 22. >> I will say in this officer's defense, if there [laughter] is any defense, he drove about a minute after he blue lighted him. Is that too long? He pulled over. He just didn't pull over right when you hit him with the blue lights. But I still think that's legitimate. Comment below. Tell me what you think. Let's see what happens next. Driver, roll the window down. >> Felony traffic stop. >> Felony traffic stop. Why are we doing a felony traffic stop? What was the reason that you pulled him over? It was for a traffic violation. It wasn't for a felony. We don't have any reason to believe that this guy's got a warrant for his felony arrest. He has to be saying that in his head to be able to justify a felony stop. And what is a felony stop? Let me tell you real quick what that is. When you're pulling over, just the average Joe citizen, pull them over, you walk up to their car, you touch their tail light, you put your fingerprint on their tail light, you walk up, identify yourself, tell them the reason for the stop. On a felony, you don't want to approach the car. Your beckon command is what you want. You want them to exit the car, turn around, pull their shirt up if you need to show that they don't have any weapons, hands on their head, face away from you, and walk back to your voice. That's what you're going to tell them to do in a felony stop. Get them to do everything that you tell them to do. Get them on their knees, cuff them, and then you do the same thing with the next occupant of the car. If you don't know if there's another occupant of the car, then you safely approach with multiple officers, guns drawn, and clear the car. He's doing that here for no felony offense. It doesn't go well for him. I'm [music] just going to say, >> put your hands out the window AND TURN THE VEHICLE OFF. Put your hands out the window. He's not complying. Joe, >> let me see your hands. How many occupants are in THE VEHICLE? >> COPS, WHY DO Y'ALL USE that kind of language? Why do you have to say how many occupants are in the vehicle? Just say, "Hey, man, how many people are in your car?" I guess it's because, you know, you have to testify in court sometimes and they want your language to be proper. Just a little snippet technical thing that I have issues with. >> Get out the car. >> OPEN THE DOOR SLOWLY AND GET OUT. >> Get out of the car now. >> Open the door AND GET OUT THE CAR. >> KEEP YOUR HANDS OUTSIDE THE WINDOW. >> Get out of the car now. YO, WHAT? GUESS WHAT? OTHER VETERANS, TOO. I KNOW TO OBEY. GET OUT OF THE CAR. >> Get out of the car now. >> What's going on? You're fixing to ride the lightning, son. >> I don't know why cops can't use their words. There's no reason that you need to be this afraid of this car. Once you see this guy's in fatigues, you should be able to deduce that he's a veteran. He said, "Well, I'm a veteran, too. I learned how to obey." I mean, he's not obeying you. This driver didn't do it right. No, he didn't. The officers didn't do it right either. >> GET OUT OF THE car now. Get out of the car now. GET OUT OF THE CAR, >> SIR. JUST GET OUT the car. Work with us and we'll talk to you. Get out the car. >> You received our order. Obey it. >> I'm I'm honestly afraid to get out. Get out. >> Yeah, dude. You should be. Get out. >> I'm honestly afraid to get out. Yeah, you should be. And he reaches for the door handle. Thank goodness this guy's got the door locked. Had the door not been locked, this cop would have opened the door and yanked, went hands-on, probably with the taser and would have tased him out to the ground. If you're a cop on this channel, you know that's true. That's what would have happened. But the door was locked and the cop's not ready to reach in there yet, but he's going to get there. >> You're being stopped by a crime violation. You're not cooperating at this point right now. You're under arrest for you're being detained. Okay. You're being detained for obstruction of justice >> violation. I do not have to get out of the vehicle. driving. >> Really? >> Get out of the car now. Get out of the car. >> You need to be using your words, officer. Tell him why you stopped him. Just deescalate a little bit. He's clearly afraid to get out of the car. And you're about to see why. >> Get out of the car now. Get out of the car. >> Get your hands off me. >> Get out of the car. Get your hands off me. You know what? Get your hands off me. >> Not a problem. >> Back up. >> Do anything, >> sir. >> Get out of the car now, sir. Hey, sir. >> Get out of the car now. >> Sir, look. I'm trying to talk to you. I'm trying to talk. Just get out of my car. Can you please relax? Can you please relax? >> Get out of the car right now. >> This is not how you treat a vet. Uh I'm actively serving this country and this is how you're going to treat me. >> I didn't do anything. Whoa. Hold on. What's going >> You should have gotten out of the car when they asked you to get out of the car. You know that if you follow this channel. It's lawful for an officer to command that you get out of the car. This use of force, I believe, is an overstepping of his bounds. I don't think the escalation was proper, but he goes straight to the pepper spray. And this guy's not actively resisting. He's passively resisting. What do you think in the comments? Should he have used pepper? Should he have used his taser? Or should he have used his words? >> A4 deploy. >> Get out of the car. >> Oh, man. He sprayed him good, too. He sprayed him three or four times because he could. This is punishment. This is not use of force. It's not proper use of force. It's not so we can get you into custody. It's punishment. He pissed him off and the cop used his spray. >> Get out of the car now. >> Get out of the car now. >> Sir, just get out of the car. >> Get out of the car now. >> Yeah. Get out of the car and get on the ground now. Get him. I I don't even want to reach my seat belt. >> Take your seatelt off and get out of the car. >> Get out of the car now. >> Look, I'm just going to >> You're going to do what you're told. Get out of the car. >> Look, >> take your seatelt off and get out of the Take your seatelt off. >> Look, my hands are out. >> Take your seatelt off and get out of the car. >> My hands are out. >> Don't reach in there, Daniel. Don't reach in there. >> My hands are out. Please. This is really bad stuff. My dog is in the back. Hey, >> my dog is choking right now. >> Get out of the car. >> Take your seatelt off. >> What are you a specialist? Corbin, what are you? >> I'M A LIEUTENANT. >> LIEUTENANT, GET OUT OF THE CAR. TAKE YOUR seatelt off and get out of the car. >> YOU MADE THIS WAY MORE DIFFICULT than it had to be. You just complied. >> Which one made it more difficult than it had to be? Officer Gutierrez. This is Joe Gutierrez and Daniel Crocker is the one that initiated the stop or Nazario is the driver. And this is the Windsor Police Department in Virginia. I'm not hating. I'm just reporting. >> Ma'am, please. Let's go. >> Get on the ground. Get on the ground. >> Please talk to me. >> GET ON THE GROUND NOW. >> GET ON THE GROUND. YOU'RE GETTING SPRAYED AGAIN. GET ON THE GROUND. >> CAN YOU please talk to me about what's going on? >> Get on the ground. GET ON THE GROUND NOW. >> CAN YOU PLEASE TALK to me about Get on the ground. >> Can you please talk to me about what's going on? or not. >> Can you please talk to me about what's going on? >> Why did you need him on the ground? He wanted him on the ground so he knew full well who's in control because he had him. Can't see. He's not armed. This guy's not a threat to you. Just cuff him. But why did you need him on the ground? Joe Gutierrez, if you're watching this video, tell me why. >> Why am I being treated like this? Why? >> Cuz you're not cooperating. Get on the ground. Why am I being treated like this? This is really messed up. This is really messed up. >> Come on, sir. Sir, well, just really This is up. >> Sir, this is Sir, >> you know, lay on the ground. Just lay flat for me, sir. You know, this is Sir, lay flat. This is I can't believe we're being treated like this and ground. >> Get on the ground. >> Get on the ground. Come >> and sir. Sir sir, can you just work with us? >> Can I >> just work with us? Lay down flat. >> Lay down flat. Lay down flat. >> Why all the way prone on the ground? I just don't get that part. Except for because you can. Most of you have never been pepper- sprrayed. I have. It's not pleasant. I mean, it's all you can do not for your hands to go straight to your eyes. And so, this guy is not resisting the cuffs. I think he wants to touch his face. He wants to wipe his face, but he doesn't want to make it worse. And you, God knows you don't want to put water on it, which they're about to do. That makes it 10 times worse. What he [music] really needs is milk. If I'm an officer on the scene, even if I saw other officers do this, I'm going to take up for this veteran, man. I'm going to go get him a quart of milk. What would you do? [music] Comment below. >> Put your hands behind your back. Put your hands behind your back. >> This is This is >> I agree. All you got to do is listen. >> Can you open up the window for my dog? I hear him choking. Can you open up the window, please? >> Yes. >> Yes, we will. >> Is there sir? >> Okay. Anyone in the vehicle? >> Yes. >> Okay. What kind? Where at? >> What kind of dog you got? >> He's mixed. He's a service animal. >> Why did you do the ass, sir? >> Why didn't you just do my hand? >> No, you weren't. You were not. My partner put his blue lights on. >> Yes. >> You didn't stop. >> I was pulling over to a well-lit area for my safety and yours. I have respect for law enforcement. >> No, you don't. No, you don't. No. Wrong answer, sir. If you did, we would not be in this situation right now. >> You've never seen somebody drive to a well-lit location on a traffic stop. [music] And you've never seen somebody in uniform that you should have treated with a little more respect. I'm going to get crucified in the comments. I know. Because the officers, as wrong as they were, this guy Nazario, he was not right. He did not handle this situation correctly. I just think they could have handled it with a a little more diplomacy, [music] less force, and with no pepper. I'm just saying. >> Set right on this curve right here. Turn around. >> Come sit on this curve. >> Walk backwards. Walk backwards. Get some way. Can you open up the window for my dog? I got him right here. Damn choking. I got them all. >> We already opened it. >> I'm going to go grab my sit. >> Dark over there. Those areas are dark. I did not feel comfortable. Those areas are dark. Cup water. >> Clearly, officer Crocker has never been sprayed with pepper spray. He wouldn't be doing this. It's going to hurt. It's going to make it so much worse. When they pour that water on his eyes, it's just going to make it burn more. >> On my face. It's going to make it worse. You know that, right? >> All right. So, it's going to make it worse. Don't do anything. >> Yeah. It's going to reactivate and make it worse. >> They're right here. >> They're here. >> Where the men? >> They're here. >> I I need them to talk to me. What's >> They're right here beside >> What's up, man? What can you do to >> All right. I have no chest pain. Short of breath. My dog. Okay. Yes, sir. >> Yeah. My brother. >> You all right? If I pop the trunk? Yes, sir. Hey pop. Hey P. Yeah. Thank you. >> Aario sued in federal court. He won partly, but he didn't win much. He won $2 or $3,000. Really didn't even pay for his attorney fees. He was expecting a lot more. Crocker, the the guy that pulled him over, you know, the kid that was being nice and trying to help and went and got water. I think he got disciplined, but he didn't lose his job. So, Gutierrez was found liable for assault and [music] was basically terminated from his job. Do you think that the punishment for losing his job was excessive or do you think this treatment was excessive? Comment below. Tell me what you think. And as always, thanks for watching our videos. And if you like breaking down body cameras like this, you're going to love this video.
