No, actually I don't have an ID on me, but I'm not going to ID. I'm not giving you my name and date of birth cuz there's been no crime. I I protect my Fourth Amendment. >> The Fourth Amendment at this point gets put aside when okay. >> Did you hear that? The Fourth Amendment doesn't get put aside, sweetheart. You should have roll call with this guy. He'll teach your deputies about the Fourth Amendment and how they should have reacted here. Obliteration of the Constitution. I like this guy. I don't drink beer, but if I did, I'd have a beer with this guy. I mean, he's my kind of guy. This is in Macon County, Tennessee. Clearly, you've got a neighbor dispute here. One neighbor called the sheriff's department because the other neighbor was shooting a firearm. He makes them believe that the guy was shooting in the air, maybe, but he didn't know that. He didn't have any evidence of that. He just heard some gunshots and thinks that he's reckless with his shots. Just watch this video. >> All right, this is an ongoing dispute about the property line and yeah, he can't stay off me and I've asked him to stay off me. So, I'll come out here and we'll just going to put up a fence. I've not said anything to him. And he come out there and stood behind that van right yonder and I assume he shot up in the air, but you can see his little target sitting right down there. It's directly in line with this. He shoots every freaking day when come out here. >> Why do you assume he shot in the air? Shooting in the air is a felony. I had a friend that died because somebody shot a gun in the air and the bullet does come down and it comes down with velocity. So, you should never, ever, ever shoot a gun in the air. He didn't shoot in the air. He's going to tell him real quick what he did. >> He He put outside he's out here shooting. And it's a constant agitation with him. >> I got you. >> Uh but you know, he wants to shoot guns while we're sitting over on the porch. It's pretty stupid. >> Yeah. >> But uh >> But he can't >> with no back style. >> If he's truly got no back stop, I'm not for that, but I don't believe that. This guy's not told the truth yet, in my opinion. >> That's a little That's about going much farther. This has been going going for 5 years. I >> I got you. >> We ain't spoken two or three, so. >> Okay. >> But it never ends with him. >> I got you. You got your ID with you, sir? >> I do. >> Okay. >> Now, this guy IDs because he wants to. It's a consensual thing. He doesn't have to ID. He's not suspected of a criminal offense, but he is the one that initiated the call. Only if you consent to the identification, do they get to ID you, unless a crime's been committed. And they have to have a reasonable suspicion of that, but you already know that. You're a follower. >> This is probably just going to make it worse. >> You still can't be back here doing that. >> documented somewhere or another that this is going on. You get it out. >> [laughter] >> They're in there tight, I'll tell you. Has he said anything to you today or >> No, we've not We've not spoken to each other in two or three years. >> I got you. Hi there. >> How are you doing? >> Let's step over here and talk. Right over here. >> What's >> Right here. >> Closer to talk. How are you >> Good, are you? >> Doing all right. I don't even know the one coming to see you. >> Yeah. >> Uh-huh. Okay. I'm sorry to tell you everything. This is Sergeant Myers. She's going to be the one dealing with you. Anytime we deal with a call that has to do with a gun, I'm going to take it off your side, okay? >> No. >> Yes. >> Well, you're That's I mean, if that's what you're going to do, then I'm saying it's not okay as far as I'm concerned. >> Okay, well >> Good answer. It's not okay as far as I'm concerned, but don't fight with him, cuz you don't want to get in a fight with him when he's reaching for your gun, cuz then he'll reach for his gun. If this guy's going to be a tyrant, he's going to be a non-constitutional believing tyrant. And he's going to disarm a legally armed citizen on his own property and he's going to cops plain to him why he loves the Constitution and loves people that carry firearms except for when he wants to disarm them. >> Okay, well, we're going to we're going to take it off your side. >> All right. >> Okay. >> Okay. >> The reason that we're here is we got a call about someone firing shots up in the air. Okay. So, that's why there's so many so many of us coming out. Okay. >> Pretty interesting. I can't wait to get the Y'all was riding in front of me. And you say the Everton and Myers. Well, there's no crimes being committed here. So, we Look, we're not saying that you committed a crime. We're just saying that we're just saying that we've got to I understand that. And I'm not I'm not an advocate to take people's guns. >> No, you're not. No, it's not an ultra safety thing. It's a tyrant thing. It's because you can thing. That's why it is. >> Soon as we figure this out, if there's nothing wrong, I'm going to give you your gun back. I'm cool with everybody having the guns. I'm cool with everybody walking around with them. I'm We're definitely pro-gun. I'm not here to take your gun. I'm not here to try to infringe on your >> you all are doing a good a good job so far. I can't wait to see what this Tut guy's bringing in now. >> Okay. So, at any point did you fire your weapon up in the air, sir? >> No. >> I don't answer questions. Macon County, y'all need this in your library. This guy should not have answered these questions. He should have respectfully said, "I don't answer questions without a lawyer." The cops would have been dead in their tracks with this investigation. They can't prove that he fired his gun in the air even if the other guy said he did unless there was an eyewitness to it and we don't have that here. This guy does go on and do a good job of denying committing any criminal offense, but he goes too far explaining in my opinion. It's why he gets arrested. He should have just said, "I don't answer questions without a lawyer." But, he doesn't and let's watch what happens. >> Okay. Why would we get a call that said they had >> Uh whenever I started my my over a ago, all my chickens was congregated underneath my van once again. So, I dropped two shots in the ground to scare them all back to their coop. But, it wasn't in the air. There was two shots fired and it was in the ground. >> Perfectly legal. I dropped two shots in the ground to get my chickens back in their coop. I didn't shoot in the air. That should have been the end of this conversation. These cops should have handed him back his firearm and said, "Have a nice day, sir. Enjoy the Macon County sun." But, no. They're going to dig a little deeper and they're going to want something that he's not willing to give them. >> Okay. >> It clears them out fast. It's not first time I've done it. >> I got you. I understand that completely. Um So, at no point you fired the weapon up in the air. >> No. >> Okay. >> I would never fire a weapon up in the air. I just got finished with a training class this Saturday. >> Yeah. >> Yeah, I know. >> Yeah, what goes up comes back down. >> Yeah, you don't ever fire a weapon. I just fired them off in the ground. >> All right. You got to try to be with me, sir. >> Um, I haven't committed any crime. >> Sir, we're out here for a call for service this week. We have to identify you. What do we do? >> Now I wish I had a camera. Uh, your camera's on, sir? Okay, I I can't tell if it is. Your Your Your's is? Okay. And you are Vincent and you are >> Woodard. >> Woodard? >> Yes. >> Okay. Yes, sir. Um No, actually I don't have an ID on me, but I'm not going to ID. I'm not giving you my name and date of birth cuz there's been no crime. I I'll protect my Fourth Amendment. >> The Fourth Amendment at this point gets put aside when Okay. >> I'm not going to fight you. I'm not going to resist, but I'm not going to ID. I've done I've done no crime. >> Listen. Listen. >> It's not a consensual conversation when you ID somebody with reasonable articulable suspicion of a crime. That's an investigation with RAS. We don't have that here. There's no crime committed. Now, you could argue on the cop's side, "I have reasonable articulable suspicion of a felony reckless endangerment because the guy said you shot in the air." Now, if he said, "I saw him shoot in the air." Absolutely, she has reasonable articulable suspicion to ID him. The guy said, "I presume he shot in the air, so I didn't really see him where he shot." This guy clears it up, he shot in the ground. No crime, no ID, no reason for the ID. Back up. Come on, officers. Realize when the investigation is at a dead end. This investigation should have been over at that point. But, she pushes it because she can. >> We don't [snorts] want to arrest you. Okay. >> Well, you don't want to ID me either cuz I ain't committed no crime. >> We have a right to ID you because we had a call for service out here. You >> That's not the law, officer. A call for service doesn't mean you can ID anybody you want to. >> She asked if I fired them in the air. So, it doesn't matter if I fired shots out on my >> So, we get a gun call, you see what I'm saying? We get a gun call. >> No. Are you Am I Am I arrested? What am I arrested for? >> Right now, you're detained. >> Okay. Well, if I'm being arrested for not giving my >> There's a difference between Right now, we're trying to give you a chance to tell your side and try to ID you. They see >> And that's when he should say, "I don't answer questions without a lawyer." He doesn't have to tell his side. He doesn't have to help you in the investigation. Macon County should play my videos at roll call. It'll help. >> I'm not IDing. >> You're not IDing. >> That's what I'm I'm not refusing to ID, but until you give me a lawful reason as to why I have to ID. >> Okay. >> Cuz we got a call for service and we >> A call for service is not a lawful reason to ID, sir. Uh well, no crimes have been committed, so I don't know quite what to say. >> Let me explain like the reason >> I'm not really wanting to hear it. I'm I'm really not. Are you going to arrest me for not for failure to ID because that's a secondary charge. You got to have a crime first, and then I have not committed any crime. >> I've tried to explain to you why we have to ID you, sir. >> I'm trying to explain to you why I'm protecting my Fourth Amendment right. If I known that it was going to be this way, I would have went and got my phone camera so I could have recorded this. >> Yes, sir. Yes, sir. You're free to go. >> I'm free >> Not right now, sir. >> Okay. Okay, what crime are you detaining me for? >> It's an investigative >> Okay, should we move off of my property because y'all are currently trespassing and I'm receding any >> No, we're not >> Okay, I'm just receding any any >> He's almost there. I'm receding any consent that I had to you entering my property. I no longer consent to this consensual conversation. I want you to leave. I'm not being detained. I'm free to go. He should have walked away. They weren't telling him he was detained, [music] but there's a difference in being detained and being arrested and she was trying to explain that to him. He said, "I don't want to hear it. I don't want to hear it. I just want to know if I'm being detained. If I'm not, I want y'all to leave." And he was well within his rights to do that. What do you think? Comment below. >> We don't want to have to take you to jail. >> I don't want to go to jail. But if you're going to arrest me on something that is a secondary offense when you actually have no original crime, then that's just something I'm going to have to fight in court. Isn't that what y'all always say? No roadside court. Just do it after the fact and if I have to sue the county, then I sue the county. No big deal. >> We have to We have to see who who we're messing with. We have to run your ID see who who you are you say you are. >> Just because somebody give you a call to service doesn't mean I have to surrender my fourth amendment right. It does not. It does not. >> No. >> We've come out here for this. We're >> It's right now this is an investigation. You can investigate if you have proof that I shot fired. Matter of fact, you didn't even say shots fired at him. You said shots fired at him. You said, "How in the world do we know since you said there were shots fired that you didn't shoot him at him." She didn't even say shot at him. She said shot in the air. Shot at him would come up on your part. >> You said that you shot in the ground. How do we know if you shot in the ground or shot up in the air? Cuz I called in said you shot up in the air. >> How do we know you didn't shoot at him? You don't know. You have to do your investigation and there's no reasonable suspicion that he did shoot at anybody cuz that wasn't the call. He's already dispelled the alarm on did you shoot in the air or did you shoot in the ground? He told him, "I shot in the ground." There's not reasonable articulable suspicion to go further. There's not probable cause to arrest him. He is exactly right with his quotation of the law and I wish these cops were as educated as he is. >> You answer. Either they are filing false allegations or your investigation will prove otherwise. But until you have the proof, the burden of proof is not on me to prove that I didn't shoot in the air. Now I'm sitting here telling you I'm not a [ __ ] so I didn't shoot in the air. >> Okay. We're not saying you're a [ __ ] but >> No, anybody that does is though. We either need an ID or a name and name and date of birth. Ma'am. >> Now what I would have done if I was Hillbilly is I would have said under the threat of arrest I'm going to give you my name and date of birth cuz you've already lost qualified immunity if you're threatening to arrest him for not ID'ing. I agree with him, don't fight on the roadside. We don't have court on the roadside. We have court in court. And I think ultimately he's going to prevail. But let's watch the rest of this video cuz it is entertaining. Watch cops who don't know the law fumble through an arrest like this. >> And what am I being arrested for? >> Right now failure to identify. >> Okay, failure to identify is a secondary offense. You need an original charge. >> What am I being arrested for? Failure to identify. Well guess what? You're in Tennessee. We're not a stop and identify state here officer. You can't charge him with failure to identify. That's not a crime in Tennessee. >> I didn't do anything. And you don't have proof that I did. >> Don't for a minute think they're not going to make something up. They're going to absolutely back their way into this one. >> You're being disorderly when you're not. >> No, I'm not. >> When you're not doing what we're asking. >> No, that's not disorderly. >> You're being disorderly when you're not doing what we ask you to do. Is that the law? I don't think so. I think these cops need to go back to rookie school. >> Disorderly, disorderly. Can you even be the complaint in a disorderly or do you have to have somebody else? >> You absolutely can. >> Okay. >> All right, you have anything else on you, sir? >> Yes, I got a magazine. >> Okay. >> In this pocket right here. >> All right. >> I'm not giving you permission to take any of my belongings. >> You're I'm just letting you know that well to arrest. All right, that's that's a false arrest. I'm just >> It's our prerogative. >> No, it's law. [music] >> Okay. >> You either follow the law or you don't. You're supposed to be here up to date upholding your oath to the Constitution. >> You're right. I agree. >> You don't have a violation. You don't have a crime. >> I'll put it up here with me. >> Uh I'll give you the firearm that come off this side. I just put it in my passenger floorboard that way it was out of play. >> All right. I'll get him identified. I'm pretty sure he's intoxicated. >> I I can smell it. >> Well, I mean >> Well, there you go. >> Now they're talking about they're huddled up over here going, "What are we going to charge him with, guys?" You know, maybe he's intoxicated. That's disorderly. Isn't that disorderly? That's No, it's not disorderly to be intoxicated on your own property, on a farm, in Macon County. >> What more can you do, you know? >> He He said he fired two shots in the ground to scare the chickens back away from the from his vehicle. So had he just identified himself, it could have been a report and we'd be on our way, but >> So that right there tells you that she has no crime. She has no legitimate arrest. He said he shot two rounds in the ground. If he'd just given me his name for the report, we'd be on our way. That tells me that you don't have reasonable articulable suspicion of a criminal offense to arrest him. You don't have anything else to arrest him for. So thus he can't be resisting arrest, and thus he can't refuse to identify because you don't have reasonable articulable suspicion of a crime. I think the female knows that was wrong. These guys had their ego hurt even though they talk about how they love Second Amendment people and they love people that carry guns down there. Do you believe any of that? I don't believe a [music] word of it. Just so you know, I reached out to the county attorneys and to the sheriff's department to do a Freedom of Information Act request. I'm going to try to get more footage, not just this one body cam, but I'm going to try to get all their body cams and I'm going to get all the arrest reports cuz I want to see what the cops wrote and I want to see what happened to this guy in court and then we're going to do a follow-up video on it. But I'm going to get to the bottom of this. I'm anxious to see what happened in court here. I'll bet you a nickel that the DA's office dropped all charges. I'd love to get this guy on the show. I'm going to send him a Dr. Judge care package. It's going to have a I plead the fifth hat, I don't answer questions t-shirt and fresh off the press I don't answer questions. But I'm going to get him on the show. I'll [music] commit to that. And if you like what we're doing on the Dr. Judge channel, go ahead and like and follow and subscribe and join. We're going to have a Patreon coming up soon. Just like and subscribe. It helps us. And if you like this bully cop video, you're going to love this one.
