Whoa, that escalated really quick. How did we get here? Watch this video. Officer Joel Linus out of Daytona Beach, Florida, he becomes a bully really quick. Does the officer actually have the right to stop him? We're going to talk about that in a few minutes. My director seems to think that he does, but I'm going to correct him in a minute. Let's watch this video. Nope, you're going to go to jail for open container. Pour it out. Pour it out or you're going to go to jail for open container. Those are your options. Here, you can pour it out. Nope, pour it out. No, you can pour it out. All right. Holy crap, did y'all even see it? I didn't even see it the first time I watched it. I had to literally watch this about five times before I saw the kid kind of flip the cork at him. The kid was being really nice. No, you can pour it out. He wasn't being combative. He wasn't being argumentative. The cop rolls up on him and says, "Here are your options. You can pour that out or you can go to jail for open container." Could he have gone to jail for open container? We're talking about Florida statute FS 856.011, drinking in public. I'm going to give this officer the benefit of the doubt as I probably should not do. Maybe he saw him take a swig of it as he pulled up, but I didn't see him take a swig of it. Did you see him take a swig of it? I saw him standing there holding this bottle. And the officer rolls up and he says, "You got two choices. You can dump that out because I can make you dump it out because I have [music] that power or you can go to jail for open container." He hands the officer the bottle and the officer starts to dump it out and as the kid backs up to turn away, he kind of flips the cork up because he had it in his hand. He thought, "I gave him the bottle. I'm just going to give him the cork on the ground. He can throw all of it away. I'm just going to walk away from this bottle that I spent good money on that the officer didn't have the right to dump out. He didn't have the right to seize it." And that's what he's done when he made him dump it out, folks. He has seized this property. This is property. This kid spent money on that alcohol and he's allowed to possess it in Florida. He's just not allowed to drink it in public on a sidewalk like this. If the officer saw him take a swig of it, yeah, he can stop him. He can cite him for drinking in public because that's what the statute requires. It requires not just possession, it requires consumption. And guess what the officer did? He caused the case to be dismissed because he dumped out the evidence. Alcohol in that bottle is now evidence. It should be taken into custody, put in an evidence bag, sealed up, put this kid's name on it and the complaint number, and held for court because guess who gets to inspect it? Me, the defense lawyer. Dr. Judge gets to inspect that bottle to see if it actually was alcohol. Was it alcohol? Don't know. He poured it out on the asphalt. Officer Joel Linus just lost his ever-loving mind. You know why? Because Officer Linus is a bully, full stop, bully of the week. You know what the officer said? He said he it was battery. He charged him with battery on a police officer because the cork actually hit the police officer. I don't think he flipped the cork at him with the intent to hit the officer. I don't even think it did hit the officer. People that say, you know, cops don't lie, they don't know cops. And this cop probably wasn't even remotely touched by this cork. Let's give him the full benefit of the doubt. Let's say it did hit him. Did that hurt, Officer Linus? Do you need some time off to recover from this very serious battery on a police officer? Watch this video again. I just can't believe what a bully he is. What do you think? Comment below. You tell me, was this justified? And if you're a cop, please identify yourself as a cop. have to give me your name or the name of the department, but at least identify yourself as, "Hey, I'm a police officer in another jurisdiction. I think this cop had the right to do what he did and here's why." Argue like a lawyer. Try to convince me. Here, you can pour it out. Nope, pour it out. No, you can pour it out. All right. Bam, right there he flips it just a little bit. I still don't think it hit him. What do you think? Comment below. I just sent you to go to the jail. Step back. Step back. STOP. YO, PUT YOUR HANDS BEHIND YOUR BACK. HEY, STOP stepping on me. Stop. What are y'all Put your hands behind your back. Y'all need to stop. Put your hands behind your back, man. What the heck? What did you tase me for? Hey, step back. Put your hands behind your Chill out. Chill out. Get back. Stop. Get back. Get back. HEY. DO you hear all the conflicting commands? Get back. Stop. Get back. Stop. Get back. Stop. Come on, guys. Be a little more professional. Have the ability to control this crowd. Apparently, there's a crowd that's approaching them. They're trying to get them to step back so they don't get hurt. I get that. You have to control the scene, but good grief, [music] what a bunch of bullies. Did this kid resist at all? Did you see him resist at all? Maybe he resisted a little bit by trying to brace himself so he didn't hit the ground, but he did not resist with force against this officer. He took the plunge and they tased him and they I mean, they pounced on this kid and really roughed him up over [music] what? This little flip of a cork? Officer Linus, you should be ashamed of yourself. That's all I'm going to say. And if you think the beating is over now, stay tuned. You haven't finished watching this video yet. Watch the rest of this beating. It's coming. Come on, kid. You're already the winner here. You're already the hero of this video. Don't cuss him. Don't bring yourself down to his level. Just take the cuffs, remain silent. When he asks you a question, you're a Dr. Judge follower, you say, "I don't answer questions without a lawyer." And don't antagonize him cuz at this point, you're the winner. If you decide to sue this man for a 1983 action, I believe he loses qualified immunity. First and foremost, I don't see the kid take a sip. So, is the original arrest even legal? Was it even valid? I don't think so. I didn't see him take a sip of this alcohol. And even if I did see him take a sip of this alcohol, I'm getting this case dismissed because the chain of evidence is on the asphalt. STOP. STOP. You're weak. Chill out. I will say right there the kid reaches up and grabs the cop's hand. Don't do that. That's why he got the fist punch to the face because the cop didn't like the kid grabbing his hand. The kid's handcuffed. He said a few things that pissed the cop off and the cop just thought, "Well, I'll just take him to the ground again cuz I can." So, you could tell there the cop had his taser out at one point. He put the taser back in then he punches this kid several times. The crowd doesn't like that. So, now they've got a crowd control problem and this thing just escalated really quick and none of it had to happen. That's my opinion. What do you think? Comment below. SO, THE KID KEEPS SAYING, "GET OFF MY HEAD. GET OFF my head." I agree with that. This kid's not resisting, folks. And this officer is leaned on this kid like George Floyd. This cop didn't need to keep that pressure on this kid like that. He was not resisting. Once you've got control of a kid in handcuffs and you're putting him in the car, if you start punching him and striking him, that's punishment, folks. You're not fighting this kid. This kid's not fighting you. You're punching him and punishing him because you can. This viral went video and the community is outraged as well they should be. This case was referred to internal affairs. The cop was placed on administrative leave, probably with pay cuz they're not going to put him on admin leave without pay. The cops are going to do their best to protect this guy. The unions are going to protect him. The qualified immunity protects him from lawsuit unless he loses qualified immunity, which you really have to drill down and look at the specifics to determine whether or not he actually violated this kid's civil rights when he made an arrest, in my opinion, without sufficient probable cause. The statute says that's not illegal to possess the alcohol, it's illegal to consume the alcohol. And I don't see that in this video. And we don't have any evidence that it's alcohol anymore because the cop destroyed the evidence. I would love it if you guys would email this chief and tell him what you think about this incident. And his email address is young.jacari@dbpd.us. I'm going to shoot him an email doing a FOIA request for the internal affairs reports cuz I want to see what actually happened to this officer. Was he disciplined? Should he have been disciplined? Comment below. Hey, everybody, if you liked this video, you're going to love this video. Stick around and watch some Dr. Judge with some popcorn and a friend.
