Your friend is driving a car and gets arrested on a traffic stop. What happens to you? If the passenger was obnoxious and and disorderly and drunk at the same time, I personally would call them a ride because I'm not going to subject the passenger to a physical criminal arrest just because their driver was stupid and drove drunk. Some of you might argue, well, what if the passenger knew that the driver was drunk and let the driver drive drunk? He's not criminally liable for your behavior because he doesn't own the car. Let's converse that with the passenger is the owner of the car. Guess what? The owner of the car in Tennessee gets arrested for allowing you to drive his car while he's impaired. It's called DUI by allowance. It's the same criminal charge as if that passenger were sitting in the driver's seat himself.
