So, the cop says he smells in your car, but you've never smoked in your life and never had it in your car. So, how do you challenge fake probable cause? Cuz what that is, what a cop's doing there when he says he smells something like marijuana, he's setting the stage to search your car. You're a Doctor Judge follower, so he already knows you're not going to consent to the search, so he needs probable cause to search. If he has probable cause to search, he doesn't need to get a warrant if it's your car because of the Carol doctrine. The Carol doctrine allows him to search your car with probable cause even if he doesn't have a warrant and even if he doesn't have consent. What do you do? You do the same thing you do if you were guilty of it. You're going to do the same thing. You're not going to answer questions. You're going to let the cop do what he says he's going to do. You're not going to fight with him on the street. That's one of those subjective things that you're not going to be able to prove on the scene. So, you can tell the judge about it when you go to court. You can say, "There's no way, Judge, that he could have smelled that." Cuz you know he's not going to find anything.
