True or false, dropped charges can come back to haunt you? The answer to this is true. Absolutely, prosecutors can walk into General Sessions Court, you're charged with criminal offenses, they can stand up and say, "Hey judge, we're not going to prosecute it. We're going to dismiss it, and we're going to let this defendant walk out of court free as a bird." And they turn around and they go to the grand jury and in secret get what's called an indictment against you and recharge you with the same offense. It happens all the time. And sometimes it's strategic because sometimes they don't have a witness that's available. For example, we go into court, we have somebody charged with an assault, and the victim doesn't show up to court, and so we get up as a defense attorney and say, "We'd like to move to dismiss for failure to prosecute." And the judge dismisses it, and then later, after you've been dismissed and walked out of court thinking you're free, you get picked up on the indictment and you get prosecuted again.
