You're not under arrest. >> Well, it sure the crap feels like I'm being under arrest cuz you got me handcuffed in the back seat of your car. >> So, they may end up not charging him. So, let's talk about how they can search this car because the cops already said, "We're searching your car." The cop can't search the car incident to arrest. He doesn't have probable cause to search the car. He's got a little hunch that this guy's worried about him searching his car. So, he's going to tow the car and then they can do what's called an inventory search, which is a loophole that he's backing into this search. He's saying, "I'm going to search this car one way or the other." And the way he gets to do it is he gets to tow the car because of the suspended plate and inventory search his car.
