Hey everybody, Dr. Judge here. Let's play who's the real jerk in this situation. Let me set the stage here. We're in Elgin, Illinois. Let's take a look at this video from a driver who videoed an a police encounter and tries to flip the script on the police officer. Let's see if it works for him. Can I help you? Hi, good morning. >> Morning. I stopped you for speeding. Uh before you begin this interaction, please be advised that I'm recording. I do not consent to this contact with you. Uh anything you say can and will be used against you in a court of law. I got to admit here, that's the first time I've ever seen a citizen read a Miranda right to a police officer who approached his car. So, you can already tell this guy's a jackleg. I can't fault the cop here. The cop holds it together pretty good. This driver kind of gets a little unhinged. Let's watch on. We're under [snorts] duress. I invoke and refuse to waive my fourth my fifth amendment right. And I will not be answering any questions today. Uh why am I being detained? >> Driver's license and proof of insurance. >> Why am I being detained? I stopped you for speeding. You were doing 59 in a 35 [music] as you were going past the golf course. All right. He's making notes. He's got a clipboard and he's writing notes here. He's really trying to antagonize this police officer. He's trying to get a rise out of the cop. He's doing a video. What he wants it is the views. He wants the cop to get pissed and he wants the cop to push back. That's what he wants. Let's see your driver's license and proof of insurance. Uh what's your name and badge number? Can I see your driver's license and proof of insurance? >> I'll be with you shortly. I'll be with you shortly. See, here's the deal. You're not in control [music] of this, sir. Did you pull me over or did I pull you over? You're not in control [music] of this interaction, sir. >> Did I pull you over? >> see your driver's license and proof of insurance? Hey, could you just chill [music] for a second? I'm trying to do my my job. No, no. That's where you're wrong. >> Is your body cam on, sir? I told you, yes, of course. >> Yeah, okay. I'm trying to do my job, sir. Matka? Uh what police department you with? Elgin? Elgin Police Department, sir. That's the city you're driving in. So, the cop just kind of goes along and he answers some of these questions. If I were the cop, I'd be wearing this hat. I've never sold one of these hats to a police officer on duty. This police officer needs this hat. It's I don't answer questions even from a citizen. The cop's supposed to be asking the questions, but he's answering questions and he let this guy get a little too much control, which is what cops hate to do. They don't want to lose control of a scene and he tried to maintain control, but he just doesn't do a good job of it. He lets this citizen play this little game with him for a little bit too long in my opinion. How is your patrol car? Your patrol car? It's right there. What number? It's not relevant to the traffic stop. >> It's not? Okay. Not relevant? Okay. Not relevant to the traffic stop, so you can see it's a marked squad [music] the lights are on. Sir, I don't know I don't know what the problem is. I'm just asking you questions. I'm just trying to get some information. >> driver's license and your proof of insurance. And we will get there. Are you Why are you What's What's What's the big deal? I mean, I'm just asking some questions here. I'm not answering your questions. Okay. So, what road did you >> All this information will be on your traffic stop. What road Before I present my license, which you will get shortly. >> to do that. You're driving in the state of Yeah. >> Yeah. Yeah. Before I do that, I need some information from you. >> [music] >> Okay, so that's where I would draw the line. I'd say, "I'm not answering any more of your questions. Step out of the car." And put a little into his show here. It's a show at this point. This citizen has his video camera propped up there. If I'm this police officer, I would end these theatrics with putting him in custody. Since he's not going to answer my questions and this is a traffic stop, I've got the right to do it safely. I've got the right to ask him out of the car according to Pennsylvania versus Mims. I'm going to detain him maybe even in the backseat of my car while I write him a ticket cuz I don't like the way this is unraveling, and I think it could lead to an escalation unnecessarily. So, I'm going to put an end to this if I'm the cop. The cop doesn't do it. Cop just kind of goes along to get along and answers this guy's questions. I think the cop is being way too polite here and too cordial and answering too many questions. The cop needs one of my hats. I don't answer questions. What do you think? Comment below. But you are asking me questions without an attorney present. I haven't asked you anything. You haven't asked me anything? >> I asked for your driver's license and your proof of insurance. That's it. Okay. What else have I asked you? You don't need to raise your voice. >> your voice to me. What else have I asked Am I raising my voice to you? Am I raising mine? >> Yeah. >> No, I'm just talking. >> It's on camera. It's on camera. >> too. It's all on here. >> Why are you raising your voice to me? Again, [music] did I pull you over? >> just told me I asked you a bunch of questions. >> Sir, again, did I pull you over? >> have I asked you? Okay. So, the cop got him there. He said, "You're asking me all these questions." He said, "I haven't asked you any questions. I just asked for your license and registration." Which is true. He didn't ask where he was coming from, didn't ask where he's going, didn't say, "Do you know why I pulled you over?" Didn't say, "Do you know how fast you were going?" This cop hasn't asked a single question. He's just letting this stop get out of control, in my opinion. You rookie? Madkin? >> Yeah, I don't have to answer your question. Oh, your name is not Madkin. What's your What's your name and badge number? >> on your citation. No, what's your name and badge number? It'll be on your citation. >> Why are you refusing to identify, sir? >> It'll be on your citation. [music] Why are you refusing to identify? >> I'm Officer Madkin with the City of Elgin, sir. Can you say that again? Cuz I can't see your name. It's being blocked. >> And again, it'll be on your citation. Sir. Sir, what's your name and badge number because it's being blocked by that radio. >> and my badge number will be on your citation. >> But I need it here for the record before I present my ID. No, you don't. I don't? >> Yeah, you don't. I don't, but I would like it. Okay, so you don't. I wouldn't have let this citizen control this much of the stop. Like I said, I would have gotten him out of the car. I would have detained him. I would have put an end to this little dog and pony show. When somebody asks me for my name and badge number, I just give them my name and badge number. How about you, sir, step out of the car because I'm going to detain you while I write you this ticket. And we're going to put an end to this little video charade that you're doing. Thank you. Here you go. I don't need that. Are you living on Colony Court in Aurora, sir? Sir, is this your current address on your identification? I'm not just going to assume that that's where you live because it's on your identification. Here's your insurance back. That looks valid. Thank you. I'll be a few minutes. All right, sir. Here's your stuff. I'm going to issue you a citation for speeding. You're going to see court date on the bottom of the citation, but you also get a box checked that says no court appearance required. So, you go to court if you want to. If you don't want to go to court, you can pay by mail. Instructions attached to the ticket itself and also in that white envelope that I have. So, any questions you might have. And there's also information in that white envelope. I'll give you court supervision to keep it off your driving record. Do you have any questions? Uh you're dismissed. Thank you. Have a good day. >> You're dismissed as well. Thanks. Have a good day. >> Pleasure speaking to you. >> You too, sir. Have a great day. Bye. What a jerk. I'm going to give this cop an A- minus. I'm giving him an in the A's because I think he was very cordial. He held his temper. A lot of cops would have gotten butt hurt really quick and they would have escalated the physical part. This cop didn't do that. He answered too many questions, which is why he's not getting an A+. Because he should have put a stop to it quicker. I would have given my name and badge number when asked for it. So, I fault him a little bit for that. So, that's why he's getting an A- minus. The citizen gets a big fat D in my opinion. Although, he invoked his rights to remain silent and not answer questions, sort of. He didn't do it the right way. And he came across as a jerk. This video played in front of the any judge and I know all the judges here in Nashville would have punished this guy for this video. The "You're Dismissed" guy gets a D. We played the little game of who's the prick here, and I want to hear your comments below. Who do you think the prick was? Was it the cop or was it the citizen? And did the citizen properly flip the script on him or did he just show that he's an ass? I want to hear from you police officers. If you came across this jackleg doing this charade, how would you have handled it? What would you have done to put a stop to it? I think it just went on way too long, but comment below, tell me what you think. Dr. Judge rules that this citizen was the prick. And that, friends, is my verdict. And if you liked this video, you'll love this one.
