Yes. >> Do you have a driver's license, registration, and proof of insurance? >> What are you stopping me for? >> I'd rather not say at this time, but I'd be more than happy to let you know. >> Well, you have to have a crime or infraction for me to identify myself, sir. >> So, the cops will tell you you're free to leave, but they sure as heck won't make you feel like it. Watch this crazy video. >> Yes. >> [laughter] >> What are you stopping me for? >> I'd rather not say at this time, but I'd be more than happy to let you know. >> Well, you have to have a crime or infraction for me to identify myself, sir. >> Who am I speaking with? >> The driver of this car. What's your name and badge number? Officer Schneider. What is the nature of the stop? >> I want to know why you're driving by me with the window down. I'm not sure what you're doing. >> Is that a crime, sir? Is that illegal? Is it a crime? Is that a lawful stop because I drove with my window down? >> You didn't give me a reason for the stop. Who am I speaking with? >> The driver of this car. >> Provide your identification. >> For what? [music] I didn't commit a crime. Driving with the window down is not unlawful. If that's all you got, you better get a supervisor out here. >> Who am I speaking with? >> You don't need to know that. I haven't broken a law. >> The only criticism I can give this guy is just say the seven words. I don't answer questions without a lawyer. There's a trigger word to make the cops stop talking to you and stop doing this. It's the word lawyer. If you say, "I don't answer questions without a lawyer." He's got nowhere to go from there. You may have to say it more than once. Now, I'm not going to say saying it one time is enough. You need to get one of these t-shirts and wear the Constitution. I invoke my right to remain silent early and often. That's what I tell people. Invoke it early and invoke it often. That means say it over and over again. I don't answer questions without a lawyer. Now, this guy does a pretty good job. He says, "Who am I talking with? The driver of this car. That's all the identification you're going to get from me, officer, cuz I haven't committed a criminal offense." If this officer would have pushed it, what if the officer would have opened the door and start putting hands on him? What would you do? You have to comply when you're on the street, but thank goodness it didn't escalate to that. But it does get more interesting. Watch what this cop does. >> That's none of your business. >> This is my business. >> It's not your business. It's irrelevant to you. >> No, it's not. >> Why is it not irrelevant? >> This is the third time that I've seen you driving by. When you drive by with your window down, your hand and hand hanging out saying >> Is that against the law? >> It's a reasonable suspicion for me to stop you. >> Reasonable suspicion of what? Riding by with the window down and your arm hanging out the window to this officer is reasonable suspicion to pull him over. I did have an officer just this stupid. It was in Burns, Tennessee, and he thought it was probable cause my client had her sunroof open because it was a cold night and that's indicative of people smoking pot. That's why I pulled her over. Believe it or not, that was truly what he said when we got into court. Let's watch this cop just fumble around with the Constitution and he just doesn't quite get it. He's a little bit daft. >> Suspicion is not a crime. You've stopped me. >> I need to know who I'm speaking with so I can >> You don't need to know that. >> Why do you need to know that? >> For what? >> I don't know if you have a reason to be in this area now at this point in time. >> Is it illegal to be in this area? >> Okay. We have had crimes going on in this area and >> Wonderful. >> suspicious person in this area. >> Okay. >> to know who I'm speaking to. >> Okay. You don't need to know. >> Are you the owner of this vehicle? >> Unless I've broken a law, I don't have to identify. Now, am I free to leave? >> No, you're not at this point, okay? >> What crime are you stopping me for? >> Hey, you are crime to investigate. >> Suspicious is not a crime. When I've done something wrong, then you may stop and detain me. >> Are you the owner of this vehicle? >> I'm not answering any questions. >> You let me know when I'm free to go. And if I'm not, you get a supervisor out here who can explain to you that unless I've broken a law, you cannot detain me. And I do not have to identify. >> Where are you headed to today? >> That's none of your business. I already told you I'm not answering questions. >> Where are you coming from? >> Are you stupid? Obviously you are. >> I think he is just a little bit daft. I think this officer is a little bit disconnected with reality. He thinks if he stands there and holds the flashlight just right, he's going to talk him into talking to him. This driver has clearly said, "I don't answer questions. I'm not answering your questions. I'm not giving my ID. It's none of your business where I'm coming from. It's none of your business where I'm going." This cop thinks it is his business, but it's not. >> Where are you going today? >> You let me know when I'm free to go. Do you always violate people's rights? >> I'm not violating any rights at all. >> Absolutely you are. >> Yes, you are. >> Rights are not violated. >> You're unlawfully detaining me. You're violating my Fourth Amendment right to travel freely. >> I'm not violating any rights. >> I haven't committed a crime. Driving is not illegal. Driving [music] with the window down is not illegal. Driving in this area is not illegal. So, until you have a reason, kick rocks. Now, am I going to get that supervisor? >> No, I don't find a reason to wake my supervisor [music] up at this time. >> Well, you don't, but I do. Clearly, you uh have an issue with me driving. >> It's my job to >> Your job to stop people unlawfully? >> I'm not unlawfully stopping anybody. >> You're preventing me from going to my destination. >> Where is that? I'd be more than happy to let you continue on your destination. >> All right. Thank you. Goodbye. Goodbye. Goodbye. >> Goodbye. >> All right, you said goodbye. >> He said you could travel on to your destination. I'd be happy to let you travel on to your destination. What he meant was, I'd be happy to let you travel on to your destination if you tell me where that is. I just want to know where you're coming from. I want to know where you're going. I want to know who you are because I think you look a little suspicious to me, but I can't quite put my finger on it. Well, guess what? That's what they call a belly hunch, and you don't get to ID somebody on a belly hunch. >> Am I being detained? Not being detained. All right, for the record, this officer is not detaining me. All [music] right. Goodbye. >> Keep driving. There you go. >> You. >> I don't believe I would have done that, but he has the right under the First Amendment to do that. This cop doesn't have the right to get pissed off about it and pull him back over cuz he used graphic language. In my opinion, it wouldn't shock me if this cop pulled him back over for that, but apparently he didn't cuz the video ends there. You're wondering why this video is so short. This video is so short because that's a Dr. Judge follower right there. He knows how to handle a police interaction, and he knows exactly what to say. You guys send me these 30 and 60-minute long videos. Well, they're that long because people don't know what they're doing, and cops take advantage of that. It's short and sweet when you know what you're doing. And if you want to check out some videos where they didn't quite do everything right, watch these.
