Now, what she's talking about here is a DUI. And she's saying that there shouldn't be a standard of a 0.08 because they're going to try to give you a DUI even if you're a 0.02. Well, that's not entirely true. There's two ways that you can get a DUI in Tennessee. One way is, look at this person. He looks drunk, he walks drunk, he talks drunk. He's clearly drunk. It's an impairment standard. The other standard is, we don't really care what he looks like to you. We have this little blood test over here that says he's over a 0.08. So, it's what we call a per se DUI. And you can be convicted of a DUI even if you don't look impaired. So, if you're under a 0.08, yes, they can still try to go after you for impairment, but it's harder to make that DUI case, and all the prosecutors know it. Those cases are never going to make it to trial because the DA's just going to say that's not worth my time. They're going to resolve those cases and usually weave them out of the system with a reckless driving or a reckless endangerment or something of that sort.
