You can't detain someone for for no crime being president. She has to investigate first. It's it's teacher, man. You know what I'm saying? 3802. Quote it for me. You know this. It's easy. Come on. You >> have to identify yourself. >> No, I don't. Not unless I've been arrested. You guys can get a supervisor. That's why I want a supervisor out here. Okay, cool. >> You know, it's easier to >> It's easier, but it's my rights. I haven't done anything wrong. You can give me the paperwork and I don't need the ID. >> Are you a paper, sir? >> Do I need to be a cop to know my rights? >> I'm asking you if you are. >> Do I need to be a cop to know my rights? >> I'm asking you if you are. Do I need to be a cop to know my rights? [Music] What's good, YouTube? It's BB Cass back again with another video and another reaction. And today's video is from Little Ellen Police Department over there in Texas where you had these Little Ellen police officers detain this guy. You having this guy that was at this car rental place and they said they they had a car for him. He got there, they said they didn't have a car for him. So he told the business owner that he didn't know how to run a business. The business owner got mad and told him to leave. When he told him to leave, he left. We having these officers show up and they said, "Oh no, even though that he told you leaving and you left, we still need your ID." And that guy wasn't giving up on it. You will see how these officers were acting when they weren't getting that ID. So I'm going to watch and give my reaction. Let me know what y'all think about the comment section. Let's get into the video. >> So I am detained. >> Yes, sir. >> And what's your name and badge number? Officer Pena. >> Officer Pena. >> Pena 689. 689. Thank you, sir. >> No, I'm Hey, man. I'm not trying to trip on you. I I understand, but you can't detain someone for for no crime being present. She has to investigate first. It's It's procedure, man. You know what I'm saying? >> Well, if we let you go before we do the investigating >> Yeah. >> and say there you were a part of the disturbance, conduct, whatever the case is. >> Yeah. >> How are we going to get to you? >> I mean, that's a point. I mean, you got to do the investigation. If I'm going, I'm going. That's it. You can't just detain somebody. >> I understand that. But we got here and >> you're allowed to investigate, but I mean, you can't you can't just tell me, "Hey, you're not going anywhere because I I haven't done anything wrong, man. You can't just go up to people." Oh, hey, look, that person called on you. We you committed a crime, but there's no evidence of a crime. You know what I'm saying? I mean, I might be wrong, but like I said, I doubt it. >> Well, I'm telling you why why we're here and what we're investigating. That's what we got called to to a disturbance here. >> Well, the reason I'm upset is because she told me that I was going to give my ID and I told her I'm not giving my ID. I haven't done anything wrong. I made the complaint against him. I hung around because I wanted his name. That's the only reason I hung around that and I don't want you guys thinking I'm running off. But then she uses that against me and tells me, "Oh, hey, by the way, I've never had an innocent person not want to give their ID." Well, I know my rights. It's 3802. I don't have to identify unless I've arrested for something. >> Right. >> Correct. >> What? >> I don't have to ID unless I'm arrested. >> Unless you're arrested. Yeah. 3802. Quote it for me. You know this. It's easy. Come on. >> Identify yourself. >> No, I don't. Not unless I've been arrested. You guys can get a supervis. That's why I want a supervisor out here. Okay, cool. >> You know, easier if we get >> It's easier, but it's my rights. I haven't done anything wrong. He started the whole confrontation. You don't come and and and penalize the victim. >> All due respect, you don't seem very calm right now. because she came up and told me I was going to be arrested for disorderly. She hasn't even done an investigation. >> With all due respect, right, I'm going to file a lawsuit against them and you guys if I go to jail for that. >> I have no idea. The only thing I was here for was So, did you get into some kind of argument there? What? >> No, he started it with me. >> I I was angry because he told me three times in a row about two times in a row that my customer can pick your car up. Oh, no. I'm sorry. I don't have anything till Thursday. I laughed. I thought it was a joke. Okay. >> And then he tells me, "Oh, no. I'm serious. I won't have anything till Thursday." Like, dude, you can't do that. I've been doing what I do for 30 years. I can't just not deliver. You know what I'm saying? So then he gets angry at me and starts talking trash to me. I said, "No, no, no." I said, "Dude, you're not going to talk to me like that." And then he kicks me out. So I came outside. I didn't I didn't stay. >> Where were you calling people? >> Really? >> Were you? >> No. Are you kidding me? >> Everybody in there is >> Everybody in there? I've been out here the whole time. He's the only one that's come by. That's ridiculous. >> You argued with him from out here. >> Excuse me. >> You argued with him. >> He was standing out here. >> Okay. So I asked him his name. at all. >> What >> did you not walk into the store at all? >> Earlier before I was kicked out in the store. >> Yeah, before I was kicked out. >> Okay, but still saying >> I never said that. >> But even if he did say it, it's protected speech. >> Okay, but still saying get >> I never said that. Where is the evidence of that? >> He's not wanting to file disorderly conduct because he can't. >> Can I talk now? >> Listen, hold on. You need to settle down, too. Okay. >> Do Can I talk now? Sure. Okay. Thank you. So, he doesn't want to file disorderly conduct or anything like that, but he does But he does want you crimally trespassing. >> I'm not trespass. I don't have I won't come back. >> I won't come back. >> I mean not to come back. I don't know. It >> is how it works. You tell her that's how it works. >> No, that's not how it works. >> It's how it works. And you guys are going to lose your qualified immunity and I'll talk to your supervisor. I'll wait. >> But you they're wanting criminal arrest. >> Well, I know. I get it. I I have I have the summon. >> That's the problem. You're not letting this >> I know because I'm I know what I'm talking about. I don't have to give ID. calm down and let us let me talk. Okay. That's something that bothers me as a person. Let me talk. Sure. Okay. >> In order to give you that criminal trespass warning, we have to get you identified. >> You can give me the paperwork and I don't need the ID. >> Are you okay, sir? >> Do I need to be a cop to know my rights? >> Do I need to be a cop to know my rights? >> I'm asking you if you are. >> Do I need to be a cop to know my rights? >> You got to answer my question first. >> No, I don't. >> Okay, then I won't answer. >> This is ridiculous. I haven't committed a crime. You guys showed up to a non-prime to a citizen that got wronged in there and now I'm the one that you're saying I have to ID which I'm not going to. Your your supervisor is going to let you know that and you guys will learn something today. >> I have a whole here for a non crime. >> Yeah, he had to call if you do several other things besides the absolutely correction. You absolutely you have every right to come investigate. There was no crime. He told me he didn't want me back, which I'll get rescended by Enterprise. I don't need the ID. That's not how that works. >> It is going to be how it works because he doesn't have the final case. You know, you're lost. >> I do. >> Okay. >> Are you telling me that his regional manager can't resend his trespass? >> That's not right. >> But on you know, you know that [Music] >> I don't need to. I know it. If I if I come back, >> then you would have known that his regional manager can't resend. >> He can't. >> Okay. He's the regional manager. >> Okay. I I own a business. I know a little something about business law. >> Oh, okay. Next time you're in the parking lot over here at this church watching YouTube or or uh Netflix, I'll be sure to report that, too. >> Okay. >> Sounds good. >> You got it. You guys come out and make fun of people that know their rights. That's why there's a disconnect, man. You guys don't You're cool. You're fine, but you came up and told me that I was going to ID or I was going to be charged with disorderly Honda. >> I did not. >> He did. It's on video. >> I said I'm going to investigate if there >> but you came out with a cocky attitude. I'm I'm the one who got wrong here. And you come out, you're laughing and joking there with those guys like I'm the one who's an idiot or something, you know, and I'm standing up for my rights and I'm the one that's potentially going to try to get arrested here because I'm standing up for my right because I know 30. >> We're putting for a different license. Whatever this is is not working. Okay. >> Absolutely. is not three policemen showed up instead of honoring the rights that I have. Not you and maybe not you, but are telling me something that is not correct. >> We're going to wait for our supervisor since you're requesting him. And then >> how far out is he? Because there's a limit on the amount of time I can be detained. >> Right. A reasonable amount of time. >> Exactly. And that's what 20 minutes. >> What is the reasonable amount of time? >> Less than 90 >> for a non-rime. >> It's not less than 90 either. And for no crime either one, too. >> Huh? >> Florida voyer. You can read that while we're waiting. >> Sure. I mean, am I not supposed to know my rights at all? >> I'm trying to help you learn more, right? >> Okay, that's fine. Then I I'll I'll But you seem mad that I that I know that I don't have to ID. I've never had to actually use the 302 thing, but here we go. >> How long has this detainment lasted so far? Would you say >> you're the one that requested a supervisor? >> So, am I undetained? If I'm undetained, I'll >> Are you going to let me answer your question or you just talk until my supervisor gets here? >> So, I'm detained till he gets here. >> Until we identify you and >> I'm not getting identified. You're walking away without knowing who I am. >> So, how long has this detainment lasted so far? >> Since you since I pulled up. >> How long was that? Is it going to say on your call notes or anything or >> how long do you think that's been? >> I don't know. >> So, more than 20 minutes probably. >> It's an unreasonable amount of time for containment. >> Sorry. >> No, it's not. It's the law. You guys can't go pick and choose what you want to cover and what you don't. You can see the angle on her face how mad she is. She can't get that ID. >> I do have some good music though. >> Party music. >> What do you say a reasonable amount of time to be painted? >> Just said we're done answering questions. >> That's that's kind of rude. I'm not, you know, I understand. I understand that, but I'm I'm the one whose rights are potentially going to be violated and nobody cares. And that's what the disconnect between police and the citizens are. I know my rights, so she makes fun of me and that's that's not cool. >> I'm not going to >> That's fine. You don't have to say another word. You don't have to say another word. >> My next step will go to the police station. and I'll get a complaint for him. >> I know and I appreciate that. I have the right to not identify for a non-rime as well. >> And unfortunately, that's all of the video that I have from that incident. But it just goes to show how these police officers of Texas really hate it when you don't want to give up that ID. One thing that these officers didn't like is the fact that he quoted 3802. >> 3802. What's quote it for me? You know this. It's easy. Come on. Identify yourself. >> No, I don't. Not unless I've been arrested. You guys can get a super. That's why I want to supervise around here. Okay, cool. >> No, it's easier if we >> It's easier, but it's my rights. I haven't done anything wrong. >> And then you having the other officer say, "Are you a cop? Are you a police officer?" All because of this guy knows his rights. >> Have to give you that criminal trespass warning. We have to get you identified. >> You can give me the paperwork and I don't need the ID. >> Are you a sir? >> Do I need to be a cop to know my rights? >> Do I need to be a cop to know my rights? >> Then you having this officer's whole argument saying, "Oh, you know, you was calling people names and cussing out and But yeah, that was all protected under freedom of speech. >> Oh, okay. But still saying >> I never said that. Where is the evidence of that? >> He's not wanting to follow disorderly conduct because he can't. >> She doesn't even know 100% if this guy said that or not. But that's my take on it though. Let me know what y'all think about the comment section. How you feel about these little Ellen police officers for detaining this dude all because that he wouldn't give up his ID. You having these officers say, "Oh, you know, you call these people this, you said that." Yes, they ain't had no proof of it. And you having this guy, they just having this guy detained literally wasting his time for no reason. We trying to tell these officers that when the guy told him to leave that he left, there should be no reason for them wanting his ID. You know, when you have these officers that just be feeding for that ID, this exactly how they at, especially even text, it doesn't even matter about 3802. Once you quote that, they just start to get mad as you can see in this video right here. But that's my take on it, though. Let me know what y'all think about the comment section. Make sure to like and subscribe and y'all have a wonderful day. [Music]
