You having this guy that was just recording. This officer rolled up on him and started asking, "Hey, were you on their property? Hey, man, I need to get your ID because they're trespassing." This officer doesn't know if this guy was on the property or the sidewalk, but just because the church said that they needed to get his ID, this officer said, "Okay, yeah, I'm going to get that for you." And tries to get this guy's ID, try to get his name, cuz you already know they be feening for it. I'm going to watch it and get my reaction. Let me know what y'all think about in the comment section. Let's get into the video. >> What's up? Okay. Okay. Am I to be in detain? Am I being detained? >> I'm just trying to identify. The problem is they asked me to identify who was on the property. >> Say what? >> They asked me to identify who was on the church property. >> Who asked you? >> The church pastors. >> You work for the church? >> No, I work for the Phoenix Police Department on answering a call. >> Okay, what's your name? >> Officer Munson, M U N S O N, serial number 6972, Phoenix Police Department. >> Okay. >> Were you on their property, sir? >> They You said they said I was on their property? >> Yes. >> Did you find out if I was on the property? >> Yes. >> And what was your what determination? >> You were on their property is what they >> So, why you asking me was I on the property? >> Well, I'm going to see what your side of the view is. Or do you have ID on you? >> Okay, am I unlawfully obligated to >> Yes, you are. >> to identify myself? >> Yes. >> I think you're mistaken, officer. >> My name is Officer M O N S O R. Serial number 6972. >> I think you you highly mistaken. I I suggest you get a supervisor on the scene before you make a big mistake. You didn't even do an investigation. Did you go talk to the people? >> Yes. >> You went and talked to them? >> Yes. >> And they said I was on the property? >> Yes. >> And and so that's that's hearsay, right? Did you see any footage of me being on the property? >> That's not hearsay, but I have three people saying the same thing. >> Just like cops, people will lie for each other. Did you see any footage of me being on the property? >> That's not hearsay, but I have three people saying the same thing. >> Okay. I suggest you get a supervisor on the scene. Yeah, thank you so much. On the rollerblades. God damn. >> What's that, sir? >> I said y'all got me detained on the rollerblades. Am I allowed to sit down or >> You can take a seat. >> Or can I sit on your bumper? >> Go right ahead, sir. Let me pull over. >> No, I'm I'm all right right now. >> You're okay? >> Yeah, but um you unlawfully detaining me right now. So, you got a time you got a time limit on what you need to be doing right now. Cuz I haven't committed any crimes, but I'm being detained. >> Well, you're being detained for trespassing. >> Even if I went on the property, you got to give me a uh uh >> No, I don't have to. >> You have They have to They have to ask me to leave before I'm trespassing. Okay. Get your supervisor on the scene. All right. Did you read the ARS? >> Yes, I did. >> Okay, I suggest you brush up on it a little bit. I suggest you brush up on it a little bit. Ho- Hopefully your supervisor come down here and tell you. >> All right. Can I get your first name, sir? >> I'll give >> you I'll give your supervisor my name once he determined if I committed a crime or not. >> All right. >> I'll take this ride. So, what they tell you I was doing on their property? >> Uh recording their service and all of the members as they were leaving. >> Oh, okay. You ever heard of Terry versus Ohio? >> Yes. >> So, what's your reasonable articulable suspicion that I I've committed a crime? >> I'm trying to determine that, sir. >> You need that You Don't you need that before you can detain somebody, Officer Munson? >> No. >> Okay. >> We can detain somebody, sir. >> Okay. >> you were under arrest, did I? >> You need reasonable You need reasonable articulable suspicion to detain me. You don't have that. >> I have three witnesses, sir. >> You don't have that. >> I have three witnesses, sir. >> You got three witnesses telling you I was on their property? >> Yes, sir. >> Okay. >> That's why I was asking you. >> Morning. >> Were you at the church this morning? >> Yes, I did. >> All right. >> Um this Officer Munson right here uh seems to believe that I have to give him my identification even though I haven't committed a crime. This officer seems to be under the impression that I need to identify myself even though I haven't committed a crime. >> Is this the gentleman that was Yes, the three people I spoke to at the church said he was on their property and filming. And he had just left, so I said, "Well, I'll go try to talk to him." They wanted to press charges. So, that's why I never figured why he's filming them for 2 hours, the service and all. You got it. Were you at the church this morning? >> Sir? >> Sir, were you at the church up the street? >> He said I'm being detained, so I therefore I'm not going to >> Were you at the church up the street? >> I I'm not asking I'm I'm going to invoke my Fifth Amendment right to silence at this point cuz he said I was detained. >> Okay, cool. If there you do understand that there are people that concerned by why you were there for 2 hours filming. >> Concerned? >> Yes. >> About what? >> You trespassing on the property filming for whatever reason making them uncomfortable. Does that make sense to you? >> Okay. >> That's all you sir. You're trespassing on the property of the church up here. Do not go back. If you do go on the premises you will be arrested for trespassing. >> Can I get your name and badge number? >> Brandis, 6589. >> All right, y'all dismissed. >> Anything else? >> Dismissed. >> All right. Thank you, sir. >> Dismissed. Walkershane, Munson. That's the Walkershane, Munson. >> You know he was upset he couldn't get that name. He couldn't go back to the church and tell them, "Hey guys, I got his name for y'all." >> They asked me to identify who was on the church property. >> Who asked you? >> The church pastors. >> You work for the church? >> If the church tells me to jump, I'm going to say how high. And like I said, this officer didn't even know if this guy was on the property, but he wants to say, "Oh, you know, three people told me you was on the property." >> You didn't even do an investigation. Did you go talk to the people? >> Yes. >> You went and talked to them? >> Yes. >> And they said I was on the property? >> Yes. >> That's hearsay, right? Did you see any footage of me being on the property? >> That's hearsay, but I have three people saying the same thing. >> I guess this officer doesn't know three people can make up the same lie. But when the supervisor got there, he didn't want to try to get this guy's name because he know he couldn't. >> You do understand that there are people that concerned by why you were there you trespassing on the property filming for whatever reason making them uncomfortable. That's all you sir. You're trespassing on the property of the church up here. Do not go back. Anything else? >> Dismissed. >> All right. Thank you, sir. >> Dismissed. >> You know this officer felt like he failed the church because he couldn't get this guy's name. But that's my take on it though. Let me know what y'all think about in the comment section. How do you feel about these Phoenix police officers for detaining this guy because they said that the church said that he was on their property. Nobody doesn't know if he was on this property or not. He could have been on the sidewalk, but you having this officer saying, "Oh, I had three people tell me you was on the property." Well, three people collide, too. And it was just the simple fact how he's not even there no more. So, this whole detainment was unlawful. Like he had no reason to detain this guy at all. He's not on the property. There's nothing he could do. But it's kind of crazy when the supervisor got there, he didn't even ask for that guy's name. But he had to take a picture real quick to show the church people, "Oh yeah, this is the person right here who was trespassing on property." For all they know, he could have just been on the sidewalk. That's my take on it though. Let me know what y'all think about in the comment section.
