Do you see the reasonable suspicion because you No. You don't fit that description? Because I wasn't over there. As far as the description I just gave you, do you fit that description? I got two penal codes, I know my law. Believe me, I know it very well. I ain't trying to give you no hard time, man. But I just walked through here. >> like you are. Why you say I'm trying to give you a hard time cuz I cuz I want to stand on my rights? >> no big deal, why won't you just identify? I told you I would get out of the car. We have every reason to get out of the car cuz it's called reasonable suspicion. All right. I but I can I can go with that. I understand that. I don't have no problem. I don't have no problem. >> to go to jail if you don't No, no. I no. I'm I'm just saying I just want everything cleared up. That's all. So Reasonable suspicion is not crime to ID anybody. Huh? Are you going to want to talk to us at all before I ask you a couple of questions? It all depends what you're talking about. All right. Give me one second. I have to read you your rights, okay? Let me ask you something. Yeah, go ahead. Is that law? Do what? Is that Do y'all have to do this? Do what? Read you your rights? Yeah. Is it mandatory? Only if you're detained and being questioned. Is it mandatory? That's what But I ran into this incident before and I had my rights were never read to me. >> Only if you're detained and questioned. He detained me, questioned me, and locked me up. >> Okay. So, real quick. You have the You have the remain silent. Anything you say can and will be against you or used against you in a court of law. You have the right to talk to a lawyer and have him or her present with you while you are being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questions if you wish. You can decide at any time to exercise these rights and not answer any questions or make any statements. Do you understand these rights? >> Yes, sir. All right, perfect. Um, are you willing to answer a couple questions for me? Yes, sir. All right. At any point over like on 4th and Mint, were you like close to a truck? No. No? No. I was walking up and down the street. I walked up there to meet somebody and I came back. That's it. So, you were at the But, were you up at 4th and Mint? Once you read me my rights, I ain't finna say nothing at all. >> No? No? No. I was walking up and down the street. I walked up there to meet somebody and I came back. That's it. So, you were at the But, were you up at 4th and Mint? I'm trying to get away from here cuz I ain't from here. Okay. I was right there by there where the stadium at. Uh-huh. I went straight up and straight back. >> Okay. I'm just walking and not But, here's the thing. Whenever you fit the description, that's our reasonable suspicion. That's what I wanted to know. So, that's our reasonable suspicion to get out and identify you and talk to you So, because we have reasonable suspicion that you might have committed a crime cuz you fit the description. So, reasonable reasonable suspicion Yes. of a crime gives you the right to ID me? Yes, it does. I I can That's something new. I can No, that's always been that way. No, I I cannot arrest you on that crime because I don't have probable cause, but reasonable suspicion Okay. Now, you you you Now, I'm learning something now. Reasonable suspicion is whenever I can get out and identify and talk to you about Okay, I got you. detain you until we can figure out if we have a crime committed. Right. Got you. Got you. Got you. take you to jail until I have probable cause. Probable cause, yeah. I thought it was rats. You have to have rats in order to ID me. That's why I'm getting confused with the law, man. That's why I'm so confused like that. I thought you had to have reasonable articulate suspicion in order to I thought it was the ID. I see I see what you're talking I see you with your reasonable suspicion and all that. Come here. No. Because I wasn't over there. No. I'm not going to answer that. No. Because I know I it wasn't me. You could definitely tell that that was a trick question. >> reasonable suspicion and all that. Come here. No. Because I wasn't over there. No. I'm not going to answer that. No. Because I know I it wasn't me. But y'all good. Y'all doing your job, man. He think I'm trying to be confrontational. I don't know why. >> [laughter] >> Oh, you good. You can ask all you want. I don't have no problem. That's crazy, man. I I can't even walk and I'm I'm getting getting accused of something I ain't did. I'm only doing this walking. It's all right. Y'all got I know y'all got a job to do, too, you know. No, man. You're doing your job, man. Yeah, you're doing your job, man. Don't worry about it, man. You're doing your job, man. Name and badge number? Hey, man. Man, may I ask you man. What? Why did it take all this? You know, multiple, you know, units. Even though even though there ain't no crime being committed and y'all trying to figure out if there was a crime committed. But I don't know. All we know is y'all got multiple units. Okay. Yeah, I ain't I don't play that, man. I did 23 years, man. I've been out six what? 27 years now, man. I did 23 years in South Carolina, man. I can't do that, man. I got grandkids. And I just came through here. You can't I I can't And they just stopped me. What the hell? Don't worry about it. I ain't do nothing, so they'll get cleared up. How you doing, officer? Name and badge number? Van Brunt, 6862. Oh, man, I like y'all, man. Respectable, man. I think me and him me and him I don't talk to him before. I don't talk to him before. I I I I can't Yeah, I talked to you a couple times before. No, not a couple times. What no. Not that wrong one. I talked to you I believe one time. Was that a bus stop, wasn't it? Yeah. >> Yeah, was that a bus stop, wasn't No, it was a It was a by Graham. No, is it Graham? No, it was over on the By the hospital. Yeah, by the hospital. Yeah. By the and and and and I ain't do nothing that day. Remember they told me about they had my picture doing the same thing. You're going to be good to go, okay? Thank you, man. Hey man, but uh Appreciate you. Being They're over here detaining the wrong person while the actual person that broke into the truck is long gone by now. Because from the beginning you having this officer saying he's giving him a hard time. >> I know two penal codes, so I know my law. Believe me, I know it very well. I ain't trying to give you no hard time, man. But I just walked through here. >> like you are. Why you say I'm trying to give you a hard time? Because I Because I want to stand on my rights? >> no big deal, why won't you just identify? I told The deal is that he's trying to protect his right. Once they pull this booklet out and they start reading me my rights, I'm just not finna say nothing after that. >> Anything you say can and will be against you and used against you in a court of law. You have the right to talk to a lawyer. I'm just saying, but as far as the description I just gave you, do you fit that description? >> No. No? I'm not going to answer that. No. >> You already know he was trying to throw in that trick question. And while these officers were messing with this guy, they just ended up letting him go. But I guess the actual person that was committing a crime just got away. You had my picture doing the same thing. What? You're going to be good to go, okay? Thank you, man. Hey, man, but uh Appreciate you. At least you had one of the officers say that they were sorry. But that's my take on it though. Let me know what y'all think about in the comment section. How do you feel about these Charlotte police officers for detaining this guy literally for no reason at all? You having this guy just walking minding his own business. You having them say, "Oh, you know, you match the description of somebody. We need to get your ID." And at first this guy was letting them know that he wasn't finna give up his name. But you already know once these officers pull these gloves out, it's either you give up your name or we're going to take you to jail. And obviously he wasn't finna do all that. But it just goes to show how these officers were literally trying to put inside your head that, "Yeah, man, you know, it doesn't matter what it is. When we come up to you, you have to give us your name." When in reality, especially when you ain't did nothing, you don't not have to talk to them at all. That's my take on it though. Let me know what y'all think about in the comment section. Make sure to like and subscribe and y'all have a wonderful day. >> [music] [music]
