I will not do any field sobriety test. >> So, you understand you'll go to jail for refusing to take the test, right? >> Take a real deep breath in. You're going to put your lips around the center here. Look at me. What's good YouTube? It's BB Cass back again with another video and another reaction. And it's today's video is from the South Carolina State Patrol office where I posted this interaction a couple days ago where this guy got pulled over by the South Carolina trooper. Trooper Christopher Footer. This guy was looking on his GPS. He's not familiar with the area. He went the wrong way. Then you having this trooper pull him over and he started asking him some fishing questions. Obviously, he wasn't going to answer none. And then you having this state trooper accuse him of being under the influence. So, he really wanted him to do some field sobriety test. And all because of he said no, he took him to jail. And mind you, he told his state trooper where he will literally do a breathalyzer to prove it. And in this video right here, he does a breathalyzer and you going to see how this trooper reacts when he sees that he blew zero. And I will play a little bit of the interaction that happened before this. So for the people that didn't see the video, y'all will get caught up on this. I'm going to watch and get my reaction. Let me know what y'all think about the comment section. Let's get into the video. >> Triple foot with the highway patrol. We stopping you and you drive. >> Yeah, the the GPS had messed up. I didn't realize I had to cut right there to do with the GPS. You got your license with you? >> Yeah. >> Where you coming from? >> That That's irrelevant. >> You had anything to drink tonight? >> I I I'm going to invoke my fifth amendment right to remain silent. >> Okay. Go ahead. >> Like I like I said, I was >> out here for me. Hey. >> What's your name and badge number? >> Yeah, you're not running the show. I am. Run back here for me. >> You don't need to be rude, sir. >> Yeah. Put your phone down. >> No, I I can record you. >> No, you can. You can set it right there, though. You're not going to hold it. >> I can If you need to pat me down, you can pat me down. >> Pat you down. Set your phone right there. >> I can I can record. I can record. The reason I'm asking is you're driving the wrong way down Olympia Street. >> I told you I was using my GPS. >> Okay. >> And it to I didn't realize it breaks off. I'm not from >> That's why I'm asking if you had anything to drink tonight cuz that's >> I don't need I don't need to answer that question. >> Okay. You going to you going to consent to performing field sobriety for me? >> No. >> No. >> I I will do a blow test, but I'm but I'm >> You understand that you're going to be placed under arrest for refusing, right? >> I will not do a field sobriety. I will do a breath test. >> Okay, that's it. >> I'm asking you questions cuz I don't want to take you to jail for no reason. >> I haven't refused to. You are refusing to take field sobriety house. I'm asking you. >> I don't need to do a field sobriety. >> Yes, you do. >> I can do a breath test, >> right? I'm asking you if you want to consent to take the field soriety. If not, you're going to go to jail. >> If if that's if that is your is your body camera on? >> Yeah, everybody's recording out here. >> Is your bad body camera on? And you said what's your name and badge number is? >> I'm not repeating myself again. Put your phone down. >> Okay. You're Can I request a supervisor? Cuz >> I am a supervisor. >> You're clearly ready to escalate this unnecessarily. >> You're under arrest. Turn around. Put your hands behind. >> Okay. What is this? >> Alvin Glenn. >> Huh? >> Alvin Glenn. >> Alvin Quinn. >> I apologize. You've been six time. Yeah. Alvin Glenn. G L E N. >> This is Columbia. >> Yeah, we're still in Columbia. All right. So, you're still being recorded by audio and video. Okay. And obviously, we're here to collect your press for me. Open your mouth for me. Oh, you got I got to see your mouth. Make sure you >> I don't have any. I don't have any weapons. >> No, it's not for weapons. If you have anything metallic, it'll mess up the sample. >> Do I get a copy of that reading? >> You get a copy of everything. >> You get No, no, no. You get a copy of every everything we're doing. >> Well, every state is different. Sometime you have to get an attorney to request body cam. >> Well, yeah. For body cam and all. Yeah. You have to submit a foyer request for that. >> No, I mean some states you have to have your attorney. They want >> Oh, okay. Yeah. No, you can you can have an attorney or you yourself can submit a foyer request if you want to to get you can't get body cam footage, but you can get the rest of the footage. >> I wonder why they don't give out body cam footage. >> Well, that's the reason why I record because it's too much of a hustle. At >> point these cuffs off. Are they hurting you that bad? >> A little bit. But I mean, I guess that's part of the process. >> Yeah, the jail I mean now we're under kind of the jail's rules. They all like us to let I'm not saying you're going to do anything, but you know, they can't we can't just cut somebody loose. >> Would you say what the um charges for the um going on around the street? >> What do you mean? >> You said the the citation of what that was. driving on the wrong side of the road. >> Yeah. What would that have been? >> Driving on That's what >> No, like the fine or whatever it is. >> I think I'd have to look up the fine to be exact. I think it's like 200. >> Do you know the code that that falls under? The traffic code or what? >> Yeah. Yeah, it falls under our metric or traffic court. >> No. What? There must be a code that that driving on the wrong side of the road is >> Oh, code. Is that what you mean? I don't know the exact statute. >> Yeah. Yeah. The statute will be on your ticket. I have to look it up. I'm not I'm not going to take a guess and tell you the wrong thing. Okay. So, can you sit back at all? >> I need to. >> Well, I you have to read this. Are you okay with it right here? I'm going to read this out loud to you. You just need to follow along for me. Okay. >> All right. So, you're under arrest for driving under the influence. Section 565 2930. South Carolina code laws 1976 as amended. The arresting officer is directed the samples be taken for alcohol and or drug testing. Samples will be taken and tested according to section 5652950 and sled policies. You do not have to take the test or give the samples. If you refuse to submit to the test, your privilege to drive in South Carolina must be suspended or denied for at least 6 months with the option of ending your suspension if you enroll in addition or lock device program and your refusal may be used to get you in court. If you take the test and give the samples or or give the samples and have an alcohol concentration of 8100s of 1% 008 or more, you may instead be charged with driving with an unlawful alcohol concentration section 5652933. If you have an alcohol concentration of 15100s to 1% or more.15, you your privacy drive in South Carolina must be suspended for at least one month with the option of ending your suspension if you enroll in the additional lot device program. You have the right to have a qualified person of your choosing. For this machine, we have a 20-minut observation period, which we have 17 minutes left on, at which point I'll give you a chance to give a sample. Okay. >> So, I need to sign this acknowledging. >> That's up to you if you want to sign. You don't have to sign, >> but I'll give you a chance to when we when they tell me to take the cups off of you, I'll give you a chance to sign if you want to. >> So, do I do do I sign then do the test or do I do the test then I sign? >> No. This is the only thing you're signing for is that what I just told you that I'm advising you of your rights. Um, so that has nothing to to do with this, but you don't have to sign the form if you don't want to. It's just you're going to get a copy and I'm going to get a copy and I'm going to put all your information on here. You're going to run this internal test. Okay? At which point I'm going ask you to stand up. I'm going put this mouthpiece on the end of here. When I tell you to take a real deep breath in and then you're going to put your lips around this end right here. Look at me. >> Yeah. So in Okay. Then you're going to give a nice steady breath out. All right. The the machine will give me an audible tone that you're given a sample. Once it gets enough of the sample, it'll click and I'll tell you to stop. Okay? You understand? Take a nice deep breath. >> All right. That's it. Takes a lot. Was that a paperwork for me? >> What's that? >> There's some paperwork you needed to sign. >> Yeah, once I take the cup off, you can sign it if you want to. That trooper was hoping for a DUI charge just for it to read zero. That's why he had to crumble up that paper because from the start of interaction, he told this state trooper that he will do a breath test. And the state troopers don't have breathalyzes available in their cars. What's the tax money really being spent on? >> Dispel if I'm intoxicated. I will do a breath test. I will not do any field sobriety test. >> You you are refusing to take field sobriety. That's >> I don't need to do a field sobriety. >> Yes, you do. want him to do the field sobriety so he could be like, "Well, I observed that he was under the influence." And then when he finally got the breath test, you having that state trooper crump up that old DUI charge. You know, he hated to see them zeros. This state trooper couldn't charge anything, so he had to say, "Oh, you know, he went the wrong side of the road, so I'm going to get him for that." and the dude has spent a night in jail all because he didn't want to answer this state trooper's questions and just for this whole case to get dismissed. And also, he has been in contact with the civil rights lawyer over all of this. I will definitely keep y'all posted and let y'all know how that unfolds. And it just goes to show, like I said, when these officers out on a fishing trip and you're not helping with their fishing. One way or another, they going to find a way to take you to jail and you have an estate trooper literally say, "Oh man, I believe you're under the influence. Just do some field sobriety test, bro. Get a breathalyzer." No, that just makes too much sense. I'm going to take you to jail. That's my take on it, though. Let me know what y'all think by the comment section. Make sure to like, subscribe, and y'all have a wonderful day.
