checked into a Utah hotel for a nightly
rest she couldn't have ever imagined the
shocking chain of events that would
follow in just a few short hours
sometime after 3:00 a.m. at the myplace
hotel in West Jordan Utah the West
Jordan Police Department received a call
from someone who was staying at the
myplace hotel complaining of noise and a
possible domestic violence situation the
caller explained that in the room next
to his there were what sounded like like
two adults having a screaming match
Furniture hitting the walls and an
infant or small child crying shortly
thereafter four officers head to the
scene and begin to knock on the door
after locating what they believed to be
the right room inside 54-year-old Sherry
Meyer was sleeping peacefully until
she's startled awake by the officer's
banging West door
police confused and frightened Sherry
gets out of bed and goes to the door
wearing only her pajama

police report this was when Sherry Meyer
threw out a closed fist at officer wood
causing officer wood to have to move out
out of the way to avoid being hit man

assault and verbal aggression the
officers decided Sherry needed to be
handcuffed and push their way into her
room this is a violation of her Fourth
Amendment rights as a hotel or motel
room shares the same protections against
unlawful search and seizure as a house
does while it's being occupied by a
paying customer Sherry claims her
husband is a police officer himself if
so it stands to reason that Sherry may
have some knowledge of both police
procedure and her legal rights when it
comes to being questioned the officers
however don't seem terribly interested

hearing however they don't seem to find
any evidence of anyone other than Sher
Ander dog this kind of search is
generally legal under the chimel rule
which allows police to search the
immediate area around someone who's been
arrested this is really a type of
Officer Safety Search where they're
looking for other potential
asants however this search is probably a
difficult one to defend in civil court
and that given the facts any
incriminating evidence found could be
suppressed later on at this point it
should have been obvious or at least
plausible to the officers that they just
might have the wrong hotel room because
they do but instead of continuing the
search for the domestic situation with a
potentially endangered child they
instead take Sherry to jail

station though it isn't long before they

officers soon continued the drive to the
jail when they arrived Sherry was booked
on several charges including assault of
police without a weapon perhaps
unsurprisingly these charges were
dropped almost immediately upon review
by the district attorney Riley Sherry's
dog was left alone at the hotel until an
officer returned for him and took him to
animal control it's unknown when or if
Sherry or her husband were able to
retrieve their dog Sherry understandably
upset by the events of that night
retained counsel and asked the city for
an apology which she didn't receive she
filed a lawsuit against the West Jordan
Police Department claiming violations of
her rights and misconduct by the five
officers involved the lawsuit is still
pending at this time the West Jordan
Police Department was quick to state
that their officers acted within
guidelines but they also refused to
comment further as the case is under
review
