I assume he shot up in the air, but you can see his little target. He shoots every freaking day. If we're outside, he's out here shooting. >> He still can't be out here doing that. >> Anytime we deal with a call has to do with a gun, I'm going to take it off your side, okay? >> No. >> You got your ID with you? >> I haven't committed any crime. I'll protect my Fourth Amendment. >> Fourth Amendment gets put aside when okay. >> You have a right to ID. We had a call to You said that you fired shots off. >> It doesn't matter if I fired shots off. I'm on >> So we get Because anybody can call and make anything up. >> I don't know that he did. >> You don't know What do you mean you don't know that he did? >> I mean I mean I he he >> [music] [music] >> What's good, YouTube? It's BB Case back again with another video and another reaction. And in today's video, it's from the Meigs County Sheriff's Office over there in Tennessee, where you have these Meigs County Sheriff Deputies, Sergeant Myers and Sergeant Edberton, pull up on this guy's property saying that he was shooting. Him and his neighbor have been having a back and forth, and so his neighbor called the Sheriff's Department saying that he was shooting and that he assumed that he was shooting in the air. Doesn't really know. And these Sheriff Officers came to this guy saying that they needed to get his ID saying that his neighbor said that he was shooting in the air. And he was trying to tell them that he was shooting on the ground because he was trying to scare some chickens away because he's cutting his grass. But you having these Sheriff Officers not even care about that because the only thing they're thinking about is getting his ID. And when he said he wasn't giving up his ID, they weren't having it because like I said, in one way or another, they finna get that ID. But I will say that this case ended up getting dismissed, but it's for the simple fact how people still be getting arrested for this stuff just for it to get dismissed. So just believe after you see this video, he most definitely did file for a lawsuit. I'm going to watch it and get my reaction. Let me know what y'all think about in the comment section. Let's get it to the video. >> I listen, I'm going to dispute about the property line and yeah, he can't stay off me and I've asked him to stay off me. So I'll come out here and I'm just going to put up a fence. I've not said anything to him. And he came out there and stood behind that van right y'all are in. I assume he shot up in the air, but you can see his little target sitting right down there. It's directly in line with this. He shoots every freaking day we come out. >> Okay. >> But he Before we're outside, he's out here shooting. And it's a constant agitation with him. >> I got you. >> Uh but you know, he wants to shoot guns while we're sitting over on the porch. It's pretty stupid. >> Yeah. >> But uh with no backstop, but we're down here fencing and he's out there popping off rounds. That's a little That's about I'm going to That's part of This has been going going for 5 years. I >> I got you. >> We ain't spoken two or three, so. >> Okay. >> But it never ends with him. >> I got you. You got your ID with you, sir? >> I do. >> Okay. >> This is probably just going to make it worse. >> He still can't be out here doing that. >> got to get documented somewhere or another that this is going on. Get it out. >> They're in there tired, I'll tell you. Has he said anything to you today or >> No, we've not We've not spoken to each other in two or three years. >> I got you. What's a good phone number for you, sir? >> I've got you. >> All right, if you don't mind, go ahead and hop in your vehicle so we can talk to him. Yeah. >> Right over here. >> Oh, let's Let's back this way. It's closer to the property line. >> How are you doing? >> Good. How are you? Fair to middling. I think there's another one coming. >> It is. >> Yeah. >> Uh >> Okay. >> I'm Sergeant Emberton. This is Sergeant Meyer. She's going to be the one dealing with you. Anytime we deal with a call that has to do with a gun, I'm going to take it off of your side, okay? >> No. >> Yes. >> Well, you're That's I mean, if that's what you're going to do, then I'm saying it's not okay as far as I'm concerned. >> Okay, well, we're going to We're going to take it off your side. >> All right. >> Okay. >> Okay. >> The reason that we're here is we got a call about someone firing shots up here. Okay? So, that's why there's so >> 72 did >> so many of us coming out here. Okay? >> Pretty interesting. I can't wait to get the uh Y'all was already in front of you? And you said Everton and >> Myatt. Sorry, Myatt. >> 10-97 that was over there. >> Well, there's no crimes being committed here. >> Okay. >> So, what you >> Look, we're not saying that you committed a crime. We're just saying that We're just saying that we've got to I understand it. >> Right. Yeah. >> And I'm not I'm not an advocate to take people's guns. I'm not. But it's just an officer safety thing. As soon as we figure this out, if there's nothing wrong, I'm going to give you your gun back. I'm cool with everybody having their guns. I'm cool with everybody walking around with them. I'm We're definitely pro-gun. I'm not here to take your gun. I'm not here to try to >> I'll tell you what, you guys are already doing a good a good job so far. I can't wait to see what this Tut guy is bringing in, though. >> Okay. So, at any point did you fire your weapon up in the air, sir? >> No. >> Okay. Why would we get a call that said that you had? >> But I thought the neighbor said that he assumed that he shot in the air. >> Why would we get a call that said that you had? >> Uh whenever I started my mower a minute ago, all my chickens was congregated underneath my van once again. So, I dropped two shots in the ground to scare them all back to their coop. But it wasn't in the air. There was two shots fired and it was in the ground. >> Okay. >> It clears them out fast. It's not first time I've done it. >> I got you. I understand that completely. Um So, at no point did you fire the weapon up in the air? >> No. >> Okay. >> I would never fire a weapon up in the air. I just got finished with a training class this Saturday. >> Yeah. >> Yeah, and then >> Yeah, what goes up comes back down. >> Yeah, you don't ever fire a weapon. I just fired them off into the ground. >> All right. You got your ID with you, sir? >> Um I haven't committed any crimes. >> Sir, we're all here for a call for service. We We have to identify everyone here. >> I wish I had a camera. Uh your camera's on, sir? Okay, I I can't tell if it is. You're You're is it? Okay, and you are Vincent and you are Woodard? >> Woodard, yes sir. >> Yeah, I'm No, actually I don't have an ID on me, but I'm not going to ID. I'm not giving you my name and date of birth cuz there's been no crime. I I protect my fourth amendment. >> The fourth amendment is put aside when Okay. >> I'm not going to fight you. I'm not going to resist, but I'm not going to ID. I've done I've done no >> Listen, listen, listen, listen to me. >> But I'm just telling you everything. No, I'm glad >> No, listen, listen, listen, listen. We don't want to arrest you. >> Okay, well, you don't want to ID me either cuz I ain't committed no crime. >> We have a right to ID you because we had a call for service out here. You said that you fired shots off. >> I didn't say that I I did but she asked if I fired them in the air. So, it doesn't matter if I fired shots out. I'm not going >> get a gun call, you see what I'm saying? We get a gun call. >> No, are you Am I being arrested? What am I arrested for? Cuz >> Right now you're detained. >> The usual being detained without any crimes being committed. >> Okay, well, if I'm being arrested for not giving my >> Right now we're trying to give you Right now we're trying to give you a chance to tell your side and try to ID you. That way that >> I'm not ID. >> You're not IDing? >> That's what I'm I'm not refusing to ID, but until you give me a lawful reason as to why I have to ID Okay. >> Cuz we got a call for service and we >> The call for service is not a lawful reason to ID, sir. >> This is >> It is. >> No, they Because anybody could call and make anything up. If I hadn't have shot those fired those shots and he called it up and lied to y'all >> We still go get his ID, too. >> So, what I shot it in the ground and you instead of you shooting at them. I wasn't. But that's burden of proof is on them. It's not burden of proof for me to prove I'm innocent, is it? >> That's why we're at We're trying to keep it civil. >> It's not You got cameras on your eyeglasses then? >> No. >> No, they just saw the little circles and I didn't know if it was a >> Those are blinders. Um >> Uh well, no crime's been committed, so I don't know quite what to say. >> Let me explain like the reason for the variety. >> I'm not really wanting to hear it. I'm I'm really not. Are you going to arrest me for not uh for failure to ID because that's a secondary charge? You got to have a crime first and I have not committed any crime. >> I tried to explain to you why we have to ID you, sir. >> I'm trying to explain to you why I'm protecting my Fourth Amendment right. Had I known that it was going to be this way, I would have went and got my phone camera so I could have recorded this. >> This message is for the Spring Branch Department. >> I don't know what you're talking about. >> Not right now, sir. >> Okay. Okay. What crime are you detaining me for? >> It's an investigation. >> Okay. Should we move off of my property because y'all are currently trespassing and I'm receding any >> No, we're not. >> Okay, I'm just receding any invite or any type of y'all y'all y'all are y'all are on here because of y'all and y'all's lawful orders. Not because of Not Not because of being invited and not because this is casual. >> 10-4. >> 10-4. >> I understand, sir. Look, we don't want to have to take you to jail. >> I don't want to go to jail. But if you're going to arrest me on something that is a secondary offense when you actually have no original crime, then that's just something I'm going to have to fight in court. Isn't that what y'all always say? No roadside court. Just do it after the fact. And if I have to sue the county, then I sue the county. No big deal. >> Well, we have to We have to see who who we're messing with. We have to run their IDs. See you who you who you are you say you are. >> Just because somebody give you a call to service doesn't mean I have to surrender my Fourth Amendment right. It does not. It does not. >> Why don't you come out and talk to us? >> No, there No, it's Right now, this is an investigation. You can investigate if you have proof that I shots fired. Matter of fact, you didn't even say shots fired at him. You said shots fired at him. You said, "How in the world do we know since you said there were shots fired that you didn't shoot them at him?" She didn't even say shot at him. She said shot in the air. Shot at him would come up on your part. >> You said that you shot in the ground. How do we know if you shot in the ground or shot up in the air? Cuz I called in said you shot up in the air. How do we know if you shooting in the air? >> Well, then they need proof or else they're they're filing false false allegations. She's They're either they're filing false Are you going to let me answer? Either they are filing false allegations or your investigation will prove otherwise. But until you have the proof, the burden of proof is not on me to prove that I didn't shoot in the air. Now, I'm sitting here telling you I'm not a [ __ ] so I didn't shoot in the air. >> Okay. We're not saying you're a [ __ ] but >> No, anybody that does is though. >> We either need an ID or name >> Name and date of birth. >> Put your hands together like you're praying so that way it don't pinch you. >> And what am I being arrested for? >> Right now, failure to identify. >> Okay, failure to identify is a secondary offense. You need an original charge. It's disorderly conduct. There's no disorderly conduct on private property. I didn't do anything. And you don't have proof that I did. >> Right together. >> Yeah, yeah, you're you're being disorderly when you're not. >> No, I'm not. >> When you're not doing what we're asking. >> No, that's not disorderly. Disorderly Can you even be the complainant in a disorderly or do you have to have somebody else? >> You absolutely can't. >> Okay. >> All right, do you have anything else on you, sir? >> Yes, I got a magazine. >> Okay. >> In this pocket right here. >> All right. >> All right, I'm not giving you permission to take any of my belongings. >> in custody right now. That's why >> Okay, I'm just letting you know well I don't That's That's a false arrest. I'm >> All right. Our prerogative. >> No, it's law. >> Okay. >> You either follow the law or you don't. You're supposed to be here upstand upholding your oath to the Constitution. >> You're right. >> Well, this is a Fourth Amendment violation. You don't have a problem. You need to call the service. Doesn't matter if you get called service. Any loony can call you up and tell you to go shoot somebody. Yeah? >> I'm the first caller over here. >> Which one was the caller? >> Me. >> You was? >> Yes. >> Okay, do you care to tell me what happened. >> This has been an ongoing dispute. >> Okay. >> Ever since I moved in. And I called him one day, this is 5 years ago. I told him I said just stay off my land. Quit mowing on me. He's obsessed with mowing on me. And so It It got real heated a few years ago and it finally kind of died down. >> Yeah. >> That's probably been 2 and 1/2 years ago. Well, all at once he just started mowing again. He just decided he's going to mow again. So I said nothing to the man. And I come out here and started fencing. I tied a string I tied a string and drove one post. Julio, show me where it's at. >> Yeah, you're in the right place. >> I've said nothing. I ain't talked to him in 2 and 1/2 years. Every Every Every time I come down my driveway he comes down here walking his dog. Every Every time he can agitate in some way he does. But I come down here and I tied a string and I drove one post. He walked out and stood and watched for about 2 2 minutes maybe while me and Julio were standing here talking and he shot three rounds in the air. Now he usually his little target's sitting out there between us and that van. And he's out here about every day when we're home. Only when we're home that I know of. He comes out here and and shoots guns at you know at back this way. I mean we're just right over there. You know he don't even know where we're at. So he's just constant agitation. Tired of it. I really just need it documented so when it escalates my wife been telling me to do this for years and I don't want to. >> Yeah, I mean I get it. >> I drove this way to go cuz I don't want the headache. >> Well, the the reason I'm asking is because he's he's just been confrontational and saying he's confrontational and saying that we're violating his Fourth Amendment rights and he's not going to ID and it's one of those I try to be nice to everybody. I try to get everybody's side because there's always two sides to every story. >> Yeah. >> You know what I mean? I'm not calling you a liar or not in the least bit. You know, I don't >> Who is else here when he shot? So >> And he was here as well? >> Yeah, Julio was here when he shot. >> So What what caused him to fire off at Did y'all exchange words or did y'all >> no, he come out, he stood and stared for about a minute. Then he just he shot three rounds in the air and he hopped on his lawn mower and rode back here. I'd say he realized he screwed up when he shot in the air. >> Okay. >> I don't know that he did, but this is not over. >> Yeah. >> You know what >> know What do you mean you don't know that he did whenever What do you mean by that? >> I mean I mean I he in his >> In that stuttering talk, he means I don't know I I don't know if he shot in the air. >> I mean I in his eyes, he just thought he was, you know >> Oh, you're saying that you don't know what he >> I've let it go for so damn long. I don't know what to do with him. >> Yeah. >> I'm tired of coming home with somebody shooting a gun every time I come back here. I've been ignoring it for years. >> Yeah. >> And but now this is the first time I've been out in the driveway >> here in the driveway >> Yeah, I was out >> driving driving T-posts. >> I stayed right there on the property line with my back. But I don't To be honest, he I I don't know that he shot back here. I'd say he shot in the air. But still >> All right. Well, let me talk to chief and then Uh I'll give you the firearm that come off this side. I just put it in my passenger floorboard that way it was out of play. >> All right. All you're identifying I'm pretty sure he's intoxicated. >> I I I can smell it. >> Well, I mean >> Well, there you go. >> He's already been out here. He said he can't be on private property with his I I'm not going to stand out here all night either. It's too hot. >> Uh he's intoxicated. >> We tried We tried to talk to him. He's intoxicated. He's admitted to shooting but he won't walk back. >> What's his name? >> I don't know. >> He's He's not identifying. >> Uh well, I mean I know what I'm going to >> Not much I can >> reckless endangerment >> Uh his fourth amendment rights were violated for asking for his ID. >> What more can you do? >> He He said he fired two shots in the ground to scare the chickens back away from the from the So. Had he just identified himself, we could have been on the phone and we'd be on our way. But >> Well, we don't know if that's true. Yeah. >> That's what I was trying to explain. >> How do we know if >> He said I was calling him a [ __ ] I could smell it on him. >> Let me see if there's anything else on there to read. >> I mean, when we come out here, Julio drove up. I was then driving fence posts and Julio drove up and he come and stood back out at the back of his van right there on there. And he shot We heard three shots. I'd say they was in the air. I'm not saying he shot at us. I'm not going to go there. But he shoots back this way every day. You can see his little target on the open. I mean, every day we're home he comes back here and shoots. Or he stands back there at that van and shoots that target. And that's kind of in line with my property. There's no backstop. It's a constant agitation. Just the Coming out here and shooting at me standing in my driveway is about all I can stand. I probably should have tolerated more, but I I don't know. I think this is the worst thing I probably could have But I'm tired of it. You know what I mean? I need you on I need you on record that >> Well, unfortunately, for you know, if we don't start doing something, it's going to get worse. >> And I'm not saying that it won't >> But at least you've done your part, you know, I'm going to prevent it going to the next step. >> Yeah. I don't believe it will. >> I don't know. So >> You just going to bring it down there for me? >> What's that? >> It's done. >> I'll give it to you. >> All right. >> I ain't cleared it or nothing else. It's exactly how it was. >> Hold that. Clear. >> Yeah, it's clear. You know how that goes. That'll be all right. >> Where are the keys at, sir? Right there. >> Have you told me Have you Have y'all figured anything out yet? >> Yes. >> Okay. >> Where you going to leave these, sir? With your wife? Down there at the house. >> They can leave them on the property. >> They don't want them to leave >> They don't want them to leave them with your wife. >> Oh. Well, we're not >> No, we're not going to be liable cuz he's going to try to sue us already, so it goes with his property. >> All right. >> Since we know he's going to sue us, we're going to make everything about this arrest 10 times harder for him. >> So, what is it I'm being arrested for? >> Right now, failure to identify disorderly conduct. >> All right, 10-4, 68. Does this cruiser have uh camera recording inside the cruiser? >> No, but my body cam's still going. >> Okay. >> 68, does patrol have one male in custody? >> 10-4, 68. Okay. Um you know what I >> They got to go with us, man. >> Huh? >> They got to go with us, whatever property you have on you. >> 10-4, 68. >> She can't leave the house with the kids. She has three kids, and all the car seats are in the van, and the only way she can make any kind of move is with the van. So, you're sitting here telling me that Wow, that's very interesting. Um Can you quote the the law that that says that that has to happen or is that just officer discretion? >> That's going to be discretion at this point. >> discretion. Thank you. So, you purposely make it to where the person who is going to have to come to the jail to get me can't because they don't have the keys to the vehicle to transport three children under the age of eight. You know, whenever you asked to get them off of me if they were on me or the mower Um do you remember telling me whether or not they and you would get her the keys when you took the keys off of me because your body camera is going to say one way or the other? >> Yep. >> But, I guess it's okay for officers to lie to civilians. It's just not okay for civilians to lie to officers, right? And at your discretion, you chose to make sure that it's hard as possible for me to get back home after you took me from my home for no crime all because I I wouldn't identify myself. Y'all really are addicted to IDing people. There's no law that states that because you get a call for service that you have the right to ID. You said on there uh paragraph multiple times that you have a right to ID if you get a call for service and that is incorrect. I appreciate it if you would issue a formal training. Did you ever find that bullet? >> I'll find that here. >> it was dropped in the grass. Did you find it? >> No, sir. >> So, you honestly believe that because you get a call to some uh some scene that you have a right to ID everybody on the scene? >> Yes, sir. >> What law is that? Can you give me the US code the USC code? You are a law enforcement officer, not feelings enforcement. You took an oath to the Constitution and the fourth amendment says there's no reason to to give search seizure papers, none of that. There was no law being broken. Had there been a law being broken and you stated that, then I would have given you that information, but you wasn't stating the original charge. You were just stating that you were going to arrest me for not ident- failure to ID. And then whenever I told you failure to ID is a secondary charge, that's when you started him hauling around. Nothing that I have done actually even falls under the statute of the state. So, I don't know why y'all brought that up after the fact. The call wasn't for that. Y'all didn't say that when I asked you why you were arresting me, you didn't say that. And then after you have me in the car, you come back and you're like, "Oh, yeah, that that's what it is." You don't understand how that seems suspect. Can you tell me what training it is that you received that led you to believe that you are required to ID every time you go to a call on scene of every individual on scene regardless of if they have broken any laws or not? Can you explain to me what training that was? No answer? Is it your policy to ignore people of the public whenever they're asking any questions about the situation that they're in? >> No, sir, it's not. >> I don't appreciate Is it Officer Myer? >> Yes. >> Are you wearing your seatbelt, Officer Myer? >> No, sir, I'm not. >> No, you're not? Do you think that that's safe? >> Remember, the law only applies to citizens. Cops can break any laws they want to. >> You think it's safe enough to wear your seat belt, Officer Myers? Is it legal for law enforcement officers to not have to wear their safety belt? Are they above the law? So, even though on a daily you would pull people over and write them tickets for not wearing their safety belt, you feel above the law to where you can just ride around all the time without one? Is that how that works? Is the speed limit through here 45? >> You're going to get a ticket. >> Can you have a male CO meet me at the door, please? >> It looks like he's doing 50 in a 45 with no emergency lights. >> Huh? Tell your dad to identify himself. I don't know. All right, come on, Al sir. He has a hold on him and he said that the firearm is his. >> And just to show y'all how corrupt this county really is, this is another video of him going to the county attorney's office to file out a FOIA request, but since he's in a lawsuit with them, watch how this county attorney treats him when he's trying to fill out a FOIA request. >> Tracy's not available. If you want to leave it, I will give it to her. >> Yes, ma'am. That's understandable. Well, just real fast, I'm going to need the the sign and receive copies. >> I'm not going to sign and receive. Do you have an attorney that's helping you on this? >> Um Well, that's just the same as the last time whenever I filed out the the public records request. They just needed the sign and receive. >> Okay, I don't do the public records request, so I'm not sure what you need signed. >> Well, just like right here. See, that's See, I dealt with you before. See, I don't think she was even going to ask for a copy of this, and I know that that would have messed it up. That's why I was looking to talk to you. You're Kim, right? >> Yes, I'm Kim. Are you videoing me? >> Yes, ma'am. >> Okay. >> Um basically, this right here, I've already asked for this information before. >> Okay. >> And Holloman had told me that he couldn't get this information. So, what I'm going to do is I'm going to resubmit it in again with y'all's form like this. >> Okay. >> And what I need to be signed received is just your name and date on there before you give a copy of it. Then you keep the original copy, and you give me the copy where it's signed and received. Now, if you uh if you don't If you don't want to accept this, this is just a copy of where y'all have done that before in the past. I still have this. So, either way you want to go on that is 100% okay. I'm just um and then this right here is a piece of information that I had got Yes, sir. >> You've got an attorney. >> I don't have an attorney. >> Yeah, you've got an attorney. You told me and said >> I I I understand that, but I don't have an attorney. >> Well, listen, until until I've received notification from that attorney that he does not represent you, legally I cannot speak with you and and neither can my staff. So >> Well, I'm filing public records requests. >> I don't care what you're doing. You have to have your attorney contact me and say that he no longer represents you. That's what's going to take. >> You're kidding. >> That's what's going to take. That's legally what I have to do. >> I want to be able to follow these. Are you denying me my public record request? >> Son, I ain't denying you anything. >> I'm not your son. >> Call the law. >> There's no reason to call the law on me. >> them. Call them because I've explained to him Call them. >> You haven't even asked me to leave at this point. >> I'm asking you to leave. You don't need to be here. I'm telling you you have an attorney that nobody's told me he's not sent me a letter saying he's not representing you. By law, I cannot speak to you if you're represented by an attorney. So, that's how it's going to be. That's how it's going to be. And if you're not out that door in 5 seconds, make the call, Kenny. >> You can't even shoot on your own property without officers feeling for that ID. Because as soon as he said he wasn't going to give up his ID, none of these deputies can lay out a crime that he committed. >> committed any crimes. >> Sir, we're all here for a call for shots fired. We have to identify everyone. >> My fourth amendment I I I think that's I Okay. >> put aside when >> But I guess in Macon County, the fourth amendment can just be put off to the side. And these deputies really thought that they could get this guy's ID by trying to do some cos playing. But he was just not going for it. >> You said that you shot in the ground. How do we know if you shot in the ground or shot up in the air? Cuz I called in said you shot up in the air. How do we know if you're shooting at the ground? >> Well, then they need proof. And they're following following false allegations. >> She's They're either they're following false >> Are you going to let me answer? >> Obviously, when they're doing that cos playing, they're not trying to have you answer. And it's crazy that these deputies could take your firearm and lose your bullets on top of that. >> You know how that goes. That'll be all right. Did you ever find that bullet? >> Don't find it. >> Yeah, unfortunately. >> Did you find it? >> No, sir. >> Are you wearing your seatbelt, Officer Myers? >> No, sir. I'm not. >> You think that's safe? >> They don't care about losing your stuff and they don't care if they're breaking the law. But that's my take on the throw. Let me know what y'all think about in the comment section. How do you feel about these Macon County Sheriff deputies for coming to this guy's property claiming that he shot in the air because that's what his neighbor was saying. Even when they was asking the neighbor, he wasn't even really sure where he shot at. He was telling these deputies that he shot in the ground. But you having him take his firearm and start feeling for that ID. And that's the thing, when you don't feed these officers your ID, one way or another, they're either going to get your name by either taking you to jail or trying to run your license plate. And it's just for the simple fact how this guy was just on his property not committing no crimes at all. But yet they still took him to jail all because of what his neighbor was saying. And it just goes to show, I guess you could just call 911 with anybody saying that they shot in the air, shot here or there, and deputies can just pull up on them and start harassing them. That's my take on it though. Let me know what y'all think about in the comment section. Make sure to like and subscribe, and y'all have a wonderful day. >> [music] [music]
