probably because she's drunk which would probably make that thought process more a little bit make sense a little bit more if you were hammered but uh yeah I mean this is it's kind of a weird scenario it doesn't happen a whole lot all of a sudden the driver just walks away get back in your car no not I 6205 dispatch females walking away from the vehicle another put your hands behind your back you're not walking away from the traffic stop put your hands behind your back get in put your hands behind your back please go put your hands behind your back put your hands behind your back hands physical fight with someone who's resisting sometimes the Cuffs don't go on right um and it you know we want to lock them so that they're not too tight and then we end up being too nice and then people slip their cuffs so it happens it's not just a thing that happens on body War camera video it happens in real life and uh sometimes you end up having to buy you have to get zip ties and and zip cuff females because those can go as small as you need them to so there's a solution to that problem where are they up Sarasota East Coast of Florida West Coast of Florida I would not fire sorry yeah drink on the ground I want to make sure you're okay to be driving you okay with doing a few tests make sure you're okay to be driving I'm fine okay are you okay with running a few tests up on the curve though take your cuffs off you are you okay with doing a few tests though it's a yes or no question are you okay with doing tests it's a yes or no question no you don't want to do tests I'm perfect this is a Super Heads Up move um the officer reads the suspect Miranda and then asks if she'll participate in the field sobriety tests um since she's already in custody she's not free to go she's been told she's under arrest he can't just administer the field sobriety test now that she's in custody he has to advise her of her Miranda rights first um it's just a it's a Nuance um because she's in custody she's not free to go and her performance on the field sobriety tests is very close to um asking questions because the answers to questions or her performance can be used against her in the court of law so that's why he had to advise her of her Miranda rights um she says no that she doesn't want to participate in them which is good because obviously between the driving the open container um his observed odor of alcoholic beverage bloodshot watery eyes slurred speech um all of the totality of the circumstances that he's observed um he's got more than enough to arrest her for DUI so um it's probably better that he didn't have to uncuff and she made it easy on him my I know that order report so I'm ready okay so with your slur speech your open alcoholic container your bloodshot watery eyes your behavior you're under arrest for DUI as well okay so DUI and resisting without violence okay perfect nice job and I like the resisting without violence um that this officer charged the suspect with because I think that's a great charge um and being it that it's criminal it lets him go and put his hands on her immediately um after she refuses the order to get back in her car so I thought that was great and um I definitely like that he went and took took custody of her immediately love it all right well it's all on camera so have fun with with that I literally told you verbatim get back in your car and you didn't listen to me pretty pretty exact you can make you can make that argument when you go to court okay cuz it's all on camera and you can make that argument talking to that dude I looped the parking lot you're hauling down Maine I get behind you what do you know that drink is in your passenger seat spilled all over the floor and there was still alcohol in the cup with the lime I saw that drink on your trunk and the ring was still on your trunk that was not old okay that's fine I got plenty of probable cost to charge you with it okay I can articulate everything and your car got impounded okay yes all right we would impound that car also I would like to know what J you did though okay hop over there blue head blue head blue ass what you found let's go to that door okay yeah right there I'm from the Midwest you know when I was 20 over I thought I was going to meet someone really nice I saw Minnesota we on nice huh we on nice when we meet nice people I'm nice just wouldn't recommend walking away from a traffic stop next time that's right so we're going to go up to this box right there we're going to get your fingerprints okay thirding here third violation within 10 years yes I love it
