Hello. Hi, officer, this is our property police man. I stopped you. You're doing 19 over. I'm sorry. >> How come you're going so fast? That's a good stop. >> I didn't realize. Yeah, I almost Okay. Show me your driver's license, please. All right, internet. I'm Frank Slow, I'm a 24-year veteran of the Sheriff's Office out here in Arizona. Today, we're going to be doing some body cam breakdown. So, our video today came from Cop Cam Max. They're not a big channel, and I don't know why, because they're great. Their stuff's great. They're everything about them, we love them. So, go check them out. Today, we're going to be doing some body cam bingo. So, we've got some great squares here. We're going to see how well we can do with this video. So, I'm hoping body cam bingo and Cop Cam Max, I'm hoping that's going to work for me. It's kind of hard. I know. I mean, pull it out. Okay. One second. In this episode of Cop Cam Max, officers >> So terrible. >> suspected of driving under the influence, but she is no ordinary driver. She insists she knows her rights and claims the police are violating her civil liberties. >> Love it. >> What follows is an encounter that is equal parts frustrating and entertaining for the arresting officer. >> Yes. >> Where are you coming from? I am coming from my friend's house. Were you in Annapolis tonight? No. Did you have any alcohol in you at all? No. I feel like I could smell it. Can I check your eyes, make sure you're safe to drive? Okay, I have I do have a condition. I have to take my contacts out. Uh for what? Because I have astigmatism. So, you can't look from side to side? So, do I. >> You can't look You can't >> Uh-huh. I like the line of questioning by the officer. Hey, do you have any eye conditions? And she says, "Hey, I have an astigmatism." I also have an astigmatism. I have one. I've got glasses that I can wear if I want. Um they definitely make things clearer. So, my optometrist was definitely correct in that I needed them. But, I can absolutely perform the horizontal gaze nystagmus test with an astigmatism. It does not prevent you from at all participating in this test. Now, if you had natural nystagmus, that would be different. That would be something where we would look at and go, "Okay, now we can't administer this test." But, an astigmatism, that's just a lame excuse. It's not something that precludes you from the test. So, if you were to look this way or this way, you couldn't do that? I can't. So, how are the doctors allowing you to drive if you can't use your eyes? Well, it's on my uh driver's license. They are strict on you? Okay. Yeah. Try to follow that with just your eyes. Don't move your head. Look at those stupid eyelashes. Um I want you to step out of the car for me. So, how much alcohol have you had tonight? I haven't. You haven't? No. Okay. You're I don't feel like you're being honest about that. I am being honest. Okay, so if I give you a breathalyzer, it'd be absolute zeros. Um I don't have to, to be honest. You don't have to do what? Do a breathalyzer. Well, I'm putting you in a scenario. I'm not asking you to do this right now. >> Yeah, well, I'm putting you in a scenario in the scenario. I don't have to if I don't want to. Okay. Um what I'm going to ask you to do, Ms. Ruby, is I'm going to ask you to submit to a field sobriety test to make sure that you're safe to drive this vehicle. >> have to do that, sir. Okay. So, Can I call my lawyer? No, you cannot. Okay. Not here in the state of Arizona. I'm going to say mentions lawyer. Whatever you're asking me to do, I don't have to. >> Okay. Really, I understand uh and that's absolutely true. You don't have to do this. But, what I'm going to have to do is I'm going to have to place you under arrest for DUI. Right. Because uh Why are you putting on lipstick? Search my car. Why would I do that? Okay, so you're telling me I smell like it. Okay, search my car. It's not in your car. >> Because you're accusing me of something. >> It's in you. That's why >> What am I accusing you of? Okay, rewind it. Rewind what? You're You told me you I smell like something. Yeah, alcohol. Okay, so search my car. Why would I search your car because you smell like alcohol? Because what if you don't find alcohol if I smell like alcohol alcohol? Well, it depends if there's open containers in your car. Yeah, well then search it. Okay. Uh face away from me. No. Yes. No. Okay. You will be after. No. No, sir. Turn around and do not resist. All force is necessary. He's against you. Okay, why? >> Turn around. Okay, I need you have a read my rights. I don't need to read you your rights for now. >> you do. Missy here seems to think that anytime that a law enforcement officer talks to you that you need Miranda. And that is absolutely and unequivocally not correct. So, the things that you need in order for an officer deputy, trooper, whatever to read you Miranda is you have to be in custody which means you you're not free to go and there has to be some sort of interrogation, which means that we have to be asking you questions very specifically about a crime that we believe you committed. Um that's it. So, you have to have custody and interrogation. So, if I put handcuffs on you we have we check the custody box. Yes. If I'm not asking you any questions like, "Hey, how much have you had to drink tonight? Where were you drinking? When was the last time you smoked marijuana?" When I'm asking you questions about the crime that I believe you committed anything outside of that, name you know, what where you live, phone number, um you know, what gender you identify as, all that None of that's covered under Miranda. So, she has a very very poorly skewed perception of when Miranda's applicable. And it certainly isn't you have to read them before you put someone in handcuffs. So, she is she is so far in the valley of wrong, she's in a gutter in the valley of wrong. That's how wrong she is. There's no aspect of anything that she said that's correct. I'm going to sue you, bro. Oh, yeah? Go ahead. Okay, what's my rights? So, what's my rights? I'll read you your rights. I need your bro to come out here. You want him to come out? Cuz he's not as sweet and as nice as I am. She said bro, I'm going to go bro. Bring him out here, sir. Bring him out here. >> Can you help me out? He's not going to be as nice as I. >> Okay, Mr. Officer. He hasn't read my Miranda rights. He hasn't read my Miranda rights. I told you you need to comply with us. Okay. Turn around. >> Let me explain something. >> That's my right now. You're under arrest for interfering with my arrest. No, I'm not resisting. >> Well, you are resisting. No, I'm not resisting. I'm going to go I'm not resisting. I got a bingo across. You don't know what you're doing. I do, because do you know who my dad is? I don't care who your dad is. Okay, you'll be you'll be real sorry after this. Okay, let go so I don't break your finger. I'm not going to let go. Okay. Stop. >> Stop holding my way. If you don't stop pulling, I'm going to put your ass on the ground. Do you understand me? Do it. Stop. >> Do it. I dare you. I dare you. I dare you. Stop. >> I dare you. I dare you times four. I don't care. Oh, really? You will. I'm going to sue you. You'll be [ __ ] crying, bro. >> Don't care. Really? You'll be [ __ ] crying, bro. You need to make better decisions. Yes, adult better. Let's go switch. What's my Miranda rights? Miranda only applies to custodial interrogation. Here, stop right here. I'll read them to everybody. I know my rights. You watch too much TV. Okay, officer. They haven't read my Miranda rights. They haven't. Look, no one cares. Okay, that was No, they should have done that before they had me in handcuffs. Separate you two. That's not true. Stop touching on me. Okay, but step out like this, please. Review your right to remain silent. Do it again. What am I being arrested me for? I told you, driving on a suspended license. What am I being for? I just told you. You have the right to remain silent. Anything you say can and will be used against you in court. >> why you're putting handcuffs on me. Handcuffs? You have the right to talk to an attorney before and during questioning. If you cannot afford an attorney one will be appointed to represent you. If you cannot afford a lawyer Gosh, I got to be appointed to represent you. Just a cyclical Do you know who my dad is? Do you know who my dad is? The question that's on my mind is who's her dad? Like is he is he a local business owner that owns a convenience store? Is he a senator or a congressman? Um like is he Is he Joe Biden? Like is it is it Obama? Is it Trump? Like who When you're throwing that out there, hey, this is who my dad Do you know who my dad is? Like your dad better have some weight behind his name. Because if not, you may be barking up the wrong tree. I I I just feel like it feel like that threat falls flat. So, I really I want to know. I want to know who her dad is. Really, really bad. You can stop at any time to exercise these rights and not answering questions or making statements. Do you understand your rights? No, bro. Cuz you didn't tell me my rights or nothing. Would you like to talk to me? So, you're going to be [ __ ] You and APD, you're going to be [ __ ] Whatever you say is fine. I I promise you that. Don't Stop moving. It's just the essence of New Mexico right there. Okay, so what am I being arrested for? About eight. I've already told you like three times. >> No, no, no. Do you want your sweater buttons? I need to call someone because uh Mr. Whatever the [ __ ] his name is didn't did not read my [ __ ] rights to me. 54, please. Yeah, bro. You [ __ ] up. Whenever you lose your job, you're going to remember me. Based on this lady's idea of Miranda, anytime before I'm going to put handcuffs on someone I would have to read them Miranda. So like during a fight I would have to read someone Miranda or standing on the side of the road someone with a warrant I would have to read them Miranda before I put it's it is it's asinine to think that that would be the threshold to which we would be held to. It's it's crazy. It makes it makes no sense to the sober mind. Which obviously isn't hers so that's why we're at where we're at. Let's go. Let's go. Let's Let's go. Put her in this bush first. I'm not going to step in there. You're going to have to. No. Yes, that's absolutely what you're going to do. No. Well, first we need to put you in there. Take a seat. No. Come on, Ruby. Okay, get me my my phone Have a seat. I'm being an adult an adult. So bring my [ __ ] phone right now. Right now. Where's your phone? On my cheek. Okay, I'll go get it for you, but you need to sit right now. Take a seat. There we go. No, I'm not I'm not. Okay, I'll bring you right here. Put your feet in. I'm not. And don't kick me or you'll get a charge. Put your feet in. Put your Do you know who my [ __ ] No, and I don't care. There it is again. If you are this woman's father this is not a proud moment for you. I mean you are the you got to watch this video and go man, I failed. I have an F in fathering [snorts] because I mean I'm I'm not a dad, but I am a very proud uncle. And if one of my nieces dropped my name do you know who my uncle is during a situation like this and then called me and told me what she did we we would be having a very not kind phone call after that point. And I feel like she just doesn't see those repercussions coming because there's some underlying issues. So, there's that. No, I think Dolly, she's blasting you. >> I'M FEELING SICK. You need TO GET ME OUT of here. You're not going to get out of here on your own power. Somebody needs to get me out of here unless you want to get sued. Okay, ma'am. I'm feeling sick. You're going to have to suck it up. Stan, are you [ __ ] [ __ ] So, whenever Ah, you can't use the R word. Okay. So, get me out of here or we're going to have some [ __ ] problems. What are you going to do? Bro, whenever you If you think about that in a [ __ ] month from now, you're going to be real [ __ ] sorry. Trust me, I promise you that. How much do you make? Like 20 dollars an hour? Okay, so why am I being arrested for? >> Maybe she's Canadian. Like from South Park. I don't need to show you a damn thing right now. Your whole [ __ ] career is about to be [ __ ] [ __ ] bro. What's your badge number? Well, I got it. Haha, badge number. Another bingo. I just told you that. I just told you it. [ __ ] give it to me. SO, WHAT'S YOUR [ __ ] BADGE NUMBER? I just told you it. What is it? I just told you it. Okay, say it again. I don't need to say it again. I already told you it. I'm asking you to. That sucks. You should have listened. You should have listened. I love it. >> have listened. No, cuz you didn't say it. Okay, well, it's on body camera. Okay, let me tell you your [ __ ] up. You're [ __ ] up. >> You're what? Can you say that again? You didn't give me my Miranda rights. What? Before you give me >> Okay. Before you put me in [ __ ] handcuffs. Well, you don't have to. Well, that's your first [ __ ] [ __ ] up. All right. Uh-huh. You have no [ __ ] reason to have me in [ __ ] handcuffs. What are you doing? >> have me arrested. >> driving drunk? Cuz once you find out who my dad is, you're going to [ __ ] cry. Okay. I have my dad on the I hope they tell me who her dad is. You [ __ ] dumb. So, I hope you [ __ ] think about that. Do you want to call my dad? Do you want to call my lawyer? And I know my [ __ ] rights. How [ __ ] nice of you. [ __ ] people knowing their [ __ ] rights. And I Get me off these [ __ ] handcuffs right now. What does that even mean? Get you off those handcuffs? I'm personally Are you [ __ ] stupid? >> Get you off those handcuffs? Yeah. What does that mean? There you go. There you go. There you go. You know what? She says get out of handcuffs is kind of like complaining about handcuffs. I'm going to do it. And that's another bingo. Up and down and diagonal. Bring her arrested for DUI. >> Okay, do you have proof? This officer does. What proof? That's proof. Do you have anything in your mouth? I don't have to answer to you if I don't want to. Okay. What proof? You want to keep adding to your dumb [ __ ] You arrested me. You did not read me my Miranda rights. You arrested me for no probable probable cause. WHAT DID YOU WHAT WHAT ARE YOU TRYING to say? Probable pause. I think so. Jeez. Like your speech is that slurred. Yeah. What was my cause? >> Jeez. Mr. Ruby, you're pretty You're pretty ripped. Why Why for intoxicated job performance? Can you re- repeat that sentence to yourself? Why am I being arrested for intoxicated You mean what am I being arrested for? >> make any sense. Why am I being arrested for? That doesn't make sense. Why am I being for interfering in your job? I've already told you and she told you. I told you and she told you. What? We both told you already. >> I got another There's so many bingos. >> I want to know what I'm being Well, that sucks for you. You don't get to make demands. >> No, it sucks for you. >> I just need a I didn't do anything. I'm reading you your Miranda rights. Okay. I am sure there's someone in the internet that says she didn't do field sobriety tests, they can't arrest her for DUI and that person would be wrong. Um there is an overwhelming amount of evidence here um that would substantiate and meet the threshold for probable cause for arrest for of this girl. Uh outside of just her demeanor and just condescending nasty ignorant talk but all of the thick slurred speech, the fact that he got to do HGN which is the most accurate of all of the standardized field sobriety test battery um and then his observations that you can't get through a video like bloodshot watery eyes or obviously slurred speech, odor of alcoholic beverage, um all of those things. I mean, the the case against her would be outstanding just based on what we watched. Come on. What am I being detained for or arrested Ruby, you have to step out. I'm asking you guys a question. >> We've already been told this. Okay. Step out like a big girl. Like an adult, step out. Like an adult. Like an a [ __ ] adult. I'm asking you guys a question. >> Why am I Why am I being arrested for? Will you step out for us? No, I'm asking Or we're going to have to pull you out. Ruby, let's not go there. >> What? We're going to pull you out if you don't get out. I'm going to start recording everything, so let me know >> Okay, Ruby. We're not going to do this. Let's go. Let's go. Don't [ __ ] pull me. Come on, Ruby. Be an adult. Okay, why am I being arrested? >> Jesus. Okay, do you have to Yes, that's why you're under arrest. What what what's wrong with you? Let me out. Look at yourself. There's that. Stop. You say you want to be treated like an adult, act like one. Well, I'm acting like an adult, right? And you acting like a child. You've been told several times Like I have not been read That's you as an adult. I'm not trying him. No. He did not read me my Miranda rights. Don't care if He did not He did not He did not That's what I don't think she understands how the law works. Don't push me. I got the keys. Take a seat. Don't buckle me in the I don't think you understand. Stop. Sit down. >> Sit down. No. Oh, now you guys have to go. Not part of me. What? Oh, you're so silly. Disgusting. You are. Your mom is. No, not as much as yours. Yours is disgusting. Now we've gone to yo mama jokes. Same to you. Your mom is really If y'all want to [ __ ] check it, body cam. He [ __ ] arrested me before he read me my [ __ ] Miranda Hey, Smith. Listen to this. No, he did >> Tell him again Tell him again. He did Tell him. You arrested me for no probable cause. Probable what? Probable cause. >> Okay. You denied reading me my Miranda rights Okay. >> before you put me in handcuffs. Before he got I know my [ __ ] rights. Oh, really? Yes. Oh, yeah. You denied I'm going to tell you something important. So, right now you're under arrest for driving while under the influence of intoxicating liquor or drugs. Under Massachusetts General Laws, you are required to submit to a breathalyzer test to determine the alcohol content of your blood. After you take our test, you have the right to choose an additional independent test. If you choose to take this additional independent test, you have the right to a reasonable opportunity to arrange for a physician, a licensed nurse, a laboratory technician, or technologist who's employed by a hospital or physician of your own choice. Okay, now you're Do you agree to take our test? I don't have to. You know, I can't force you to take our test, but if you refuse, you will lose your New Mexico driver's license. >> See, in Arizona, we've got a better solution. >> tested? I won't be tested. I don't want to. Okay, I can consider your actions a refusal. So, this video is occurring in New Mexico. New Mexico has very different laws than the state of Arizona. I would consider our laws better. And the reason is during the same exact scenario here in the state of Arizona, if someone says, "No, I'm not going to submit to a chemical test." we offer a warrant and send it electronically to a judge 24/7 365 days a year. A superior court judge reads your probable cause statement, grants the warrant with a signature, and returns it to you electronically. Then you have a signed search warrant, which allows us to conduct a search, which is drawing blood um per the Fourth Amendment, and not violate anyone's rights. So, instead of just saying, "Okay, you refused. You can do that." We make sure that we get the evidence that's required to successfully prosecute the case. Um and that's something that eWarrants started here in the state of Arizona. Actually started with Phoenix Police Department. Um and has now spread all through the entire state of Arizona, and other states are also jumping on um with the ability to get and obtain electronic warrants. So, I don't think New Mexico does it. Um it In here, it didn't appear that they did. Um but if you're in New Mexico, look into eWarrants. They're great. >> Can I call my attorney? Mr. Nthony Are you going to force me first to sign I have my I probably stayed in there. I don't have any. Okay, well you got to see to get it. If that [ __ ] gets lost I'll call you. >> I don't care about your Gucci purse. It's in your vehicle. You got towed. The vehicle's rolled up. They're like roll the windows up. [ __ ] handcuffs cuz I can't [ __ ] breathe. Repeat that sentence to yourself. >> I'm on my period, so Repeat that sentence. I like that. Repeat that sentence to yourself. Those handcuffs. Yeah, cuz I'm on my period. >> I'm over here. The restroom's right here. Go to the restroom. >> Hey, can you get me a tampon? I'll get you one. You Stand over here second. >> before. I'll [ __ ] get you Okay, go back in the cage. I need a tampon. >> Come on. Go back in the cage. Go back in the cage. Let's go. Go to your home. You can go back to your home. I need a tampon. Get it later. Step number two. >> I need to call my aunt. Go ahead. I have the right to >> I don't care. attorney. >> Okay, so if you're going to keep doing this Yeah. you're not going to use the restroom. I told you you have to use the restroom. That's the only thing you're doing. I have the right for me to use the restroom. >> Okay, well you're going to go back in the cage then. Back in the cage then. Go back in the cage then. You're not going to go to the restroom. I need to change my [ __ ] tampon. I tried to do that for you. >> You want me to You don't want to over my head. I tried to I tried to pull Please shut I need to change my [ __ ] tampon. Be quiet for a second. Listen. I tried to pull you out. Will you listen for a second? Okay. I am [ __ ] listening. >> Just be quiet then. No, you're not. If I pull you out, that's to let you use the restroom so you can do that. Okay? Do you Do you want to do that? That sounds like a yes. Well, use that time to do that. [ __ ] off and get me the [ __ ] out of here. >> You're not going to make demands. But I'm going to accommodate you, okay? But you need to use the restroom, okay? All right. And you got that [ __ ] all on your [ __ ] camera. >> And you have to go into the restroom. That's abuse. I've been [ __ ] asking you. >> I understand that's abuse. Shut up. Okay, get me out of here. Go to the restroom and I will. >> my pad? >> Go to the restroom and it's in it's on the sink. Nope, turn and face me. It's the way it has to be you have to be handcuffed. I'm being serious. How am I supposed to change my [ __ ] pad like this? >> way it goes. It's the way it goes. You have to yeah. >> I'll get a [ __ ] infection. You you have to be restrained. All like prisoners have to be restrained. >> Okay, for what? Because that's the policy. >> Okay, no, tell me why. Because how combative have you been? Now change your pad. Change your pad. I can't change it like this. >> Or you're going to go back in the cage. I can't change my pad like this. >> Okay, so you don't want to do that. Okay, what am I being arrested and charged for? >> we're not going to put you in the cage right now. Oh my goodness. Don't [ __ ] touch me. You're touching me for no That's good. Linda, can you open the cage again? This is ridiculous. You're a child. Don't [ __ ] touch me. >> You are acting like a child. >> No, you're acting like a child. I'm not touching you. When you try to do that, that's not going to go. Aggravated DWI. [ __ ] Such a [ __ ] child, Linda. All the charges against the woman were dismissed because the officer did not read her Miranda rights before placing her in handcuffs. Just kidding. The woman pleaded not guilty. That is one of the best performances of a video in the history of body cam bingo. So, we have all but one square. We got them all. I mean, she is at the pinnacle of ignorance when it comes to how great this video is. So, thank you so much. Soon, these are going to be available on the website. So, we're working on it.
