down the right Road she just made the wrong turn um if you have AAA and you're really drunk the way AAA can help you is you could always call them and have them tow your car to your house then you could ride in the front passenger seat of the AAA tow truck then your car and you get home safely and you don't have to drive like that's I think that was kind of the way she was looking the direction she was going um so maybe Triple A could help I mean they could have helped her before she made the poor decision obviously somehow ending up headon with the police car um but before all that maybe AAA could have helped so I don't know call you triple AG agent I know but right now you're not going to be able to pee I'm sorry I'm sorry you're not going to be able to right this second can I go inside please where right there please this is a church that's not open I don't want to pee in front of everybody you can't pee at the church in front of anybody please I don't want to pee in front of everybody be able to pee right now there's nowhere to pee unfortunately would you be willing to participate in those exercises no and why is that because so this officer is trying to do a full and thorough investigation and I get that um but once she says no that she doesn't want to participate in the in the tests you can't make her um there's a thing called implied consent um or the implied consent affidavit so so what that means is you don't have to do these tests um there's Arizona case law that says hey you have to uh if you don't participate in them we can use that against you in the court of law in other words we can tell a jury hey we asked them if they participate in these tests they said no implied consent means you have to submit to a to a chemical test which means that in the state of Arizona we can do blood breath urine or other bodily substance um or all of them if we want if if the officer desires that um so we we run the direction as the investigation goes and you are required to submit to all of those tests and if not your license is suspended um so that's how State of Arizona works every state is different so I can't speak for other states but so her refusing this the standardized field sobriety test battery doesn't mean that her license is going to be suspended immediately what it means is that officer has to make a decision based on the information that he has which is probably her poor driving which led to the traffic stop and obviously looking at her and seeing how absolutely impaired she is like this is a no-brainer this the first time she said no I don't want to participate these I would have been like you're under arrest turn around P while you're back well if you don't participate in those exercises I have to make my determination on a driving those guys reckless driving you're not going to arrest them well I'm dealing with you right now unfortunately really yes you're my fish man me m instead of those guys reckless driving you're going to deal with me this girl sees a car drive by and she's like he's Reckless that gu you should go arrest him which is common we've talked about it before um but like reckless driving is driving without due regard for other people which is what you do when you're impaired and you get behind the wheel of a car and drive so she is reckless driving in theory and if she were to take a plea The Plea would ultimately at least in the state of Arizona typically they go down to reckless driving so you plea down in the state of Arizona to reckless driving from DUI because DUI is a higher offense um at least in in how most prosecutors look at it so as she's pointing out I thought it was kind of funny that um you know she's looking at a reckless driver and if she's lucky and gets a good plea she will also be a reckless driver so hold on if you do not if you do not participate in some of those exercises then I have to make my determination on a DUI charge based off of what I've seen so far it seems like any Court would convict her signs that you're under the influence I am under the influence but I did not drive swear to God but you were driving I was not I was not sopia you were
