On December 30th, 2021, >> officers responded to a parking lot of a public's grocery store in reference to a crash with no injuries. >> All right, internet. I'm Frank Slope. I'm a 25-y year veteran of a sheriff's office here in the state of Arizona. Today, we're going to be doing some body cam breakdown. We're checking out a new channel. It's called Caught in the Act. They don't have very many subscribers, but Sam says that this might be a good video, so we're going to check it out and uh we'll see how they go. Body Cam Bingo is the game we play while we're breaking down body cam. We're going to be using card number one today. If you want the whole set one through five, check out bodycambingo.com. You can order anything you want there and we'll send it to you. But for right now, let's check this video out. What's going on? Oh, are you here? Great. This guy backed into me and then took off. I had to follow him here and he's impaired. >> Where did he hit you at? >> I was parked in a parking lot over there. He backed out of his lot into the front of my my RV and then took off. I followed him up here and he's >> I tried to find the person that was who he was to like make sure it was all right. But >> no wow. >> He backed up, hit and then took off and I f I pulled out and followed him and he stopped. Luckily, I got in front of his car, told him to get out. >> I'll drive you. >> I'm going to drive her out. >> Okay, that's fine. >> Thank you. Well, she's not related, is she? Or I mean, >> she might have seen it. I don't know. The gun other guy pulled out. >> Okay. Let me hit you in this. >> Yeah. Back into the front of it. >> Can you grab your driver's license registration insurance for me? >> I backed out real quick and I'm I'm totally not. I'm like I want to do again. >> Sure. Looking bladed. >> Okay. You got your driver's license, registration, insurance. >> You were driving this, right? >> No. Yeah. I've got my friend my my my boss's daughter in the car. I don't want to make this any weirder than it has to be. Like he's like he's inaction registration insurance. >> I'm so sorry. Sorry about your you know. >> Where did he back in? Where did he back front? So you were How are you parked in? Both like spots. Yeah, I was parked in two spots and I wasn't pulled out all the way. I was actually towards the back spot. >> But you were facing this way. >> Yes. >> They hurt. >> Are you hurt? Do you need medical attention? >> Okay. >> Thanks, buddy. >> I'm sorry. I'm sorry, >> dude. And how how did he back into you? >> It was just a >> backwards. >> Yeah. If you wouldn't have been impaired, it wouldn't happen though. And you could have killed >> That's not necessarily true >> because look, you can't go back over. >> Go back over to your car >> and I'm going to ask you what happened. >> Okay. >> Probably this spot or that one backs up and I'm watching the stop. >> Ma'am, do you need medical attention? >> There we go. There we go. Okay. How old are you? >> 13. >> 13. Okay. Can you step out for me? Is that how you found it? She's >> like, I definitely want to get out of this car. >> How do you know him? >> Uh, he works with my mom. >> Can you get your own phone or can pick you up? >> Ashley, >> this is Ashley. >> Hi, Ashley. This is Officer Sylvester Beach Police Department. >> Yes. >> Um, I have someone coming to get her. His name is Brendan Collins cuz I am actually showing a property way out in Banel. >> Okay. >> So, he's the closest person I could get to come get her. >> Okay. >> Is is are they okay? What happened? >> Everybody's okay as far as the crash. >> Did you know that Medicare is about to cover some GLP weight loss drugs? And maybe that's not your thing, but what is? There are all kinds of Medicare plans across the country and navigating them is confusing. That's why I wanted to tell you about this video sponsor, Chapter. Millions of seniors are on the wrong Medicare plan and they don't even know it. You may not need weight loss drugs, but Chapter will make sure that your coverage continues to get you the right medications at the right price. Chapter Advisors are salary based and look for the best plan, not the one that makes them the biggest commission. So, if you want unbiased help with Medicare, give Chapter a call at 805604-5905. You'll talk to a real person in the United States who'll help you figure out exactly which plan is right for you. They'll even tell you if you already have the right plan. Chapter is free and has saved the average senior over $1,100 a year. So give them a call today at 8056045905. Again, it's completely free. So you really you have nothing to lose. >> Is he okay? Like is it medically like it is? He Aubrey said he passed or he fell asleep like he passed out. Is he is he okay? He was fine when I spoke to him earlier. >> He uh I haven't started um that part of the investigation yet. Um another officer's working the crash report and crash investigation and then once he's finished through with that >> um I'm going to begin my own investigation. >> Um as far as criminal um >> criminal. >> Yes. >> What's what's wrong with him? >> I don't know at this point. I have to conduct that investigation. But once I do >> been 48 hours without sleep. So >> uh once I >> 48 hours without sleep, I will let you know. And the main reason is because >> well he has a 13-year-old with >> So here in Arizona regular DUI that happens when you're impaired, you're just by yourself or you have other adults with you. When you have a child in the state of Arizona, it turns into a felony. So, anyone under the age of 15 years old in a vehicle here in Arizona, if you are impaired and they are in your vehicle, turns it into a felony, um, it encompasses some child neglect issues and and endangerment and and other other violations. Uh, so I'm pretty sure it's the same way here. So, it's bad when you have someone under the age of 15 in your car. It's even worse when it's a 13-year-old who is the daughter of your boss. I can't possibly imagine this guy having a job when he gets out of jail cuz he's going to go to jail. I just there's no way he's not. This guy's going to go to jail. When he gets out, his boss is going to be like, "You don't work here anymore cuz you endangered my daughter by driving while impaired and having her there." Absolutely. So, this this guy's day is only going to get worse. >> Can I say a little more about my story? What? >> Off my meds. Okay. So, I'm a little bit high if I take a pillow. I'm a little bit wacky right now, but I'm not. I have to short my friend's daughter with me. I don't want you to think I'm like crazy. >> I don't think we're just finishing up the uh the crash report. >> What happens? He's going to finish up the crash report. Can >> I leave? >> No. No, you can't leave. >> You can definitely not leave. >> Don't touch me. And yes, I do not have a cheer. >> You said that twice now. He no longer works for us. >> I'm sorry. I >> I'm going to give you this information. This is You're responsible for contacting your insurance company and reporting to them that you were involved in a crash today. Okay. I investigated the crash today and at my conclusion of investigation and witness testimony, I found you at fault for improper packing. Okay. I'm giving you a citation today. >> That's interesting. >> You have 30 days to take care of this. >> It's $166. You have 30 days to take care of it. Okay. >> So, I'm kind of I'm I'm interested in this because here in the state of Arizona, non-injury collision on private property, um we cannot by state law, we cannot issue a citation. Um, now you can get a DUI on private property, which I have a feeling this investigation is going to go that way also. Um, but just a regular being involved in a collision, like this officer said, unsafe backing, which would be appropriate. Um, we don't have those here in Arizona. So, in Arizona, if you get into a non-injury collision on private property, you just exchange insurance information and you call your insurance company and say, "Hey, I was in a parking lot and, you know, someone backed into me," or, "Hey, I backed into someone." And that's it. That's that's the only thing we do here. We don't take police reports on private property for non-injury stuff. Um it just we we just kind of we just tell them to exchange information and go about our business. So very interesting and a very different aspect of the law this being in a different state. >> At this point I'm going to turn it over to Officer Sylvester who is further going to talk to you. Okay. >> All right. Cool. >> You're going to talk to officer Sylvester at this time. >> That's >> not right now. I'm going to give this to Officer Sylvester. Thank you >> for a second and he's going to talk with you and I'll be right back. >> I like it. >> Thank you. >> All right. >> I haven't slept too much here. >> Okay. So, here's what we're going to do. Like Officer Cornwell said, he is done with the crash investigation. The civil aspect, >> the civil aspect of this investigation. Okay. Now, I'm going to investigate the criminal aspect of this investigation. Okay. Now, what I mean by the criminal aspect of this investigation is I have reason to believe that you are under the influence and operating a motor vehicle. >> Okay. So, I'm going to investigate. Okay. Are you willing to submit to some field sobriety exercises? >> I am, but but no, I'm kind of anory here and no, I'm not because I'm I'm bipolar and I'm off my meds right now. >> So, you do not wish to bipolar and off my meds? >> Like, do we have to do this? Like, >> we have to do this. >> I I'm severely bipolar. I'm off my meds. >> Yeah. You don't want to do field sobriety exercise without a lawyer here? >> Not really. I feel like I'm going to get myself in trouble cuz I I always mess things up. So, >> all right. So, that's a no. >> All right. >> So, I'm going in jail, right? >> Well, I do have to make my determination based on what I have at this point. >> Okay. >> You know who I am, right? I I don't do this normally. This is not like who I do what normally. This is not like I I'm just off my meds and >> Okay. Okay. So, you don't wish to do >> Don't ruin my life over >> You don't wish to do field sobriety exercises? >> I don't think it's him that's ruining your life. >> Saying don't ruin my life over this. >> So, that's a no. >> I don't know. I I'm afraid that if I do the field sobriety, I'm going to fail and and I Yeah, I guess I will then. >> You will? >> I'm going to go to jail either way, right? So >> why would you go to jail either way? Then >> I I have bad relations with police. Yeah. I just feel like I'm going to jail no matter what I do. >> Do you wish to do field sobriety exercises? >> Yes or no? >> Yes. >> Yes. Okay. Let's walk over here. >> Yeah. >> Here's what I want you to do. >> And don't ask him to ask about backwards. I can't do that. >> I'm not going to do that. >> We don't do that. >> Okay. I'm just going to check your eyes. Okay. I need you to keep your head still and follow the stimulus with your eyes and your eyes only. Don't move your head. Okay? Follow this with your eyes and your eyes only. Okay? Do not move your head. >> Water. Next, we're just going to do an exercise called the walk and turn. Okay. >> Love the walk and turn. >> Put your left foot on the line. Put your right foot in front of touching your heel. Left foot on the line. Right foot in front touching your heel. Okay. Keep your hands down to your side. Okay. So, look just like this. >> Give me it all the time. >> Okay. It's going to look just like this. Okay. >> Hands down to your side. >> Okay. Stay there until I tell you to >> Okay. >> I do that pretty much on a daily basis. >> All right. Well, we're just going to stop bowing for safety since you can't stand in the stationary position. Okay. I don't want you falling over. Take your hands out of your pockets. It's the second time I've told you I will not tell you again. So next we're going to do the one leg stand. Okay. >> So if you've watched any of my videos, you've seen me perform HGN, the horizontal gaze nestagmus, walk and turn and one leg stand in that order. Uh I've done it on camera. We've seen other deputies do it here. We've watched body cam video from all over the country of that three test battery being performed. Um, this battery is established and was was nationally administered by Nitsa. So, Nitsa, the National Highway Traffic Safety Administration, is the governmental body that helped develop these tests. Um, back in the 60s and the early '7s, every state, sometimes every different agency had different tests. So what they did was they brought all of the tests together, all of the most popular tests from around the country and they got the most reliable tests, the top three most reliable, which in the initial order was HGN, walk and turn and one leg stand. Then they conducted tests that were both clinical, so they did them inside in a lab, they did them on the road, they had a mixture of studies um in all over the place. They did them in Colorado, did it in San Diego, um did it back east, all to make sure that weather wasn't a variable, that altitude wasn't a variable, that temperature wasn't a variable, and then they came out with this battery. So here they're on the east coast, they're performing this battery. If this same scenario happened in the state of Washington or in Nevada, they would be doing the same tests. So it's it's the same everywhere. We do the same test. We look for the same clues of impairment and we very often come to the very same result. >> So I'm going to demonstrate it. >> I'm bad at this. Yeah, >> I'm going to demonstrate. >> You be bad at it. >> Just standing. >> The one leg stand where you trying to stand. >> I'm going to demonstrate it for you. >> Look at me. Stop walking around. Okay. Stand with your feet together. When I tell you to, I want you to raise one leg. Either leg. It doesn't matter. Approximately 6 in off the ground. Okay? It's about the height of a soda can. >> You know, I had a stroke two weeks ago. So, yeah. Anyway, nobody listens to that. So, yeah. >> Okay. >> Do you understand? >> The first time you mentioned it. >> Okay. >> You look like a flamingo. That's not how the one leg stand is performed. I don't know what that is. It's the best thing I can do. Yeah. >> All right, Jonathan. So, at this time, uh, I do find you to be impaired. >> Yeah. >> Operating motor vehicle. Okay. So, I'm going to place you under arrest for DUI. Okay. Put your hands behind your back. Okay. >> There we go. >> Yeah. >> We'll take care of it. I'll take care of all that for you. Don't worry about it. >> And don't pull away. Don't pull away. No, I'm not I'm not pulling him. There's nothing we can do. Like >> No, >> you might not have the balance handcuffs. >> No. >> You have anything else on you? Cuz once we get to the jail, it's going to be a felony. >> Do you have anything on you? >> What? >> No. >> Did you just bribe me while I'm holding your money in my hand? Yeah. Did I just get a charge? >> You did. Yeah. >> No, I I didn't say that. I didn't say that. No, you did. >> Your money's going with you. Okay. That's going to be with you. Unfortunately, we can't take your vape. >> Go ahead and slide in there. >> I'm sorry. I'm sorry. >> Easy. Use the Use the running board. >> I can't step up. Just >> I just just let my throat right here. Just let my throat here cuz I'm done. I'm done. No, I'm done. I'm done. >> I'm done. You want to bake? You want a baker me? Because I'm I'm about done. If this happens right now, >> you are going to jail. >> I am. Yeah. Then I'm done. I'm done. >> You're under. >> I'm I'm a big deal in this town. And if I get arrested, then [ __ ] me. >> But you are arrested. >> No, just just get me Baker actor then. >> You can be Baker actor after you get out of jail. >> That's fine. >> No, no, no. I'm I'm going to I'm going to I'm going to kill myself in the back seat of your car. Our suspect here claims that he's bipolar, which I think right now what it looks like is that half the time he's sober and the other half of the time he's impaired and he's thinking that that's bipolar because he's definitely on half of that right now. Um, so with his his bipolarness, which I'm sure he's probably not supposed to be consuming alcohol now, he makes these suicidal statements, which he doesn't understand the repercussions of those. But as law enforcement, we know that when we tell our brothers and sisters on the correction side of things, hey, he made suicidal statements. Um, at least here where I work, they will strip that person naked and they will put him in a padded room to make sure that he can't hurt himself. So, he's just a padded room with like a little mattress pad on the floor and a blanket. That's what he'll get and until he soers up and becomes less suicidal. So, just him saying that, his bad day that then got worse when he had his boss's daughter in the car now got exponentially worse when he gets to jail and doesn't have any pants anymore. Things are going to get bad. >> Yeah. >> No, you're not. >> I will slip my >> Slide your feet in. >> Yeah. You don't You don't understand. You just >> press the wrong one. >> Okay. Slide your feet. >> I'm done. I'm done. I'm I'm going to >> put your feet in. >> Watch your foot. Watch your knee. >> Good. Let me hit it. [music] >> Jonathan Gamrell, age 40, was arrested and originally charged with five counts, including [music] DUI with a minor passenger, DUI with property damage, >> child neglect, bribery of a public servant, and leaving the scene with property damage. It is noted that Gambrell was already on probation at the time [music] of the arrest for aggravated assault on a law enforcement officer. On September 6th, 2022, [music] Gambrell entered a plea of no contest and [music] was adjudicated guilty for four counts. >> For the felony DUI, Gambrell was sentenced to 5 years of supervised probation. That's it. >> Had his driver's [music] license suspended. For the child neglect charge, he received an additional 5 years of [music] drug offender probation. The remaining counts carried two days in county jail with credit for [music] time served. The bribery charge and the leaving the scene charge were not pursued. From the posting of this video, Gambrell still owes nearly $3,000 in fines. The case is now closed. >> I had my pen ready. I had card number one ready. And these two never met. He just didn't say anything crazy enough to make it on card number one. So, I got nothing on body cam bingo. What I do want is if you guys could just become subscribers. Right here is the link. Click that. Go to our page, subscribe. There's a little bell there. You could ring that. Then when we put out a new video, you're made aware. You'll never miss a video that Sam puts out. So, do that.
