Are you like discriminating because I am not American? You are like freaking communist like like taking me out. >> If you want to speak in in German what else? >> I'm not speaking German. >> All right everyone, I'm Frank Slow. I've got 25 years as a deputy sheriff here in state of Arizona. Today we're going to be doing some body cam breakdown. So we found today's video on a small channel called body cam stories. Uh this one looks pretty good so we're going to give it a try while we're doing some body cam bingo. So we're at card number three. We sell them in a pack of five and you can find them at body cambingo.com. So you can order yourself some and then you can play along just like we're going to play right now as we watch this video. >> A witness calls 911 after spotting a driver striking a concrete barrier and weaving through traffic in Cape Coral, Florida. But they quickly realize this stop may >> failed to maintain lane there. >> traffic violation. >> Stop in the left lane. >> Put it in park. Put it in [ __ ] park. Jesus Christ. Step out of the vehicle. I'm locking your car. Put it in [ __ ] park. >> Get out of the car. Get out. Get out. >> I'm driving my husband's car. >> I see that you're not doing a very good job of that. Step over here. Like over here away from the car. Over here. >> This entire stopping sequence is just terrible. Like she yields to the left which from what I understand from riding along with several agencies in Florida, there isn't a mandatory pull to the right like we have here in Arizona. So pulling to the left is more common in Florida because it's not prohibited by law. But she comes to a stop in the left lane and then puts her car in reverse and starts to back up towards the officer's vehicle. Uh like it's all terrible. It is all shades of terrible on this stop. And she can't figure out to put her car in park. Um then they obviously get her out because she needs to be not in control of that vehicle anymore. So, um right from the get-go, she's a mess. >> Do you have your driver's license in the car? >> Yes. >> What's your name? >> Emily Bogash. >> Emily? >> Yana Bogash. >> All right, I'm not going to be able to spell that. Is it in your car? In your purse, your wallet? >> Is it in your purse? >> Is your ID in your purse? Okay. You're showing some significant signs of impairment, okay? You were speeding, you were swerving, you're stumbling all around, you have slurred speech, you have bloodshot, watery eyes. You nearly backed into my cruiser. >> I'm not. >> Okay, well, I would like for you to participate in some standardized field sobriety evaluations to dispel my fear that you may be impaired. Are you willing to participate in those evaluations? >> I >> Would you participate in some standardized field >> I I I I like uh you're interrogating me? >> what I said? >> No. >> Would you participate in some standardized field sobriety evaluations to dispel my fear that you are impaired? >> I'm I'm sorry. I don't speak English. >> You are doing a perfectly good job right now. >> No, no, no, no, no. >> So, are you going to participate in some evaluations to dispel my fear that you're not intoxicated? >> I'm not. >> She definitely doesn't know what dispel means. >> You're what? I I I I like you're interrogating me? >> No, I'm asking you to perform some standardized field sobriety evaluations to dispel my fear that you're impaired or not. >> I I I target me because I'm like a criminal or something? >> No. >> I'm going to call that the race card. >> I'm asking you questions because you're a suspect in your driving this vehicle down the road. >> I'm not. Okay, so are you going to perform some evaluations to dispel my fear? >> I stop people all the time who don't know the law, and it's not because they're bad. They just have never had anyone tell them. Turning 65 and signing up for Medicare is the same story. No one hands you a rulebook. You get a stack of mail and it looks like ransom notes, and messages contradict each other. And that's why I trust Chapter, the only Medicare advisors that compare every plan nationwide. They're free and they're honest, and no one's paying them to push you towards one plan or another. The real person gets on the phone, looks at your doctors, and looks at your prescriptions, and then walks you through your best options. It takes under 20 minutes. Call 805-604-5905. No pressure. Just the facts laid out straight, the way that I want it done for my own family. If you're turning 65, or like in my case, you're helping a parent who is, call 805-604-5905, or go to askchapter.org/frank. Get it right the first time with Chapter. >> That is English. >> I am I'm sorry. I am my English >> you say your first name? >> Yana. >> Yana? >> Yabash. >> Yana? >> Okay, so stop. >> Are you going to perform >> Talk to me in English, okay? >> English. >> Okay. >> You're doing it again. >> Stop saying some like nonsense to me. >> Okay. Are you going to perform some >> She's figured out the English language pretty well. >> That's English. >> There are a lot of people that are going to say, "Hey, this is this is an obvious language barrier, and they should have gotten an interpreter." Which by the way, trying to find a Slovak interpreter in the middle of the night in the middle of Florida is probably right between impossible and not going to happen. Um but she is saying I speak English. Speak to me in English. And then she's saying I don't understand you. Speak to me in English. So she wants to be talked to in English and then she said she can't understand English. But then she said she understands English. So I'm a little bit confused as to how fluent she is. But no matter how fluent she is, she's kind of rude and probably just needs to go to jail. >> Okay. Are you going to perform some evaluations? Perfect. Are you comfortable in those or would you like to take them off? >> No. Do you care to run her real fast? Thank you. >> No I don't speak Polish. I do not know. No. I speak Polish. >> Are you like targeting me because I'm an illegal immigrant? >> No. >> Are you like calling >> We're pulling you over because you were driving down the wrong way and you slammed into a wall. You understand >> Are you like targeting me >> No we're not. >> because you are like >> Can you say your first name again? Yana? >> Yana. >> Yana. Okay. >> Yana. Can you remember this? Yana Labash. >> Perfect. Okay, what I want you to do Yana Labash is put your feet together. >> Yes. >> Put your feet like perfectly together for me. Can you put them completely together? >> Yes. >> Would you like to take those off? >> Yes. >> I'm here. Put your feet together like mine are. Completely together touching. >> Yes. >> Put your hands down by your >> touching the car. >> Stay just like that, okay? So what I want you to do is keep your feet together and your hands down by your side. I want you to follow the tip of my pen with your eyes and your eyes only, okay? Do you understand? Do you understand what I said? >> No. >> I want you to keep your head still. Do you understand? >> like freaking like like um >> Like a police officer? Yes. >> Yes. >> Yes. I'm Officer Allen with the Cape Coral Police Department. So, keep your hands down by your side and your feet together. I want you to follow the tip of my pen with your eyes and your eyes only, okay? Don't move your head. Just follow this. >> You look like like like you don't like freaking kindness like like freaking me out. >> No. >> Because I was raised in >> Stay right here. >> No. >> Yes. >> No. No. >> Okay, listen. I'm asking you, then I'm going to tell you, and then I'm going to make you listen. >> Yeah, ATM. >> I'm American now, and we're going to do some evaluations. >> raised in a communist country. Don't freaking me out. >> Keep your feet Okay. >> Okay. >> If you keep doing this, I'm going to take that as a refusal, and I'm going to base my decision on what I've already observed, and you're going to go straight to jail. Do I make myself clear? >> Uh let me uh let me get my stuff. >> You're not getting back in that car. So, what I want you to do is keep your feet together and your hands down by your side, and I want you to follow the tip of my pen with your eyes and your eyes only, okay? Look at this. >> What am I supposed to >> See this You see the blue tip here? >> No. >> Keep your eyes on it. >> Can you like talk slow? >> Yes, I will talk slow. Keep your hands down by your side. Keep your feet together. Follow the tip of this pen with your eyes and your eyes only, okay? >> Yes. >> Can you be nice? >> I am being nice. >> Okay. >> Okay? >> So, what? Now >> That's for me. You follow the blue tip. >> No, I'm not I'm not I don't know what I'm supposed to do. >> You're going to follow the tip of this pen. The pen. That's a flashlight. Look at this pen. See this pen? >> Yes. >> Keep your eyes on that. Follow it. Don't move your head. >> Yes. You're talking. Keep your eyes. >> Don't move your head. Follow it with your eyes only. Do not move your head. >> I'm not. >> Keep following it with your eyes and eyes only. Do not move your head. Do you need to like hold your head so you don't move it cuz you keep moving it? Okay. Follow it with your eyes only. Don't move your Keep your eyes here. Just follow it with your eyes. Follow the tip of my Keep your eyes on it. You're not keeping your eyes on it. Do you understand what I say follow it? You're going to follow it with your eyes and your eyes only. You're not going to move your head. You see what I'm doing there? Okay, see this line here? We're going to use this for the next evaluation. We're not going to use the center of the line. We're going to use the edge of the line. You see where my foot is? It's on the edge of the line. I want you to put your left foot on the edge of that line. Your left. Your left. So left. You do you know Do you know your left from your right? Perfect. So what I want you to do is put your left foot on the edge of the line. The edge. Right here. This is the edge. Yours is on the center. I want it on the on the edge. Perfect. Leave it there. Then what I Go ahead and get back in that position. Put your right foot in front of your left, just like I have here. Heel to toe. My feet are touching. Yours are not. Put your right foot in front of your left. I want you to put your right foot in front of your left. See how my feet are? >> I'm like you freaking like >> Do you see how my feet >> I'm I'm an immigrant. >> Okay. >> I am an immigrant. >> That makes it irrelevant to whether you're >> Yeah, doesn't matter. >> I want you to put your left I want you to put your left foot on the >> you want me to do? >> you to put your left foot on the line. And your right foot in front of the other. >> This. >> Just like I have here. >> This. This. >> Do you see how my feet are? >> Yes. Yes. Yes. Yes. >> Get back over there. Left foot on the line. >> This is not difficult. >> Just like this. >> Yes. So, what do you want me to do? >> I want you to put your right foot in front of your left. >> What? >> The outside. >> Wow. >> Put your right foot in front of your left. >> What do you want me to do? >> I want you to put your right foot in front of your left touching heel to toe. Do you know what your heel is and your toe is? >> My heel is here. My toe is here. What do you want me to >> Perfect. I want you to put your right heel touching your left toe. Make sense? >> No. >> Put your left foot on the line. >> Speak slowly to me, okay? >> Listen to me. >> Speak Speak slowly to me. >> going to explain >> I am I am I'm I'm I'm >> You're an immigrant. I get it. You're going >> I am immigrant, okay? You don't You're freaking me out. >> If you're going to keep doing this >> You're like telling me this and this and this and that, okay? >> want to do this, I'm going to take it as a refusal. >> Okay. >> Take it as a refusal. Just do it. >> is here. >> Put your left foot on the line. And now your right foot in front of the other. Touching heel to toe. >> Reach. >> Okay, we're going to skip that one. You can't >> Which foot you want me to left? >> Put your feet together. Put your feet >> What do you want me to do? >> Put your feet together. Right here. Come right here. Keep feet together. >> What? >> Put your feet >> What do you want me to do? >> Put your feet together. >> This. >> Keep your hands >> feet together. >> Keep your hands down by your side. >> This. >> What I want you to do, when I tell you to, I want you to raise your left or your right foot. Doesn't matter which one, whichever one you choose. Do you understand? >> No. >> You're going to raise your left or your right foot 6 in off the ground, flush with the ground, just like this, okay? >> What? Are you like Are you like like >> What? Do you see what I'm doing here? >> Yes. >> You're going to raise your Don't begin until I tell you to. >> What? What are you talking >> put your feet together. Put your feet together. >> Yes. Yes. >> Put your feet together. >> They're not together. >> My feet are together. >> When I tell you to, but not until I tell you to, you're going to raise your left or your right foot. You're going to raise it 6 in off the ground, flush with the ground, just like I have here, okay? You're going to count out loud. 1,001, 1,002, 1,003 until I tell you to stop. Can you count? >> Why are you asking me? >> I'm asking if you know how to count. >> I know how to count. >> Perfect. Perfect. >> you asking me? >> Okay. >> Why are you asking me? >> So, are you going to raise your left or your right foot? >> What? >> Are you going to raise your left or your right foot? >> Are you like discriminating me because I am not American? >> Okay. >> You are discriminating me. Do you Do you discriminate me because I am not >> If you're going to continue to be argumentative and not want to participate, then we're just going to take that as a refusal. Okay. So, I want you to raise your left or your right foot 6 in off the ground, flush with the ground, just like this. Don't begin until I tell you to. When I tell you to >> foot Am I uh Which >> Whichever one you wish. You're going to raise it 6 in off the ground, flush with the ground, just like this. You're going to look at your foot. You're going to count out loud. 1,000 Don't begin until I tell you to. Go ahead and put your foot back. >> I don't understand what you're asking me. >> Because you keep asking me. >> me. >> Okay. You're going to raise your foot 6 in off the ground, like the size of a pop can, okay? You're going to look at your foot, and you're going to count out loud. 1,001, 1,002, 1,003 until I tell you to stop, okay? You keep your hands down by your side and you count out loud. 1 2 3 4 or if you want to speak it in German, >> I'm not speaking German. Don't do not. >> Okay. >> Wow, she's telling me to speak German. She's telling me she's like >> Whatever your native language is. >> Speaking a second ago? >> Excuse me? >> What language were you speaking? >> Excuse me. >> What language were you speaking? >> You are telling me to speak German? >> Jesus Christ. >> You are like intimidating me. You telling me to speak German? >> Do you understand the instructions? >> Oh, so you think I don't >> You can speak English if you prefer, but you did a second ago. >> You think I speak German? >> to raise your foot 6 in off the ground. Listen to me. If you do not participate >> Place her and just take her into custody. >> Are you going to start cooperating or I'm just going to place you under arrest? >> Take her into custody. >> You are not following the instructions. >> What language were you speaking? What were you speaking? >> Slovak. >> Okay, perfect. If you want to speak Slovak, speak Slovak. If you want to speak English, speak English, okay? >> Why am I supposed to speak German because she wants me to speak German? >> I don't know what language you speak. >> She wants me to speak German. >> 6 in off the >> Oh my goodness. >> Just like this. You're going to look at your foot. You're going to count out loud. >> Now I'm not going to broadcast myself as a world traveler, but I have traveled to some different countries outside of the United States. I literally, just 2 weeks ago, I just got back from Canada. When I'm not here in the United States, I try to have as little contact with anyone of law enforcement relation at all. I don't want to talk to a federale. I don't want to talk to local police. I don't want to talk to a park ranger. I just want to go and enjoy it and go home and not have any law enforcement contact. The last thing I want to do is be standing on the side of the road literally having an argument with a law enforcement officer from another country. Because I am sure that the law enforcement in Slovakia are not going to accept behavior like what we're seeing right here. Now, I've got fans. I've I've fans in Slovakia, uh Czecho- Slovak the old Czechoslovakia which went away in the '90s um is where my original family's from. Slope is a is a Czech name. So, I know I know a thing or two and I'm telling you right now they are not going to stand for someone acting like this. >> I'm supposed to do what? >> When I tell you to, you're going to raise your foot 6 in off the ground, flush with the ground, just like I demonstrated. >> slow down. Slow the [ __ ] down, okay? Tell me to what to speak. I won't follow your direction. >> explained it 15 times. I'll explain it again. >> sorry. I'm sorry. >> You are going to stop talking. You need to stop talking. >> Slow the [ __ ] down, okay? Don't tell me to speak Don't tell me to speak German. You're telling me to speak German. >> Okay, you're going to raise your foot. >> Okay, you're telling me to >> Done. Yep. There we go. It's about time. >> Put your hands behind your back. Stop. You're refusing to cooperate. I've explained this to you a million times. You don't want to participate. >> me to speak German. >> Don't look back at me. >> You're telling me to speak German. >> Sorry, I misspoke. Who cares? People make mistakes. It's not a big deal. >> Well, I don't know what you said. You're telling me to speak German. You told me to speak German. >> Slovak. >> You're telling me to speak German. I don't speak German. I'm sorry. >> I got a 10-70. >> Cool. Appreciate it. Do you have anything on you that's going to stick, poke, or harm you? >> Mhm. >> Do you have anything on you? >> Excuse me. >> Do you have anything Okay. >> That's a side effect of being under the influence of alcohol is you get single single subject focus. >> I said that we would get that. >> You are you are violating the violating >> Okay. We don't even need Okay. Um you're being arrested for DUI. Would you now be willing to provide a breath sample to measure the alcohol content? >> Mhm. >> You don't have idea what you're saying to me. You are you are a >> Do you have a Florida driver's license? >> You want to attack me? >> Is this a Florida driver's license? >> You are attacking me. You are you are >> Do you want to provide a breath sample? >> You are attacking >> Giving my people a bad name. >> You are attacking me. >> If you continue to say that, I'm going to take that as a refusal. >> You are a >> Perfect. Go ahead and watch your elbow. >> So obviously, she refused to participate in the HGN, she refused to participate in the walk and turn, she refused to participate in the one leg stand. Of course, she was going to refuse to participate in a breath test. So, they took them they I would imagine this officer took the suspect to a breath testing instrument, read some version of a of a administrative form known as the admin per se affidavit, and then this woman probably said, "Hey, I don't understand it." and then refused to submit to that test. Um in Florida, which I love, they have a specific charge for refusing to submit to a chemical test. Lots of states have it, especially back on the East Coast. Here in Arizona, we don't have a refusal law. Um there are penalties for refusing and license suspensions, but there is no actual criminal offense for failing to just submit to a chemical test. So, it's one of those differences, like I say all the time, different states have different laws. That's the law in Florida that I wish we had here. >> After conducting their investigation, deputies take the suspect into custody. The suspect now faces serious charges, including DUI and refusing to submit to a lawful breath test under Florida's new statute. >> I like it. Definitely a drawn-out, yet incredibly entertaining video. What wasn't entertaining is nobody can bingo on that one. We just got her dropping the race card. Now, even though it's white on white, I'm still going to take it because it's my game, and I believe that's still dropping the race card because she wanted preferential treatment due to her immigration status. I think we checked that box. Now, the box that you guys need to check is just becoming a subscriber. So, click on that, join the channel. We're trying to get to a million. It's the next big It's the next threshold that we need to get past. YouTube says we need to get there, and we need your help. We'll see you on the next one.
