Jesus need my friend a right. Please don't shoot me. They talk loud, act bold, and quote laws they clearly don't understand. These Karens thought they were legal experts until real cops stepped in and proved them dead wrong. First little push down here. I have you stand up on 30. Get ready to witness what happens when dumb confidence meets actual law enforcement. A 22-year-old drunk woman was driving dangerously with no sense of responsibility. On March 5th, 2023, Berea police officer Santos was on patrol in Brea, California. She noticed a female driver texting and driving without headlights while driving. She initiated a traffic stop on the vehicle, and it took the driver longer than normal to pull over. Sorry to interrupt your uh cell phone usage or chat you have going on. Okay. I'm officer Santos of the Bria Police Department and I stopped you for a numerous things. Um number one is you're driving for quite a few miles with no headlights on. Were you aware? Oh, no. Okay. And also, you haven't put your cell phone down the entire time you've been on your phone. Okay. Do you have your ID on you? I do. Have you been drinking this evening? I have not. Okay. Were you taking any drugs or anything? No, sir. No, sir. Do you know where you're at right now? Somewhere around Uklid something. Oh my gosh. Okay. What are you handing me right now? Just my ID. Just your ID? I mean, I assume so. Yeah. Okay. You're handing me your credit card. When she finally did stop, the 22-year-old seemed oblivious that the officer was at her door since she still appeared to be texting. The woman denied consuming any alcohol. The officer told her the reason why she was being stopped. Then the woman called Officer Santos. Sir. Officer Santos asked the woman for her license and she was handed a credit card. Okay. Go ahead and shut the vehicle off. All right. Go ahead and take your credit card. Take your credit card. Okay. Unbuckle your seat belt. Okay. What I'm going to have you do is I'm going to have you do some field sobriety tests. Okay. Okay. Go ahead. The owner is operator. I'm going to have her conduct some SFSTs. All right. Come on. Go ahead and step outside of the vehicle. All right. And then we're going to walk over here to the sidewalk. Okay. Okay. Okay. Over here to the sidewalk. All right. What I want you to do is just stand right here. Okay. When the woman was asked to step out of her car, her pants were unbuttoned and unzipped. She was administered standardized field sobriety tests. So, the first thing I'm going to do is I'm going to be checking your eyes. What I need for you to do is stand with your arms to your side. Do you need to button up your pants or I mean, I guess I can. Yeah. Okay. It's for your comfort. No, I never. It doesn't matter. Okay. All right. Hands down to your side, feet together. Okay. And then I need for you to follow the tip of my finger with your eyes and your eyes only. Do not move your head. Do you understand? Yep. Okay. Okay. Don't move your head. Okay. Okay. Don't move your head, just your eyes. 1622 radio. I'll be with Okay. What I need for you to do, if you can't hold your head still, can you put your hands up to your face and just hold your head? Okay. Just hold it still right now. Okay. Yeah. Just hold your head still and just follow it with your eyes. Okay. Okay. Now, we're going to be going up. Okay. Okay. Just with your eyes, okay? Not your face. Okay. All right. So, the next test we're going to be doing is the walk and turn test. Do you have any type of uh disabilities or physical limitations that would stop you from walking nine steps, turning around, and walking nine steps back? Okay. What I want for you to do is I want you to imagine a line directly in front of you. Okay? I want you to put your left foot on that line with your right foot in front of your line like this. Okay? So, your left foot's on the line. Nope, don't start walking. Okay? So, imagine the line in front of you. Place your left foot on that line with your right foot directly in front of your left foot and then put your arms down at your sides and maintain that position until told to do otherwise. Do you understand? Okay. So, when I tell you to begin, no, not not yet. Not yet. Don't start. Okay. Go back to the starting position with your left foot and then your right foot directly in front of that one. Okay. When I tell you to begin, you're going to walk nine heel to toe steps counting out loud in the following manner. One 2 3 on down to nine. When you've reached your nine your ninth step, leaving your lead foot on the line, make a series of small steps in the following manner. And then you're going to make nine heel totoe steps back down that line. Once you start the test, do not stop the test. Make sure you watch your feet at all times, keeping your arms down to your side and counting your steps out loud. Once you start the test, do not stop the test until finished. Do you understand? Okay, I think one, two, three, four, five. Put your arms down your sides. Seven, eight, nine. Okay, you you have to turn around and do nine steps back. Put your arms at your side now. Yes. Okay. Okay, go ahead and stop. All right, go ahead and turn around. All right, so the last test we're going to do is called the one leg stand. Okay, do you have any issues that would stop you from standing on one leg for about 30 seconds? No. Okay, so when I tell you to begin, okay, first of all, just maintain the position you're in. Feet together, arms down at your side. Do you need to zip up your jacket? No, it's just kind of cold. But no, I'm good. Okay. All right. Arms down at your side, feet together, and then whenever I tell you to, you're going to raise one leg, either leg, 6 in off the ground, with your toe pointing outward, and you're going to watch that foot. And you're going to count out loud in the following manner. 1,00 1,002 100,004 and so on until I tell you to stop. Okay? Once you begin, no, don't start yet. Once you begin, do not stop until I tell you to do so. Make sure you watch your foot, keeping it parallel to the ground, and count out loud. Okay, do you understand? Okay, give me just a second to get the timer going. Okay, are you ready? Begin. Make sure you're counting out loud and watching your foot with your arms at your [Applause] sides. Okay. You have to count out loud and watch your toe. One, two, watch your raised foot. You have to watch your raised foot. You're not watching your raised foot. [Applause] All right, go ahead and stop. The first test was horizontal gaze nestagmas. She was told not to move her head, but she continuously moved her head, and the woman turned the walk and turn test into a walk and strolled down the sidewalk. During the one leg stand test, she didn't count out loud. She was detained after failing all of her tests. Okay. So, right now you're under arrest for OVI. Turn around. Put your hands behind your back. Do you have anything that you need to get out of your vehicle? Do you have a purse in there or do you have a cell phone? I I saw it in there that you had it on your lap. Yeah, I'd probably have a cell phone. Yeah, sure. Okay. Would you like that? Yeah, I guess. Okay. All right. We're going to walk over here to the back of my cruiser and then I'm going to search you real quick. Do you have anything on your person? 78. Okay, good. [Music] Well, we'd either park it at the high school or call for a tow. I just called uh the auxiliary over here to come tow it unless you want me to park it. Honestly, it's your call. Well, your stop, your call. Open container. Yep. Uh half empty bottle of tequila. My I didn't grab my other flashlight. Yeah, you're good. How old is she? I believe she's over 21. Uh we're having issues with leads right now. Yeah, sounds about right. She was arrested for DUI and taken to the police station. The officers inspected her vehicle. An open container of alcohol was eventually discovered in the vehicle. The police report indicates she blew a 0.202% BAC. She was charged with operating a vehicle impaired, having a breath alcohol concentration of over the legal limit, not using her turn signals, texting while driving, not having her headlight on, and having an open container of alcohol. The incident is caused by a woman named Ashley. In 2023 in Albuquerque, New Mexico, officers noticed a vehicle driving erratically. The officer tried to conduct a traffic stop by turning his cruiser lights and siren on. The vehicle kept driving. The officer decided to perform a pit maneuver to stop the vehicle. The first attempt resulted in a failure. The vehicle stopped for a brief moment, but then drove away once again. Another officer successfully performed the maneuver and stopped the vehicle. The officers quickly blocked the vehicle with their cruisers. Officers immediately ordered Ashley to show her hands. Ashley finally complied and exited the vehicle. Another officer issued commands to her to come towards them, walking backwards. They then told her to get on her knees. One of the officers quickly handcuffed her. Let me see your hands. Hands. Let me see your hands. Hands. Exit the vehicle. Exit the vehicle with your hands up. Yeah, we got a filling stop here. Hey, Sergeant, go around to the left. Go around to the left. Exit the vehicle with your hands up. Let me see your hands here. I'm going to get on you. I got on you. I got on you. I got on you. Take two steps to your left. Walk to the sound of our voice. Here you go. Get it. Walk up. Go down on your knees. Hands behind your back. Vehicle's clear. Go ahead and stand up here. Stand up. You have your purse on you? Yes. You have you have you have your ID in there? Yes. All right. Thank you. All right. Just just Okay. Just just sit right there. Okay. [Music] Ashley. All right. So, you have the right to remain silent. Is it all right if I get it? Yeah. Go ahead. All right. Yeah. I'm caught up in Yeah. No, no. I got you. Just lean back. I don't want you to fall over. Yeah. It's in here. Are you sure? Yes. It should be in there. Are you the registered owner of the vehicle? Yes. This is my vehicle. What's your name? Ashley. Ashley. What? Delon. Delion. Yes. Okay. If it's not in there, it should be in the middle. Okay. So, you said you're coming from downtown. Yes. So, I mean, there's a heavy odor of alcohol, right? Flur speech. Your eyes are bloodshot watery. How much alcohol have you consume? Be honest with us. Yeah, we're doing our job, right? I understand. So, how much alcohol have you consumed? Well, I just came from downtown, so So, how much alcohol have you consumed? I do not know. You don't know? No. Well, I've been honest with you, so you're going to be honest with me? Yeah. All right. So, how much alcohol do you consume? I don't know. You don't know? No, I don't. Okay. And I've been honest with that [ __ ] Okay. So, are you willing to take uh some field sobriety tests? If I need to, yes, I will. Well, I mean, I'm asking you, are you going to take some standardized field test? If I need to, yes, I will. All right. An officer then read her Miranda rights. He then began his questioning. The cop then located her driver license and successfully identified her. He unccuffed her to remove her purse from her. He then inquired about how much alcohol she consumed and if she was willing to participate in field sobriety tests. Ashley agreed to the tests. So put your feet together. Okay. Arms to your side. Just like just like so. Okay. Have you had any recent head injuries? No. No. No. Okay. All right. So, what I want you to do is follow the tip of my finger with your eyes and your eyes only. Okay. So, put your arms to your side. Sorry. All right. So, like I said, follow the tip of my finger with your eyes and your eyes only. Don't move your head. Put your chin down. Look at my finger up here. All right. So, keep your head straight. Right here. Right here. My finger's over here. You're looking somewhere else. Follow my finger. All right. Keep your head straight. Follow the tip of my finger with your eyes and your eyes only. Do not move your head. Do you understand? Yes. Okay. Right up here. All right. You're looking somewhere else. Follow my finger. Okay. Okay. What's your last name again? Delon. Delon. So, Miss Dillion. Okay. Work with me. Okay. Follow my finger. Just with your eyes. My finger's over here. All right, keep your head straight. All right. Up and down. Okay. All right. So, be honest with me. I wish I call you consumed. Huh? No. No. The officer then explained the gaze test to her. He also asked if she had any head injuries. He then proceeded to perform the test. Despite clearly explaining the test, Ashley kept messing up the test. She was not able to follow the finger properly. After the test, he again asked about her alcohol consumption. Do you feel comfortable walking in those shoes? Yes, I do. Okay. All right. So, there's going to be an imaginary line from your left foot directly to my left foot. You able to imagine that line? Mhm. Yes or no? Yeah. Yes or no? Yes. All right. So, now that your left foot's on that line, go ahead and put your right right foot directly in front. Heel to toe. Now they're in that Now they're in that position. Do not move. Put your arms to your side. Arms to your side just like so. Just like I am. Okay. Put your arms to your side like like this. Directly to your side. All right. Now, stay in that position. So, once I tell you to begin, you're going to take nine heel to toe steps forward on that imaginary line. heel to toe, counting each step out loud, looking down directly at your feet, and counting each step out loud. Once you get to that ninth step, you're going to leave your lead foot planted, take a series of small steps with your rear foot, and turn yourself back around. You're going to take nine heel toe steps in the opposite direction. Do you understand? Okay. All right. Stay in that position. So, left foot on that line, right foot directly in front. One, two, three. I took three steps. So, you're going to take nine. Once you get to that ninth step, lead foot planted, series of small steps with your rear foot. Okay? You're going to take nine hill toe steps back. Right. One, two, three. Again, I took three steps. How many you going to take? Right. Three. You're going to take nine. Nine. Would you like me to demonstrate it again? One more time, please. Miss Deion, do you understand? Yes. Okay. One one more thing. Once you begin the test, do not stop. Okay. Do you understand? Yes. One, two, three. Again, I took three steps. You're going to take nine. Once you get to that ninth step, lead foot planted, series of small steps with your rear foot. Turn yourself back around to take nine heel toe steps in the opposite direction. One, two, three. Again, I took three steps. You're going to take nine. All right. Do you understand? Yes, I understand. Would you like me to demonstrate it again? No. Give me one sec. Whenever you're ready, put your right foot directly in front. went ahead and added a go ahead and begin. This if you would just notate that I had a short force pistol. Miss Deion, are you done? Miss Deion, are you done? Yeah. Okay, let's walk back over here. Yeah. Here. Stand up. Sorry. All right. Sorry. Here. Stand up straight. I got you. Stand up straight. Face me. Put your feet together. Do you think you could do this next test? It's going to be the the one leg stand. Would you like me to attempt it for me? Yes. Okay. Cuz I don't want you to fall fall again and get hurt. Okay. Do you think you're going to get hurt? No. Okay. All right. So, put your feet together, arms directly to your side. The officer then proceeded to conduct a heel totoe test. He explained the test to Ashley. She asked the officer to demonstrate the test twice again to her. She then tried to perform the test. Ashley was unable to perform the test properly. She then suddenly laid down on the road. The officer then inquired if she could perform the next test safely. She replied in a positive manner. All right. All right. Once I tell you to begin, you're going to pick up the leg of your choice, left or right, 6 in off the ground, about the size of a Coke can. You're going to keep both arms to the side. Look down directly at that foot that you decide to pick up. The foot that you decide to pick up is going to be parallel with the floor. Do you know what parallel means? Parallel. Parallel like this. Look at my hand. Parallel. Okay. So, I'm going to demonstrate it. Okay. All right. So, put your feet together. Hands direct at your side. All right. I'm going to pick up my right leg for demonstration purposes. Both legs are going to be straight and the foot's going to be parallel. Pay attention. You're going to count in a series of 1,00 1,002 1,00 3 100 4 105 and so on and so on until I tell you to stop. Do you understand? Yes. Would you like me to demonstrate it again? No. All right. So, give me one sec. So, like I said before, you can pick up your left or your right. Just make sure the legs are straight and the foot's parallel with the floor. And a counter serves 10,000. Keep your arms to your side. Look down directly at your feet. Would you like me to demonstrate it again? No. Okay. Count out loud. 1,00 1,000. Right. Correct. 1,00 1,00 1. Okay. Okay. All right. Let's walk right right over here. Hey, right over here. Right over there. All right, stand right here. Okay, put your hands behind your back. Do you have anything in that vehicle that you need? Cell phone, wallet, the officer then explained the one leg stand test to Ashley. She then attempted the test. She repeatedly failed to keep her balance. Abruptly, she stopped performing the test attempt and exclaimed that she could not do the test. The officer then immediately handcuffed her again. 11:59. Look at me real quick. Mhm. Lift up your tongue. Open your mouth. Lift up your tongue. Lift up your tongue. Nothing in there? No. Okay. All right. So, at this point, you're going to be under arrest, okay? For DWI, driving under the fillings of intoxicating liquor and or drugs. Okay. Okay. All right. So, take a step back. I'm going to pat you down. You don't have anything on you? No. Nothing on you. Nothing sharp, dangerous that's going to poke me. Nothing at all. Just some jewelry. Nothing at all. Just jewelry. Okay. Uh, no. I 544. Show that. Uh 41 10:15 for 47 on my watch. Oh, 11:59. Yeah, I did. So, you so you have to take our test and then you could request for an additional test. Okay. The officer then asked if Ashley needed anything from her vehicle. He also told her that they would remove her jewelry later. The cop then checked under the tongue for any contraband. He then informed Ashley that she was being arrested for DUI. He then patted her down for safety reasons. She was then placed inside the police cruiser. Ashley was charged with DUI. The incident revolves around 48-year-old Michael Alonso on July 16th, 2023 in Palm Coast, Florida. Police received a report of a black Mercedes that had traveled into the wrong lane and nearly caused a head-on collision. An officer located the vehicle. He immediately tried to conduct a traffic stop. However, Michael kept driving. The officer then used the cruiser's loudspeaker system and ordered him to pull over. He seemed under the influence and the cop promptly made him exit the vehicle. Stop the vehicle. Pull over. Do it now. Dispatch has been updated. 224. We got that vehicle stopped. What are you doing? What? We've had our lights and sirens on since I 95 and you've taken this long to pull over. Step out of the vehicle for me. You all right? No. What's going on? Um What's up? What? What's going on? I I don't know. Well, I asked you if you were all right and you said no. Correct. So, what's going on? Why aren't you okay? You having any kind of a medical episode? Do you need any kind of medical attention? Are you? Yes. Okay. For what? Are you diabetic, epileptic, anything like that? Yes. Which one? What's hurting right now? We're uh we're here to help you. We just want to know what what's hurting you. What's hurting you? What do you need medical attention for? They're on their way to come see you, but we got to tell them something, right? What can we tell them? What's hurting you? Lower back. Yeah. Lower back. Is it Is it okay? Is what okay? Your back? Yes. I don't know. Typically your back doesn't make you act like this though. Is there anything else going on? After Michael exited the vehicle, an officer inquired about his health. Michael, however, was acting incoherently. Michael claimed that his back was causing him issues. One of the officers promptly told him that back issues should not make him act the way he was acting. What are you diagnosed with, partner? What do you have? Seizures. Are you diabetic? Yeah. Okay. Are you having any kind of a medical episode with your diabetes? Hypoglycemic, hypoglycemic, anything like that? I don't. Okay. Where do you live at? 303. Where do you live at? 30. Where's your ID at, partner? You don't have to grab it. Just where where would your ID be at? Do you have it on you or is it in the car? If it's in the car, don't worry about it. We're just going to grab it for you. It's right here. Yeah. The officers inquired if he had any medical issues. The cop then inquired if he was on his way to the hospital. Michael was unable to give any proper answer. The officers then inquired about his ID. Hey boss. Hey. We got a call. This guy was driving suspicious and they might be drunk. We got out with him. He comes out of the car stumbling and then he's saying he's a diabetic but can't really smell anything. He's not really telling us what's going on with them. All right, we'll check the sugar and everything. All right, do some vitals real quick. All right, you sit down, ask them. I'm going to diabetic22. What's up? Yeah, it should be fine. Our medical staff checked you out. Okay, right now there's your blood sugar is fine. Okay, you're presenting symptoms of what I believe are consistent with impairment. Okay? Whether that be alcohol or narcotics. Okay. Right now, what I'm going to ask you is, are you willing to perform standardized field sobriety exercises to dispel my concern of you being able to safely operate a motor vehicle? No. You are not willing to perform field sobriety exercises? No. Michael then claimed that he was not feeling well. The officers decided to call an EMS team. After a medical checkup, nothing wrong was found. The officers then told Michael about their suspicion about his intoxication. They asked for his permission to perform field sobriety tests. Michael and he gave Heisy consent. Do you want to perform field sobriety exercises? Yes or no? Yes. Okay. I need you to step out of the vehicle. Okay. So, we can I can't. Let's go. Come on out. Please. Well, come on up. There you go. There you go. You're good. Okay, Mike, are you going to stand up or No, I'm trying to Why don't you put grab the door? I'm not being trying to do what he's trying. The officer asked Michael to stand up for the tests. However, he claimed that he could not do it. He then asked the help of the officers. Despite the officer's best attempts, Michael could not stand on his feet. Another officer asked about his medical history. Michael replied harshly to the cop. The officer who initiated the traffic stop gave him instructions on how to get up. All right. All right, Mike. We're going to help you up. How about that? Bring your knees up. Bring your knees up. We're going to we're going to pick you up. Do you have one? No, but I can run to the hospital and grab one real quick. Come on out, dude. We're going to take them out. Come on. Let's let we get those legs. Come on. Those legs work. There you go. Yay. All right. You can reach out to the car. Look at that. All right. Good job. you, man. You behind your back. Yeah. All right. All right. Fine. Okay. Oh, yeah. Yeah. Absolutely. Showing his I'm Mike. You're under arrest for driving under the influence. Great. You're I know. I'm Instead of following, Michael hurled insults at him and stayed on the ground. He then proceeded to lie down on the street. Seeing no other option, cops helped him to his feet. They then handcuffed him. Michael was charged with DUI and two counts of failure to obey the law enforcement. In this incident, a woman named Jara got herself in trouble due to her drinking problem. He claimed that he used to be a contraband user and was probably suffering from psychosis. He also informed them that he had a beer earlier. So, kind of with how you're driving. Okay. You said you've just been drinking a little bit. Freaking out, man. I'm scared, dude. So, what I'd like to do is I'd like to like bring you something a little bit warmer. Okay. I want to run through some tests with you. Make sure you're safe to be driving tonight. And then we're going to make sure we get driving. I want to go to the hospital. I know, but I don't want you I also you kind of see the conundrum I'm at. I want to help you out, but I also can't have you driving 50 miles an hour. Hey, ask her. I'm trying to go to the hospital. I know. And I want to and I want to get you there, but I'd like to run you through some tests to make sure that you you are safe to get down to the hospital and everything. Yeah, I certainly could do that. Yeah, I certainly could, but I want to make sure that you are safe to be driving somebody else and they wouldn't hear me call for me. So, what do you say about going somewhere warm to to run you through some deals and make sure you want to go to the hospital, do that? Okay. And we'll do that and and you have my word. We're going to get you taken care of after that, but I kind of have to go through that portion first. Okay. Really don't feel safe, dude. I don't want to go to the hospital, man. Okay. Well, I'm not going to hurt you. You're safe with us. Okay. I've been decent with you the whole time, haven't I, asked? Yeah. I mean, I'll shut the car off or whatever. Just please take me to Gunderson. So, get me out of my right meds again, man. Yep. We'll do that. Okay. Would you be okay going over to the Fairfield? Just going into the lobby. We'll be nice and warm. We'll run through those fields. You pass those. We're going to get you right to Gunderson. Okay. What's Fairfield? Just the hotel right there. It's warm. They've got an inner lobby. We could do it. That way, we're not out in the cold. It's like 3° right now. I just want to go to the hospital. You okay if we do the fields right here then? If you don't want to go somewhere else, give me five minutes. We'll get we'll get through everything. Okay. Yeah, it's it's right there. It's warm. That's my hospital or mayo because they were the second hospital. You've been drinking. You're driving in in that manner. And I want to get you the help that you can. And believe me, we're going to do that. But I also have a job to do. You might as well shoot me. No, we're not going to do that. The officer asked if Matthew could go somewhere warmer for the tests. He explained that afterward they would take him to the hospital. The officer tried to explain that he had been drinking and driving. He tried to explain that they would get him the help he needs. Matthew abruptly told the officers to shoot him. Just back the up. Stop. Back the up. First of all, put your hands on a resisting double lock. Matt, are you okay? No, I'm not okay. Like physically okay. I know that I know that you're upset. I didn't want to hurt nobody. I didn't swing at you for a reason. Matthew then started to back away from the officers. He suddenly became aggressive. He then took off his jacket in an aggressive manner. The officers tried to grab his arm and he tried to sway it away. A physical altercation immediately ensued. The cops quickly brought him to the ground and neutralized him. He was then handcuffed. I have you stand up. All right. Stand up on three. We're going to walk back to my car. Okay. We'll get you in the washing go. I know. Like I said, we're trying to get you there, but you start acting like that and driving like that. Dude, I'ming scared every day. I'm told they're coming for me. I really don't appreciate you swatting at me like that. I didn't swing on you, man. You swatted at my arm. Let me go right here to the 25. I tried to brush your arm off me. That's all. I know. I didn't try to punch you, man. But when you when you push my arm away like that makes me think you're gonna do something else. Spread your feet for me, please. Dude, I was seriously going to theing hospital, man. I'ming scared, dude. Yeah. I got to take your head off that take back here. Please stay warm. Try that snow up a little bit. Okay. Watch your head. Pulling back first. Easiest if you kind of put your hands towards the other the other door. Okay. After handcuffing, the officers helped him to his feet. They then escorted him to a police cruiser. Matthew told the cops that he did not swing at them. An officer replied he swatted his handoff. Matthew complained that he was only going to the hospital and was scared. Before placing him inside, the cops patted him down for security reasons. He was then placed inside the cruiser. Excuse me. Yes, sir. I'm sorry. I I appreciate the apology. I didn't mean to hurt any of you. That's why I didn't swing on any of you or anything. I just tried to brush your arm off mine. Hey. So, he like gets really amped up, starts backing up away from us, takes his jacket off. He's like, "Why don't you shoot me then?" So, we grab onto him. What you're describing, it sounds like he's under the influence. Yeah. I I I definitely feel that the behavior is an indicator of uh drug ingestion versus mental health. It seems like, I mean, with the speed and all the other stuff, that's why he's acting that way. I'm sorry, man. I didn't mean to fight you guys, man. I just I just want you to to get the help you need and get through what you're fighting. Matthew was apologetic once inside the cruiser. The officers then discussed the situation among themselves. They speculated that the entire incident was a combination of intoxication mixed with mental health issues. The cops transported him to a hospital. They decided to conduct the field sobriety tests in the warm ambulance bay. Don't move your head. Okay. Yeah. And you're just moving your head just enough. Okay. Just move your eyes your eyes. No worries. I'm just helping out with the instructions. Not feeling well. Okay. I understand that. Sick was spitting and and just charge me. I mean, what? Oh, I'm I'm trying to give you the chance to prove your sobriety. Okay. All right. You able to look up so we can continue? That's all I'm asking for. Just a couple minutes. I know the outcome of this. You're going to charge me. If you if you pass my test, then I'm not going to charge you. That's why I'm giving you the chance to off to pass these tests. I hear freaking voices. They have me running to the hospital, man. I understand that. I just want some help. I don't give a if it's in prison or what, man. Take me to prison. Do you want Do you not want to continue with that test, Matt? Here. Just stay right here. Okay. Just I don't want to get in trouble for [ __ ] refusing either, man. Just do the test. Okay. Or not. But I see move over here and it freaks me out. Don't move your head at all. You're turning your head. You're turning your whole head again. I'm telling you, man. Moving. It's not supposed to move. Like, there's nothing over here, right? Let me try one more time. We don't go through that, then we'll move on. It's okay over there. We're here to keep you safe. Red light right there. Look. Okay. Yep. That's fine. That's part of the garage. I'm not worried about it. Okay. We're just going to go up and down. Okay. Yep. Just lit. Last two. The officers first conducted the gaze test. Despite the cops instructing him to not move his head, Matthew kept failing. He then claimed that he was hearing voices. He was becoming increasingly emotional. Furthermore, he said that he was seeing things out of the corner of his eyes. Despite the best attempts of the officers to keep him calm, Matthew kept failing the test. Stop. I can cuff. I got cuffs. I got Matt. Matt, stop. You got cuffs. Hate me any way. Trying to help me for Matt. Stop. Stop. Tell the ground. Get his arm. [Music] Good. Matt, stop. Stop. Hey, Matt. He suddenly started to pace around and became agitated once again. He mentioned the blood test and tried to walk away. The officers tried to stop him and another altercation began. Matthew hurled insults at the cops and started to hit the wall with his head. The officers quickly brought him to the ground out of safety concerns. No. My gun, you [ __ ] He's off it. He's off it. A yeah, he went he grabbed my gun. [Music] We're 95 again, you guys. Okay. Yeah, we're good. Yep. You good? 602. We'll take you here. We'll get him in. Get him checked out. Matt, why did you do that? I need help, man. Okay, let's roll you on your side. The officers struggled to handcuff him once again. Suddenly, Matthew reached back with one of his arms. One of the officers informed others that he was reaching for his firearm. The attempt was quickly foiled by them. They were finally able to handcuff him once again. Oh, well, stop. Matt, stop. Stop trying to hit your head. Gosh, mad ice over anyway. Don't Don't sit. Just sit right there. Okay. Don't stand up. I could hurt you so bad right now, dude. Don't talk like that, man. I don't want to hurt nobody, man. I don't want to hurt nobody. Matt, listen to me, man. Just take a breath. Breathe in deep. I don't want to hurt nobody. Okay, just breathe with me, man. Damn it. Just breathe. Stop. Hey, ma'am. Just take a deep breath, bud. Just breathe. I'm not a piece of man. Always saying you are, man. Just take a breath. Take a breath for me. Okay. Hey, just stay seated. I was trying to get some help. We're going to get you checked out here shortly. Okay. Well, going through fields. He uh flipped, started pulling away, walking away towards the inside, grabbed onto him, was pulling away. He started banging his head off the wall there. Went down to the ground. He actually grabbed onto my gun. He got him puffed up. And so we grabbed a gun. Yeah. I tried. He's been cooperative. He tried disarming one of us. Um centralized in twice. Cleared from the hospital. Very good. Good. He's got a split mask on. It's pretty looped up still. You got clear from the paperwork. Yep. There you go. Search out there. Matthew started to cry. He asked if the officers were going to be charged with everything. The cops assured him that he was only going through a rough night. Matthew denied that he was trying to grab the firearm. His blood was then collected for tests and the hospital conducted medical tests. Afterward, he was released in the custody of the officers. He was then transported to jail. Matthew is charged with owi. Attempt to disarm an officer operating with restricted controlled substances and operating with pack. 19-year-old Mia Basera's intoxication led to a big car crash. Um, I believe you to be possibly impaired and I want to be able to do some tests. Okay. Should I get a lawyer or Well, I mean that'd be something you can do at a later time. Right now, I'm just trying to make sure that you were good to drive right now. Okay. So, they're simple, easy test. Make sure you are good because I got to do my part. It's my job. And if you don't do my test, I have to go off what I already have right now, which uh you smash into a pole, your car's cold, and you're showing the signs I say. The officer started the investigation. Basera stated she had no idea how it happened because it was too fast. She admitted to consuming an illegal substance at 9:00 p.m. She agreed to perform the field sobriety test. For the tests, they walked across the street to a parking lot. Adjust your eyes out. Don't move your head. Okay. Can you actually move your hair just a little to the side so I can see your eyes? Okay. I'm sorry. That's fine. All right. So, you understand the instructions? When I go this way, you keep moving your eyes. Okay, there. Just take a Indiana portion. So, for this test, why don't you do is stay your feet together, arms on your side, and then just stay in that position while I put the instructions over this guy. Okay. Don't don't do anything until I tell you to. Do you understand? Okay. When I tell you to begin, I want you to tilt your head back and close your eyes. Mhm. And I want you to Sorry. Tilt your head and close your eyes and remain in that position until you think 30 seconds has passed. When you think 30 seconds has passed, I want you to bring your head forward and say stop. But you also open your eyes. Okay. Okay. Do it again. Hold on one second. Let me just reexlain. All right. So, you're going to tilt your back and close your eyes and I want you to stay in position until you think 30 seconds is passed. And you think 30 seconds pass, I want you to tilt your head forward. Open your eyes and say stop. You understand? All right. Tilt your head back and close your eyes. Begin. How much sign was that? I counted 30. And how'd you get there? 1 2 3 4 1 2 3 4. Okay. She continuously moved her head. The next test was the modified Romberg balance test in which one have to estimate 30 seconds. The woman later did the walk and turn test and the one leg stand test. She lacked balance. Did you drink any alcohol earlier? Maybe. How earlier was How early did you drink? Like 1:00 in the morning. Like 1 in the morning. How much? 9 a.m. Like like 1:00 p.m. So it's been that long. Yeah. I drank a fireball. A fireball at 1:00 p.m. Where was that at? Huh? Where was that at? The hotel. Where do you stay at? What hotel? Hotel 6. By the mall or by Lin and McDonald? Lin. Okay. Well, I mean, are you willing to or it's kind of like a yes or no? Because here's the thing. You said you haven't drank in that long. You're going to be totally fine. Okay. On a breath test. Breath test only determines alcohol. Doesn't do anything else. Okay. I don't want to. Okay. Is there any reason for that? Just because I went to talk to a lawyer before because like I don't I don't deal with this type of stuff. I don't really know what to do and I don't want nothing on my criminal history. Okay. I rather talk to a lawyer. Do you take any prescription medication? No. Well, you're under arrest for DUI. Put your hands behind your back. [Music] Is there any proof? Is he asking? Yeah. It's my opinion that you're impaired and unable to operate a vehicle safely. She admitted to drinking alcohol at 100 p.m. which proved her statements were inconsistent. Through the test, she wanted to talk to her lawyer. The officer confronted her and then arrested her, placing her in handcuffs. The woman was charged with possession of a controlled substance, DUI of alcohol, and DUI of drug. The incident revolved around someone named Kai. In New Mexico, an officer on patrol noticed her driving into oncoming traffic. He promptly initiated a traffic stop. Uh, this is your car? Yes. I'll go get your insurance. No, not my car, but it's my mom's. Cuz my car got kind ofed up. I'm so sorry. What happened to your car? It's with my dad like No, but you said it got messed up. Yeah, like it has a bad oil change and stuff. So, okay. Is it insured? Yes, it is. Okay. Can I just have you step out? We'll go look it up on my computer and I'll get you out of here. Okay. Well, can I just look for the insurance real quick? Cuz that's what you ask for first. Sure. Sorry. I just have like really bad social anxiety and stuff. My car just right down the network. Just a heads up. I don't want to be out here any longer than you do. We walk back to my car. I look it up on my computer and I get you out of here. Okay. Okay. Go ahead and step out for me. Wait, what are you looking for? Your insurance, registration. I'm going to check your driver's license status. I'm going to do all that. Just go ahead and step out for me, ma'am. Okay. But do you have any weapons on you? Anything I need to know about? No, but that's the thing is like I don't want to step out whenever you're asking for stuff. Okay. Well, we're past that. Just go ahead and step out. I'll walk you back to my patrol car and then I'll talk to you back there. Okay. What do you go by? Kai, how can I refer to you tonight, Kai? Okay. Hey, I'm smelling alcohol. I know. How much have you consumed tonight? Like probably three drinks. Three drinks. Okay. Judging by driving wrong way on that street. I know. That's the other thing that Well, hang on. Don't cut me off. Judging by how you're driving, the smell, I need to run you through some tests right now. Okay. That's why I have you out of the car. Once I That's the thing that I asked about before. I said, "Okay, so you're just giving me for my registration." And he said, "Yes." Yep. And now you're running me for other stuff. Yeah. I'm going to run you through some tests to make sure you're safe to drive. The cop asked for her documents. She notified him that she had social anxiety. He then told her that he will check her documents. He then asked her to exit the vehicle, but Kai tried to protest. He ignored her protest and ordered her to exit the vehicle. Once she exited, the officer noticed the smell of alcohol on her. He then told her that he would conduct some tests to judge if she was fit to drive. Are we talking like a mixed drink? Are we talking a shot? What are we talking about? Well, Ram is going to be mixed drink. Cider is just Okay, perfect. Stand facing me, please. But I just want you to know that I also have very bad social anxiety. You and me both. Okay. Okay. Stand with your feet together, toes touching, arms by your side, just like I am. Hands outside your pockets, please. I'm going to have you take those glasses off. You can fold them up. Put them in one of your pockets. Perfect. I'm going to be going back and forth with my finger. I don't want you to move your head throughout this test. I just want you to focus on the tip of my finger. Only moving your eyes. You obviously have glasses, so there's no contacts in your eyes right now. Correct. Any recent head trauma, traumatic brain injuries, anything I need to know about? Uh, mental. Yes. Any of you say head trauma though? You haven't hit your head in like the last month or so? You have? Okay. What the doc say? That I had a little concussion. Okay. So, concussions heal any long-lasting effects? Sure. I don't know. I'm asking you. I know. Is there anything that would prevent you from driving that car? Okay. Stand with your arms by your side, please. I want you to focus on the tip of my finger. Okay. Focus on my finger, please. I am. You're just like trying to intimidate me. I don't know how I'm trying to do that. This is the test. I need you to take your glasses off. Okay. Focus on my finger. Focus on my finger, please. I am, but you're This is just how the test goes. I know, but you're exaggerating it more than it needs to be right now. This is just the test. Okay. when you stop and look at me, I have to redo a certain portion of the test. Okay? So, just focus on my finger. Well, as you know, as an indigenous person and there's a bunch of [ __ ] going around, I'm sorry, but it's just for me to be on my toes. I get you. Will you go back to that position I had you in? Standing with your feet together, arms by your side. Let's go. The officer then explained the test to her. He also inquired about any injuries. He then began the test. Kai was not able to do the test properly. She kept complaining about irrelevant things to the officer. Hang on. Do you want I'm going to go over some instructions before you do anything. Okay. I need to know if you have any injuries or anything that would prevent you from doing a standard walk or a turn tonight. Mental health. Um any physical injuries? Mentally? Yeah. But no, nothing that would prevent you from just walking and turning. I saw you exit the vehicle. You walked over here just fine. No complaints of injuries. No, I'm just saying PTSD, depression, anxiety. I get you. What else you want? Well, unfortunately, I'm just asking about physical. I know. I know you are. So, I want you to go ahead and put your left foot on that 4-in wide line just like I'm doing. When I instruct you to do so, you're going to do nine heel totoe steps. It'll look like this. One, two, three. But on your ninth step, you'll plant your lead foot with the foot behind it. You'll do a series of small turns, keeping this lead foot planted. You'll continue down the line. Nine heel to toe steps. One, two, three. When I instruct you to start, you'll focus on each step, counting each step out loud. You'll keep your arms by your side, and you won't stop the test at any point until you're completely finished. Do you understand what I want you to do? Do you have any questions? No, I'm just really anxious. Okay. You have zero questions? No, but I just want to tell you that I suffer from really bad anxiety, especially with generational trauma and PTSD around white people and cops. Like, it's just it's just like a whole new thing. Hang on then. I'm asking if you have any questions before I instruct you to start. 7 8 9 10. Switch around. One, two. All right. The officer then explained the heel to toe test to her.
