cold what's your
name who that all right just go talk to
my partner over
here no I'll speak with you over here so
what's going on why you just passed out
in the middle of the road right there no
it's because I was worke
but I got off kind of late there so then
I went to my friends but then I fell
asleep so then I was just barely going
home it's right here on Lumen I was just
going home do you know where you're at
right now yeah it was on Lumen and then
right here well right here is where the
old Gro station R but my home is like
right down the street what's the
address Colorado Avenue okay have you
drank anything or taking anything any
drugs or anything that would no I have
my medical car but I just smoked earlier
but where I left work how long ago was
that 4 4 yeah it's like like 8 hours ago
yeah okay do you know what time it is
right now no without looking no I never
know okay like 11: like
11: okay
uh yeah I was just down the road to my
house it's on East Colorado
Avenue okay and you know where you're at
right now yeah what's it what's today
what's today dat dat is the
16th
17th no so 22 uh you know what city
you're in yeah that's
Mexico okay cool give me a a sec can you
take a seat right there for
now I don't smell
anything it's not I could it's not it's
not alcohol I know that she said 8 hours
ago oh just
sleeping and we 15 for the 47 you do all
the paper
I'll hey Felicity right no Felicity hey
why were you
sleeping why was I sleeping yeah I do
doubles I was so tired so have you
fallen asleep on the at the whe before
no I was literally on my way home I was
going to go to sleep
you didn't drink anything no I really
don't drink that much you smoked eight
hours ago yeah I really smoked that's it
CU well I work at a dispensary so I
smoke more than I drink when was the
last time you smoked smoked like 4 hours
ago 4 hours ago
M no I was just tired cuz I've been
doing doubles for a long time
so okay do you have any medical
conditions at all no
just so is it going to be any marijuana
or anything in your car
no I don't carry Marana on me you don't
carry anything on you no have you ever
taken like meth or Fano or
anything no no is it okay if we search
your car just to make sure there's
nothing in it that would have made you
go to sleep or something like that it's
cool if you search it yeah hey you just
want to search it real quick make sure
there's nothing in it and then we'll
just cut her loose she was just tired is
it okay if we check to make sure there's
no like drugs like bomb I was just I was
really tired just search it and then
we'll just send her on
I'm sorry how long would your
shift I work 8 in the morning till 3:00
in the afternoon and then I get an hour
break then 4: till 12: at
night but today they let me off a little
early so I was like I'm tired I'm going
to
[Music]
sleep is nothing in
there I
anything all right get in your car and
go straight home thank you yeah I was
just on the I'm sorry are we with her
too it's
so okay Felicity real quick um just to
make sure you're good to go and good to
drive we're going to run you through
some f saret tests okay if everything's
good we'll send you anywhere okay okay
okay have you taken F Friday test before
no I never been pulled over okay this
officer here is walking away we'll do it
for you uh we'll do over here
[Music]
okay we'll do them right here okay this
is a pretty level right that way you're
not like losing your balance or anything
you want to stand right here for
me right here and then just face this
way towards
me and then just put your feet together
like mine arms down your side and just
stay in this position until I tell you
otherwise okay okay uh can you take off
your glasses just put them on your on
top of your head for me
just like on top cool no worries okay
you don't have anything wrong with your
eyes like any no like crazy brain
injuries anything crazy no okay so what
you're going to do is you're going to
follow the tip of my pen with your eyes
your eyes only okay don't move your head
at all or anything just look right here
and I'm going to be moving it and just
follow it as best as you can all
right my
flashlight okay ready mhm
don't move your head okay just keep
ready start again you see it uh okay
[Music]
cool you can relax right so for this
next one uh can you stand right here you
see this line right in front of you this
way or this way yeah so you're going to
face that way now you see that line
right in front of you right there so can
you place your left foot on that line
right there look you see that one right
there yeah cool put your left foot on
that line and then can you put your
right foot right in front of it touching
Heel To Toe like mine and then you're
going to put your arms down at your side
and you're going to stay this way until
I tell you otherwise okay okay cool so
for this test get back how I told you
it's on C cool yeah I get you we'll try
and finish this quick okay so you're
going to keep your arms down your side
and then I'm going to give you uh
instructions and you're going to follow
basically what I say okay and then I'm
going to give you a demonstration then
you're just going to do it all right so
for this on that straight line you're
going to take a series of small steps I
mean you're going to take nine heeler
toe steps on that line and on your ninth
step you're going to leave your lead
foot pled okay and then on your ninth
step you're going to take a small series
of steps to come back on that same line
okay the whole time I want you to stare
at your feet keep your arms down at your
side count each step out loud and don't
stop until you've or until you finish
the test okay and you said n yeah so
it's going to look like this okay it's
going to be one two three leave your
lead foot planted small series of steps
to come back one 2 3 all the way till
you reach nine okay okay again back
three back nine you're doing nine I did
three just to show you okay okay it's
going to be nine okay uh once you
started the test don't stop until you're
done okay okay do you have any questions
no no okay cool you can begin one two 3
4 5
68
[Music]
9 I'm
sorry 4 5 6
7 9
cool you done okay we'll do one more and
then you can uh you'll warm up okay okay
so for this next one you're going to put
your feet together like mine arms down
at your side and you're going to stay
this way until I tell you to begin okay
so for this test you're going to lift
whichever leg you're choosing which I
want you're more comfortable with okay
you're going to lift it approximately 6
in off the ground like I'm doing and
you're going to keep your foot parallel
to the ground okay okay the whole time I
want you to stare at the tip of your toe
keep your arms down at your side and
count like this 1,1 1,2 1,3 3 Etc until
I tell you to stop okay okay do you have
any questions no okay give me one
sec okay you can begin 1001 1002 1003
LIF your leg leab
high4 1005 1006
10078
1009
sorry 110 2011
1124
1156
178
201920 okay you can relax cool so for
this next one can you face uh the
building right there and then just give
me your hands and put it behind your
back cool and then you're going to be
placed under arrest okay why for driving
Under the Influence no I'm okay
too tight no
no uh yeah we'll get it okay we'll just
go to that second unit over there over
there you don't have anybody that can
come pick up your car or anything that
way we don't have to tow it we can call
somebody for you and they can come pick
it up I baby dad he's down the street
yeah okay but he doesn't have his phone
on so okay
uh is there like a like house one he has
or something cuz on my phone I can come
through uh Bluetooth audio okay cool uh
you don't have anything that's going to
like stick poke stabinger me anything in
your pockets anything no no okay you can
check me do you want your purse from the
car or do you want to just leave this in
your
car can I it one more time uh what is it
Nick yeah it's ni hit it then start that
time okay yeah go I'm
sorry you have the
[Music]
what consent
yeah just turn I'm just going to
make okay no one pick the car uh we're
going to call yeah okay you seat
please and you said his phone isn't on
no but I can call him from my phone on
Bluetooth
audio okay you think so let me take two
reps
apprciate hey you're still going to help
me though yeah okay I'm going to need
you to uh open your mouth really quick
I'm just going to make sure you don't
have like uh gum anything can you look
up for me cool can you lift your tongue
and then go like that with your gums
like like with your tongue
cool but yeah if um he can get my phone
I can call my 980 you start my
D I'm sorry if he can get my phone I can
call him on Bluetooth face audio so you
can come get my car cool we'll figure
that out okay like just cuz I don't have
to tow it and then you pay a bunch of
money buch money I've never even got in
a toil before so no okay
ever okay so for this I'm going to read
you something okay okay that's fine so
it says listen to me I'm about to tell
you something important you're under
arrest for like I told you DWI right mhm
uh the New Mexico appi implied consent
act requires you to submit to a breath
test to determine the alcohol content of
your blood after you take the test take
our test you have the right to choose an
additional independent test uh if you
choose a take this in additional
independent test you have the right to a
reasonable opportunity to arrange for a
physician uh licensed nurse or
laboratory technician or technologist
who is employed by a hospital or
physician of your own choice to perform
an additional chemical test okay the
cost of this additional test will be
paid for by the law enforcement agency
uh do you agree to take our test or do
you have any
questions either way I'm going to have
to take okay yeah so yeah you'll take
the test yeah okay I mean I don't know
how that works like it's the one like
you've seen on TV or anything or you
just blow into it and then however much
like cuz I can get build out fast so I'm
like no yeah but that's just to I know
I'm just asking if you're willing to
take the
test cuz either way you're going to jail
with it's just if you want to do the
take the test it's all I'm asking so
it's a I guess you're not I mean either
way I'm wrong but if I take the test
well everybody gets arrested for DWI or
something I'm like I get what you yeah
that's cool whatever so yeah yeah okay
cool we'll start calling your dad that
way uh on your phone or will it work if
I call him on our phone you bring it
over here so I could show you how to do
it cuz where's your phone um [ __ ] it's
in my car no wait it's right here
was do you know your dad's phone number

he's at my house so your baby yeah it's
right here okay what phone number oh you

I'll turn on the heater and all that
once we
[Music]
good good thing you woke up cuz we were
about to break your window good thing I

your window oh no that would have suck

your ID from the car it was in the
center console

way you can use it for the tow sheet and
