labor that's what this is about but I I have the separate lawsuit about the doctor that actually was there for the labor this doctor is about how when she paid for independent autopsy he was posting the pictures of her baby on Instagram and video of her baby on his Instagram which is now private by the way because I did go look um and he tried to say it was for educational purposes and I'm like that's not where you share that stuff we're not we're not medical students like The General Public is not medical students so and she did not give them permission uh or him permission so we're gonna go over her lawsuit and um what she and her family feel about it that would I would think so sharing right that would be a probably a HIPAA violation saw that on the news this morning yep yep yep so we're gonna go over her lawsuit uh let me get it ready oh this man this man he and apparently that's what he does like this this is not the first time but they I'm sure you don't go searching for your Jackson Gates the doctor and Gates rapid diagnostic laboratory of Atlanta uh doing business as Medical Diagnostic choices okay make sure I miss y'all okay okay all right so this is a complaint in demand for a jury trial I'm gonna read my highlighted Parts because I also found nesto's other Instagram account nasty nesto um and I wanted to go over that with y'all so I I'm reading the highlighted Parts because I promise it'll give you a good idea plus as I scroll you know that's why it's up here for y'all to take screenshots if you want and again this is publicly available information so I all of these are allegations I am reading directly from a publicly available document okay all right um so trayvion Isaiah Taylor Jr also known as baby Isaiah was deceased at the time of his delivery on July 10 2023 on July 12 2023 Jessica Ross signed a contract with defendant Dr Gates the contract call for defendant Dr gates to conduct a postmortem examination of baby Isaiah for a payment of twenty five hundred dollars from Jessica Ross baby Isaiah had been decapitated the contract did not give defendant Dr Gates or NDC permission to release the postmortem examination its results photographs or video images taken during the post-mortem examination to the public in any format defendant Dr Gates never sought permission from plaintiff's Jessica Ross or trayvion Taylor Senior to video record the postmortem examination of baby Isaiah plaintiffs never gave defendant Dr Gates permission to record or make available to the public via social media photographs or videos of the post-mortem examination of baby Isaiah on July 14 2023 defendant Dr Gates uploaded a video to his Instagram account which that which is identified as Dr J Gates and that's where I left myself a note to say again his account is private now um of course it was not I'm sure it was not private well I don't know if I won't say that I'm not sure if it was it wasn't private like people that he accepted to follow could see it or if it was just public and if he just was scrolling you'd see it I'm actually not sure so um thank you all for liking the video uh this video showed in graphic and grisly detail of postmortem examination of the decapitated severed head of baby Isaiah Dr Gates subsequently removed that video but then on July 21st 2023 posted two more videos on Instagram from the post-mortem examination of baby Isaiah these videos show in graphic and grizzly detail post-mortem examinations of the head and body of baby Isaiah the plaintiffs were informed about the posting of these videos on social media resulting in the plaintiffs experiencing feelings of shock anger humiliation and outrage okay Karma Girl go take care of your chickens yes ma'am gotcha gotcha um planus and thank you for listening to me in the background uh plaintiffs through their attorneys sent to cease and desist letter to the defendant on August 10 2023 directing him to immediately remove the videos from social media so um count three is intentional infliction of emotional distress by defendants Dr gayson MDC is this so-called doctor's license suspended I don't know yet because I don't know when just the complaint is filed I don't know if that's enough for them to because you know it probably has to actually go through or he'd have to have other complaints maybe that's in um progress I um I am going to look to see what his status is later but I I know them just filing I'm gonna guess it's not enough for his license to be immediately revoked although you know obviously they have picture and video proof it happened I'm sure because they had to see it somebody saw it they were notified so I don't I don't know Linda but I do I personally believe it should be I do that is a HIPAA violation okay yep yep um okay so this is the now a lot of it is repeated so I'm trying to highlight some of the key points that I found key obviously and if something else could be important to someone else that looks at this and if I repeat a phrase I'm sorry but obviously you know that's the the nature of it is Torah you know they repeat certain things so I apologize if I sound repetitive but uh y'all gonna get through this The Compassion is definitely lacking in this doctor and also in everyone that attempted to cover this up yes pumpkin pumpkin and I just want to again reiterate and we will go through the lawsuit against the doctor that did the delivery this is a different doctor this is the one that performed the independent autopsy there is a separate doctor that we will go over on a different day if um about who oh my gosh about how it actually went down on that day when she was actually in labor um the display of these postmortem videos of baby Isaiah's brain and other organs was extreme and outrageous Defenders knew or should have known that the public dissemination of these videos would cause the plaintiff's severe emotional distress anxiety shock and embarrassment yet he did this anyway with no regard for the emotional damage his actions would cause the plaintiffs as a result of defendants intentional Reckless conduct the plaintiffs have sustained and continued to suffer from profound emotional pain and psychological duress and damages under the theories of agency and vicarious liability defendant MDC is liable for the intentionally torches actions of defendant Gates oh thank you thank you all for liking the video If you haven't gotten a chance please like the video hate talking out loud talking out loud is also a content creator there are probably broken a second time yeah like this this definitely broke them a second time in my opinion as well Shan like that's ridiculous um let me see okay count for defendants invasion of privacy through intrusion into Private Affairs the public social media release of videos of the post-mortem examination of baby Isaiah was and is embarrassing to the plaintiffs and was damaging to the preservation of the Dignity of hide it and to convince them to cremate the baby before they actually got to see their baby you know so yeah um no they're as far as I know I have not seen anything stated that they would be related in any way um let me see so count five fraud by defendants Georgia statute ocga 51-6-1 provides for an independent Civil Right of action for fraud accompanied with damage more specifically the statute and case law establishes the following conditions that must be established to Prevail in such a claim that the defendant made the representations that at the time the defendant knew the representations were false that the defendant made the representations with the intention and purpose of deceiving the plaintiff that the plaintiff reasonably relied upon such representations and that the plaintiff sustained the alleged loss and damage as I'm sorry and damage as the proximate result of the representations having been made in present in the present case Dr Gates as a medical pathologist had a position of trust within the community which contributes it which contributed to the plaintiffs trusting him these pants have gone through tremendous grief and Trauma from these medical professionals they have like it's just a hit after a hit at this point the plaintiffs reasonably placed their trust in Dr gates to conduct a postmortem examination in a dignified Manner and according to the contract they signed Dr Gates knew it that at the time that he was engaged to do the autopsy on baby Isaiah that he was not contracted to videotape the autopsy Dr Gates knew at the time that he was engaged to perform the autopsy on baby Isaiah that he was not contracted to to post videotapes from the autopsy the plane is reasonably relied upon such representations by Dr Gates as reflected in the autopsy agreement namely that Dr Gates's services and functions would be limited by the Four Corners of the agreement the plaintiff sustained profound humiliation embarrassment anger outrage anxiety and emotional trauma as the proximate results of the misrepresentations made by DR Gates regarding his performance of the autopsy on baby Isaiah the Fitness Gates Instagram page shows a history of his posting photographs and videos of his post-mortem examinations of other uh this oh I can't get this word I want to say descendant but that's not what they're saying I'm gonna say decedence based on the contents of his Instagram page defendant Dr Gates had every intention of videotaping the post-mortem examination of baby Isaiah but withheld this information from the plaintiffs and never sought their permission to do such videotaping good morning Professor Damita Anita Baker Joe thank you for joining me and why would he post this baby these folks have serious issues right and that's why I put and as it was quoted in other articles it's Cloud chasing there's no reason to do this there's no reason to do this except clout if you oh thank you Shan if y'all do want to provided by law this actually be Tried by a jury that judgment be entered in favor of the plaintiffs and against the defendant in an amount in excess of ten thousand dollars for damages all costs be taxed against the defendants jointly and severally including attorneys fees that punitive damages be authorized and awarded to plaintiffs and against the defendants and the plaintiffs have all other relief as this court deems just improper this first day of September 2023 and that was filed by their attorney Roderick Edmond so that's that is where that's what if y'all if you see about this doctor I mean the title that that title is not clickbait when I see the Articles he literally was doing it but yeah if you see it um that's what he was doing it's just ridiculous it's so sad and disgusting for doctors who we place our lives in their hands we should not have to become medical professionals together what we do uh together what we deserve and pay for right right right I'm sorry to get what
