called to a local hospital regarding a reported battery incident a security guard had witnessed a wife repeatedly slapping her husband in front of their one-year-old baby before confronting the suspect the officer spoke with the nurse and security guard to confirm the wife's actions and ensure the child hadn't been harmed be EAS there's people I didn't got it hello how are you good how you doing so we're kind of in a pickle here okay technically I can't show you the video without a court order shut up okay okay well I'll let you see it cuz I know you need to so let's let's not do that girl's temperature okay and and things seemed very tense between the two of them that was after we knew all of or saw all of the hitting so you've also viewed the footage yeah okay cool my nurse who was out so we have cameras like this out where we set um and she saw it and she like slapped me on the arm and was like oh my God and so I came back here to watch it are these audio and video just video and you could get the footage from me oh yeah okay cool that that wouldn't be an issue at all okay well um I've seen her mood is very roller Co like after the first hit she was smiling like it was a joke kind of and then after the five hits or so she was like gritting her teeth and seemed very agitated do we have the ability to get her information right now so that I can have it before we go in there or before I go in there and she stay acted like she was mad for a good 30 45 minutes MH and then it went back to smiling and then it would go back to the roller coaster be smiling for 5 minutes pissed off smiling do you have met on your computer when she was hitting him the child was in the room just like she or he is now yeah just sitting right on the bed okay mom's back was turn turned to the kid while she was heading so technically no one was watching her at the time gotcha all right well I'm going to go talk to him see what's going on in there if she gets uh combative in there I'm going to have another person come over here so which which door is easier for them to access me and I can call and let just to let them in okay so that way there's no issue that's perfect aggressive Manner and she did in front of your child in a public setting to where other people have it videoed okay so even if you don't want to press charges she is going to she's going to be placed under arrest for simple battery simple battery Family Violence okay I know this seems like a very minuscule thing for her to be arrested for it's a really big deal okay she did it here in the hospital she did it in front of your child you know like I want press I got you and that's why I was explaining the it's so here's here's why all right the state of Georgia went ahead and put this into effect several several years ago that if we have a family violence relationship and we have evidence of things getting physically of a crime then we make that arrest because say it was reversed so you're in here hitting on her she says I don't want to press charges I don't to press charges worst case scenario y'all go home things get worse and it could be that way with you as well if she keep saying things on your phone like that things could escate we don't live together I understand that but due to the fact that y'all technically right now are married you know you're going to the divorce you do have a child together those two right there and you've lived together I mean that's three Family Violence that's three three family bence relationships right there off the bat when can she get out so and she's going to go with me uh tonight um and then first thing in the morning she's going to either sit in front of a judge or teleconference a judge okay they're going to talk about the fact that you'll have a kid together they're going to talk about not put hands on each other I mean I know this might sound Elementary but these are things that that they are going to sit down and talk to to her about what they're going to do is they're going to call you on the phone they're going to say hey we're meeting with her here's what's going on on you need to make sure that you were able to answer your phone between the hours of 8:00 a.m. and 12 so just that 4H hour block was roughly when she's going to see a judge okay so the judge is going to call you she can't be released until he makes contact here or she makes contact with you okay so that's why I'm putting the emphasis on make sure you got your phone she got a bail or live no so so so she's so she will sit in there until she sees the judge and then she'll be released okay so it's not like I'm going to drop her off in an hour later she can get out she has to see the judge for a Family Violence crime okay the law enforcement official calmly managed the situation clearly explaining the legal consequences to both spouses when she was hitting you open hand closed hand I I just okay I just turn my head so per the video they they were telling me that it seemed like open hand from the video and so I just wanted to run it past you does that seem like something that probably happened I was punch okay um what was she saying anything when she was hitting you or she was just reacting to something she saw and and she overreacted and so stuff happens this isn't going to be the end of the world um it's not like she's going to be a convicted felon or something crazy right but this this is something that we cannot allow to continue um especially when we it's it's in a public area where people can see it right and especially in front of your a child I mean I mean you got to put her in handcuffs pleas yeah she's have to go in handcuffs me I mean that's she's under arrest so so she's going to have to go to handcuffs um here's what uh I would like to do um it's obviously your your dad right okay do yall have any current custody issues I mean she gets them through the week and I get one night through the week okay and then but nothing like you can't be alone with the child stuff like that okay other daughters with her mom okay other daughters with her mom okay I mean I might have to go to her call and get the car seat out cuz I don't have mine so the the car's going to stay here so if she's fine with the key staying with you cool I mean she can't take her car with her you know what I mean did y all ride together no okay so her car will just stay here then okay um you can make the decision of however you want to do the car situation but the car will stay here and then y'all can come get it tomorrow or her and someone else whatever can come get it tomorrow okay look man I I know this is a crappy situation especially when youall are just worried about your kid but but you kind of you're going to see a judge either in person or over teleconference okay he's going to he's going to talk to you about some stuff he or she's going to talk to you that judge is also going to call him they're going to have a conversation over the phone and then they're going to just go over some stipulations with you and try to make sure this doesn't happen anymore okay okay if you'll just set your while ago yeah a long time I did good for a long time so right now obviously my I have my dispor is running you for like prior thefts or whatever okay there's something called aad which is adult diversion which uh is what happens and this is in Li of being arrested okay but what's going to happen is if that is the case um you'll basically I'm going to give you a piece of paper and it gives you a date you have to go to the jail and they have to set something up with this program to do like community service or something that's in Li of going to jail okay I don't know if that's the outcome I'm going jail no I didn't say that I'm saying there's two options I'm my dispatch is running that right now okay so the option is obviously jail right or there's a diversion program that I'm seeing if you're eligible for okay so I need help bro IGN my family's calls like ignore them because it's like just feel a shame bro right so good I just let everybody know dude I'm not trying to like specifically take you to jail okay I'll tell you what though a lot of people that we stop here do go to jail not not not because of you know they have past history too right they right but so for if you are eligible like you're going to leave today on your own okay but hear me out I'm going to give you the homeless Outreach I'm going to give you the homeless Outreach officer number okay and he has a social worker and they have an array of resources to help you drug treatment whatever it is housing okay all right but I'm waiting for that okay so I don't see any prior thefts do you have any where about Oklahoma any prior theft convictions there no like do you live in any other states Bible school there okay any other states any convictions of theft no this is the first time ever being stopped okay so if it works out in your favor then um I'll be a have the pril me out for you for my laptop in the car and then we'll have to go from there okay so let me just give me a couple minutes it was it I was down town like some some something I had a few drinks and I fell asleep with the pure yeah they came out like woke me up and they started giving me a hard time and you're refusing to leave I said I'm not refusing to leave man I leave like where do you want me to go right were you homeless then too yeah okay reality hits hard as the consequences of past choices catch up leaving JN grappling with an uncertain future you were convicted though for that right for trespassing like you were like it was guilty conviction right it wasn't like anything like that anything else cuz my dispat said that it was guilty conviction oh just said I didn't have okay um because of that you're not eligible okay that doesn't mean I'm not going to give you the person's number okay so you do unfortunately all right but that keeps you away from drugs though right but you got to get yourself back okay and I'm still going to put that number in here okay for that number just give me a sec okay there's no way you can write me a thing like to a fear in court no can't do that I wish I would that's what this was going to be but I can't do that all right just give me a couple minutes okay car I'm saying you're not eligible because there's for that program right there's different eligibilities right so I I'll show you what it says here because you can't have so many convictions of misme or felonies and quite frankly I don't remember the actual time frame it's either 2 or 5 years but I need to just take a quick look so I one one thing right so it says here um no misdemeanor convictions within the last 2 years right so that that would that conviction in October would would not make you eligible all right so and also I mean you're also um you know kind of homeless so the reason why that's not going to work okay but I'm still going to give you paperwork all right a couple minutes so I can finish this I'm just going to do my Viper okay real quick yes you good yeah okay like I said these people I'm going to give you their number for is going to be able to help you with stuff like that okay you just got to you got to ask I I give this number to a lot of people and see what they're actually they're putting a bunch of all sorts of stuff they're they're they're lacing it even you know things that you think that are like their press so you got to really I'm not advocating for you using drugs but you have to watch out for that despite setbacks the officers extend a hand of support pointing John toward a path of recovery and Redemption I'm going to put this in [Music] right I I was really trying for you with that that program but there's other than that program I can't do anything to help you other than that like dude I didn't even I didn't even do anything Pete so I don't know the outcome you know of whatever happened there and what they did you know what I mean I haven't been charged for drugs for anything other than other than when I slept in my car at the beer they they gave and arrest me for chess passing uhhuh like other than that like I I was doing great a year and a half ago man like or not 2 months ago man I was doing great like I just I made a bad mistake man now like I addiction dude that's not what I want you to do I I I I understand and I'm not saying you're a bad person I'm just saying that my hands are tied when it comes I was trying to get you eligible for that program but I you know you're not eligible no we when you're not eligible for that we we hardly do notice who appears it's it's either that or it's jail you know and I was trying my hardest for you but can you please try to see if you you do a notice to appear can go to court car I can't do a notice to appear man that's you know why we we just don't do that here as an agency you know plus you're homeless so that's another factor that comes into this program right so there's a couple things that are not in your favor but I you know I'm I'm trying for you not being like a dick or anything my everything you'll be able to come back here and get your car is that is that out in the parking lot John a couple numbers um you'll be able to write them down at the jail okay they'll let you even actually my phone to they have plugs they'll be able to they have Chargers there you open it up and use it there too okay oh you didn't know that they let you open them up and that's what I heard okay sure if they does and they don't have I have nothing you get a charger in here know I'm saying if I dies in there and they won't let me to do that they'll let you
