[clears throat] Okay. Um, I just need to give quick context about this video before we go any further. So, we're watching portions of the arraignment and testimony in the East Point McDonald stabbing case. The defendant, Apheni Badu Muhammad, is accused of fatally stabbing her manager, Jennifer Harris, who was 39 years old on July 10th, 2025. This live stream is for educational andformational purposes, as the original court proceedings are presented. What you're seeing is public court footage and we are watching it together in real time with live commentary, discussion, and viewer interaction. I am not an authority or legal expert and I'm not here to explain or teach the law. The goal is to observe the process here, what is said in court and react to it as it unfolds the way the court and the public are allowed to view it. I'll be pausing at times to add commentary, read chat, and provide context. And I'll also be highlighting viewer comments on screens on the screen throughout the live stream. Um, and obviously these are serious allegations with real people and all right, so let's go. So, first we're watching when she appeared after she actually um shower, sorry, after she stabbed the manager. This is her appearance in courts or in, you know, she's in jail. But we're watching that first. Then we're going to look at the court uh where some witnesses testified. Please approach for a swear to. Please raise your right hand. Do you swear that the information being provided is true and accurate to the best of your information, knowledge, and belief subject to penalties of perjury? >> I do. >> Put your hand down with regard to the defendant, Afani Muhammad. Please set forth a factual basis for the warrant request. >> Yes, your honor. 71025 McDonald's employee offending Muhammad staff McDonald's manager Jennifer Harris multiple times with a kitchen knife at the McDonald's restaurant at 179219 mile. Harris was not armed at the time and died of her injuries. Prior to the stabbing, Muhammad was sent home by Harris for not performing her work duties and told Harris, "I'll be back." Muhammad was arrested on scene and the knife was recovered. Muhammad admitted that she intended to kill Harris and stated that after she was sent home. Uh she drove to a nearby park, decided to come back and stab Harris with a knife uh that she had inside of her vehicle. When Muhammad returned to stab Harris, she entered the back entrance with a hood mask over her face in an attempt to conceal her identity and attempted to flee the scene after the stabbing, but was stopped by an armed customer. And the requested charges are murder in the first degree, count two, dangerous weapon carrying with unlawful intent, and there's a habitual second notice offense. Is that correct? >> That is correct, your honor. >> The warrant is being signed, and we can proceed to arraignment. >> Thank you, honor. >> Calling file number 25354, people versus Afani Badu Muhammad. Council appearances for the record, please. Good afternoon. Sean Hay on behalf of the people. >> Thank you very much gentlemen. Please d this honorable court on behalf of Mr. Mohammed which who does appear is >> your name please. Ma'am >> Muhammed. >> Very good. You're here today for arraignment on the charges of murder in the first degree premeditated count two carrying a weapon with unlawful intent and a habitual second notice. Mr. Lacata, how does your client wish to proceed? Thank you very much, your honor. At this time, my client is asking the question not guilty plate and as mayor said for a probable cause conference in the preliminary exam. I have advised my client of her rights as well as the charges against her and the potential penalties. We are ready to proceed on those trials. >> Very good, ma'am. Do you understand the nature of the charges against you to your satisfaction after talking to your attorney? >> Yes. >> Very good. I will go ahead and enter a not guilty plea on your behalf. Um, are you requesting a court-appointed attorney? >> Yes, >> I will appoint an attorney. We'll set this matter for a probable cause conference on July 23rd, 2025 at 1 p.m. The preliminary examination will be on July 30th, 2025 at 1:00 p.m. Uh, as to bond um, Mr. L >> for college for physical therapy uh, degree. Your honor, there are obviously there are some disturbing facts in this particular matter, but there are facts that haven't been uh brought out yet and and my client is extremely anxious to have those facts brought to light during the pendency of this case. Um she was in a extremely abusive uh relationship that was not only mental but physical uh that involved uh alcohol issues which is where the habitual second stems from and her prior record. Um your honor, my my client is a a helpful person. She's a giving person. uh she's actually is credited with saving a life because of a 60-year-old who had skin cancer that she may go to the doctor to find out that that's exactly what it was and that person is doing extremely well right now. Um I understand the the facts that have been laid out today uh in the uh the warrant but at this time your honor uh we are asking the court to consider a bond in this manner that is appropriate that my client can meet uh so that she can meet with her attorneys and prepare her for defense in this manner. Thank you. >> Thank you on behalf of the people. >> Yes. Thank you your honor. Uh pursuant to court rule, the court is well within its authority to grant no bond involving any case involving murder. In this case, we are requesting no bond for this defendant. Uh also provided within the court rules are certain factors for this court to consider when determining whether to grant any bond at all. And in this case, we are requesting no bond. Uh first of all, the court can consider whether or not this defendant is a threat to the community. Uh she entered a public building with other individuals, other employees that were present. uh she produced a uh a weapon that was a knife longer than 3 in and she stabbed the victim multiple times up to possibly as many as 15 times eventually causing her death. There were other employees that were present at the time, some of which attempted to help the victim after the stabbing occurred. Uh that alone is enough to show that there is a threat to the community. She then ran from the building uh to her vehicle presumably with the intent to flee from the scene. She was stopped by a helpful bystander. You're also able to consider the likelihood of conviction in this case. Given the facts as laid out by Detective Showers and the information that the prosecutors have reviewed in order to charge this defendant, there is a very high likelihood of conviction. And then finally, the defendant does have a prior instance of at least one that I'm aware that involved a stabbing uh similar obviously to the scabbing that occurred in this case involving a knife. Um so >> okay. So uh just to give [clears throat] some some comments of some things I saw on social media. What was disturbing was that there were a lot of people that were like, "I see why she stabbed that manager." Um, some people get in positions of power over you, and they think that like they can talk to you any kind of way, treat you any kind of way, and they can't. But, um, it does not mean you take their life because they they do they try to get to you. from the standpoint of Apheni, Apheni, the one that's on trial, she her social media, and I would suggest going to Leah Gordon's channel to see the social media clips put together that that um may not still be up, but Leah Gordon already had them by that time when the stabbing had happened. and she was in her camera talking about, you know, people are this people are trying to mess with her and um you can only take so much. So, I do believe that. Now, here's the thing. I don't know about her job performance though, but I still believe for her she felt it was true that she was being mistreated either way. And because I know there's sorry managers and sorry supervisors out there, you can be a okay person and be a horrible manager supervisor at the same time. You could you could maybe be picking on people. I don't know for sure if she was picked on, but I know that woman shouldn't have lost her life about it either way. Um, so the manager that she um stabbed to death was not [clears throat] related to her. She is just the manager and this woman that's on trial is the employee that took that manager's life. when they were talking about the relationship stuff that is a prior relationship that the attorney tried to bring up that she was in that was abusive because she had a similar charge about stabbing and stuff like that. Um, also there was some what Leo Gordon had put up there. there was some stuff of her in her room and there's this older guy that I don't know if he's a tenant in her same building or something, but he definitely has like some financial weirdness with her because he was like giving her money or lending her money, but then he wanted things in return from her. So, she had a lot of stressors. She didn't obviously she didn't have a lot of an income. Then she's got this older guy trying to take advantage of her. Um and she was either getting sent home for good or getting fired. But either way, her last [clears throat] straw was with the manager um that she felt was like talking to her poorly and messing with her money that she already didn't have a lot of. And then she got this older guy that's pressuring her about stuff. First he would give her food and money, I think, and then he started asking for other things. Um so they're going to describe hopefully the witnesses that we'll see will describe what they saw at that time because that's the whole point. Um, so I don't want to do too much because I don't want to mislabel details on accident. But that's kind of the background of it. She's already had a disturbed past. Um, again, I don't know if that manager was a saint. Most people are not saints, but she didn't deserve to die for being not the best manager when basically everywhere we work. That's why there's so many Instagram accounts and Tik Tok accounts that go viral for everybody sharing the same woes of having to work under people because a lot of people are that way. It doesn't make it right, but they shouldn't die because of it. >> Given all of those factors and given the fact that this court does have authority to uh give no bot to defendants charged with murder, I am asking at this time for no bond in this case. >> Thank you, councel. The court has reviewed the charges and the circumstances surrounding this case. The defendant is fe facing various serious charges including murder in the first degree which is one of the most serious criminal offenses in our state. Carrying penalties up to life without parole. Additionally, carrying a dangerous weapon with unlawful intent further underscores defendants's potential threat uh to public safety. Defendant has a prior criminal record out of Virginia for malicious wounding. It was actually a felony malicious wounding that was uh reduced to unlawful bodily injury uh concerning a stabbing and I that is what gives rise to the habit habitual second and uh in determining bond the court must look to the factors outlined in Michigan court rule 6.106 number one the seriousness of the offense and the danger posed to the community. The charges here involved uh a violent crime with a weapon indicating a substantial risk to the public. The court finds there is a significant threat to public safety and therefore the bond must reflect that risk. Number two, the weight of the evidence against the defendant. While the evidence is not fully before us and the defendant is cloaked with the presumption of innocence, the nature of the charges along with the prior criminal history suggests that there's substantial evidence against the defendant. defendant's criminal history. The defendant has a vi violent criminal past. The history supports the court's concern that the defendant may engage in further violent conduct if she is released. The defendant's ties to the community. While the defendant is a relatively young at 26 years of age, there's no indication that she has any significant stabilizing ties to the community that would ensure her return for court appearances. Without these ties, the court is concerned about the likelihood of flight. Number five, defendants's risk of fleeing or failing to appear. Due to the severity of the charges and the habitual offender status, it makes the defendant a high risk for flight. The court finds that this factor weighs heavily in favor of a high bond amount. Substance abuse or mental treatment. Although there are no reports at this time suggesting that the defendant suffers from mental health or substance abuse issues that would mitigate the risks posed by defendants's release, the court is after considering all of these factors going to be setting bond at 25 million cash only with conditions. If the defendant is able to meet those conditions, she must be on a GPS steel cuff tether. She is not to leave the state of Michigan. She is to report her address within 24 hours of um she must report any change of address within 24 hours. There would be stringent um daily contact uh with community corrections uh as to her whereabouts. She also uh would be required to uh have alcohol and um drug testing as condition of her release. there would be no contact with the family of the deedent, any witnesses, she is not to return to McDonald's. Um, and if she is unable to post the $25 million bond, she will remain in custody um, pending further proceedings. And that concludes this matter for today. We will see you back here, ma'am, on July 23rd at 1:00 for your probable cause conference. >> Okay, so Oh, hold on. Sorry. Okay, so that's just part of it. I'm going to give y'all a quick timeline and then we're going to go to her where some of the witnesses testified on November 14th I believe. So July 10th, 2025, that's when the stabbing occurred. It was 8:00 a.m. This is what I'm getting from articles, so hopefully I'm not misquing anything, but it was at 8:00 a.m. a 3 when 39year-old McDonald's manager Jennifer Harris was allegedly stabbed by coworker Aphini Badu Muhammad at the East Point McDonald's. Police were called to the scene and Harris later died from her injuries. July 11th was what we just watched where they were talking about her bond. That was her that that's what we were looking at. Sorry. And then July 23rd, they had a probable cause conference and a probable cause conference was scheduled following the arraignment to assess the evidence and next procedural steps. July 30th, they had a preliminary examination with the district court and it was scheduled to determine if there was enough evidence to bind the case over to circuit court for trial. Then there was a competency proceeding and court appearances. It was scheduled for September 3rd, October 8th. She appeared in court including hearings related to her competency and procedural procedural scheduling. And then we're going to November 14th where since I didn't watch this cuz I wanted to watch it with y'all. I don't know if the portion that I have shows any of this, but when they went when they were in court, the victim's family brought a knife and tried to stab her. So, we're going to look at this quick quick news clip and then we're going to the court. But I'm not saying the court will show it. I'm just saying I'm showing you where they talk about it. And this happened the same day of what we're going to watch in court. So, okay, here we go. >> For joining us at noon, I'm Pria Man. Things got heated in court today. An altercation brings the hearing for Afani Muhammad to a standstill. She's the woman accused of stabbing her McDonald's manager to death. That courtroom is now closed off. Lauren Costik is following today's proceedings. Lauren, what can you tell us? Well, Pria, we knew this was going to be a contentious hearing. Before it even started, the judge said there was a fight between a family of the victim with some of them being escorted out. And then just a little bit ago, we watched as this video of the incident was being shown, a very graphic video. And we are told one of the family members, they went out and they retrieved two knives and then attempted to bring them back into the courtroom. And because of all this, like you said, the public is now banned from attending this hearing. Just the media is allowed inside. So let me catch you up. We know that 27year-old Finey Vadu. >> All right. Now, we're going to the actual inside the courtroom and they're uh we're going to go with where they started with where the news posted their court proceedings for the witnesses. So, that's what I'm starting with. I obvious heard the introduction, I'm like, "Okay, I'm missing some witnesses. Hopefully, I'll be able to find them at another time." But, we're starting with the witnesses they have in this one. And it's it's a pretty long thing. I don't know if they're actually going to be talking for this long, but it's a long um video. So, all right, we'll get started. >> Catherine Ome 53823 on behalf of Missain. >> Very good. Uh you may be seated. Um we left off with the medical examiner's report that was tendered to the court. My understanding is we have one more witness. Is that correct? >> That's correct, Judge. >> All right. You may call your witness. people call Lieutenant Alex Hollish who was just here. our victim advocate uh in the courtroom, uh myself, Mr. Urban, uh the public defenders office, uh and some camera from media, and of course your staff. >> Thank you. >> Friends will attest to that as well, your honor. Please raise your hand. You swear that the testimony that you are about to give is the truth, the whole truth, and nothing but the truth. So help me God. >> I do. >> Put your hand down. Take your name for the record. >> Detective Lieutenant Alexander Hollish. Alexander Common. H O L I S. >> Thank you. You may proceed. >> Thanks, Judge. Uh, where do you work, sir? Uh Eastman Police Department. >> How long have you worked there? >> Uh about 18 years now. >> And what are your what's your current uh rank and duties? >> Uh currently I'm a detective lieutenant. I'm in charge of investigative division for the department. >> What were your duties? Uh honor about July 10th of 2025. >> Okay. Now, since I haven't heard him speak before, if I miss anything in the chat, I apologize cuz I'm going to try to focus and take my notes on what he says in case we do get the chance to come back to these things later and we can kind of do a recall back. Um, my notes are all over the place in all kinds of notebooks, but I still like to at least do the exercise of writing it down to help me in case, you know, we keep going deeper into this. Um, so yeah, if I miss anything or I don't reply, I'm just trying to keep track of a few things, but I'll try to highlight your comments and thank you I am unique for the super chat. I appreciate it. >> I was uh in the same capacity as a detective. >> And uh at some point in time uh did you get contacted to conduct an interview with a suspect? I was about uh by then it was uh probably shortly after 8:00 a.m. >> And at that point in time, what did you do? >> I made contact with uh Miss Muhammad um who was in a booking room. >> And when you say Miss Muhammad, do you see uh Fanny Muhammad in the courtroom today? >> I do. >> And could you identify her for us, please? >> Uh she's uh sitting to the left of me uh far left. She's wearing a jumpsuit issued by Mcome County Jail. Her hair is different uh since but uh at a time she had a red hair but I do recognize a facial features. >> Let the record reflect that uh Lieutenant Hollish has identified the defendant. >> So noted for the record. >> Um so where did your interactions take place with the defendant? >> Uh first she was in a booking room uh and she was wearing a uh like hooded jacket uh that I observed had blood on it. So I asked her to remove that jacket. And after that uh I had to call a female officer from Sinclair Shores because we did not have a female officer working at the time. Uh she walked to the uh private area where um female officer from Sinclair Shores uh observed her take off her clothing that we took uh as evidence and gave her our uh jail clothing. >> And after that what happened? Uh after that I uh spoke with her at um at our interview room. >> Tell me a little bit about that interview. >> Uh it's a small room. Uh has pretty much table, three chairs. Uh Detective May, he's my partner. He joined me during the interview. Uh it's equipped with a camera and microphone. Uh there's a small file cabinet and that's it. And before uh interacting with her as far as talking about things, uh was there anything that you did first? >> Um I observed dry blood on her. >> I think the I think this is the prosecutor most likely cuz he would be a witness for them first. I think the prosecutor's making sure he read her her Miranda rights. That's what I'm thinking. He he wants to know. Uh before we continue cuz I didn't want to cover up the caption since I don't know how the audio is on y'all's end. Um, but Jamie said from what I remember it was a break or something and during the break the daughter went to her vehicle and got a weapon and attempted to get back into the building with it hands and I asked her if I could collect it. Uh, Detective May read uh, Miss Muhammad her uh, rights uh, as far as uh, the right for us uh, if she would wave her search rights search. Uh, she agreed. She signed the form. Uh, I used the distilled water and a cotton swabs uh to collect dry blood from each of her hands. >> And as far as her her rights that were given to her by Detective May, were you there at the time that that occurred? I will >> um approach >> you may approaching with people's proposed exhibit I believe is six. >> Uh that's constitutional rights sir. Uh first she was giving uh the form rights to search. >> That's what we talked about not this right. >> Correct. that those >> that's eventually tax committed give uh constitutional rights to Athenia as well but I'm talking about to collect the blood it was a consent to search for >> I understand and as far as the form here when was when did this take place >> uh right after I collect blood uh the dry blood what appeared to be dry blood uh detective May read u Miss Muhammad uh her constitutional rights directly from the forum she initial initial next to each right uh she signed the form I see my signature on it and uh I see Dr. May's signature recognizing signature uh on it as well. >> Is it dated? >> Uh yeah. >> What's 71025? At this point it's 8:56 a.m. >> Does that accurately reflect the document that uh with the constitutional rights that she was given by you and Detective May and which everyone signed? >> Uh that's right. It's a copy of it actually. But yes. >> Okay. And during this period of time, uh, while she was being given her constitutional rights, are there things that you look to when you're giving rights to determine if someone is intoxicated? When we asked uh how far she went to school, she said she graduated high school. Uh, she stated she could read and write. Uh, she indicated she was not intoxicated. She was not on any drugs or alcohol. I asked her how much she got sleep the night before. She said at least 8 hours. She did indicate that she slept in her vehicle because she was currently homeless, but she said she's been doing it for a while now, staying out of her car. Um, so that was a conversation. >> Any any concerns that you wouldn't be able to have a proper interview with her? >> Okay. And the social media videos that I watched that she would upload to either it was either Instagram or Tik Tok, they some had happened in this like but it was just like a room. It never was outside this room. But the the ones right before she did what she did was filmed in her car. She filmed a lot in her car. She filmed some in McDonald's, which goes back to what Jamie said about how she'd be at work, but she wasn't working and she was getting chastised for not working. >> Uh she appeared lucid. Uh I did not see any signs of intoxication or anything like that. So um I believe she was uh okay to talk to me. Uh before I move to admit exhibit 6, I just want to hand over uh things to Josh Jones in case he wants to void her on voluntariness. >> All right. Not at this time, your honor. >> Okay. Then people move to admit uh exhibit six. >> Number six will be admitted. >> Thank you, judge. Tell me a little bit more. Um after the rights are signed, what's the next step for you and that interview with Detective May? >> Usually we ask a question of what happened. Uh, I believe detective may asked if she knew who um Jennifer Harris was and she stated she did. >> Was this a recorded interview? >> That's correct. >> Have you reviewed it prior to today? >> I did. >> And uh does it uh accurately reflect the interview that you had with the defendant um on July 10th of this year? >> Uh the video that I reviewed that was attached to evidence.com. Yes, that's an interview. I assume that's what you're going to play, but for me to certify it, I would have to see it. Okay. One. >> So, this detective, this lieutenant Alex last I think his last name is H for or his last initial is H. But he's really good because the the last trial I came up off of was the YSL trial. And they were so familiar with the prosecutors. It seemed like that they were trying to answer ahead a lot instead of like pacing it to where he's making sure he answers carefully to not hurt the case, if that makes sense. So, I feel like I I I do see the difference with him saying, "Well, I'll watch the video and see if that's what you're talking about, but I think that's what you're talking about." He's very different from how the detectives in the YSL case acted to me. We're about to put up on the screen [snorts] proposed exhibit seven judge. Now, sir, do you recognize the still of this? >> Yeah, it's the entry room. Uh, that's me in a blue shirt. Detective May uh is in a gray t-shirt with a baseball hat on. And uh Miss Muhammad, she's wearing um our um jail uniform. And at the time, I told you she had a different hair. It was red in color. >> People move to admit exhibit 7. No objection. >> Be admitted by stipulation. >> Thank you. >> Published to the court. >> Yes. Thank you. We're going to start at 3 minutes and 42 [clears throat] seconds. >> Okay. I was hoping so. So, um I was hoping we got to see some of her interrogation that they now call interviews. So, I'm glad we'll get to see that. Um, again, this this occurred, not the interrogation part. The this trial, this not this court date we're watching is November 14th, 2025, if I'm not mistaken, for those that like to kind of stay on track with dates. This was from November 14th, 2025. And then I'm I'm sure this had to be around July 10th, 11thish, because that's when the actual crime happened. Is the volume up on the TV? I'm not sure. >> Yes, sir. >> One moment. I'll fast forward through their technical issues. I was going to fast forward again, but I feel like people do want to see the person that's the defendant in court. So, I'll let this part stable, but if they go back to the screen and they're troubleshooting, I'll fast forward that part. 3.2. >> Nope. [clears throat] >> Okay. There's rights that you have. These protect you. They also protect myself and protect Polish. Uh this is called the East Point Constitutional Rights uh certificate of notification. I am going to be reading your rights uh one through five. Okay. Um and when I when I read these rights to you, I need you to verbally say I'm going to ask you, do you understand your rights? I don't want you to do this. Just say yes. You know, you know, don't do this or don't do this. Just say yes or no. Okay. All right. Okay. Um number one uh I have a right to remain silent uh and that I do not have to answer any questions put to me or make any statements. You understand? Okay. Number two, any statement I make or anything I say can or will be used against me uh in a court of law. Understand? Okay. Number three, I have a right to I have a right to have an attorney lawyer present before I answer any questions or make any statements. Understand? Okay. Number four, if I cannot afford an attorney lawyer, one will be appointed for me by the court prior to any question. Understand? Number five, I can decide at any time. I respect my rights and not answer any questions. Okay. So, what I need you to do, I'm going to have you sign this and then 1 2 3 4 5 just for two. Damn. You Where'd you go to high school? >> High school. >> So you have your high school, right? >> Yeah, it was actually in my inside my desk. >> Um, so you know how to read, right, spell all that. Smart girl. Smart. What did you mean? Oh, we trying to warm her up in this one. We went straight to Cuz that ain't what I've been seeing on some of these other ones where they're uh suspect. Well, I mean, they saw her do it, but they don't really say that. So, they're trying to butter her up real early. >> What's your favorite place? >> I like Italian language. little. [clears throat] >> Okay, we're going to get down to business. Hard is it going to be? It's going to be >> Where do you >> prescription medication? >> Yeah. How many hours? >> Where did you Where did you sleep? >> I um slept in the truck because I didn't have enough money, you know. >> What do you do? What do you do at McDonald's? Are you um I practically >> Okay. Were you working today? >> I did. I was >> What time did you start? >> At 4:00 a.m. >> 4 a.m. >> I popped in at 4:02 a.m. >> Who is who who is who is your manager there or who is in charge of you? >> Today it was Jennifer Harris. >> Jennifer Harris. >> Yes. >> Okay. Do you have any sort of issues with Jennifer Harris? And of course, Jennifer Harris is the victim that didn't make it from the stab wounds. >> I I had an issue with how I had to talk out three times in a row just because she was no. [clears throat] >> Was this today or was this prior? >> That was today. >> Okay. So, has has any time prior to to this day today, did she make you clock out or not? >> Yes. >> How many times? >> It happened. It happened just the third time this week. >> Third time this week. And can you tell me why do you think she's doing that? >> I think she's doing that because I had spoke up to her and I don't um trying to figure I think it was time last week. It was not sure but it was I had told her um that racist racing like that. >> So let me ask you this. Can you tell me what kind of racist comments that she's making towards you or >> Yeah. So sometimes when they looking at her phones or something and like it was one time the guy had showed her on my phone was like she had like five and she was like that's what she had said you know and then so be meaning [ __ ] right >> yeah yeah >> does has she ever used any derogatory remarks towards you that what give me an example what she was >> she said that she was one time she said she wanted her gun at her children like this like make me feel like I got scared of her and cuz she's a really kind person. >> Did she did she uh say anything racist to you today? >> No, she didn't say anything to me that the only thing she said to me is well now and then I was like I'm working my shift like you know I didn't do anything wrong. >> Did you leave after she told you that? >> No, I stay work my shift and I just kept working. Nobody came over there. Okay, I I'm going to go back a few seconds because what I feel like I missed cuz I'm sitting here looking down right in my nose, but I feel like I missed is that she did the manager did tell her you need to clock out and leave. But she but she chose not to leave cuz see she said I people were clocking me out and making me work for free. But if they told you two clock out and leave and you still work and I had a lot of Okay, I'm just gonna I'm just gonna go back and see what did she say when that happened because they asked her did she leave and she said no I went back to work or something. So let me let me see. And then the caption unfortunately isn't catching everything. So I'm really trying to catch the part that is not picking up. >> She did she say anything racist to you today? >> No, she didn't say anything to me. The only thing she said to me was now and then I was like sorry y'all. I forgot to mute to make that a little bit clearer. Okay. So, the wording she's saying Jennifer used was you can walk out then. Um, this is okay. I'm with Mary. I'm not saying this to excuse what this what what Apheni did. I'm saying this because I just want to have a dialogue about the whole thing that led up to the events. And I do think that let's say what she's saying that part is true. I do think you have to be very clear that I'm I'm ordering you to leave. I'm telling you to leave. I am about to clock you out. Even if you don't clock yourself out because nobody, especially someone in financial hard times, wants to be working for free. Now, since this happened two other times, Apheni probably understood Jennifer's language of how she would use it when she's saying, "You need to leave." That might just be a phrasing that Jennifer used, but I because there's been so many misunderstandings in just in general between people that work uh you know, work for someone and then they're communicating down to people that work for them. I am a fan of it has to be very clear communication. Do not leave things up for assumption. Um you don't know what someone's going through. You don't know their last straw. Um and you get someone that is imbalanced and has a history and here here we are. Now her not using clear phrasing should not have led to her being killed. And I know I'm going to have to probably keep saying that. I just want to talk about the whole picture though because that's why I'm watching it with y'all. we already know we got here. So, I just want to talk about the rest as well. Um, but yeah, so that's my thoughts so far as just in general because there's still people out there. There's still going to be workplace violence, preventable, not preventable, all kinds. And clear communication really can prevent some things, not all things. And I don't think it would have prevented this cuz she was still in a desperate monetary situation. And if you're and then she if she's not actually working, she was going to eventually get fired. Then she might have got mad, she got fired and still we would have been right back at the events we were where we were at. >> But just talking through it. >> And that's when I had that I didn't know you found out. You didn't even tell me that I'm not talking to you. I told you. >> So what did you do after that? Did you leave? >> Yeah, I left. I said this is wrong. I thought you keep telling me this is wrong. >> Where did you go? >> I went to shopping and drove to skate park a little bit. >> Okay. I left. >> So we were working for 3 hours. >> Y >> Okay. >> Yes. And then after that, that's when I just started listening to my music and I decided to start prayer and I um I started thinking about like like how she everything that she was doing that was wrong. >> Did that piss you off? >> Okay. So, at some point you returned to the McDonald's, right? Okay. Um would you have how did how did you injure? I had an eye and I walked her and I >> How many times? >> Where did you stab her at? >> Did you want to kill her? >> I can't hear the response. >> Oh, thank you for finally saying it. We can't hear it either. I'm just here getting mumbling. The caption won't pick it up. Oh my gosh. I'm like, this is the crucial time to be able to hear what her response is. >> Play that back, please. >> How many knives did you have? >> Did you want to kill her? That's how he felt. >> That's how he felt. >> How many knives did you have on you? >> Can you Can you describe the knife that you srench? >> Explain what a French knife. >> Oh, it's a chef knife like >> Is it long? >> Okay. Did you walk? [clears throat] >> Did you? Before we go on, one of the things I saw, shout out to Leah Gordon. Um, I feel like she she had a thing for either the Chucky doll or something else with red hair that would kill stuff, kill people. I feel like it was the Chucky doll, but I watched this back when she did her video. So, that was a few months ago. Um, but she has an affinity towards I'm going to go with Chucky Doll, but I don't remember for sure if that was it was something that little little disturbing. Well, after her actions, it's disturbing because a lot of people that like the Chucky doll and they're not ever gonna hurt anybody. >> You just walk up to her. Show me how you did it. You walked up to her and you just started doing what? Show me how you did it. You can stand up. It's okay. I >> shirt is that the one I had on. And then when So I'm Jennifer. >> Her eyes are going to give me nightmares. Her eyes are scaring the heck out of me right now. Jesus. And And You have the knife in your hand. I need you to show me how you do that. Did you do it like this? It's okay. >> Did you start doing this? >> Do it. Where? Where am I? It's okay. Don't Don't worry. It's okay. >> Did you get Did you stab her in the stomach or just >> I don't know. I might have So you mentioned somebody you were in a >> gunshot. Hey [snorts] beind. You >> saw the blood on your hand. It was was >> it came from the jacket to >> you think? >> Yeah. >> Where did you get the Walmart? I had another cake. I was here. >> Walmart. I'm all right. >> Has this has this lady has she been bullying you for a while or is this was just a one or two or three times? >> She's been bullying for a while. >> Does she do that to other employees? >> She she has been bullying. Um it was one of the girls she recently stopped messing with. Um because now I guess I turned out to be one she wanted to bully. But she has been bullied for a very long time. [snorts] She play she play her little gangster music and she don't like classical music. She doesn't like her and she's like she knows like we supposed to like other >> Okay, let's try to get through some of the the mumbling noise, but she said that she feels like Jennifer bullied her, that Jennifer likes [clears throat] more gangster music, she liked more classical music, and she just basically picked on is what she felt like. Um, I'm I'm looking through my notes real fast. She also didn't like when Jennifer would make uh she said racist comments like she'd be looking on her phone and she call somebody a skinny white bee. Um, this was a red flag. Actually, this is my red flag. Treating treating your actual employees that work for you like your children backfires quickly. Now, if it's like >> you're um you don't outrank somebody or whatever and you're like the auntie or the work mom, that's different. But when you actually control someone's hours, their money, you can't treat them like your kids like that because that puts you in a position of now you might go past those HR boundaries and personal boundaries and things that you're not taking them seriously that you would someone that you looked at, oh, this is a working relationship. That's a muddy place to be if someone's actually working under you is to treat them like your kids. That's not a It's not a good thing in my opinion to do that. hold the time up and they start like yelling at me. But it's like sometimes I can't rush your customer. >> Well, just so that I could get like an idea about where your head space was when you were stabbing her. Well, how would you monitor that feel? Also, I want to say I noticed that when she mimicked the stabbing, when she finally started doing it, the first place she went for in the mimicking, don't know if that's what happened in order in real time, but she went straight for that lady's neck like twice as what she mimicked, just stabbing her in the neck alone before she went to any other part of her body. >> I can be honest. >> Yes. >> Yes. >> Okay. I felt that it spoke to him because because I felt like I felt like she had like people under oppression who wasn't free. So that's how I felt when I was and I felt that's what I supposed to get and and that's what and if somebody want to take me down then I have to fight in this situation. >> What about now? Do you feel remorse? But like you said, >> you feel bad about why remorseful that you did it or you feel >> that you did it. >> I feel better. >> I feel better. >> I'm not a cold person. That's why I'm crazy. >> Okay. So, she said she feels better that she did she did it. I wonder how her defense is going to say she feels now months later, but at the time she said she feels better and she now you always ask for an attorney first because when she said, "Can I be honest?" Of course they want you to be honest. They want to know. >> You feel like people >> Have you ever seen it down there? Did you ever pull it out and point it at anybody or say, "Hey, come here and check out my piece or you know peace me." It's just what you thought in your head at the time like cuz the way that she talks like she's gangster, you know what I'm saying? I'm blood on this and blood gang, right? >> Yeah. So that's probably something her defense would use in trial that which it still don't make sense because she wasn't under a physical threat. She came back up to the plate. She was told to leave the job. But and somewhere in there I feel like her defense is going to try to work in that because Jennifer talked about owning a gun, possibly having a gun, the gun that never was seen by a fine that that somehow justifies the knife. Uh what car is the handle? >> So you left it behind the door. >> Did you after the shot was fired? What did you do besides you know ahead? Did you >> No, I had I had heard it hit the rack and then I kind of fall on the floor and I ran out the other side of the door and I ran into the shop. >> What? That's when the guy walked out with a light yellow shirt on. It's like a neon shirt. >> What kind of truck is that? >> It's a Silverado 2021. >> But it's my truck for sure. Like we shared like he's 50. We just turned 51 because basically we were living together. >> Yeah. I think they just lose like a lot of things to take care of. I hope all these questions are asked again while that detective or lieutenant or whoever is on the stand because there is so much I'm losing trying to hear her words. Uh, we stopped just now at 1908. Um, and detective, to to the best of your ability, that was um that encapsulated uh the defendant's explanation of what had happened that morning. >> That's correct. after um after the interview. Uh what happened right after that? >> Uh I let her make a phone call, let her family know where she was and uh lied on her side. >> One moment. [clears throat] Can we approach sidebar just briefly? >> Certainly. >> Oops. >> Okay. And I'll I'll fast forward some of their sidebar stuff and then get back to where we can hear them talking again. So if we get done sorry >> thanks Um, just one second. I have no further questions of this witness. pro. >> Okay. So, her attorney that was there during when her bond hearing and everything is not at this table. I don't I don't see him. At least I see other people. So, I wonder when her case became so high profile, did she get attorneys that maybe they're not asking for her to pay cuz they don't look public defendery and it's more than one of them. So, I'm h curious about that. Just one moment. >> You're good. You may be excused. Any further witnesses on the >> Are you kidding me? I need questions asked because I couldn't hear some of the things she said. And that judge said that she couldn't hear too. And I don't think when they replayed it, she really heard what she said after that. So, we just going to be here left in the dark for now. Hopefully on cross it gets a little bit more um clarified. Like what? I can't believe we don't have questions. Okay, let's move. Let's go with them. >> Judge, [clears throat] >> any witnesses on behalf of defense? >> None, your honor. Good. You want to take a few minutes for argument or do you are you ready? >> I'm ready. I can >> argument, please. >> Thanks, sir. Um, judge, today you've heard from uh six witnesses. >> Now, see, this is the part I want to find. I didn't get to hear the other five witnesses, and they're not included in this this particular video segment. So, I'm hoping I find the other five witnesses cuz I want to know about the lady that I thought I heard about that had to hold Afeni at at gunpoint to get her to stop stabbing Jennifer. I wanted to at least see that lady if I didn't see the other witnesses. So, um hopefully I find that and if I do, we'll come back and I'll try to label it so y'all know that's what I found. >> But effectively seven because of the interrogation. So you heard from Devonte Pace, Officer Mclofflin, uh Luke Moreno, Deborah McMillan, Lieutenant Hollish, and of course the interrogation brings in the statements of the defendant and her explanation of the things >> Turnage, >> sorry, Kashana Turnage. Um then Lieutenant Hollage is six, and then the defendant's statements through the interrogation. That is her explanation of uh what happened and why she murdered uh Jennifer Harris. Um, one of the interesting things is that uh we all understand now through what the witness testimony was from Ms. McMillan is that the defendant was irate that when she came to work, Jennifer Harris confronted her about not working and clocked her out. The defendant sat there for about an hour um intermittently working and then discovering that she had indeed been clocked out and then was told uh by Miss Harris to leave. And she did. She left. She went to the skate park. She told Lieutenant Hollish that while she was there, she skated. She I believe she said she prayed. Um, and she thought about everything that happened and then everything that Jennifer Harris was doing wrong. And despite having that time to contemplate on everything, she went back in about an hour's time. And when she went back, she had a mask. She brought a knife that she said she bought from Walmart. and she walked through the back entrance where Mr. Moreno said that he looked over and saw the defendant walking up masked and she said very calmly and he said she walked calmly, "Don't worry, I work here." Okay, so it's given you thought about it. You went to purchase your supplies. You maybe didn't want to be identified if you bought a mask. your co-workers were still going to recognize you if no one else did though. But yeah, it's giving uh I I premeditated is what it's giving. She proceeds to walk through and as Miss Harris is working prepping the food, she sets upon her and begins to stab her. There was no argument. There was no talking. And as we saw from that video, the defendant stabbed Jennifer Harris around 13 times all over. There's um the number for those that were wondering cuz they kept saying multiple in the headlines. Multiple multiple. So 13 times is how many times? And that's because she was stopped. She was going to keep going if she wasn't stopped >> her body. but specifically in vital areas. She stabbed her in the neck, the chest, the scalp, and there are 23 individual sharp wounds that the medical examiner's office identified. Some of which being 4 in deep through her through her neck. All of those were aimed at areas where even one strike could kill a person. And when she was interviewed, she admitted that when she went in there to confront her, to kill her, that she intended to kill Jennifer Harris. >> You know what maybe would have played out a little different on how I think the general public would see this? Now, there's, like I said, there's some that's like, don't bully people at work. This is what you get. That's that is some people they are very raw with their response on that. But I do think that there would be others that let's say that because Jennifer she's able to name the time she felt bullied picked on and stuff. I'm not Jennifer Afeni is able to name the time she felt picked on by the victim Jennifer. And she used the word bullied and always constantly picking and all this stuff. if and then she she said she thought um Jennifer owned a a gun cuz Jennifer always talked about owning a gun. Had this happened, let's say, in the McDonald's kitchen while she was still clocked in and it could have been more that Jennifer was standing over me physically intimidating me, I felt in threat, all this stuff. It uh she seemed like she was about to strike me. It it might go more manslaughter than murder type thing on here. Um, but you left mad, but you was also clocked out. They clocked you out. You went to the skate park. You thought about it. You went to Walmart, purchased your knife, and got a mask from somewhere. Then you came back and and there was no argument. You just started stabbing. >> [clears throat] >> That's what I'm That's what I'm But I'm just wondering what what how would the public have seen it differently if it had have been I felt habitually bullied by this woman and I felt physically intimidated and in threat for my life at the time and then this happened. Um I this is just my brain. I'm just trying to talk it out because I I one I have to add commentary anyway. So I'm just trying to talk it out with y'all where my brain's going. And when she did this, it wasn't in a manic state. It wasn't some emotional outburst. She came in calmly to do all these things. She was prepared. So, as far as what you've heard and what I've got to prove today with count one and count two is with premeditated murder, the law says that premeditation and deliberation may be inferred from the circumstances surrounding the killing. And there is two cases. Uh Tilly 405, Mish 38 at 44, a 1979 case. And Jolly 442, Mish 458 at 466, and that's 1993 case. So the premeditation and deliberation, >> sorry. Uh 442 mish >> 458 at 466. Um, that's a 1993 case. >> Um, as far as what we have without her any of her statements, we still have her leaving, going to another location, and then coming back prepared. She has a mask. She's got a hidden knife, and she enters through a back entrance. And then immediately when she is near Jennifer Harris, she begins to stab her. The reason that you know that she intended to commit murder and kill her that day is when you're watching the video, there's a time when Jennifer Harris collapses and she's on the ground and the defendant doesn't stop. She's prepared to stab her while she's on the ground. And the only thing that stopped her is thankfully Devonte Pace pulled out his 45 and shot at her. And on the video, the minute that shot gets off and you can see the gun through the the window, she throws the knife and tears through the exit. So, it's clear that even though Jennifer Harris had collapsed on her back, bleeding, that the defendant intended to finish the job on the ground. But now we know from her own statements that that's what she always intended to do and that she's prepared to do it. One moment. So as far [clears throat] as as far as her state of mind and what her motive is, even though I don't have to prove motive, we know what those things are. and we know why she did what she did and that she intended to do it. Um, as far as count two, dangerous weapon carrying with unlawful intent, uh, we heard from from Ms. McMillan that the knife that she saw the defendant using was somewhere between 5 and 7 in in length. Uh, additionally, we know that she brought that knife there with a specific intent to stab and kill Jennifer Harris because that's what she told police. And she explained using uh Detective May as a uh a prop is that where she was stabbing was intentionally in the neck area um and the upper chest. So based on everything you've seen today and what you've heard and the defendants's own explanation, I just ask that you bind over counts one and counts two. >> Thank you, Mr. Jones. >> Judge, obviously the people are objecting to bind over one. I guess I want >> defenses objecting to bind over. >> What did I say? >> You said people are bind. I'm sorry. >> Oh lord. All right. Now, [laughter] okay, this my first impression >> and I where I was going really your honor is were the insinuation of in her statements of and how the people are identifying this insinuation that she bought the knife for this. And I I hope it's clear to the court that based on her own statement, which the court I believe is relying on and the people are relying on her own statement in part to satisfy the buying over that she indicated that she bought it previously for something different. Um, now I'm not saying that there can't be an insinuation from that, but I don't want the court nor do I want the facts to be insinuated that it was bought for this purpose or this incident because I don't think that one the facts reveal that at all. even in her own statements, she doesn't make that um as a fact of itself. >> Now, didn't she say, y'all correct me, that's why I have multiple eyes and ears on this, but didn't she say she went to the skate park to cool off? She was still mad playing events over her head when she realized she had logged into that app and she had been working and but the manager had clocked her out. So, she went to that skate park. Then didn't she go same day to Walmart to get the knife and then the knife was immediately basically used to kill Jennifer? I thought that's what I heard, but and I know the defense has to spin things. They have to, but I didn't hear anything else but that. >> Um, and so that I just want to clarify that and I know that the people have introduced the interview. So, if the court, again, if there's a hang up, the court can listen to that and make that determination. But again, I'm just going off of her explanation of why she had what she had had at the time. Um, beyond that, I think it's clear as well from the testimony, um, from the other witnesses that what we're talking about is a hooded, it's a hooded mask. And again, I'm just identifying some, um, I don't want to say clarifying some things on what we heard. facts because it was very clear that it was some sort of zip up hood that went over the face. It's not a separate mask that was, you know, bought uh for this purpose. It was it was an entire it was a tire, meaning, you know, someone owning a hoodie and then that zips it up. I don't think it changes the fact that it zips up into a mask, but again, I think that those are facts that um at least [clears throat] need to be clarified when we're talking about >> Fine, clarify it. Did she conceal the bottom half of her face with a hoodie that zips up high above the nose and everything else or wherever it zips up to? Did she Did she Was it freezing that day to [clears throat] where it would make sense that you have everything but your eyes covered up? That's my question. Oh, it wasn't cuz it was in July. So, no, it was not cold. Come. I know he got to do his job. I know >> about the bind over specifically because we're talking about the difference between you know at least for today's purposes first and second degree and there's that identification of um premeditation or preparation to get you to first degree. Um so I I wanted that's the reason I wanted to clarify those two facts your otherwise generally speaking um for count one I would indicate that they generally when I say generally that they generally have not met their burden um on their elements your honor to show that there is a difference between uh first and second. Um in regards to count two as I'm sitting here um listening to Mr. Pallet wrap up his um request for a bind over. I know we've talked we've had discussion that there was a knife used. There's been discussion that there was the potential of this knife that was um identified at the scene, but there was not really any specifics. And I think that Miss Loose McMillan was identifying um the knife that she saw. She wasn't referencing the difference between the length of the actual knife and the blade. And I say legally speaking, there is a difference between that. And I don't know if the people have really necessarily um shown that even in a probable cause level. And the reason I say that, your honor, is because the length, the blade length must be over 3 in. And the only thing that we necessarily had from Miss McMillan is that it may be between five and six. And she's just referencing the size of the knife. Again, we don't have anything specific to the blade, which is really what the requirement is for count two. We have no officer that identified that they collected it. We have an officer that says, "Well, they should have collected it or they they did collect it, but he couldn't testify beyond that. He didn't testify who collected it. Um whether or not they had the knife or even presented a photo of this being the knife in some sort of reference to what length we're dealing with. Um and so with count two, I think that they're just they're lacking on that. I think we have some testimony there, but we don't have the specifics that we need even at a probable cause standard to identify that for that particular count. So, um, in regards to my my objection, your honor, um, again, I leave it to whatever what I've already said about count one and then with count two specifically, I think, um, that they lacked on that proof, so I would ask for a dismissal on both, but more tech or more specifically on count two. >> Thank you, >> Amanda. >> Um, and I I guess maybe I didn't annunciate whenever I was speaking as I said she brought the knife. I didn't say she bought the knife. I know that she said she bought the knife at Walmart because she had bought a cake at the same time or she planned to bake a cake. So, I said brought I didn't say bought. I know that or I I never wanted to have anybody believe that I thought she bought that specifically for killing Mrs. uh >> Miss Harris. >> I appreciate that. Um, additionally, as far as the testimony that we did have for the knife itself and the length of the knife, we have a witness saying that she saw the knife uh and that it was between uh in excess of 5 in. As well, if you just look at the video, you can see the life the knife is a large butcher knife, not some small knife that would be below 3 in. And so, I'm relying on the video itself and the testimony of the witness that we had on the scene. And your honor, uh, I have a, uh, flash drive for you. If the court would like to review any of these, I can provide it to your court officer to provide to you for your review. >> Thank you. The court's going to take a a recess to review my notes, and I will be back. >> Okay. So, um, first of all, he will now be known as hair bun attorney for sure. A hair bun attorney. But Jacqueline said, is he a courtappointed attorney? And I'm I muted her on purpose because she they're just wrapping up for now. I still have more video. We'll get there to see what they come back and say, but that way y'all don't have to look at a steel picture. Um she has multiple attorneys at her desk. So I don't think she has a public defender anymore, but may are you assigned multiple public defenders in any instance depending on the size of the case or do you only get one public defender? That's why I was thinking her attorneys were upgraded. They probably took on her case again like y'all said for notoriety, experience, build their clientele up, stuff like that. I just didn't think that. I don't know. I don't think she has a public attorney or public defender now. But I'm not saying for sure she doesn't. I just don't think she does. All right. So, let me see where we get back to them being in court doing their thing here. Let's see. They might I don't know if they talking to us. No, I don't see the judge in her seat. No, they just talking. Okay, let's see what else we got. See if the judge comes back. Here we go. >> There's no sound yet. I have the sound on. There's just no sound yet. >> For the record, please. Kumar Palipu for the people P74099. >> Chris Bourbon on behalf of the people P 1013. >> Your honor Josh Johnson on behalf of Miss Mohammed stands to my right >> and Capital P5 3823. Thank you. >> You may be seated. >> The court has carefully considered the testimony of the six witnesses today. That being number one, Devonte Case, an eyewitness. Witness number two, Officer McGlaughlin. Witness number three, Luke Marino. Witness number four, Deborah McMillan, manager at the McDonald's. Witness number five, Desa Turnage, employee of the McDonald's. Witness number six, Detective Hollish, who took the statement of the defendant. I got to find these other witnesses, especially Devonte. Devonte was the shooter that finally got her to stop stabbing Jennifer. Then we got Mclofflin. We got uh it said Marino McMillan and Turnage. And one was a manager, one was an employee. Hopefully I can find it. Hopefully they um got that somewhere. They just separated the footage because that's very important. >> At this stage, it's not for the court to determine guilt or innocence. This is a probable cause hearing and the court must be satisfied that the prosecution has presented evidence by a probable cause standard as to both charges. Count one, firstdegree premeditated murder and count two carrying a dangerous weapon with unlawful intent. Probable cause is a very low evidentiary threshold under Michigan law. In viewing the evidence in the light most favorable to the prosecution, the court makes the following findings. Count one, first-degree premeditated murder. The people presented testimony showing that the victim was found on the floor of the restaurant in a large pool of blood suffering from what appeared to be multiple stab wounds. This clearly establishes that a homicide occurred by a criminal agency. the manager of the McDonald's, that being witness number four, Deborah McMillan, testified that she um heard a commotion, came around, found the victim on the floor bleeding. Regarding the intent and premeditation, the defendant stated in her own interview that she had left the location earlier by her own testimony. She testified or she um stated to the police that she was told to leave and she didn't leave and then became angry later because her boss had clocked her out. She indicated that she left. She went to the park. She prayed um and thought about how she had been wronged. Uh she admitted that she possessed a long chef's knife. And when I talk about the chef's knife, Mr. Jones, you made argument that um there was insufficient evidence with regard to the um 3 in or being 3 in or more on the blade. Um the court did review the interview by the police of the defendant and the um the graphic scene once again. And the knife in there clearly is over 3 in. And the testimony of Deborah McMillan that the blade was she put it which looks like six inches. We don't know if that's the knife or not but in the video of the um the stabbing you can you can see the blade of the knife. The blade of the knife was rather large and by defendant's own statements had indicated that it was a chef's knife. So, that being said, >> okay, I was wondering if we were going to take what she said into account cuz she definitely said it was a chef's night. That was one of the ones I could make out when she was in her interrogation. So, good to know. Um, real fast before the judge continues. So, it is an honor that that anybody would ever want to see me react to anything. So, just for Final Fantasy Fiend, um, about that Daryl Brooks trial, she was asking, would I react to older trials? I, if I find the time, I definitely would, and that is a crazy one to start with. So, I will look into how to work that in eventually sometime for 2026, get that in there. But yeah, that's an honor to even want to spend your time seeing what I might think about it, what my opinions may be. So, I'll I'll do my best. [laughter] She admitted that she possessed this knife. She admitted that she wanted her dead. I think her statement to the police was [clears throat] um I felt like I wanted her dead. I'm not a cold person. Um another thing that was interesting um or not interesting, that's a poor choice of words. um corroborates the testimony of witness number five, Kashana Turnage. In the interview at the police station while the demonstration of how the stabbing occurred, you can see the defendant's fingernails and it was blue and white as described by Kashana Turner or Turnage, I'm sorry. >> [clears throat] >> So, the fact that she left, had time for cool reflection, and returned back to the location, and as witness number three testified, appeared to be casual and calm while she walked in. Her statement that she wanted her dead, and she knowingly carried out that plan, purposely arming herself with this knife, wearing a hoodie and a mask. um as witness number four testified appeared to be a Jason mask and witness number three testified that it looked like a ski mask. Taken together, this evidence is more than sufficient for a person of ordinary prudence to reasonably believe that the defendant intentionally with premeditation killed the defendant by a probable cause standard. The court therefore finds that the people have met their burden as to count one. As to count two, carrying a dangerous weapon with unlawful intent. Testimony clearly established that the defendant possessed and carried a long chef knife. The defendant admitted that she brought the knife um for the purpose of stabbing the victim and she did in fact stab the victim with that weapon. The unlawful intent requirement is fully supported by her statements and the eyewitness testimony. Accordingly, the court finds probable cause exists that the defendant carried a dangerous weapon with intent to use it unlawfully against another person. So, for the reasons stated on the record, the court does find that the prosecution has met their burden as to both counts. There is sufficient evidence as to each element of the offenses charged. I therefore ambing over to circuit court for further proceedings as charged. >> Okay. So, Count One and Count Two Stuck, which were in the past. This happened back in November 14th, but I didn't get to watch it yet. So, most people, if they were following this, they already knew Count One and Count Two Stuck. But I I love to hear the reasoning behind it. Um, there was a date for arraignment that kept coming up for December 2nd, but then when I kept searching for anything happening on December 2nd, I didn't see anything. So, I I didn't even see a mention of a delay yet. So, I'll keep trying to look for that, but I'll also look for Devonte Pac's at minimum his testimony because we have to see that. Um, and I also may reabel this as interrogation versus witnesses because the detective is a witness, but it's more like it was about his interrogation. So, I'mma change the thumbnail on this one and then we'll find hopefully the actual witnesses we can watch together. >> Do we know who the arigning judge is in this matter? >> Mass judge. Mastering judge. That's correct. >> Judge Maserone, here's his arignment on the information on Tuesdays at 9:00 a.m. for in custody. >> It'll be December 2nd, Judge. I'm sorry. >> You pick December 2nd. Be December 2nd at 9:00 a.m. Judge Maserone. And I need you to fill out the cap sheet. doing that now. >> And I want to thank both sides for your professionalism. And that concludes this matter for today. >> All right, we made it through y'all. This was um let me know what you thought about it. Would you stick around to see more even if I'm behind cuz being right on time is probably not going to happen. But um let me know your thoughts about it. All of it. You know, you ready to see all guilty? Do you think the charges should be reduced? What? Um, just everything. Work workplace violence, all of it. Just let me know your thoughts in the comments if you're in the replay. Gang gang and chat, too, cuz you know, once I end this, I can't see your chat anymore. But yeah, I look forward to seeing how this develops. And I'm going to try to find out what happened to this December 2nd arraignment date cuz I knew that's what I read, but I didn't see anything. But, okay y'all. I hope that you enjoyed your time over here. whether you're on the legal at some point side or the trending at some point side. Eventually, this will only be on the legal at some point side, but right now we're doing some dual streams. All right, y'all. I'll talk to you later. Bye.
