So, thank you, Veronica. All right, so we're gonna start with belligerent 25-year-old drives drunk on the sidewalk, and we will then go over what prosecution would have to prove and what the defense could argue, not specifically maybe for her case, but what a defense may argue against on certain charges. I want to clarify that. All right, so let's go ahead and get started. I was on mute. I think I was trying to say and I talk. If you don't like talking, link is in the description box. >> I don't think so. Hello. >> Hi. >> What's going on? >> Uh, I'm trying to talk to my husband. >> Okay. Why are you here? >> What should I say? Can I talk to you in a second then? I don't know. I just uh >> Well, what's going on? Are you all right? >> Okay. Yeah, I'm fine. >> You're fine? >> Yes, sir. >> Um Yes, ma'am. I'm telling you. I don't know. Um going home soon. >> Okay, sounds good. >> Um can you just uh she decided to talk to you later? >> Who? >> My sister. Who's it? >> Okay. Well, we had a we had a complaint that somebody was driving on the sidewalk and you're here parked on the sidewalk. >> So, yeah. You >> Why don't you go ahead and hang up the phone and step out of the car for me? >> Um, what should I do? >> Um, no sir. >> I don't know what to do. She doesn't know what to do. But what she is going to commit to doing is not obeying the [clears throat] law, rolling up the window on a traffic uh I'll say I don't know if I say traffic stop, but all right, girl. Um, [laughter] and whoever's on the phone is giving her horrible advice again. >> What's going on? >> Are you okay? >> Yeah, sir. I don't know. I'm nervous to talk. >> Well, why are you nervous? Give >> Can I have a second? Yep. What should I say? >> What? >> Can I Can I talk to my lawyer? >> Why would you need to talk to your lawyer? >> I don't know. I just want to be safe. >> You just want to be safe. >> Okay. I'm talking Yeah. I don't know. Okay. Um I'm talking to my brother right now. He's a lawyer. He said just to wait. >> Okay. How much have you had to drink today? >> Nothing. You haven't had anything. >> Okay. What did I say? All right. Um, where are you headed to? Honestly, >> what's what's your name, Miss? >> I I don't talk to cops anymore. I had really bad experiences with you guys. I said I talk to you guys. >> I don't want to talk. >> Okay, girl. Let's turn the tears off. You don't want to have this encounter because you're drunk [laughter] and you're about to get it. Well, she's not going to get it. Get it, but she know the DUI is coming. It is like a SNL skit, Candace. She She's out of Look, she's impaired making horrible decisions. [laughter] >> So, >> we're kind of we're kind of in the situation where we have to talk. Okay. >> Mhm. >> So, what's your name? So, I'm not just calling you miss and man the whole time. >> This is fair. Zach, I'm with you. Just like I would have a spit mask in my pocket at all times. I'm I'mma put some stopsticks down, too. Yeah. Yeah. Because you you're too sketchy for me. Stop sticks are going down. And don't come and tell me that's illegal, y'all. I don't care. I'm not a cop. I'm just saying what I would do, which is probably why I'd be fired. [laughter] >> Can I talk to my lawyer real quick? >> Can you just step out of the car for me? >> Yeah. Talk to my lawyer. I'm going to talk to my lawyer. >> Okay. Right now, you're being detained. Step out of the car. >> Wait, wait, wait, wait. >> Step out of the car. >> Why? >> Because I want to talk to you outside the car. >> No, but I have done nothing wrong. >> Well, how'd you end up here? You see where the street is, right? >> I've done nothing. >> Do you see where the street is, >> Miss? >> I have. Miss, >> do you see where the street is? >> Yes. >> Okay. How did you end up? >> Oh, this is a great day for body cam bingo. So, we're on version 9. Uh, the link is in the description box if you want to play along, but I feel like this is a pretty good chance of a getting a bingo day [laughter] >> up here on the sidewalk >> sir. I don't know. I don't actually I'm going to wait cuz last time I talked to the cops, I got in trouble. I'm going to talk to my lawyer. Okay. Well, you're you're talking with us right now. So, >> can I talk >> Can you just step you step on the car? I'm not. >> Okay. Can you just turn it off for me then? >> Can I talk to my lawyer? >> Can you turn the car off for me? >> Maybe. >> Babe, can I I don't know. I'm I don't know what's going on right now. I'm trying to Christian told me not to let cops. I >> did. Okay. Is is she on [clears throat] the phone with her boyfriend now? Cuz I definitely heard brother who's a lawyer and now I'm hearing babe. So did she is she on the phone with somebody else again? >> I have no idea what's going on right now. >> Six. Could you pull up a little closer, please? >> Oh my god. I don't know. I need to call Christian because I told me not to talk to you. I don't I don't know. I talked to Christian and I'm going to get detained now. Yeah. Step out of the car for me, please. >> Oh my god. Where's my Oh, Christian. Okay. Um, I don't I don't understand the situation. Can I I'm going to talk to my I'm going to call my brother. >> You're talking to us. Step out of the car, please. >> I don't know. Actually, >> I don't know why this angle is hilarious. [laughter] The closeup was like she's annoying. This angle that they now have is hilarious [laughter] >> cuz I don't trust I don't know the situation. I'm going to call my brother. I'm going to call my lawyer. >> Here's the situation. >> I know. I don't I I don't know you guys. >> Here's Oh, I know. And I don't know you. So, here's the situation. We got a call because somebody is driving on the sidewalk. You're here parked on the sidewalk in front of somebody's house. Okay. You I need you to step out of the car. >> What do I do? >> You hang up the phone. You step out of the car. >> I'm calling I I don't >> Can you turn the car off for me? >> I'm calling my I I don't I don't know what to do. I'm calling my >> miss. Can you turn off the car? >> Please turn off the car. >> Can you turn off the car? >> Okay. Step out of the car for me. >> Can I get a second, please? I don't know. I don't honestly I don't know my legal rights. What is my rights? >> Well, you're running out of seconds here. >> How? I don't I never got any I never got spoken anything. You never told me my rights. I don't know what's going on. I'm trying to talk to my brother right now who's a lawyer. >> 203. Miss, step out of the car. >> Um >> I don't honestly don't know what's going on. >> Could I get another car, please? No emergency. I'm sure. >> Miss, you're going to have to step out of the car. >> I will. I just I just want to talk to my lawyer before >> I get involved. >> How much How much have you had to drink today? >> I'm not talking to you, sir. >> Okay. >> Ma'am, come on. Step out of the car so we can we can have a conversation. Come on. >> Can I actually call my lawyer first or is this not allowed? Like I don't know what >> No, right now. >> Actually, I'm calling my lawyer. >> Well, right now you're interfering with our investigation. So, am I? >> Yes. >> Because my my brother's a lawyer and >> Okay. And I'm a police officer. So, if you could please step out of the car. >> Only reason I haven't interrupted this more is because the only thing I have in my head is that she's annoying. She's annoying. Hurry the hell up. That's That's all I have in my head. >> Say, actually, I rather just not talk to you guys until I talk to a cop. >> We are talking. We are the cops. >> I don't want to talk to you guys unless I'm a lawyer. >> Okay. Step out of the car. >> Are you Yes, I am. Step out of the car. Unblock your seat belt. >> Oh my god. What the out? >> Step out of the car. >> Oh my god. >> Get out of the car. >> Are you serious? >> Step out of the car. >> Get out of the car. Get out of the car. Oh my god. >> Get out of the car. >> Right now you're under arrest for OVI. Step out of the car. >> What the? >> Put your hands behind your back. [screaming] >> What the >> Can we all say it's about time? God. Oh, this took a long time. >> Oh my god. >> Okay. You're under arrest for operating a vehicle intoxicated. Okay. >> Can I call my >> lawyer, please? >> When you go to jail, you can call him. >> We're going to roll you to the side and step you up. Sit up. >> How can I get a hold of my lawyer? >> What do you call him? >> My brother. >> Do you have anything in your pocket? With all these people that have family members as lawyers, why are they not telling you that you do not get to necessarily call the lawyer at the stop? That's when you kind of are in cuffs and you're going they're going to have a time where they set to interview you if they still need to ask you questions and then your lawyer can appear there. It's not at the traffic stop. It's not wherever the inconvenience is for you that you're being arrested. That's going to be down when they're actually doing the formal interview. [snorts] >> No, sir. >> No. Do you need clothes? >> I have for my hair. >> What's your name? >> 25. >> What's your name? >> Honestly, I I'm not going to talk to you guys. Do you have an ID on you? >> I would rather talk to the cop. I mean, >> I'm going to talk to my lawyer. Okay. Well, right now you have to identify yourself >> or you're going to get another charge for failure to identify. for about a month. >> Do you have an ID on you? >> Ma'am, I actually don't know. I don't trust you guys. Actually, >> I don't trust >> A crime has been committed. So, you have to you have to >> identify yourself. >> I committed a crime. >> Yeah. Do you see this car? You see this car right here? Where are Where's your car? Where is it at? >> Is this your Is this your car? >> Can we call her? Okay, we got the officer Uncle Dad's. Can we get the officer auntie mom's? Because where is your car? Where do you Where's your car at right now? That sounds such like a auntie mom thing. [laughter] >> Somebody else's. >> I'm not going to talk to you. >> Okay, sure. True. Let's teach. >> Okay. >> Okay. Turn around. I'm going have you lean up against this car over here. >> You have anything that's going to prick or poke me? 203. >> Can I talk to my lawyer, please? Go ahead. >> Once I confirm who this female is, I'm going to have her herbi open container. >> Are you wearing her bra right now? >> I have to check a BMP photo, but I think so. >> You good? >> Yeah. Okay, we're going to walk back to this car right here. Or actually, you're pull up here, aren't I? >> All right, let's let's get her in the car cuz this is just a lot of struggling. All right, let's see the meltdown. It's a light meltdown. [ __ ] [snorts] Whoa, whoa, whoa, whoa. Akuo, thank you so much. We're about to have five new trendies in the trendy tribe. Hold on. I got to open my chat for this one. Oh, I hope y'all got swept up in it. Hold on. Let me see. Thank you so so much. I And I'm traveling. So, this month y'all will, you know, I'll get to do a little bit at the um airport and stuff because I got to go to St. Louis, which was an accident. Did not mean to be going to St. Louis, but here we are. So, okay. Congratulations, McMahon. February finest. Like the name Cheryl Pool, Sweet T. Wait, wait, no. So, sorry. Sweet Tea already had a membership. Hold on. It might still be low. Oh, here it goes. the elegant elephantest and nandi Z possibly or nands. Either way, congratulations to all five of y'all. Oh snap. We're about to have some fun now. All right, let's keep going. Do I Hey. Hi. Do I get to talk to husband? Oh my god. What the? >> So now she's married. Didn't she say boyfriend earlier? Ain't that what she said? >> Oh my god. You c Hey, where were you guys for anything? I needed you. Hey. Hey, where was I? YOU [screaming] guess what the happened. Guess what? I was youshole. You dead. Yeah, you won't. Youshole. What is it like to you? >> I ain't got here. God guys, you guys. Seriously, I was. And you guys, >> we're going through the stages of grief again. Okay, so now we're angry. We're not scared anymore. I don't like when drunk people start crying and they their mouth doesn't really close. I'm always like, "Are you about to slob?" I always feel like we're about to either see a spit glob or I'm sorry if you're eating breakfast. Let me warn you now. There's one coming up. You definitely should not be eating breakfast because it gets gross. at least two videos. Honestly, it gets gross. So, you need to finish right now if you're eating breakfast. But, um I hate it. Her lips are killing me. I don't know if she has lip fillers, but it just looks like she's about to slob a lot. I don't know. Me over you, Cleveland. You guys, I was literally going home. You guys [clears throat] [snorts] you guys please open up. Can I tell you? What the? That's so up. [snorts] >> I don't know. We're done. >> Oh my. >> Yeah, we got a picture of that one already. >> Zach, I'm telling you, I think that's why she has lip fillers because the reason you feel like she has a pencil mustache is there's a shadow on the rim of her lip. It is the lighting and it I don't It could be her natural lips. Some other, you know, they they have n they have thick lips, too. There is definitely a distinct crease and that's probably why you're seeing a um a pencil mustache on on like as an illusion. >> Yeah, we got a picture of that. >> I need these. >> They're all empty. >> They're all empty. Okay. >> You put that window down just a little more. >> Okay. >> I'm skipping some more. Oh god. Without [sighs and gasps] an attorney present, you will have the right to stop answering at any time. You also have the right to stop answering any time until you talk to an attorney. Further, you have the right to have an attorney present with you during any questioning. >> Do you understand your rights as they've been read to you? >> Yes, sir. >> Yes. >> Can I have my Can I talk to my husband? >> Yeah. When we get to jail. >> Thank you. I have a question. >> Yep. Hey, when I was 18 years old, do you want to No, I want to talk to you. >> Hold on. Do you want to answer any questions right now? >> Yeah. Actually, I'm like really concerned because like my experience with the cops is horrible. I've called you guys multiple times. >> Okay. >> And I'm actually really pissed off because this is so unfair. I have done nothing wrong. Like, it's not fair. I and I'm really pissed off because the cops already told me I didn't I didn't they have like choking and finger [laughter] I don't even know and I'm actually now just now trying to get my life together after 18 years >> lies you're not trying to get your life together if you drunk driving on the sidewalk. I don't know what she is trying to describe but this is all you boo. You did this to yourself. >> Fortunately you were in the situation we are right now. Okay. And this has to do with you driving and being intoxicated. Okay. So, I have I have a series of questions. They're standard questions we ask. Do you [snorts] want to answer any of those questions right now? >> No, sir. I'll probably talk to my >> No. Okay. >> Can I talk on the way? >> Cool. It's a yes or no questions. You do you want to >> No, sir. I just I can I lawyer? >> Okay. >> Can I leave now or like what? It's been 20 minutes. >> Can I talk to my lawyer? Not yet. >> Not yet. When I saw she didn't understand instructions when I had to me as the hypothetical cop had to snatch her out the car. After I read you your rights and you don't make it clear that you understand your rights, we don't have anything else to talk about. You're going to be yelling and talking to yourself till we get there and then you can talk to whoever you in a sale with or whoever's booking you in. I have nothing else to say to you because this is such a waste of energy. It's annoying these switching up these emotions back and forth. It seems exhausting. I'm I can't entertain this. If If it was me, I couldn't. I'm not answering any more of your questions. >> You're Could you imagine your sister or your daughter getting >> Dude, that's your karma. I pray to God, you get what you give. >> You see what I'm saying? Now she's wishing a sexual assault on this woman's family. Like, where's this coming from? You did this to yourself. Why are you driving on the sidewalk? Why are you impaired and you're getting your life together? It's everybody else's fault. And they are so vile like all the time. Like I hate I I don't hate Okay, I don't hate drunk people. I hate these types of drunks cuz if you're drunk and responsible like you're just in a place, you're not bothering nobody. You happen to be under the influence cuz you decided to partake. Fine. But I hate these types of drunks. >> Honestly, it's not my problem. Just imagine if your daughter ever got Just think about this moment like if I didn't do that and she got cute [clears throat] you guys. >> You know, right? And you guys did nothing. >> You're also tired of >> Yeah, I'm sure. >> Kids are walking home. >> Oh, yeah. For sure. >> So, let's step up here towards this female. Okay. Okay. She was charged with OVI, driving on the sidewalk and having an open container of alcohol. Let's look at where Oh, she was in Ohio. Lakewood, Ohio. It say she was 25. Um because the title said 25, but I kept hearing her say something about 18. So, uh maybe she was just talking about in the past, but yeah, I don't think she's going to age well either. Mindy, it's too much going on. Uh, Lovel said, "Trending, I had a co-orker who used to say she couldn't do stupid, and that is how I feel right now watching her." Yeah, you're Yes. Yes, I've heard that saying. I like it. And I I'm with her on that. I'm with you, too. All right. So, the first one, a OVI in Ohio is a misdemeanor, commonly a first-degree misdemeanor for a first offense. Don't know if this is her first offense. Um, prosecutors generally must prove the defendant operated a vehicle and the defendant was under the influence of alcohol, a drug of abuse, or a combination of them at the time of operation. A defense attorney may challenge whether the driver's behavior could have been caused by fatigue, a medical condition, or another non-alcohol-related explanation. The field sobriety exercises did not accurately reflect impairment, which we saw they did not do field sobriety exercises. The officer mistook normal behavior for signs of impairment. Next charge, driving on a sidewalk. Prosecutors generally must prove the defendant drove a vehicle and the defendant drove upon a sidewalk or sidewalk area where driving was not legally permitted. Uh the defense attorney may challenge whether the defendant intentionally drove onto the sidewalk in emergency or other lawful circumstance justified the conduct. the prosecution can prove whether the vehicle was driven in an area legally considered a sidewalk. And um who I think BRB is the one that asked for us to start adding what the defense could try to argue. So you can thank him for why that's in here. Now uh the next charge, open container of alcohol classified as possibly a misdemeanor or minor misdemeanor. Prosecutors generally must prove the defendant had an open container of beer or intoxicating liquor and the container was possessed in a place or circumstance prohibited by Ohio law. Possible defense charges or challenges, sorry. They can challenge whether the container actually contained alcohol. The defendant knowingly possessed the open container. The prosecution can prove the container was possessed in a location prohibited by law. And this is one of those examples I was saying sometimes in there it does have something about did the defendant knowingly blank and that's this is one of the examples and we'll have a few more like that because uh like we were talking about yesterday usually it's ignorance of the law is not a defense but I I was saying sometimes in here it does say something about knowingly and this is one of those examples. Oh yeah she a mess forever TRL. Yep. Yeah. This is my first this is definitely my first driving on the sidewalk. Like that's a actual I think statute too. Let me let me let me click on the link. Hold on. Cuz that was that was unique. Hold on. Let me see. Yeah, look. It's titled literally driving on a sidewalk. [laughter] That one got me too. I was like, "Yeah, we have to talk about this." That's crazy. Okay, so now we're going on to our next one. And oh, hold on. Mindy said she said something happened to her 18 years ago, which doesn't make sense cuz I think she meant when she was 18 and she then misspoke and said, "I've been getting my life together for 18 years or something." But yeah, she she's 25 according to the title. All right, next one is this is the one from the thumbnail. Police surprise woman sleeping at a red light with her pants down. Here we go. >> How drunk do you have to be to fall asleep in traffic at a red light? The car is in drive running. Driver's got their foot on the brake. I might try to wake him up in a moment. 74 2A supervisor. I'm going to have the next car coming in. Go nose tonse with the car so it doesn't roll into the intersection over here. Before I attempt to wake the driver up, >> would you guys just want to block the inter or kind of just just park right in the middle? Make sure cars go around you, I guess, just so they don't roll to the intersection. >> This is a great candidate for stop sticks. This is one you definitely should have done. If you're if they're already asleep at a red light and you got and you're telling them they got to put the car in park, stop stick should already be down. >> I know nobody goes on green leaf, but just in case. >> Which direction you want to block? >> I don't know. Just got to park right there. Just right in the middle of the intersection just for a second. >> All right. Do you guys want to help? >> Plenty of them. >> Sleep at the wheel. >> Try the other door. >> Bye. >> Professor Purple Queen. Yes, she was asleep with her foot on the brake. The car is not in park. I'm like, and it I've seen too many of these. Like, people are doing this way too much. This This is crazy. Obviously, it's dangerous. Different days we will watch ones where they actually end up unalivvening people. But yes, this woman is asleep at the red light with her foot on the brake with the car in drive. >> Mr. Police, your body cam, can you toss the car in park for me? Can Can you put the car in park for me? Can you uh Can you roll down the window? >> Putting the pants on. >> Yeah. Why? Okay. A cool though. Why isn't the car nose tonseed with her? Cuz when he said, "Can you pull up and block?" Oh, he said block traffic on that street. He did say that. But still, someone should be nose tonose with her. Like, why why does she have so much leeway right now? This is this is the worst of the worst to allow so much freedom. Omar said, "I ain't going to lie. My 20s has happened to me." Omar, no. One time it was so bad I fell asleep in Jack in the Box drive-thru. I was at the speaker. Omar, I'm glad you're not living that life no more. Oh my gosh, that's horrible. Auntie Natty said, "My sister fell asleep at a red light and she don't even drink. We had been up all night at the hospital with our mom. We're not Your sister cannot be a part of this one then, Auntie Natty." That's that's to that's real real different. Real different. Now, they drunk driving while sleepy is as bad or worse as as far as your response time, but sometimes you don't even realize how tired you are. That's that's not the same as you her voluntarily consuming something. So, you know, I'm not going I ain't got nothing for your uh your sister. That's a taking care of your mom is a lot. Zach said, "Is there a reason they don't automatically throw stop sticks down? I'd be throwing her down for a bad license plate." Traffic stop, stop sticks down, Zach. Just like spit mask in the pocket. It's going to be mandatory for me. [laughter] >> Can Can you roll down the window for me? >> Yeah. >> Just I see you. Just >> How's it going? Can you toss the car in park for a moment? >> Yeah. I don't know. Why in park? >> Uh, it's in drive right now. Can you put it in park? >> Yeah, that's >> I appreciate you. Um, the gear shifter to the right. Can you just toss it in park for me? >> Uh, yes. Nope. Yep. Nope. Stay right right where you are, ma'am. Right right where you are. Just toss it right in park. >> Yeah. No, no, just put the uh from driving to park. Just move it up three spaces. >> I'm saying I got to move. >> No, no, you're you're good. Right where you are. You're good, right? Ma'am. Ma'am, ma'am. Ma'am, ma'am, can you just stay right here? >> Can you just toss and park for me? >> One more. Beautiful. Okay. Do you want to put your pants up? >> Yeah, that's all. >> No, you're good. You're good. >> No, no, no, no. You leave the park. Just let me >> No, no, no. Where Where are you going? Yeah. Ma'am, ma'am. Ma'am, what are we doing? And there we go. Good candidate for stopstakes. Why is this happening? Why is she able to drive off right now when you had your car and then you had the police car blocking blocking the traffic of the street that's not blocking much? Can't even see the police car in this frame. Don't know how this is happening right now. I just if someone's asleep at a stoplight, I just feel like we should be doing everything cuz they're going to be out of it. Medical emergency under the influence. Some kind of reason. [laughter] 74. The vehicle is taking off eastbound on Green Leaf from Dodge. The driver's awake and she's heavily intoxicated. Taking off eastbound on Greenbound, [laughter] >> Candace said, "And she still signal to turn." That's funny. Not Not having the wherewithal to still put your signal light on. Ashley says, "So passed out drunk with pants down." Like, what the f was she doing? That is a good valid question. What were you doing? Why are your pants down? on Daryl, female black driver. She's actively pulling her pants up. She's heavily intoxicated, traveling northbound on that street just east of Dodge. 71, if you guys want to go follow it in that direction, I'll go see if it comes out on a dumpster over here. Can we have 77 go to its address over? We'll be cruising around over here 74 looking for it. >> Where would she have gone? >> All right. Yes. Forever TRL. I think he was trying to be the chill cop. That did not work at all. Zach said this is some Barney F typeish. Oh. Oh, Omar said the police weren't called for him. Oh, you got lucky. Lucky Omar. Oh my gosh. Auntie Natty says she didn't run. He let her go. In my opinion, he did not let her go. Auntie Natty, he didn't. He did not let that woman go. [laughter] He was just way too chill. But he did not let her go from that traffic stop. >> I'm still on. No, I was knocking. I was like, "Hey, some police like put it in park." And she did put it back in direction. I'm just going to park right here. I'm like, "No, no, just leave it right here." She's like, "No, no, right here." Puts it in and just dips on the green leaf. Okay, we got to replay this cuz Professor Purple Queen is also saying he did let her go. We got to go back. We got We need a replay. A instant replay cuz Hold on. Let's see here. All right. >> Just move it up three spaces. >> I'm saying I got to move. >> No, no. You're You're good. Right where you are. You're good. Right. Ma'am, ma'am, ma'am, ma'am, ma'am. Can you just stay right here? Can you just toss and park for me? One more. Beautiful. Okay. Do you want to put your pants up? >> Yeah, that's all. >> No, you're good. You're good. >> No, no, no, no. You leave the park. >> Just let me. >> No, no, no. Where? Where you going? >> Ma'am, ma'am. Ma'am, what are we doing? >> Got you. His lack of action, proper action. Basically, she was Okay, I got you. He was not doing what he needed to do, so she had a little little outing to go ahead and go. Got you. I thought you meant legally he was letting her go. >> 74. The vehicle is taking off eastbound on Green Leaf from Dodge. The driver's awake and she's heavily intoxicated. Taking off eastbound on Green Leaf, northbound on Daryl. >> He said move the gear up three spaces. But she's so drunk. She pro Well, I know she knew she was driving off. She knew by the time she was supposed to do it to put her in park and move up three spaces. But yeah, he they just need to take control period and actually box her in. But he told that other officer to block traffic, not box her in necessarily. Or he might have said both, but then he said block the traffic, although no one really comes down Green Leaf or whatever the name of the road is. >> Female black driver. She's actively pulling her pants up. She's heavily intoxicated traveling northbound down that street just east of Dodge. 71. If you guys want to go follow it in that direction, I'll go see if it comes out on a dumpster over here. Can we have 77 go to its address over? We'll be cruising around over here at 74 looking for it. Where would she have gone? >> I'm still on. Oh, I was knocking. I was like, "Hey, I some police. put it in park and she did put it back in drive. So I'm just going to park right here. I'm like, "No, no, just leave it right here." She's like, "No, no, right here." Puts it in and just dips on the green leaf. >> This must be I don't know if this is a small town cuz he is really laz about all this. Where could she have gone? And yeah, why didn't the other cop car just follow her? How would you lose her? You already got somebody behind the wheel. What is happening here? [laughter] Pull your pants up. Sign to her to go. They come back to Is it a female >> Kimberly? Yeah. >> If you run the race on it, would you be able to recognize her? >> I'll take a look at it. Yeah. >> Okay. All right. Well, we'll we'll >> Yeah, it's just Yeah, I don't know where she is. >> All right. >> 74. She's right in front of me. [ __ ] in front of the right here. 74 is what the subject. Hi. >> All right. So, >> why why'd you take off from me a moment ago? >> I got to get home. >> I know, but you're you're home right here. So, >> I'm sorry. >> You're good. Can you pop over right over here for me? >> Yes. >> Do you have any firearms or anything like that? >> I don't know, bro. >> Okay. I'm just just checking to make sure. >> No, I don't. >> Okay. So, can you keep your hands out of your pockets for me? >> Um, so you said no firearms or nothing like that? You're on body cam again. I got to let you know, >> bro. Come on, bro. Please. What happened right over there? >> Cuz I don't want to go to jail, bro. Please. >> Why would you go to jail? >> Because I My license is suspended. >> I have video. >> Your license? What's your license suspended for? >> DUI. >> It's suspended for DUI. Yes. >> How much did you have to drink tonight? >> No, I'm not drinking. >> I don't know about that. >> No, I'm not drinking. >> You were just parked up at the red light right in front of me. It took a minute to wake you up. >> I'm I'm not drinking, bro. I'm not drinking. >> Not right now. How much did you drink earlier? >> I'm not drinking. >> Okay. How much you smoke? I'm not smoking. This is my house. I I I just >> It's not what you're currently doing. It's what did you consume in the last couple of hours. Nobody said you're currently putting a a bottle up to your lips to drink or anything to your mouth to smoke. You drank or this is a crazy medical emergency. [laughter] >> Yeah. My family and I can't afford to. I just told you I had been drinking. >> I know. You just told me you had been drinking. >> No, I told you I'm not drinking. told me you're not drinking. Okay. >> Um, so your license is suspended for DUI. Yes. >> Is that why you took off? >> Yes. >> Okay. So, do you are you okay to walk in a straight line and everything like that? >> Yes. >> Okay. So, I'm going to have my partner can she patch you down for firearms really quick? Do you have any weapons on you? >> Can I park? >> You're You're parked right now. Do you want me to train? >> No, it's not. It's not. >> It's good for right now. We're going to leave it how it is. Can my partner patch you down for any weapons? Okay, perfect. Just Yeah, just stay right over here. Appreciate it. Don't do that in front of my house, please. I got my neighbor. [snorts] >> I know you got your neighbors and all that. But we we got a few things to work through right now. A little bit of things that concern me tonight. And >> this is my house. I'm right here. >> I understand. However, you're putting me in a difficult spot. So, we got to do a couple things to rule out all the possibilities that there might be intox. >> I don't >> I definitely think you should be able to take the square of you can follow me home cuz she literally did the action even if she didn't quote by, you know, word for word say it. So, you can do you can follow me home. There might be more, but that's the one I was looking for. Oh, I live right there. You can kind of take that one, too, cuz she showed them exactly how close she lived. [laughter] >> I I never >> Look what's in front of my house. I'm I'm part of the union. >> Yeah. >> Like I'm the bread winner in my family right now. >> If anything h like >> So, why were you why were you passed out at the red light over there dodging Green Leaf? >> No, I wasn't passed out. I was just like, >> she was just resting her eyes. She was praying officer. Yeah. Forever TRL said, "Does this count as fleeing and eluting?" I don't know if he ever said, "You aren't free to go." It it's implied once you're at a traffic stop. So, they could have charged her for freeing and eluting. They they did not end up charging her with that for this one, but they I feel like they had a good grounds to do it, though. Me and my girl, if you look me up, me and my girl been getting into it a lot. Like I call I call a lot on her because it's just like she's just like really like I wouldn't say she's harmful, but she's just protective and it's just like >> what does it got to do with the price of tea in China? You were found asleep at the wheel. You sound and look and are acting impaired. We don't care about your relationship issues. >> Whatever I do, I have to stop and pay attention. It doesn't matter if I'm at work. It's just like she drives me crazy right now. But I'm not I'm not just at the like. But when y'all stopped me, I knew what was going on. And then I'm like, damn, I'm at my house. Like >> my I work with my neighbor as well. So it's just like >> there's a suspect. I never ever in my life he f from the police ever. >> Just tonight. >> I swear to God this is the first. >> Where were you where were you coming from? >> I was coming from downtown. So >> Okay. Where were you downtown? >> I was matter of fact I was coming from Wrigley Field. I was in um I I didn't go out last night and I was supposed to meet up with somebody last night and I didn't meet up with them last night and I met up with them. I really feel right across. If you look at my car, you'll see stuff from 711. Yeah. I met up with them, chill with them for a little bit and then came back home and that was it. That that's why I went tonight. >> The million-dollar question is why were her pants down? There's theories flowing in the chat. I'm trying my best not to accidentally highlight, but I only have one guess as well, and it's basically what the chat's guessing. But why were her p not nothing good comes of why her pants were down and she was passed out at a red light. >> You doing when you were chilling? >> I was talking to them to be honest. I I I parked I can't show you my Snapchat like the whole >> Yeah. Like >> so I rolled up and you also had your pants down right >> because I piss outside. >> You pissed outside? >> Yes, I piss outside. That's why. >> Sounds good. >> Um what? No, no, no. That's not why. Stop playing with us. No, [laughter] >> I had to pee and and I pulled to the side. I pissed outside and then I was a little embarrassed and I hurry up and get back in my car and then I I pissed outside. That's why >> might have fallen asleep in the car cuz when I walked up, you were asleep. That's the thing. So, you say you'd be able to walk in a straight line, everything like that? Sorry. >> Okay. I know it's extremely dark over here, unfortunately. But fortunately, Officer Brown has a flashlight. Um >> Oh, man. I I work hard too. So I might be tired, but one thing I ain't freaking I'm not after that [ __ ] bro. I've been going to therapy like I will show you like I'm okay. >> Everybody getting their life together, aren't they? First video. She said, "I'm trying to change my life around." Drunk. This one I've been going to therapy. Drunk pants looking like a fool with her pants on the ground. Give me [laughter] Leia's grandma said, "Was she so drunk she thought she was on her toilet?" That is the cleanest, nicest, innocent explanation. Leia's grandma. So, I'll go with that one. >> Like, I'm not driving and drinking none of that [ __ ] Like, if you want me to [snorts] walk a straight line, like, I will. >> Yeah. There there's a few things I'm going to ask you to do, okay? Just to make sure that you're okay based on everything tonight. Okay. Do you have any eye problems or abnormalities? >> I'm good. >> How is your general health? >> I'm good. I always appreciate the police officers that do ask the health related questions before they go straight into you're drunk. There's a video, don't know if y'all sent it to me or I saved it for myself, but I do have one where it was he was either a offduty cop or retired cop that got pulled over. He was accused of being drunk um whole time he was having a um heart attack or some type of medical emergency. And I don't believe the cop asked him, "Do you think you're having a medical emergency?" I just think he went into he looked uh impaired and because if you don't hindsight know the title and know what's going on, it could be mistaken as that. Which is why I do appreciate when certain questions are asked like are you feeling okay? You haven't do you have something that that's going on. You should at least just ask even if you really really feel it's the fact that they're just drunk. >> I want you to follow the tip of my pen with your eyes and your uh right here. Tip my pen. I'm going ask you to follow the tip of my pen with your eyes and your eyes only. Okay? Do not move your head. Okay? Do you understand? >> Yeah. It's perfect. >> Now, you're doing well. We're just going to take a quick break. Okay. You're doing well so far. Just another minute of this. Okay. >> All right. >> I felt that with your eyes and your eyes only done. Move your head. >> Bro, I'll take care of my family, please. >> No, you're good. Just to the best of your abilities. Okay, >> I got you. I do not want no problems. >> You're good. Can you just follow my Thank you. >> Y'all crazy. Y'all met me in the front of my house. >> You're good. Can you do this for one more minute? You're doing Thank you. >> Oh my god, bro. I feel so stupid. >> You're good. Just the best of your >> You know what? That's an accurate feeling you should have. Let's try to change our life again going off of that that you feel stupid. >> Hold on to that. >> Just keep following tip. >> I see you, bro. I see you. >> All right. Thank you. >> Trust me. I see you. >> And do you have any back problems? Any leg problems? Anything like that? >> Any back problems or leg problems? Do you wear like a knee brace? Back brace? >> Okay, perfect. Um I just got to ask everybody that. >> So, one more thing. And you said be able to walk a straight line. >> Oh yeah. I mean this left and then you say put my right. >> Perfect. Just like that. And your arms down just like this. Don't do anything else until I tell you to maintain this position. Do you understand? >> Okay. What do you want me to do? Just stay right there. >> When I say begin, take nine heel to toe steps on the line. Turn around and take nine heel to toe steps back in the line. >> Hold on. That's too much. >> Yeah, I know. I'm just really >> Yeah, it's too much because you're impaired and can't follow these simple directions. I still would not take a field sobriety test if sober. I just want to keep saying that because I have no balance. I also when I'm nervous, I also will not remember instructions you gave me. Even if you only gave me two-word instructions, I've already forgotten what you said. So, I have to take the L. If someone if a cop ever pulls me over suspecting that I am impaired, I have to take the initial L, which I will hate. I will be terrified. I don't want this to happen to me. Go ahead and let them get me for refusing. Not refusing, sorry. But um I would just say please just go ahead and perform the blood and blood and breath test on me because there's I I my body is not going to let me perform this. Like I'm nervous. There's nothing wrong with me, but it's not going to happen. So I I go straight to the take my blood, take my breath. That's all I got for you. U she appears to be a happy drunk. She a little rebellious drunk, too, though. There was something else I was going to say. Oh, I just wonder too when this comes to court and let's say they watch the body cams, the the prosecution and defense watches the body cams, right? If you've already found someone passed out at a light, does it make sense to do a field sobriety test because it doesn't seem like they're for whatever reason going to be able to physically perform something or should you just go straight to would you like to have your blood and uh and breath tested? I always wonder that because it just seems like we've already gone to something more serious to back up and then do a field sobriety test. >> I'm going to demonstrate as well. >> Okay. >> As you're walking, keep your arms down to your sides, watch your feet, and count your steps out loud. Once you start walking, don't stop until you finish. Do you understand? >> One 2 3 4 5 6 7 8 9. >> There's not one heel and toe touching. There is not one heel touching a toe. >> And you say take some small steps. >> Yep. Just exactly how I demonstrated. >> One, two, three, and then go back. >> Yep. >> One, two, three, four, five, 6, 7, 8, 9, and then what else? >> That's good [snorts] for right now. >> That's a lot, bro. >> It's It's to the best of your ability. If you can get to 30 seconds, that would be great. I'll start my timer as soon as you raise either. I don't >> What happened? I'll go to jail. >> No, this is just to the best of your abilities. So, whenever you're ready. All >> right. Can you look at your toe while you count? I mean, no. I'm I'm I'm not I don't I don't even exercise. I want me to do that. I don't exercise. >> Okay. Recite the alphabet from the letter D to the letter P. Starting with D and ending with P. >> Hold on. I don't want to say >> Recite the English alphabet from the letter D to P by just saying it and not singing it. >> Hold on. Do you want me to say the alphabet? >> Yes. But don't say D and P. >> Say D and say P. Start with D and end at P. >> What? That's a trick. >> How am I What? How am I >> like D E F all the way to P? >> Bro, everybody's knows if you have to sing the alphabet, you have to do the whole thing. >> Okay. Would you [clears throat] be able to try to the best of your ability? >> I can do the whole thing. Yes, >> sure. I'll hear that as well. I f a j l k i s o. >> So you argue for yourself to say the full alphabet and then you also don't say the full alphabet. Don't say what everybody else can and can't do. You can't do this. WV, >> you making me feel dumb, right? >> Did she say a word? Look, look, look. Here we go. You're making me feel dumb. Did she say W bent instead of V? Like, are we throwing in words in the alphabet, too? Now it's it's lost. It's a lost cause. Why are we doing this? It's great for the officer's case. It's great for him. But she needs to stop. I don't know what she's saying. Lovable. Candace said I always have to sing the whole thing. Omar said pig Latin. [laughter] Let me go back. I want to enjoy this. Hold on. >> Mellow pig. It said alphabet. You have to do the whole thing. >> Okay. Would you be able to try it to the best of your ability? Start. >> I can do the whole thing. Yes. >> Sure. I'll hear that as well. >> Oh, she started off with the Spanish alphabet. [laughter] That's what Okay. A f J K L M O P Q I S O P W V. You making me feel dumb right now. >> Wow. Wow. Noir said, "I'm clumsy and have bad balance naturally, and I'm a super lightweight when it comes to alcohol. I'm going to jail automatically." Period. Yeah, we're going. We're gonna have to go and be defended later. To be fair, SOPs are important. They are important, Candace. [laughter] That's not what she was asked for, but they are important. [laughter] Mini, I'm sorry. Audo said there's only 26 letters in the alphabet. Why are you making up more? She went straight Spanish, Ashley. Uh oh, I think skipping. Let me see. Okay. Yes. Oh, this is a mess. I mean, the body cam will definitely show she's a mess. Yeah, there's no defending this. Not Creole, Louisiana. Oh [laughter] my. Maybe she wants to be arrested. At this point, I feel like she Yeah, she wants to go. >> You making me feel dumb. >> What's your first language? >> My first language is Creole and then I speak French. >> Creole and French. >> Okay. You you called it on the creole part, but you said but she said the alphabet in Spanish. Well, maybe that was maybe No, cuz maybe those first consonants can also sound I got to redo my stuff on on French. I'm not sure on that one though. I feel like she did more Spanish inunciation than French inunciation cuz French kind they kind of cut theirs off shorter in my opinion. >> Okay. Um >> speak French and English. Do you know how to count backwards from like 57? >> Oh, I know how to count. >> Would you be able to count backwards from 57 to 42? >> Yeah. >> All right. Whenever you write to the best of your ability. >> 57 56 55 54 53 52 51 50 49 48 47 46 45 46 47. >> All right. Do you remember what I asked you to count down to? >> 50 to 47. 57 [snorts] to 42. So that's that. Um >> I mean I just said it backward. >> I know you're under the influence. >> No, I'm I am not. >> Okay. >> I'm tired. >> When's the last time you slept? >> Oh man. [laughter] >> Yeah. Careful. I don't want you falling over. >> I don't want you falling over that behind you. >> This is my neighborhood. >> Yeah. I just I a circle thing behind you. >> What's in the cup in your center console? >> Oh. A big ass cup of water. >> Cup of water. So, here's the thing. I know you said your license is suspended for the DUI. Yes. >> There's a fleeing and looting that occurred as well as you're displaying multiple signs of impairment. Okay. >> You said I did what? >> You're displaying multiple signs of impairment. Okay. >> I did what? >> There's actually so much that she could have been charged with. And I think she only got a DUI charge or OVI charge. He could have got her for driving knowingly driving on a suspended license. Um, the fleeing and the looting open container possibly cuz I don't think it's a big I don't think it's a big cup of water in that car. Just I'm not thinking that. Could be. But >> displaying multiple signs of impairment. >> So at this point you're going to be placed under arrest for DUI. We got to go to the station. We're going to ask you to place your hand. >> We'll figure that. I'm going to ask you to place your hands behind your back. You're being placed under arrest for a moment. >> So you going sell my car? Can you leave my car? >> I unfortunately cannot. >> No. Listen to me. >> I know. I know. We got a couple things to do. We got to talk about what happened tonight. We got to go to the station, do all that stuff. Can I take your vape from me? >> But that's in my bag. >> I know that this is in the trunk, but I still got to make note of it. So, >> tequila reposado in the trunk. I know. >> I know. I know. But you still got it. >> You're right. It's not immediately. >> I know. You got me there. Um, [snorts] all right. You're going to go sit in my car for a moment and we'll figure figure everything out. Okay. So, we're just going to walk this way. I appreciate you. I know. >> Okay. Can Can you take my key out and leave it in my face? >> I'm going to take the key. Yes. I'm not going to leave. >> Good one, Ashley. Well, okay. Does she get it if she's still inside her car? Because they saw it. But did she fix her pants before she got outside of the car? And does that matter? But indecent exposure is a pretty good suggestion of a charge. That's That's a good one. >> I'm just saying put it in my >> I can't leave it. >> I got it, bro. I got it. No, I'm not. >> No, >> I got to let you know that. >> Can you pop right in there for me? We got the seat up there. >> Take me to jail, right? >> Yes, you're going to jail. >> Okay. I can't afford to get my phone. >> Please take a seat. I know. >> Have a seat in there for me. >> We got a little bit of paperwork to do the station. We'll figure everything out. >> Going to continue to talk to you. You just got to have a seat. >> I'm with you for the next couple hours. We'll figure everything out. Well, we're in this together. >> We don't even have to do all that, bro. >> We do. >> Ma'am, you got to take We got to get out of the ring. We do though for he he [laughter] gets an award for being one of the chillest officers I've seen in a while. I'll give him that because he's not no nonsense. Definitely not no nonsense. He is laidback and like overly chill cuz she shouldn't have been able to drive off, but he is very much just even kill. Just you're really not going to get me riled up. T forever. TRL said I'm not saying you should flee, but if you do take the car home, you need a garage to park it in. You have a better shot of them not towing it. Your chances increase. Now they can say we'll take it because now you committed a crime and you used it in the commission of a crime. But this chill officer doesn't look like he's going to tow the car possibly. So you're right. Your chances increase of your car not being towed. At least she's actually she actually has been only drunk that passed the sobriety test in my opinion. She didn't pass it though. Tequila mention [laughter] so bro. Everything's recorded on camera. I got to let you know. >> And then he's going to buckle you in. >> All right. Thank you. All right. Thank you. Just All right. >> The woman was arrested and charged with DUI. >> See y'all, he was even chill on the charges. Let's look at her DUI. [laughter] So, she was in Ohio. It's a misdemeanor on a first offense. She's on the suspended license for pre or for previous times. So, I don't know. Um, it says prosecutors generally must prove the defendant operated a vehicle and the defendant was under the influence of alcohol, a drug of abuse, or a combination of them at the time of operation. Possible defense challenges. A defense attorney may challenge whether the defendant was sleeping, not driving when officers made contact. The observed behavior may have resulted from fatigue or a medical issue rather than intoxication. The officer's observations alone do not establish impairment. Um, no. She she she fell all over the place. She couldn't keep her foot up for the 30 seconds, let alone 10 seconds. Omar, she did not do her heel to toe. Her heel and toe never touched on that non-estep turn. Um, alphabet was a no-go in any language. She skipped letters. [laughter] No, she did not pass. Omar, if you were a cop, it'd be a lot of people that got away with Phil so Oh my gosh. Okay, on to the next one. Oh, we got to do our lawyer reaction. So, this says police force driver to take a field sobriety test. All right, let's see what Let's see. We'll just have to go cuz I never know when he's going to ask this question. >> Lawyer's reaction. >> You're going to just watch my finger for a DUI checkpoint. Okay. Oh, I don't consent to any. Uh, >> yeah, >> this looks like AI, but I play it for the education of it all. But he looks very AIish. >> It's a DUI checkpoint. You have to consent, sir. >> Can I have a supervisor? Cuz field sobriety tests are not required by law. >> Yeah, just as I don't want to do that. >> I know, sir. >> No, I don't. >> Follow his commands or we're going to drag you out of the car. It's a two. It's a violation by fourth amendment. So, are you going to arrest me if I don't come out of the car? Arrested PC1 the Supreme Court. All right, let's see what the attorney says. I'm not even sure what I guess. Do you have to take the field sobriety test or can they force you to take it, I guess, is the question. But here we go. Cuz we kind of watch so many DUIs. I feel like we know the answer to this one. But here we go. >> Has already ruled that DUI CHECKPOINTS ARE LAWFUL, REQUIRING YOU TO STOP for police observation. Now, when it comes to a CHEMICAL TEST, REFUSING TO consent could get your license suspended IN CERTAIN JURISDICTIONS, BUT THAT DOES NOT APPLY TO A FIELD SOBRIETY TEST. It is important to remember THAT A FIELD SOBRIETY TEST RELIES ON THE officer's interpretation of that test, unlike a chemical test that has actual data. So, this officer's statement that he must consent because it's a DUI CHECKPOINT IS ABSOLUTELY CORRECT BECAUSE THERE'S no requirement under the law to provide consent. You don't want to. >> Yep. There's temporary consequences if you don't, but you don't have to. But yeah, all day. Test my blood and breath. I'm ne I'm never passing a uh field sobriety test. When does Sorry. When does fatigue cause you to pull your pants down? It shouldn't. [laughter] It shouldn't. Lay his grandma. That was just our hypothetical uh feature we've added. But for her, no. [laughter] All right. So, this says California Highway Patrol DUI stop turns violent in Long Beach. Suspect kicks officers during arrest. I think this is one where she does get a lot of charges. All right, let's start. It's going to be annoying. It was 2:40 in the morning on January 14th, 2026 in Long Beach, California when highway patrol officers pulled a Toyota Corolla over on Long Beach Boulevard after the intoxicated driver failed to stop at a red traffic light. >> Stop right here. Stop right here. Stop right here. Window down the car. Window down the car. Hello. The red light. >> Where you coming from? >> You're grabbing friends. >> Thank you, ma'am. >> Right here you right now. Where's home attorney for the car? Who's the owner of the car? >> Okay. Your insurance company should be infinity. >> Any alcohol tonight? >> You said it should be infinity. >> Hang on the car. driving. >> Okay. All right. So, because you red and I smell alcohol, I just want to make sure you're good to continue driving since you're going all the way to Gardina. Okay. So, I have you hop out. I'm ask you a couple questions. If you're good, you're good. Okay. I just smell that alcohol in the car. Go ahead and sit by for me. Did she say she was going to church or uh on her way from church? Cuz I saw Omar, I saw your comment about church. Did [laughter] she Did she say that's where she was coming from or going to? No weapons on you or anything. I'll just walk over the car for a minute. Okay. And then you said grandpa's car. >> Okay. You want to put your phone on your trunk? You want to put your phone on top of your trunk? Uh No, you're not going to hold it. I'm asking you if you'd like to put in the car on top of the trunk. Put you through field test over here. Hold your phone. one top your trunk for now. You get it back when we're done. Okay. All right. And you said grandpa's part. Is there anything mechanically wrong with the car? You know, are you sick or injured? Diabetic epileptic. >> Do you have any physical? No. >> And when's the last time you slept? >> Last night. >> Last night? How long did you sleep for? >> 9 hours. >> Okay. And when the last time you ate? >> Two hours ago. And what did you have? >> In driving this car, >> where did you start diving from? Where did you start driving? My house. Okay. My house. >> Your grandma's house? >> Yes. >> And where you going right now? >> To drop them off. >> Which is where? >> Probably the Murray Park. >> Okay. >> Okay. And um uh what did you drink tonight? >> Nothing. >> Nothing at all. No alcohol. whatsoever. When's the last thing you have off? >> Maybe like two weeks ago. >> Two weeks ago. Okay. So, I'm going to tell you right now, I'll be straight up with you. I can smell it on your breath right now. That's fine. If you're going to admit that's fine, your eyes are red and watery and I can smell it on you. That's why we're here right now. So, I don't need to ask you started drinking, you stop drinking, where you're drinking or feeling affecting drinks. Okay. And uh you taking any medicine today? Any drugs? >> Okay. Not clean. Any drugs? Okay. Involved in an accident at all. You had any recent surgery performed? >> I ask if you're in the car doctor. >> Yes. >> Okay. You're not? >> Yeah, I am. >> You are in the car doctor. Okay. For what? >> My medical. >> Like like what what kind of issues do you have? >> I don't have any issues, but I just go get checked up there. >> Okay. So, I mean, we all get checked up at the doctor like maybe like a physical, but do you have any health issues regularly? >> All right. So, she actually tried to claim medical, but since I know she actually got charged, I'm waiting to see how this goes. I skipped from just making sure I knew the location of this and then to where her charges were, and I did see her get a little crazy in the middle, but I didn't watch this straight through. >> Okay, I'll have you step off off the sidewalk here. Let me take a look at your eyes. Okay, right there. Turn around and face me. Turn around. Face me. So, put your feet together for me. Hands down by your side. Just like that. You wear contacts? >> No. >> No. Okay. Don't you follow my pen here with your eyes only. Okay. You're not going to move your head. >> Oh, that's what got her. She still took the test. That's going to be part of the issue. >> You understand the instructions? >> Do you understand the instructions? >> Yes. You said just don't move my head. Yeah. So, keep your head still and just follow with your eyes only. Okay. Oh, I was on mute. Sorry. I was trying to say in a turn of events, there is a literal Candace pointed out there's a Jack in the Box drive-thru behind her right now. And I said, "What are the odds?" >> Your head still with me, like straight with me like this. And then just follow with your eyes on me. Okay. >> Keep following the pen. Okay. Can you see the pen? Can you see the pen or not? >> Yeah. Okay. So, I want you to follow the pen. Okay. So, your eyes should follow it to the pen. So your eyes should follow the tip of this pen. Okay. I can tell you're not looking at the very top. >> Okay, that is an interesting tattoo because she is not treating herself well the more this video is going to go because her tattoo says, "Love yourself and the rest will follow. I don't know. She's giving herself the love. You know, you would want to give yourself in this situation. No, it's it's on there. She got two earrings on. It's causing a shadow, I think, right now. You going to get completely tell you're not following the tip of the pen. I'm going to do one more for you. I want you to follow the tip of the pen. We're not following the pen at all. You're going to sit back on your feet together. Hands by your side for me. Face me. Face me. Face me. Feet together. Hands by your side. Perfect. Maintain that position until I tell you to move. Okay. So, when I tell you to begin, you're going to raise one of your feet approximately six inches above the ground. Okay. I'm going to demonstrate for you. Go ahead and look at my foot. Okay. Keeping your raised foot parallel to the ground just like me. You're going to count out 101 100 3 and so on until I tell you to stop. Okay, you understand those instructions? >> Yes, ma'am. >> Yes. So, which one are you going to race? >> I'm probably going to raise my right >> right one. Okay. >> It is crazy that she is pre- crash out right now and very calm. I guess she really thought she was about to pass this field sobriety test. 20012. >> Her feet look so tiny. [laughter] 14 2015 2016. >> Now I want to know what the sheen tattoo says too. It's a whole paragraph. It's a whole paragraph on her leg. Um, okay. So you do a test I I'll explain it to you, but you think you can perform a test that requires walking in a straight line? Yes. Um, it's a little slanted right here. We'll go in the parking lot. Just stand right there with >> I hope it doesn't say something like make the best choices in life and make wise decisions and don't do something you'll regret later. >> Excuse me. Okay. So, I want [snorts] you to imagine a straight line. Take a few step that way. I'll leave you right here. There you go. Okay. I want you to imagine a straight line directly in front of you. Okay. Take your left foot and place it on the line. Go ahead and do that. Now, you know, the heel of your Yeah, your left foot. Yes. Okay. With the heel of your right foot, you're going to take it and place it directly in front of the toe of your left foot. Just like me. Perfect. Just like that. Make heel toe contact. Okay. Like your sandals on top of your other sand. >> There you go. Just like a little >> You want to take them off? Yeah. >> Is that all right? Okay. Hands by [snorts] your side. Okay. Maintain that position until I tell you to. Okay. So, don't move from understand. Yes. Okay. Go when I say to begin, you're going to take nine heel to toe steps down the imaginary line. Okay? They're going to look just like this. I'm going to demonstrate for you. Okay? So, watch me. One, two, three, four, five, six, seven, eight, nine. Okay? On step number nine, leaving your front foot forward, you're going to take a series of small steps to turn around, >> just like me. >> You're going to take nine heel to toe steps back down the line. Okay? Heel to toe. One, two, three, four, five, six, seven, eight, nine. >> While you're doing [snorts] this, you're going to look down at your feet the entire time. Okay? You're going to count your steps out loud. You're going to keep your hands by your side. Once you start walking, you're not going to begin 4 6 Oh, Jacqueline, expand on your question. Does it make a difference if locations change when taking the test? Are you saying like if they start here and then end up at the police station to finish the test? Even if you do ask this, let me tell you, I hope somebody in law enforcement answers the question or an attorney comes in here and answers that question because it's a good question. I don't know if you mid change the location if that's okay or not. I know they usually if they trying to get them on flatter ground sometimes, but that's a good question. >> Um, so I am requesting that you take a preliminary alcohol screening test, okay, to further assist me in determining whether you under the influence of alcohol, okay? You may refuse to take this test. However, it does not imply consent test. And if arrested, you will be required to give a sample of your blood or breath. Okay. For the purpose of determining the actual alcoholic and drug content of your blood. Okay. Do you understand that or would you like me to explain it? >> Noir. Not a heel, not a toe touching. I'm with you on that one. Gwen, you're like me. I wasn't going to say anything. I'm like, okay, her feet are nicely arched. [laughter] I was thinking the same thing. I'm like, I don't know about cutting in here to say that. I also was like, oh, I I would not want to be walking on that concrete barefoot. I understand. I just want to figure out what's going on with the vehicle. >> Oh, well, yeah. Well, we'll get to that. Let's focus on it now. Is she on you have permission? You do you have permission? >> No. Okay. So, would you like to perform the test? Yes. >> Yeah, I'll take it. I just want to um just make sure that the vehicle is okay. And we will once once we get to that step >> 99. >> Do you know the man in that SUV? >> Okay. >> Sorry. He keeps going over or something. >> Okay. So, before I take the test, I just want to see like can I just get the vehicle moved off the road or moved off the side? >> Yeah. So, we'll make sure that the vehicle's safe for sure. That's part of our our policy. Um, right now, if you want to perform a test, like I said, you can. You don't have to. It's not it's not required. It's voluntary. It's up to you. You're not required to do this. >> You want to do it? >> Because I know when I get to the station, it's going to be like take a test or something. >> So, you're familiar with implied consent, >> right? Okay. So, you're familiar with the test you have to submit to once you are arrested. If you are arrested, this portion is voluntary. You don't have to do this. So, this is not the same thing. That makes sense. >> No, I just want to make sure what's going on with the vehicle >> and we'll we'll get to the car about you right now. Okay. So, do you want to blow into this? Yes or no? >> Yes. >> Yes. Okay, big breath for me. Big breath and blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Okay. Do that one more time. Okay. Two seconds. We'll wait about two minutes. >> Okay. On this screen, the text says, "Preliminary alcohol screening breath test result was a blood alcohol content of 0.164%, just over two times the legal limit." >> Who are the the ladies in your car? My cousins. Your cousins. Okay. So you were coming from right there. I was taking them home and I was going to go right back home. Okay. Come here for my son. Oh, okay. My son is almost two months. He's with his dad. Dad doesn't live with you. >> [laughter] >> Okay. >> You weren't going to go pick him up tonight, were you? >> No. >> Okay. All right. I'm just asking. Probably not a good idea. All right. Let's go one more time. Take a breath. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Bl. Bl. Bl. Bl. Bl. Bl. Bl. Bl. Bl. Bl. Okay, it says it again. Did they do two tests? I'm like, why are we seeing this again? All right, we're going to keep going. Oh, here come the flip. It's coming. It's coming soon now. Forever TRL remembers All right. So, right now you're under arrest. Okay. Um I understand that you've been through the process before. >> So, the car is going to be taken care of. I'll make sure that your cousins are taken care of. Okay. You kind know the deal here. You guys submit to a test for us. Okay. Okay. Hey, so can I just call someone and come pick up the vehicle? >> I gave you guys the valid license. >> Okay. I didn't run it, so I didn't. >> That's the first thing I had gave you. >> No, no, I have it, but I didn't run like I parked. I didn't run it. So, it makes I don't >> Yeah. So, I have a valid license. So, if I could just drive it off the road or something. >> You So, we can't drive. >> No, not me. Drive it off the road. I'm saying like someone could just drive it off the road and park it and my mom can come get it or >> So, we'll talk about that. That's something I have to ask my supervisor about. Okay. That's not a promise, though. Okay. So I mean place under arrest. Um do you have anything in your pockets or anything on you like in your bra or anything? >> I don't go and take a seat in the car for now. >> CALL MY MOM CUZ I DON'T KNOW WHAT they trying to do with the car. So call my mom. >> Take a seat in the car. >> Take a seat in the car. I'm not going to ask you again. >> You heard me. >> YO, I'M NOT ASK my mom. >> Sit in the car. I will tell her to call her. >> Okay. So, there maybe there was someone in the car with her cuz she's calling somebody by name or maybe that SUV that we thought was like just a stranger. Maybe Leila's in the SUV. I don't know. >> Mom, just sit in the car. I will tell her to call your mom. You need to sit in the car right now. I'm not asking you right now. >> You need to sit in the car >> for what? >> Because I think you're under arrest. That's why. >> Okay. So, I'm asking so I can give my >> You need to sit in the car. I will I will tell them myself. You need you need to sit in the car, sir. What's going on? >> Nothing really. I just was trying to tell my little cous. Okay. >> No, I'm telling what's going on with the car. I have a valid driver's license. So, why can't they call my mom over? When is this suspended? >> January 4th, 202. >> January 4th. It's January 13. >> Oh, that is soon cuz it is okay. To be fair, maybe she didn't know her license was suspended because they said it was suspended on January 4th. It's January 14th right now. So, >> how is this suspended from January 4th? >> 13th, you need to pass as of like 11 days ago. Your license is suspended. You see what I'm saying? January 4th. 13th. >> Okay. So, where's the super? >> Wait, what year? Hold on. He said January 4th something, though. Let me turn caption on, too. Hold on. Let me see. >> January 13th. How is this from January 4th? Okay. 13th. You made it past 4. As of like 11 days ago, your license is suspended. You know what I'm saying? >> He said 11 days ago. So, okay. They were arguing about the 4th and the 13th. You got it. >> January 4th, the 13th. >> Okay. So, where's the supervisor at? I'm going to >> You're getting in the car. >> You are getting in the car. No, I'm not. >> Yes, you are. >> If you don't get in the car, you're doing a lot worse for yourself. Okay. Please get in the car. All right. Supervisor is not tired. TELL THEM TO COME. TELL HER TO COME RIGHT NOW. >> I WILL. I WILL TELL HER. >> CALL HER AND TELL HER TO COME RIGHT NOW CUZ THEY TRYING TO DO SOME janky [ __ ] >> Yo, you're facing more charges right now if you don't get in this car. Tell you that right now. It's more charges for you. If you don't get in this car, my last time I'm telling you, I'm putting you in this car. >> Please do yourself a favor. Just car. >> There's another misdemeanor charge. If you don't, >> don't drive drunk and then be pulled over. So then the cops have the discretion on if they'll be nice and let someone get the car and pull it over for you or if they're going to take it and get it towed. Don't drive drunk. That's the initial cause of any other inconvenience you are experiencing at this time. >> All for a car. You'll stand for the whole week. Get in this car. >> Get in the car. Get in the car. Why are you touching me? >> I told you five times. That's why I know you're really drunk right now. Get in the car. Yeah, you are. Get in the car. No, I'm not. All right. Omar said it looked like she was already in the car. I'll go back and look. Pay more attention and see. Let's see here. >> Get in the car. >> I told you five times. That's why I told you. Yes, I did. I know you're really drunk right now. Get in the car. Yeah, you are. Get in the car. No, I'm not. Nah, I think she's doing something passively on purpose. Omar, because the the shuffle didn't happen as soon as she sat down and it's like they got impatient and started pushing her. She look like she's doing a semi-rebellious let me hang my thigh meat off the thing in my foot where they can't get me all the way in this seat belt and close the door possibly. But y'all let me know since we're all paying more attention. >> Stop resisting weird. Yeah. >> Oh, yeah. I'm out of gloves now. I'll skip ahead to where they start interacting with her again. It might not take Okay, they're talking to the person about the vehicle. I'm skipping that cuz we still got a lot to go. All right, so y'all were right. Two breath tests were taken. Oh, wait. Three. Was it three? Oh, yeah. Two. They're just splitting it up twice. Okay. Yeah. Two breath tests were taken around 3:57 and 3:54 a.m. >> Cuz you this [ __ ] You think you cool. Y'ALL BOTHING EACH OTHER. HOW CUTE. Y bothing. How cute. Y MIGHT AS WELL GET MARRIED. Y MIGHT AS WELL GET MARRIED. Y BOTH EACH OTHER. OH [ __ ] >> WHY WOULD Y'ALL BOTH JUST DRIVE IT? [screaming] >> Oh snap. Oh, baby. You got to understand your weight class, too. I don't know if they did or didn't do it on purpose. It is some plausible deniability in this one between she doesn't have balance cuz she's twice the limit. There's a size thing. There's an unexpected movement [laughter] component. I don't know if they did this on purpose. Oh my god. Okay, we're gonna go back. I did not expect to see that. >> WHY WOULD Y'ALL BOTH JUST DROP ME LIKE [screaming] THAT? Y BOTH STUPID AS [ __ ] Y BOTH AGREEING ON STUPID [ __ ] JUST DROPPING PEOPLE. DISAGREEING ON DUMB [ __ ] >> Maybe they got distracted with thinking they should get married and so they weren't, you know. I think she slipped on something though. Her balance or whatever. I don't think they push they didn't push her down. I'm going tell you right now, if you slip and we are not about the same, you're going to have to fall and eat it because you're not going to hurt as much being drunk. You're not going to hurt my back and hurt my career. It's It's not happen. Oh my. The way I just [laughter] Oh, I didn't know it was coming. >> This [ __ ] is dumb. >> Throw up. >> Throw up. >> Oh, >> nasty. >> Fantastic. >> Who's throwing up? [snorts] WHO THROWING UP? WHEN DID I EVER THROW UP? Don't touch me. Y'all both nasty. Y'all bothing each other. Y'all nasty. >> Nasty ass. Nasty ass. Now yall trying to carry me. >> Ma'am, you back. Shut up. Nobody Nobody spitting over each other. Who spit on each other? Y'alling each other. Y nasty ass. >> She tried. >> Oh, she got a spit mask on. Okay. >> Hey, what? So what? So what? I don't give a We hot tire. We're hot tire. Get tire. Get a hot tire. >> Oh, that is a very I'm glad you did this. Okay. Public friendmy number one said, "I am a retired law enforcement officer from LA County." I didn't know that. So, okay. I did have at least one person with some some law enforcement experience in here. Okay, Shan is my other legal eagle, but Shan be Shan Shan doing her her thing, living her best life, [laughter] but yeah. So, okay. Thank you for being here. I worked a solo unit. Whenever I saw a female California Highway Patrol officer alone on a traffic stop, I always back them up. Their backup could be miles away. I'm sure that was very much appreciated. And I'm glad you were conscious of that. That That's very nice. And that seems like that's not common the way you worded that, too. She's kicking. Get her out. No. No. Leave in the car. Leave in the car. Leave in the car. Leave me in the car. She's kicking. Leave me in the car. >> Leave me in the car. Yeah, >> it's in my bag. It's right here. Pop the truck. >> Yeah, it's in his backpack right here. >> I don't know. And the front pan, >> baby. That ham hawk is about to do damage. [laughter] Oh my gosh. I do not want to be in their position. >> I don't know. >> Take her out. >> Are you going to take her out? Stupid. Are you going to take her out? stupid. >> Stop. Stop. What? Sit up. >> I'm sitting up. >> Yeah, that's why I'm sitting up, homie. What? Now what? >> I don't care. >> Where's my property at? Where's my earrings? Where's my [ __ ] at? >> I thought that one officer had a leash in his hand. At first, I was like, what? What is going on here? [laughter] >> Where's my [ __ ] at? >> You're wearing it, son. >> No, I'm I'm missing one earring. I'm not stupid. Why would y'all put me with these lovers? Theying on each other. Why would y'all put me with them? This is stupid. They flirting and [ __ ] the whole time. This [ __ ] is dumb as with each other. >> Again, she is partially correct. This is dumb AF. I can agree with that part. But who she believes is dumb is the problem. >> Please put me with somebody else. I'm sorry. I'm sorry. I'm sorry. I have We have seen, as Zach called it, the burrito wrap. What in the gym class, Matt, are they rolling out right now? And what are they going to do with it? [laughter] Look at Tell me this don't remind you of school. Hold on. They What is this? I Oh, I ain't never seen Oh, no. Is it because they couldn't do the normal rap? Fantasy final thing. The hobble is when they do the ankles together. This a whole I don't This is a rap. I don't know. I don't know if they'll end up using it or not, but wow. Never. I have never seen something like this. Ashley said, "I knew she was missing an earring." She had it for a little while, Ashley. when you first asked it was still in her ear. And uh y'all said she said she got a two-month-old at home. That's crazy. Lovable said the cops are still getting their job done even if they're flirting with each other. Fair. They really are. They about to wrestle, girl. [laughter] Let's see. Oh, wow. I'm having gym class flashbacks. I'm telling you, noir. Audo say it's like a chalupa rap. Please go down >> for what? I'm not no animal. >> I don't care. This way right here. >> You so slow. You don't even know what to do. You don't even know. You don't even know what to do. Use your body weight. Slow ass. Slow ass. You don't even know what the to do. You so busy this [ __ ] you don't even know what to do. You so busy [ __ ] that [ __ ] you don't even know what to do. Damn ass. He's so busy this [ __ ] you don't even know how to hide. Don't cross the feet. Keep Keep them side by side. Much easier in between. >> Stupid. He's so busy as >> stupid. You don't know what to do. Oh, it's really happening. It's really, really happening. They are really putting her on this thing. I don't know if some of y'all I know cuz we've been watching body cams together for a while, but I don't know if y'all know what the traditional rap looks like. It's more of a slim old school ambulance type carrier where they have to mainly carry you but they end up you know wrapping you so you're you're stuck to the thing and everything. I have not seen one made like this before. What's your name? Ma'am. Yeah, she is really fixated on that forever tiara. I agree. I'm not skipping this part. I'm staying right here. Um, Noir Angel said, "Calling someone else stupid while you are getting rolled up like a burrito because you won't walk and hauled off to jail without your dignity is crazy work." I couldn't have said it better. Noir. [laughter] Jacqueline said she can't wait for the finished product. I've never seen it. I hope we get to see the end as well. I need to see what this does. Omar said that they wrap her mouth. She is quiet. I don't know if her dignity finally kicked in or [laughter] she's quiet. Yep. Lovable Sergeant Curtis would give would approve of the female officer having her hair in a bun. Very tactical. That looks like the slide used for emergencies on an airplane. That's a good comparison, too. It looks It does look like a training class. Like y'all, we don't use this often. We got to use this as a training moment. Come on. So we can sign your uh we can sign your training forms off on OJT for this one. [laughter] I'm so if I could have got a better thumbnail with this [ __ ] I'm going to describe it in case you can't see. So, we have one, two, three, four, five, six officers standing close. We got one in the foreground. That's seven. And then they they haven't really rolled or done anything with this blue mat yet, but the way they have her on here, she's she's laying perpendicular to the creases of the mat. So, I'm wondering what's going on with that. And then like her shoulders on the mat, but her head isn't resting. It's very actively up and she has a spit mask on and for all the activities she's been doing, she's very very still right now like a mannequin challenge. And all of this is cracking me up. Yes, it's it's it looks like a teachable moment. Candace and this is how you hem a silly Billy goat up, right? [laughter] >> You have an explorer. Whose floors are there for >> with the way she's acting. I feel like she knew exactly why her license was suspended, that it was getting suspended and everything. I now seeing her, I don't care that you it was only suspended 11 days ago. I feel like you definitely knew it was coming. See a chest ride. Did she already kick the cop or is that still coming? I missed it. You want me to bring the car up? >> No, he's bringing his car up. >> We'll just leave this with Ray Darters. You're good. >> Okay. >> Yeah, you can go, dude. >> Okay. Yeah, we got we got calling. So, >> yeah, I just said go. I just said, yeah, we'll leave the graveyard. Go 108. >> You're good. apart. >> Oh, her battery recharged. She's She's activated again. She rebooted. She is She is very much here again. That Okay, who said it? That it might be a cushion. Omar said they wrapped her up the they put her on the mat so she wouldn't be on the ground. So, okay, it might just be a cushion. They were standing around like it was real training, though. I thought they was really about to do something with that. And there we go. All right. There we go. Throwing the words out. >> Oh yeah. That's why [ __ ] like this. They touching on each other and [ __ ] I can't wait till y'all catch them. That's why I'm losing mother feeling in my [ __ ] Watch. >> There's legitimately there's like 16 people out there cuz you got one driving away. possibly has a partner in the passenger seat. They they turned around to the crowd. I'm not even trying to count them. There's a lot of officers out here. [laughter] This [ __ ] is stupid. >> Again, she's not wrong. This is is stupid af. And you could have walked on your own. We are here because she didn't want to walk on her own. Are we not? Cuz I'm pretty sure they didn't mean to exert all this energy and would have loved for you to sit in the car voluntarily. Walk on your own voluntarily. >> You figure out how to tag my big ass. This is stupid. >> One of each. >> You get two offers. Only so far that they can go. Let's get a couple. >> That was an efficient lift with all those officers out there. They didn't really use as many to lift her as I I would have thought they would have. though. Oh gosh. Okay. Ham hawks out >> my hand. All right. All right. >> Wash it. >> One more time. HURRY THE UP. DAMN. I DO NOT TAKE ALL OF THIS. like what y'all should have been >> again. She is right. It doesn't take all of this if you had a walked voluntarily. But here we are. Public friendmy number one said the mat is so that she does not get scraped up from being wrapped. California pays out a lot of liability claims. Gotcha. >> Y knew how to do this [ __ ] What? She don't know how to do [ __ ] [ __ ] trying to break my arm and my leg. Watch, [ __ ] Watch when you be fired. >> Watch. So you need to move. >> Well, now it's going to be. >> Okay, they listed the charges in the description box. I'm glad I went down to see that. Thought, dang, they didn't tell us the charges. But they did. It's in the description box. I already have it for us. There were a few. Here we go. So, the first one was driving under the influence of alcohol. We already looked at what prosecutors generally must prove, so I won't reread that. And we also looked at the average, you know, defense attorney's possible challenges. So, I won't read that. We'll go to another charge. Then, we have a DUI with a blood alcohol content of 01.1% or higher. And it says they have to be convicted of the DUI. and the defendant's blood alcohol content was 0.15% or higher or other aggravating facts under the statute apply because this is an enhancement slash aggravating factor for as a or to a charge I should say possible defense challenges the reported BAC is is the reported BAC accurate the enhancement is supported by is I hate when not okay sorry is the enhancement supported by admissible evidence can the prosecution prove the enhancement applies under California Um, and because they they had two charges listed in the description box, the other one was a BAC of 0.08 or higher, they have to choose one. One will supersede the other. So, only one can, I guess, stick as a actual charge. Um, battery on a peace officer is the next charge. It said, okay, this says wobbler can be charged as a misdemeanor or felony depending on injury and circumstances. Prosecutors generally must prove the defendant committed a battery against a peace officer and the officer was engaged in performance of official duties and the defendant knew or reasonably should have known the victim was a peace officer and the battery caused an injury requiring medical treatment. Possible defense challenges. Was the officer lawfully performing official duties? Did the defendant act in a lawful self-defense? Was the alleged contact meeting the legal definition of battery? And then hold on. Did I do this twice? Uh, I think I did. The other one's supposed to be assault on a police on a peace officer. For assault, it is a misdemeanor. And sorry, I'm I'm losing my words. The prosecution must generally prove the defendant committed an assault and the alleged victim was a peace officer. they were performing their official duties and the defendant knew or reasonably should have known the victim was a peace officer. The defense attorney can challenge, did the defendant ever attempt to strike the officer? Did the officer misunderstand the defendant's movements? Does the evidence show defensive actions rather than an assault? That would actually be good for sometimes because they they they call bad on Leo sometimes a little too easily. So with the defense attorney on some not hers but on some that will be I'm glad they can challenge was it defensive actions or were they attacking you? So that's a good one. Next is uh hold on keep going get my charge resisting slashobstructing an officer misdemeanor. Prosecutors prosecutors generally must prove a peace officer was lawfully performing official duties and the defendant willfully resisted delayed or obstructed the officer. A defense attorney may challenge whether the defendant was confused rather than intentionally resisting. The defendant was attempting to comply under difficult circumstances. The body camera footage tells a different story than the officer's report. I like those challenges. For her, it's a no-go, but those are great challenges for others. Next charge we have driving on a suspended license. Misdemeanor. Prosecutors generally must prove the defendant drove a mo motor vehicle and the defendant's driving privilege was suspended or revoked and the defendant knew of the suspension or revocation. And that's usually where they they may get out of trouble if they did not know they had been suspended. With it being so close, the defense could maybe have a good argument that she had not been properly notified just yet. But the arguments could be from the defense. The defendant was never properly notified that the license had been suspended. The suspension was no longer in effect. The prosecution identified the wrong driver. All right, let's see here. Let me see what y'all said before we go to the next video. They need their lunch catered after dealing with her. I agree. I agree. The judge should make her watch this video. She also might I don't know like okay this is a a stretch but because we watch some of the videos where parents neglect their kids and put them in bad situations and she has a two-month old at home and this is the type of decision she makes. She might need a just maybe a light short parenting class just to reinforce some better habits just in case. Public friendmy number one said when the feet are attached to the handcuffs that's called tarp total appendage restraint procedure. Oh okay thank you. you will have to remind us again because my brain will not hold on to the information. But thank you. Let's see. You said, "Oh, you sent me like six videos last night. I will be reviewing them." Let's I'm looking to make sure. Please like the video. Thank you, Candace. The Mindy said the judge needs to send it to someone in her family that's like me. That way, not only will she see it, but everybody that shows up to the next family reunion will, too. I like it. a little little family, you know, justice, get her better. They never read her her Miranda Rice either. They did not ask her questions that I remember. They only they they asked if she would consent to the field sobriety test. But on DUIs, if they ask her questions, maybe they can't use her answers because they didn't read her the Miranda rights. But I don't see them really use Miranda a lot on DUI stops. It just depends. So, I'm not surprised that they didn't. just depends on what they're going to use in anything that she says without it being as Mindy reminded me of spontaneous utterance because if they didn't ask for anything and she's still yelling out stuff that's on her. So yeah, it just it kind of just depends. Let's see here. Akuo coming in with another trendy tribe membership gift. Let me see. Let me see. Tahesia. Okay, congratulations, Tahesia Moore. I hope you enjoy it back there. All right, so next video. This is our second to last video. This is one I hope you're not eating breakfast. Do not be eating breakfast. She I don't know. Either way, she throws up. I don't know if she forces it or it really happened, but she does throw up. So, stop eating now if you have a weak stomach. The title is He's a D. This DUI stop turned into a nightlong battle between an officer and this woman. I think maybe if you haven't seen this, your feelings will kind of change and just kind of eb and flow as this video goes. So, I like to see what y'all are thinking as we watch this one. And here we go. I'm officer Cuffner at the Ste Police Department. The reason why I stopped you, okay, was because of the way you were driving, first of all. >> I was kind of like >> Yeah, you're you're a little bit all over the road. You also didn't have >> She already said too much. She already admitted. She She knows she was swerving. [laughter] >> Your tail lights on. So, just pitch black car >> at least five five minutes away. >> Okay, no problem. Are Are you okay? Yes. >> Okay. Are you just in a rush to get home? What's What's the deal? >> Like I have to be home. Uh my I just get out from my husband concert. >> Okay. Nice. >> In and Jensen. >> In Jensen. >> And I have to be at home sometime because I have to be home at 8. >> At 8. >> No, I have to be at work at 8:30. >> At 8:30. >> So that's why. >> Okay. No problem. Um do you have registration insurance for the vehicle? You said you were coming from a concert. Your husband's concert. >> Yeah. >> Okay. Where was that at? >> In Con George. >> Con Joe's. Okay. Nice. Where do you work at? >> Uh Hone >> in Palm City. >> Okay. >> I'm a esthetician. >> Esthetician. Okay. Nice. >> Are you okay? >> No, no, no. I'm okay. But like the way you say it is kind of weird. >> What do you mean? >> I just said it was nice. Good job. Like that's a it's a good job to have. >> Do you not like it? Is that why? >> Okay. >> At your concert, anything to drink or smoke tonight? >> I was I had two drinks. >> Okay, no problem. How do you feel to drive? >> Fine. >> You feel fine? Okay. >> Like you even can follow me my house like Okay. >> I like 10 minutes 10 minutes away. >> All right. real quick. Got to fill in some boxes. License revoked was a square and you can definitely have that one. Um, how many drinks did you have? You can take that square. Hold on. Let's see. License suspended is a square you can take. Okay. And I think that's it. Well, keep looking for the insurance, okay? I'm going to hand you back all this. I don't need this paperwork, but try and find your insurance. Okay. I'm going to I'm going to be back in one second. Okay. Are you able to pull it pull it up? >> Okay. You're okay. Are you able to get it on your cell phone? >> Okay. B. Um, that's my husband. Officer, >> it's fine. >> She has it officer. She has insurance. I'm I'm I'm coming back. I'm from Evergreen. I I'm in Evergreen right now. I can uh provide that for you if you need it. >> I I [clears throat] I'll have it I have it on my end. I just I just next time make sure you print it out and have it in the car or if you have it on your phone too, that works. Um but uh >> yeah, I thought I had it out. I apologize. Yeah, I thought I had given it to her, but okay. I'll make sure she gets a copy of it. >> Yes. All right. Um just hang tight for one more second. Okay. >> Hey, how's it going? >> Good. >> He's up He's up there busy. How? Where y'all coming from? >> Hello. >> Now he asked they asked me he's a new officer and they asked me what where did I come from? >> Cons. >> How are you, sir? I don't know who I'm speaking to. >> What's it called? Cony Joe's. Hold on. Let me see cuz I am about to Google it because that is a crazy name. Hold on. Cony Joe's. >> I don't know if that's what it's called, but I'm about to try. Cony Joe's. I think they're in Florida. >> How are you, sir? I don't know who I'm speaking to. >> That's my husband. >> Oh, okay. I I don't know what's going on. I'm just >> I don't know what's going on either. >> Okay. Okay. Relax. >> I don't feel good. >> Okay. Do you need fire rescue? >> I don't feel good. >> Okay. Well, kind of not feel good. >> I don't feel good. All right. >> There is a Con Ki or Coni Joe's in Jensen Beach, Florida, in case anybody wants to try them. Now, after she reacts how she reacts, you might not want to try the food, but it exists. >> All right. Well, I don't I didn't want to irritate you. I'll be right back. What? Whoa. >> Do you need fire rescue? Hey >> man, what's going on? >> She said she's >> not feeling good. >> Ick warning like I seek warning cuz she's she's about to go there. >> You want fire rescue? >> She won't answer me. I've already answered. She's been having trouble with her stomach. I know that one. >> How about this? Do you feel like you're going to want >> here? Step here. Get Get out of the car. Why don't you stand up? >> I need my husband. >> Okay. >> Okay. Well, no vomit in your car. >> It's okay. But I need my husband. >> You're from Argentina. >> What part? >> What part? >> She's there. One is >> Yeah, my wife's been having trouble with her stomach. >> This is why I said to get out of the car, you're vomiting on your car now. >> What did you eat, if you don't mind me asking? >> I think she had not been >> I don't Yeah, I don't know. Yeah, yak alert for real. I like I like that. I might try to remember that so I can just say that uh for future warnings cuz it's that's definitely what it is. Candace, that is her auntie or Tia in the passenger seat. Um Lovable said now the husband wants to lie for her talking about her having trouble with her stomach. It and he keeps going with it. I'm like, if this is what happens to you when you eat calamari, don't eat calamari or you are knowingly becoming a risk on the road because it's a lot that they about to blame on this calamari or something. I'm not sure officer, but anytime she eats any kind of fried food like that, I don't know why she does she eats. >> So, uh, I'm gonna stop. >> Okay. Get fired. >> I'm going to have fire rescue. >> Fired. >> She tipped out of the car and he did not pull her out the car. >> Ma'am, >> has she taken any medication today? >> Have you taken any medication? >> Mindy, thank you. Okay, hold on. Candace said, "When I used to drink, I had trouble with my stomach, too." Right. [laughter] We we all have, you know, stomach troubles are coming with that one. Mindy said, "I know the person sitting next to her better not know how to drive or be sober." When I watched this the first time, Mindy, I said, "Does her aunt have a driver's license for here? Is she sober?" That's the same questions I asked. I'm like, "Why are you even driving if you happen to have a capable driver? If if not, did you not see how your niece was acting and y'all should not be in the car with her driving? Even if you can't drive as the aunt, I was thinking the same thing cuz the aunt seems sober. Don't know if she can legally drive, but why is why are you letting her drive? I know it's going to be like she said she was okay, blah blah blah, but no. >> Sir, do you know of any medication she could be on? >> No. doesn't take any any aua. No aua. >> We need to get her out of the way. >> Move her out. We need to move her off the road. >> Hold on. Ma'am, watch out, >> Monica. Ma'am, ma'am, ma'am, ma'am, ma'am. >> We're on the road. We need to watch. >> Okay. We're going to bring her away like towards the car. Oh. Her pants are actually also undone right now. I think more cuz she was full though. But her just It's ironic she also has pants that are undone. >> She's on two cars. There you go. >> Bam. Bam. >> Ma chest. >> Do you see the nestagmas in her eyes? It's insane. >> So, yeah. >> Yeah, she had way too much to drink. >> Let me tell you what, I She's good. She [laughter] had me going back and forth in my emotions on some things like, do we need an ambulance? But she she's good. I'm like, I need to learn how to play like this for I don't know why, but I don't know. I want this skill. >> Ma'am, did she do anything else at the restaurant? Keep your head up. >> Oh, you don't like that, huh? That's called the ch. That's >> You don't like that, huh? Y'all heard that if you're actually kind of struggling being conscious uh or I should say it really really hurts if you're faking like you're unconscious that sternum rub I don't want to ever feel that >> she's alive she's >> she's just not holding Eyes aren't responding at all. There may be something more. Ma'am, can you speak to us? >> Say something. >> Mama, >> are you okay? >> Can you breathe? >> Okay. >> Are you Are you spinning? Is everything like spinning right now? >> What's What's going on, you guys? >> You got to tell me what's going on. >> Are you having trouble breathing? You feel like you're going to vomit again? >> Are you tr having trouble breathing? Ma'am, it's very important to us. Tell us if you did you take anything. >> Nothing. >> Did you have any alcohol? >> How much? One drink. Two drinks. Two drinks of what? >> Did you Did you take anything? >> She is playing on these people time. And still, please, I hope you have weak stomach. You are not looking because it's still too much going on around her mouth. I don't. >> Mom. Mom. >> What's wrong? >> What's wrong? >> You can talk. >> You want to get up? Is that what you want? >> No. Just stay on the ground. >> Ma'am, >> she's super. >> No. No. No. No. No. No. No. No. No. She like she vomited. >> No. No. Ma'am. She was talking to me for a minute. Okay. Driver. >> Okay. Stay on the ground. >> Yes. You have You need to stay on the ground. >> You need to peel. >> I think in the beginning they did direct someone to call for rescue. I feel like rescue was honestly mentioned. Did I ever see rescue? I don't believe so. But it was mentioned. Maybe they will come. I'm not sure. I don't know if there is one. Are they here now? I don't know. I can't tell whose hands are cops and whose possible rescue, but I feel like they did instruct someone to call rescue. >> Sit up right here. >> I just told you. >> No, no, I heard. >> No, no, no. >> If you have to vomit, vomit. >> No, no. >> I don't have any water. >> He's getting water. >> He's getting you water. Awa. Aua. >> Awa. >> He's getting you awa. Awa. >> What's up? You want to stand up? No. What do you need? You can talk. Tell me what is going on. >> Stay. >> What does that mean? What does What does this mean? >> Has this ever happened before? >> Now she's devolved into a toddler. It's I don't have the patience for that job. >> He's got water for you. >> Look, you see this? >> Yeah. >> Okay. >> And marijuana. >> This is passenger. >> This is your mom, right? >> Tia. >> Tia. >> Tia on. Come on, >> Aqua. >> Awa, >> drink. You need a drink. >> I'm just like, rinse your mouth out, nasty. >> Compassion. You have to be hard. >> You cannot be in this work >> if you don't have a heart. >> Okay. >> So, you can talk. >> You're a dick. >> Okay. I'm sorry you feel that way. How much have you >> die? >> Yes, ma'am. >> Sorry, >> ma'am. Yeah, you just have vomit on you. >> You just have vomit on you. Okay. >> There would be two puddles because she would gross me out so much. Now I'm losing my meal. If you sit up there breathing on me, you touch me. I see what you did and you Oh, God. Nope. Nope. Nope. Nope. >> Sir. Sir. >> Yes, sir. >> Is officer Cuffner? >> Yes. >> Why is she acting like this? Why is she >> She's like not talking to us. She's clapping her hands. >> I I don't >> Has this ever Has this type of episode ever happened? She can't even stand up. >> She's had this before when she eats. I don't know if she's allergic to something. >> No, this is not an allergic reaction. I can tell you that. >> I'm sorry. >> It's okay. He's a dick. >> Okay. How much have you had to drink today? >> I only had two drinks. >> Two drinks. What kind of drinks? >> Two drinks. >> Two Corona. >> Two Coronas. >> Two Corona. >> But this guy >> Mhm. >> cannot be on the job. >> Okay. So, you had two Coronas and you're you're vomiting. >> Yes, we're helping. >> So, she's on her high horse talking about he doesn't have the best I'm going to say best eye manner. Um, but you don't understand. You shouldn't be driving, but you know somebody shouldn't have a job. You y'all shouldn't have met cuz you shouldn't have been behind the wheel driving drunk right now. We're helping you right now. >> I'm good. >> Do you have any medical issues? >> No, I'm good. >> Do you have any medical issues? >> You help me. >> Yes. Exactly what I'm doing. You You need help? >> Yes. >> So, fire rescue's coming. >> You're in the right position. >> Okay. Yes. >> You're in the right job. >> What's your name? >> Your compassion. >> This This is my supervisor. He's my >> I understand. I'm cool. I'm fine. >> What's your name? >> I'm I'm Velasa. I'm 39 years old. >> I'm I'm I'm just turned 39 years old couple years ago. >> She looks good. Wait, she turned 39 a couple years ago. Hold on. So you 41? I was going to say though, she looks good for 39. Not for nothing. >> Okay. How much did you drink? >> Come on, Aqua. I only had two drinks and two shots. Like >> where were you at that you had your two coronas and two shots? Where were you? >> Downtown or >> Aua? >> I was >> be honest to you. Be honest. Sure. >> Completely. >> I don't know where I was. >> You don't know where you were? >> No. >> Were you in downtown Stewart? >> Probably. I was in downtown Palm City because that's where I live. >> Okay. But I'll be honest to you, >> take you to two at least to take that by heart. >> He's a dick. >> Okay, we're we're here today because you're driving your vehicle. We believe you're under the influence. >> I mean, you're vomiting. You had told me that you had numerous drinks and >> No, I said I I I said I have few drinks, >> right? Numerous. You had two two Coronas and two shots. Yeah. >> Yeah. That's numerous drinks. You're not you're you're barely able to stand and you're vomiting all over the place. Uh >> but when that happened, >> do you think you should be driving a vehicle? >> No. >> Were you driving a vehicle? >> I wasn't in Joe's. >> You were at Joe? >> Yes. >> I was in Joe's. I wasn't calling jokes. >> Okay. >> My husband's a musician. >> Okay. How did you get here though? You were coming down. >> Did she say her husband's a m a musician? Because one of y'all said her husband sounds like a rocker or something y'all said, which is if she said her husband's a musician. Y'all have way too much like talent in observing things because how in the heck I'm going to go back a little bit to see if she's saying her husband's a musician. in Jones. I was in Cong. >> Okay. >> My husband is a musician. >> Okay. How did you get here though? You were coming down Palm City Road. >> I'm not Jo is in Jensen, right? That Jensen. Where's Confy Joe? Jensen. Yeah. Drink off. And then you got >> I wasn't I wasn't drinking a lot. >> You had two and two shots and you can't stand. You're vomiting. Um, ma'am, can I have you? Can we go over there, please? Let's walk. I'm going to get you away from all the shining bright lights and all that stuff. >> She wasn't drinking. Like, she had maybe a corona or two at dinner. >> If you want, just wait in your car and I'll come back. >> He is too old to say she wasn't drinking and then followed up with saying she maybe had a corona or two for dinner. That is the definition of she was drinking. >> I can explain the rest. And then she admits she had two coronas and then I think two shots if she hasn't said it already. >> Just a minute. She may not be. It could be something else. >> That's what I'm thinking. It has to be because I know my wife like in other words and she was with her aunt and her cousin. She was eating dinner. We were playing music over there and I think she had maybe one corona or two coronas. That's it. >> Do you know of any other medic? Does she smoke marijuana? Does she >> she occasionally will smoke some marijuana, but she doesn't do any drugs? Like she doesn't do any hard >> any prescribed drugs? >> No. >> Marijuana is still a drug. Is it a horrible one? Doesn't seem like it. Seems like it's great for cancer patients to kind of calm your mind down. You still can't do it and drive cuz that's still an impairment. But sir, it is the definition of still being a drug. >> Nothing like that. >> Okay. But she has had trouble with her stomach. I know that where she's almost become like like uh comeomaos almost. >> Okay. So, if you would just have a seat in your car and I'll be right back with >> Thank you. You're being cool. We're >> Yeah, I I appreciate I I'm really really worried about her. >> Let's do it. If you think I'm I'm not >> Yeah, there So, there are three simple tasks. I'm going to check your eyes. We're going to do a walk and turn and then a one leg stand. Okay. Um All right. You see this blue pen? Bluetooth my pen. See the blue light? >> Do you think that's right? >> What? >> What you're doing? >> Well, is it wrong? >> No, but I'm asking you if you think it is right. >> Yeah. Yeah, I do. I think it's very right. Do you see the blue light? >> Of course. It's like forehead in two foreheads. >> Perfect. Can you touch it for me? Like that? >> I can touch it. You see? >> Perfect. You going to stand with your arms >> like this? Yeah. >> With your feet together. All right. I think I can. >> Okay, just remain in this position. Okay, with the blue light, you're gonna to stare with it. Stare at the blue light with your eyes and your eyes only. Do not move your head. Okay, so you're just going to follow the tip of my pen with your eyes only. Do not move your head. Do you understand? >> I guess. >> Understand? Here, put your arms back like this. Perfect. Do you understand everything that I told you? >> No. >> What do you need me to go over? I said before from the beginning. >> Okay. So, same thing. Arms down by your side, feet together. You're going to stare at the blue pen. All right. The blue tip of my pen with your eyes and your eyes only. Do not move your head. >> Yeah. Lovable said, "I might have to rethink my marriage because my husband wouldn't lie for me like this man." I was I'mma have to show Mr. Trin this video as a training video. Like, hey, no matter how bad I look, you better act like I didn't do anything wrong. You better defend me this hard verbally. Go hard for me. Cuz what? [laughter] >> Do you understand everything I've told you? >> That's right. >> Okay. You're supposed to follow the tip of my pen with your eyes and your eyes only. Do not move your head. Good. Okay. Good. Next one's going to be the walking turn. Okay. Do you uh you see this line right here? You see this white this straight even white or line right here? Do you see this line? >> You don't think that's too much? >> What? >> The line and the pen, the line, the light and everything. >> No, I don't think it's too much at all. >> Do you agree that this line is straight and level? That's what he's asking you. It's a yes or no question. Do you agree? >> I'm not agreed. >> So you don't agree in what fashion? >> I know it's a partial line, >> but I'm not agree to walk to the line. >> So you're refusing? >> Yes. >> Okay. >> I refusing because I'm not drunk and I know what I'm saying. >> Okay. Then you could perfectly walk down this line. >> I don't have to. >> Okay. >> I'm not drunk. Was that an actual box? Hold on, Jamie. I'mma give credit for the I'm not belligerent one because you put it in the chat. So, I'm going still go ahead and let y'all have that one. I thought Oh, they say I'm 100% sober on this square. That's what y'all wanted. Not the I'm not drunk one. >> Are you refusing to do walk and turn? >> If I refuse, it's against to myself to my right. If I do it, it's guess to myself, to my right, too. >> I think it's important for you to note that these tests, these these roadside test, >> I've done it before. >> Okay. But >> excuse me. >> There. >> And >> are you refusing to do them? Yes or no? No. No. No. No. >> Do you want to do them? Yes or no? >> Excuse me. Stop being so rude and like arrogant. I know my rights. >> I'm sorry that you feel that way. >> No, I do feel that way. >> So, >> excuse me, too. >> We're not going to keep EXCUSING ME. NO, NO, NO, NO, NO, NO. DON'T. You don't have to give me that. >> Either you do the tasks or you don't. If you're refusing to do the tasks, we will make the judgment. >> If I was If I was If I was >> Either you're refusing or you're going to do them. We're not going to sit here all night going back and forth. >> If I was a dick, >> you're being No. If I was a dick, you're not going to be acting like that. >> I'm asking you. >> No. No. No. Excuse me. I >> Excuse me again. >> Mhm. >> Are you going to do the task or not? That's all we want to know. Yes, >> I do the like what he told me and we asked me. I did. >> Are you going to do the next one? >> Excuse me. Excuse me. Yes or no? >> Excuse me. >> You got three seconds to answer. Three. Two. >> Will you do them or not? That's all. >> I'm not going to do it. >> Okay. >> Okay. >> All right. We're going to go to the next one. Okay. Can you do the third one for me? It's really simple. >> No, because y'all be y not being nice to me. I'm I'm being cooperating to do that one too and he's being a dick to me. You're being nice to me because you want me to do it. >> You know you understand what I'm saying? And and the probably the >> Listen, I just I just want to make sure you're safe to drive. That's all. That's all. >> Listen, I don't want to drive and you're safe to drive. >> I don't I don't need to drive. My husband can drive me. >> I have right now. >> My husband can drive me. >> Okay. >> I don't have to drive. >> Okay. you and and you shouldn't have if you could have waited for him. Why are you driving? You made a choice or some at some point she actually put her pants together. So that's good. You made a choice to drive drunk having had at minimum cuz this is what she admitted to which I feel like she's had more than this cuz I feel like most people do not admit how much they actually had. She had two Coronas and two shots. You know what you drank? Why did you just wait for your husband to drive then? >> Understand that. But I need you to die. If you refuse to do these tasks, you're subject to an arrest right now. Do you understand that? >> Cuz I'm basing my investigation off of what I have. >> So, refuse to do. >> So, what do you have? >> Are you doing them or not? >> Are you going to do them or not? >> It's a yes or no question. >> Can I speak to my husband? I'm not refusing. >> Yeah. You refused on that. >> You refused. >> At one point, didn't she literally use Oh god, her mouth is disgusting. Didn't she literally use the words, "I refuse." I refuse. [laughter] Now it's I'm not refusing. >> We tried everything. >> I want to take it on your mouth. >> No. Now you can go to jail. >> Pro tip. If you're going to try to be helpless and cute, you got to do it prevomit on your mouth. >> I don't want >> You're under arrest for the suspicion of DUI. >> Please, I don't want to do that. You already made that decision. >> Yes. >> Huh? >> Okay. There's a nurse at the jail. What's your phone number? >> Help me. >> What's your cell phone number? >> Please help me. >> You don't have one? >> Help me. >> You don't have one? >> Please help me. >> That is kicking back in again. You got a lot going on in this back seat. >> I need help. >> What's your cell phone number? >> I need help. >> Well, that's why I'm taking you to the jail. They're going to have a nurse there that's going to help you. >> I need help. I cannot breathe. >> Well, you're talking to me, so you're able to breathe. >> No, I have asthma. Please. >> Okay. >> Please, sir. Please. I can't breathe. >> You're talking fine right now. So, >> help. Help. Help. >> You can't breathe, but you can yell. Nope. Please don't. Oh gosh. Sorry. >> Oh no, she did it again. Ew. Ew. Ew. It was auditory, but ew. >> Here. Vomit into this. Here you go. Vomit into this, please. >> Hold it. Vomit. Here you go. Don't vomit on the floor. >> Do you think I want to be vomiting in the floor? >> That's why I gave you this. >> How I going to hold it? >> I I didn't think about that. Sorry. You should be ashamed of yourself. >> Very much so. >> Again, good statement directed at the wrong person. You should be ashamed of yourself and your husband should be ashamed trying to blame this on Calamari and not making you wait till he could drive you home. >> You okay? Feeling a little better now? Medicine help. We're going to get you out of here. Can I just have your attention for two seconds? >> Can you look at me real quick? >> I have to I have to read you something. Okay. >> This is for breath testing. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining alcohol content. Will you take the test? >> You don't. Okay. I just have to read you what happens now. Okay. If you refuse to take the test, sorry, I'm going to turn this down. If you refuse to take the test I have requested of you, your driving privilege will be suspended for a period of one year. Hold on. There you go. Keep going. Do that. Okay. Deep deep breath. Take a deep breath in and then blow. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Nope. You're not blowing hard enough. >> I am. >> Try again. Blow. Blow. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. blowing longer. >> I am. >> I need you to blow longer. Try it again. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. >> You're not providing a long enough sample and then go. Blow. Keep going. Keep going. You're not blowing. You're not blowing long enough. >> I am. I'm asthmatic. >> Keep going. Keep going. Keep going. Keep going. Keep blow. You're not blowing. >> Let me try to explain a little bit to you. Okay. So understand. I'll be his uh testing person. Seal just like you're blowing up a balloon. Okay. And then blow a nice steady air through the mouthpiece. Do it for seven seconds or more. It doesn't have to be. >> Would you like to practice on this piece? >> No, he already explained to me. >> He's better than you. >> I'm sorry about that. >> More training. >> Yes, I do. >> Yes, you do. >> Can I ask you something? >> No. >> How old are you? Okay, just I'm going to say this more for replay gang gang because I know y'all are already looking at the chat, but I do want to straighten this up because I see a couple times. So, she was only physically in the car with her aunt in the passenger seat and she was driving. She was on speaker phone with her husband who later showed up as the one making all those extra excuses for her, but he was not with her in the original car, but clearly stated he could have driven her home. She said she didn't have to drive. She could have ridden with him, but he was not physically there when she was stopped initially for swerving. Probably you like 20, middle 20s or something like that. >> Probably. Yeah. You get more for people if you have more sympathy. If you don't have sympathy, you're not going to go go no go any further. >> I have given you enough sympathy. >> No, you're not. This gentleman over there in one minute he explained like you cannot do it like in 10 minutes. >> I'm sorry. >> No, I'm being honest. >> Do you think you can do it now? >> If he go with me here. Yes, I will. With you? No. >> Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. That was good. >> Yeah, >> he know how to sign. You don't >> just need one more sample. Okay. >> More samples. You don't think that was enough? >> One more. >> You want more sample for me? You want me to do a lot of things? Let me talk to my husband. >> I'm going to let you call someone once you're done with this. >> I don't need to talk. So, I need to talk to my husband. I know you think I'm a I'm a hardhead. I'm a pain ass for you all night. Like you you probably think I'm the worst client ever, but I'm not. >> I don't think that at all. >> I just need to talk to my husband. >> Once we're done with this, I just need one more sample and then talk to your >> I already give you what you want. Now give me what I want. >> Keep going. Keep going. Nope. >> I totally agree with this. Um, oh, so she got a two-month-old at home as well. So, a lot of similarities between these uh DUI videos. Pants undone. Two-month-old at home. Was there another one? I feel like there is. And my brain just won't think of it immediately. Jamie said they would have to take her blood. She wouldn't be burning my brows off with her breath. I'm the same way. I have to give you two tries. I'm not giving you nothing extra. Do you consent to the blood alcohol um like the blood draw test? If not, will a judge give me a warrant to get it? Nope. All right, she got to go cuz I'm not going to have her blowing her breath in my face. I'm the same way. [laughter] Candace said anything. She shouldn't be saying anything that starts with an H. [laughter] Did she call herself a client? I missed it if she did. Yeah, I see. I don't know if she actually has asthma, but I definitely understand it. The test would be crazy hard for someone with asthma. Keep going. Nope. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Nope. Keep going. Keep going. Keep going. Nope. Keep going. Keep blowing. Keep blowing. Keep going. You're not doing it. Come on. Keep going. >> I am blowing. >> Keep going. Keep going. Keep going. All right. >> [snorts] >> All right. Text on the screen says two insufficient samples yielded BRAC readings of.120 and.121 but due to inadequate volume they were not considered valid samples. Oh, hold on. I think I missed one piece of text. Okay, hold on. The woman pled no contest to driving under the influence impairment and first refusal to submit to testing. She was found guilty on both charges. And since it's driving under the influence, we're just going to look at a refusal to test because we we've kind of seen the DUI one a few times. So, we'll look at just that charge. Let me see. All right. Refusal to submit to testing classification. Administrative driver license sanction may also have criminal consequences depending on prior refusals and circumstances. And this was in Florida. Prosecutors generally must prove the defendant was lawfully requested to submit to a breath, blood, or urine test under Florida's implied consent law and the defendant refused after being properly advised of the legal consequences. Possible defense challenges. A defense attorney may challenge whether the officer properly advised the defendant of Florida's implied consent law. The defendant actually refused testing and the request for testing uh complied with Florida law, which it was proven because she was found guilty. So that that burden of proof was met. Her her husband should have uh took a call in for her tomorrow because she would not be going to work. Yes. Oh, you confusing videos. Jacqueline Noir said this isn't working because she isn't cooperating. Do all departments have on staff medical to take blood? No, it seems like a lot of times they have an agreement with the hospitals um instead of them always drawing blood at the jail. Some have, but I've seen them take them to the hospital a lot of times. H look, if you thought you were going to be mean, it probably was going to be mean. [laughter] Yep. License automatically gone. All right. Look, Norir said now she want to know what you was gonna say. Oh my god. Hold on. Let me turn this off. All right. Go ahead and type what you were gonna say. Lovable. I'm have to turn replay off, too, cuz I don't know what you're about to do. [laughter] Um, okay. I'm gonna play. We're about to go to our last video. Oh, wait. No, we I have two things. One I have is the advice from a lawyer I pulled from Instagram. Might have more of these in the future for y'all. But here you go. Definitely going to play this on the other ones like when they do shoplifting and scamming and stuff, but here you go. >> What is one advice you give every client? >> Shut up. Shut it up. >> Should you delete after getting after getting arrested? >> What is the biggest people after they talk they talk to the police? >> What's something people illegal is illegal but isn't >> not talking to the police. >> What is your favorite part of being defense attorney? Standing up. standing up for people. >> What's one legal television show that gets that gets it right? >> The wire. The wire. The wire. The wire. The wire. The wire. >> Would you prefer a higher profile or more of a low key case? >> You know, low key because high profile is made and I'd rather just rather know. No one knows. >> What is the f someone ruins their own case >> by talking to by talking to the police? >> Okay. Let me know. Sound check. Did that echo for y'all? Was there an echo? Because I I think I need to mute one of my screens if it uh if it was echoing, but I'm not sure if it did or didn't. I know when I play my song sometimes it echoes back if I don't have the settings right. So, let me know about that audio quality real fast. And identify yourself and then don't talk. It did echo badly. Okay. Definitely an echo. Okay. Let if y'all hear echoes, you can let me know. I I see what I should have done. So, I'll play it one more time after the next video and then with no echo. My bad. My bad. My bad. Hey, please. Thank you so much for the super chat, Akuo. Can we get the likes up before we get out for the day? Thank you so much. It does help people find me. Every now and again, I get a little, "Oh, I found you. Glad I found you." Um, and then they're like, "I subscribed." I'm like, "Oh, I appreciate you." All right. So, this is asking ask I cannot do this. Lawyer's reaction driver had the right away then made it worse. So, we'll look at the circumstance. I'm going let this one play the whole way through cuz I don't know what this question is about to be. >> Lawyer's reaction. You have to remember, ladies and gentlemen, that last CLEAR CHANCE NEVER APPLIES TO ROAD RANGE. THERE'S NO DOUBT THAT THIS POB SUV had the right of way. AND THAT DARK HATCHBACK TRYING TO SCOOCH IN WOULD MAKE THAT HATCHBACK LIABLE FOR THAT INITIAL CONTACT. THE PROBLEM IS THAT AFTER THE TWO CARS HIT FOR THE FIRST TIME, IT CLEARLY infuriated the POV SUV, WHICH CAUSED EVEN MORE DAMAGE DUE to road rage. And the law says that if you engage in road rage, you are going to be liable, MAKING BOTH CARS ALIVE. THE damages that have this man's mannerisms. He said that he said the hatchback scooched in with all the shoulders. Oh my god, I love his mannerisms. I feel like I'm going remember more because of his just the the way that he [laughter] is. Okay, last full video, then I'mma play the lawyer's advice one more time with no echo. This is Law and Crime. Tell you right now, it's going to be a lot of skipping ahead. I do not like how the original Law and Crime channel does their narration. I like Law and Crime Body Cam because it's more of like how the other narrators do when they upload a body cam video. >> [sighs and gasps] >> But the actual lawn crime is I just don't like it. It's a preference thing. I don't like it. All right, but here we go. We're I'm going to play it. But sorry for a lot of skips if it happens. >> I rather just >> Oh, and he's nasty cuz he's going to spit. It says drunk man gets the spit chair after losing it on cops. >> Have the woman who pulled in front of this car uh pick up the dog that's in this car. >> He was pulled over for a traffic violation. So, how did it spiral into this? 191 dude. >> We're breaking down every moment of this shocking arrest and explaining how a routine stop ultimately led [music] to a year's long prison sentence. >> Be seeing you again me. >> This is inside the crime presented by lawn crime. I'm Elizabeth car that is swerving in the road. >> Hi officer Ali. New Berlin PD. >> Oh, sorry. Sorry. It's okay. Oh, it's okay. I love dogs. I don't mind. >> Okay. >> Do you have an ID on you? >> Yes. Yes. Ma'am. >> My name's Officer Holiday. The reason I pulled you over. >> Sorry. >> Nope. That's okay. Uh, a couple things. >> Can you go? >> Hey, Crystal Gal from Barbados. Are you in London right now? Good morning. Thank you for stopping through. Thank you for the super chat. Says, "Enjoy the rest of your weekend. Trending in chat. Remember to hype." Yes, replay gang gang. Please hype if you have one left for the week. We're at the end. I don't know if the week starts over at Monday or Sunday, but if you could spare a hype, [laughter] but no, thank you so much for dropping in the chat, Crystal Gal. >> Go in the back. >> Yeah, he'll go in the back. >> Yeah, >> buddy. Hey, go in the back. >> I say why don't you roll your window up so he doesn't Oh, he just smashed that. >> I'm sorry. >> That's okay. He's a puppy. I get it. >> Reason I pulled you over. >> Yeah. So, you caught my attention back there cuz you were honking at the lady. And then when I was following you, I mean, you kind you didn't stop. You drove off. You almost hit people. So, that's why I'm pulling you over. Okay. >> That's okay. Where you heading to? >> Um, I'm heading to my brother's house. Getting on the freeway. Oh my god. >> Where are you coming from? >> Yeah, he did that with his nail, I think. >> That's where you're coming from? >> That's where I moved. >> Okay. >> Okay. She's at I can give you her address. >> Is that where you were coming from? >> Same address on that ID. >> Okay. >> That's where I'm coming from. >> Okay, perfect. Well, give me a sec. We'll get you going. Okay. And then Yeah, you might need a towel. I think he >> I think his nail messed it up. Is that your dog? >> Yeah, it's my dog. >> He's a good boy. >> I can start cleaning him up. Cleaning the stuff up. >> Uh do you have a towel somewhere? >> I do. >> Is it in the back? Can you Can you easily grab it? Oh, yeah. Go ahead. Start cleaning up. Yeah, you're good. Nope. That's okay. New Berlin police IDed the driver as Christopher Nelson. And Christopher's driving wasn't the only thing that caught the officer's attention. >> This guy is insanely drunk right now. >> Oo, we that face was made for radio. >> I was sitting at >> uh No, he's cleaning up. So, >> he's I'll explain in a second, but we can go up and grab him. >> No. Uh he has a dog in his car. >> Yeah. >> He's got an uh closed smear off ice. And in the excitement, the dog punctured it and spread smeared off ice all over the car. >> Amazing. >> So, he's cooperative. Extremely drunk, though. Just a heads up. What's up? >> Nothing. My dog. My mom's on her way like driving right behind us. Dog is >> right behind us. Sorry. >> That's okay. Don't be freaked out. Hey, I'm going to have you do me a solid, though. You're going to step out with me, okay? We're going to have a chat. >> Yeah, no problem. >> I just don't want to lose these. Okay. >> No, no problem. >> Okay, dear. He won't jump out. Can you? >> No. No, he won't. You just shut the door. >> Yeah, I just don't want him to jump out the window or try to jump out the window again. Okay. >> No, he's good. I'm good. >> Any weapons on you? >> No. None. >> Do you mind if my uh partner here searches you? >> No, you can go ahead and >> turn around your car for me. Yep. >> Put your hands behind your Put your hands behind your back. >> Behind your back. There you go. That's >> just sit right here. >> Y >> spread your feet for me. >> Have you ever had contact with the New Brun Police Department before? >> Yes, I have. >> When was that? I recognize you. I'm trying to remember how I remember you. >> Uh, Springdale. >> Springdale. You and me. >> I remember. Okay, I remember now. >> Y my mom. >> Oh, that's all right. >> So, let me let me get back to >> I >> That's okay. Let me get back to what I was saying. So, >> the reason I pulled you out, okay, there's a couple concerning things. >> Um, I'm getting indicators that you may be under the influence of alcohol right now. Okay. >> Um, including the Well, it was closed. Now your dog punctured it took you off. Um, how much alcohol have you had today? >> None. >> None at all? >> No. >> Okay. Um, >> you're good. Relax. >> Yep. Yep. >> Turn around. Turn around and face off here. >> How much alcohol have you had today? >> None. >> None at all? >> No. >> Any illegal drugs? >> No. >> Any prescription medication? >> No. No ma'am. >> Okay. Yeah. Um, so I'm going to be running you. >> I know who that is with that. >> Don't Yep. Don't Don't worry about her. >> Sorry. >> Um, can you You get sit down for a second. >> Okay. Or >> my mom my uh my mom is on her way. I know. I >> I had to go back in my car anyways. I was going to have to darn it. >> The 40-year-old is no stranger to the routine. By the time this incident occurred, he had six DUIs on his record, but he said he didn't consume any alcohol on this day. >> Just from what I'm picking up and indicators that I observed, um I'm going to be running you through some fields, okay? I just want to make sure you're safe to drive. >> Sure. Sure. No. >> Why did you Why did you call your mom already? >> Uh because I I saw the police lights behind me and >> I got scared. >> Okay. Or were you concerned that you were going to >> like get in trouble or get arrested or >> No. >> You just wanted her to come. >> I just was worried about the dog. >> Okay. Well, we'll take care of it. What's his name? >> Winston. >> Win. Oh, that is a very >> I told you, partner. >> It's a very proper name. >> 11 months old. >> I like him. Well, I'm gonna have you stand up, okay? So that way we can start this and get you all set to go. Okay. So, >> yep. I'd ra I'd rather not take field sobriety. >> So, you're not willing to cooperate with any? >> I'm not trying to tell you that I'm not willing to cooperate. I just >> Okay. Well, I'd like you to try the test because right now I want to give you the benefit of the doubt. I want to give you the best. >> To try the test. >> Yep. The SFSTs. >> Okay. >> So, are you willing to stand with your feet together for me? Put your hands down to your side. >> Right there. Right there. >> Nope. Down to your side. Stay just like this until I instruct you otherwise. Do you understand? >> Yes, ma'am. >> Okay. Any medical conditions I need to be aware of? >> I don't know what they are specifically, but yes. >> Yeah. Okay. What do they do? What do they >> I couldn't tell you specifically, but yes. >> Okay. Um, and you said no alcohol. >> No alcohol. >> No drugs. >> No drugs. >> Okay. Um, and no recent head. >> When my mother gets here, she'd be better off to take the dog. >> Yep. We'll worry about that in a sec. recent head injuries. Don't worry about that. No reason. >> Okay. >> Sorry. >> Nope. That's okay. Okay. >> Trying to just do what you told me to do. >> Yep. So, just Can you see the tip of my finger? >> Yes, ma'am. >> Okay. So, I'm going to be moving my finger. I want you to follow my finger with your eyes and your eyes only. Do you understand those instructions? >> Yes, ma'am. >> Okay. Go ahead. See my finger. Look at it. All right. There she is. >> Okay. Well, we we'll worry about her in a in a sec. Okay. I don't want you to be distracted. >> No, I'm not distracted at all. I'm just looking at her and >> Okay. >> noticing that she pulled up so we could >> That's okay. We'll have her hang tight. Okay. Can you finish the test? >> You can. You can. >> Can you keep looking? >> I can just hang tight with her >> like you said. My mom just pulled up. >> Yeah. So, we're gonna have her sit in the car and wait. >> So, can you >> So, if I understand correctly, the actual attention he got from the officer was first because he was having a little bit of road rage and then she noticed when she tried to light him up. He didn't stop and he almost hit some people. Wait till you see what his road rage cost him. Cuz I'm like, "Oh, I didn't realize you had the road rage first." I thought it immediately just showed he was driving erratically. Okay. Okay. But yeah, y'all will see. We actually get to see the conclusion of what happened with him on this one. >> Finish the test with me. >> No. No. >> Okay. >> So, you're not willing to continue with the >> I'm not telling you that I'm not willing to continue with anything. >> Okay. Then what are you telling me? Okay. Are you willing to >> I don't want to argue with you. >> No, that's okay. This >> I'm just going to ask. Are you willing to do my tests? Are you willing to cooperate with SS? >> Of course, I'm willing to. >> Okay. Can we continue then? >> I'd rather just go see with with just to make sure that she can take my daughter home. >> So, I'm going to tell you right now that's not an option right now. Right now, I'm I'm conducting an investigation. Okay. Are you willing to perform the test and I'm asking you to pursue? >> Of course. >> Okay. Can we continue those, please? >> Okay, we can. >> Okay. Can you stand with your feet together for me? >> My feet are together. >> Nope. Touch them, please. I need them touching >> your feet touching. >> Touch your touch your toes together. >> Nope. They're they're short. I'm not >> I'm going to tell you right now. Okay. These tests need to be done a certain way. So when I give you instructions, thank you very much. Yep. Arms down to your side. >> Do not move. Okay. >> Yes, ma'am. >> Keep using that finger. Keep following it. >> After six times, why is he wasting his time consenting to this? We could just skip this. He might as well just say, "I refuse. Take me to jail." He actually could have saved himself some charges had he said, "I refuse. Just take me to jail." >> Yep. >> I was playing with my dog at the park for the last half hour and now we're here doing a finger test and I'm wobbling. You know, I don't I don't want to look. >> Okay. I'm going to have to keep following up. Okay. Can you take your hat off? It might be easier for you. >> Yes, ma'am. Oh, >> that's okay. We'll leave it there. Okay. Keep following up. Okay. It's going to go up this side. >> Yes, I can. Throw it on the side. Now I look like I'm >> ready. >> Yes, ma'am. >> Okay. So, what I'm going to do is we're going to do the walk and turn next. Okay. So, >> I'd rather not do that. I'd rather just have the woman pulled in front of this car uh pick up the dog that's in this car. We will worry about that with myself. Well, I'm not worried about we're doing that one. I'm going to give you one more. >> I I'd rather be done right now. >> Okay. So, I'm going to have you turn around. You were going to be under arrest for OWI. >> Okay, we can do that. >> I tried to give you the benefit of the doubt, dude. But >> yeah, you know, do what you got to do. >> Yep. Absolutely. And we'll make sure Winston gets in with your mom. Okay. >> Perfect. I'm not one to leave a dog >> strayed. Yeah. >> Step up on the ground. >> Yeah. >> Christopher's attachment to his dog Winston seemed to be an emotional tipping point for him. The thought something could happen escalated the arrest even further. >> Is there anything illegal in the vehicle? >> No. No. No. You can go let my mom, my 67year-old mom go. >> Share with her. You're not going anywhere yet. >> She can take care of the dog. Not going anywhere yet. house guy. >> I'm just >> Okay. >> Jacqueline, this is a good question. I don't know if we closed this loop. He said, "I just came from playing with my daughter at the park to now y'all have stopped me on the side of the road cuz he don't he don't he don't take it um he doesn't take accountability for how he got himself here." But yeah, I wondered did he have supervised visitation so another adult has her? That's what I was hoping. I I was like, "Let me assume there's a responsible adult with a daughter still cuz I ain't seen no sign of a daughter." So, yeah. Hopefully, she just went with another family member or her mom. >> Do not tense up. >> Not tense up while I buddy. >> You're going to go in a restraint chair. >> Yeah. Yeah. You ain't going to put me since I was 13. You're mad at >> Here we go. Sometimes the handcuffs are tranquilizer. Sometimes I said steroid shot, but if you have a better one that that illustrates how they amp up. I'll use that. But here he goes. His wrist jewelry came on and he's escalating. Some of them calm down. >> Two years old. >> Oh, did he say dog at the park? Because I know he has a dog in the car, but I could have sworn when he said I was playing with my blank at the park. I thought he said doctor. H >> I know [clears throat] you want to just >> do what you do. Go ahead. Beat you up. Throw me in the car. Do what you do. I ain't going to I'm you do this and the other thing. You guys are finding both you lucky that you both. Hey. Hey. Hey dude. Hey. Hey. Hey. Yeah. Did you get beat up in high school? You must you must >> stop. >> Yeah. Yeah. >> Stop. >> Pissed off at the ground. >> I'm not pissed off at myself. >> Let me finish my search. I hope you >> all >> I wonder if the lady in the grass is the one he road raged against. I just saw someone when they the body cam [clears throat] panned over. It was a lady standing in the grass and she had on like a professional clothing but I don't think it was a uniform >> and a 67y old woman who had a glass >> for no reason man you man go I know where I'm going >> officers almost had him in there we have to pause it here because of YouTube guidelines but let's just say saliva went airborne a few times >> he just >> well hold on and we don't have to be sub subjected to saliva actually being spit. Why do we still see that all the time on other body cams? I'm glad they skipped it. I don't want to see it, but I see them let that fly all the time on the other body cams. Yep. >> On the ground. On the ground right now. >> You the lawn crime person that had to edit this body cam footage needs a raise. It is so many so many bleeps in here. >> You ain't nothing but a >> Yeah. Put your knee on my chest. >> Put your knee on my chest. You >> I got his leg down. >> Go ahead. Go ahead. >> You got my arms? >> Yeah. You got a female helping you? Yeah. Put your hand on my arm. mother you grab in that you >> Yep. Yep. Good. Do that. Good. You guys are tough. You guys are so tough. >> Maybe me. >> Yep. >> There's a couple. >> Yep. Yep. Grab Grab 19 cops. All right, >> I'll just hold it open. >> You guys have no idea. That's awesome. All your names are on the police report. I can't wait. I can't. >> I bet he can wait when he sees how this is about to go. >> I grab a towel to wait. >> Wait. Wipe your face. Wipe your face. >> Yeah. Grab my head and smash it down. >> I'm not I'm turning you away from me. >> Oh, yeah. You're turning turning me away from me, huh? >> Yeah. >> Yeah. You're a tough guy. >> Yeah. >> You're a real tough guy. >> Yeah, I would. >> They're all Yeah. You're real tough. >> Oh, you're so tough. Fortunately for his dog, Winston, he was left in good hands. >> I grabbed toys, too. I don't know. >> Can handle? >> Yeah. Um, no. Here, let me put him put this on him for your brave. Okay. >> No, you can't. Is there >> Winston got some energy on him. I wouldn't have been brave like that, K. I'll be like, here is his collar and leash. Do what you will. Keep your windows cracked so he don't jump out. Ain't no way Winston's a little too active for me. But I'm glad Winston got somewhere to go. That's your car, right? No. No. Whose car is that? I thought he said yours. The red one behind. Okay, don't worry about it. You're all set to go, ma'am. It'll be Elers's. >> Yes, ma'am. Yes, I will. So, okay. Thank you so much. Drive safe. Roll the window up cuz I think he tries to jump out. >> Unfortunately for Christopher, he had to be transported to jail in the spit chair. >> Roll onto this. Bring this knee up and then roll onto it and up. So, roll. There you go. Good. Just like that. >> And then >> we're still at the >> Yeah, I can clear it first. Yeah, take a seat. >> Thank you, sir. Push your hands down a little bit. >> Yeah. >> Oh, I'm sorry. >> Yeah, [laughter] if that was his mom. Looks like she didn't try to make excuses for him. She just took care of the dog, which is good because we have seen moms inter interfere in traffic stops. They don't make it any better. It's not going to help anything. You didn't see how your child was your your adult child was acting before you got here. They're still going to jail. Um, so yeah, but Noir said, "Okay, so maybe mom showed up because she knows her son has a drinking problem and not to challenge the arrest." She was Yeah, she did pretty good. I didn't hear anything. I'm like, "Was [clears throat] that mom >> with mom?" >> Okay. They just said mom for my my hearing. I'm sure they mentioned it earlier, too. >> Yeah. >> I'm sorry. >> I want you to be comfortable. So, I'm not going to >> I got weak arms. They don't pull that hard. >> Yeah. What's up? What's up? Should >> be. All right. Legs done. >> All right. We got the ankles. >> Yep. >> Yeah. >> Hands will be next. Tell >> me I'll break your >> breakers. >> Get your hands off my >> You got to You want to relax, >> dude? Stop pulling my hands back. >> Well, quit pulling my mother hand off. I'm not trying to do it. Look at me. There's eight of you. What the are we talking about? >> All right. Can someone grab this >> bunch of tough guys? >> 191. One dude. >> You guys are so >> I was trying to see what her wrist said. Let me I'm slow down. I I I'm curious. Oh, wanderlust. Okay. I thought that's what it said, but I was like, maybe I'm making that up in my mind. >> Make sure you can't move. >> Yeah. Yeah. >> Better tight. >> No. >> You better sense it tight, mother. >> That's my knife. You let me go for half a second. You're about to get busted. >> Um, >> do you want me to >> You guys are so tough. >> Just I mean, we're going to have to go to the hospital either way. Yep. >> Um, so because it's 7:00, >> so it's going to be boring if he refuses. So I can do all the paperwork >> while we're out to the hospital. >> Okay. >> Um, should we just go out to Waka um hospital WH considering we're going to jail? >> Yeah, seven. Seven. >> Okay. >> Yeah. >> Yep. >> Deal. >> Here we go. [laughter] >> Go down. Grab that. >> Yeah. Nice little operation here. What state is this he? We'll see when I when we look at everything. If I didn't if cuz I forgot. If they said it, I already forgotten. But uh yeah, it's nice little nice little vehicle here. Lot lot of technology going on. >> Be seeing you again. >> Me? Oh, for sure. >> Where are you going to see me? >> Kids [laughter] at your house. >> Oh, >> yeah. I don't have kids, so that's easy. >> That's fine. >> Where we at? You see? Um, >> okay. >> There's alcohol in it. The dog was running around and he came off and sprayed all over the >> A blood alcohol test revealed Christopher's BAC was way over the legal limit. It was reportedly 223. He had faced a number of charges after his arrest, including operating while intoxicated, throwing/ discharging bodily fluid at a public safety worker, battery or threat to a judge, prosecutor, or law enforcement officer, bail jumping plus resistance. >> All right, Chris, >> not bail jumping. >> Can you hear me? Can you hear me? >> Okay, I'm assuming you can hear me. So, before I ask you any questions, you must understand your rights. You have the right to remain silent. Anything you say can will be used against you in court. You have the right to talk with a lawyer before questioning. Have a lawyer with you during questioning. If you cannot afford to hire a lawyer and want one, a lawyer will be appointed for you without charge prior to any question. If we decide to start answering questions at this time, you can also stop during uh any of the questioning. So, with you waving those rights, are you willing to answer my questions? No. Okay. Online records show a judge initially set his bond at $30,000. On May 21st of 2025, Christopher entered a plea of not guilty. The case was supposed to be bound for trial in August of that year. But on July 11th, he pleaded no contest to operating while intoxicated, throwing/ discharging bodily fluid at a public safety worker, and battery or a threat to judge, prosecutor, or law enforcement. He was sentenced to a term of 6 years in prison, plus extended supervision after his release. I didn't want to spoiler alert, Mindy, but I when you said what happened to your I think you said your brother, I was like that sound like kind of what happened to him. He got six years in prison. That's why I was like, yeah, a lot of choices he made that day cost him six years, which oh well. All right, let's look at his charges. Yeah, it still could have been more charges for him lovable. I feel like we're missing something. We'll see though. Okay, so we have first charge was a owi operating while intoxicated. We're we're well verssed today on that one. So, we'll keep going. And then we have throwing or discharging, no throwing or expelling bodily substances at certain public safety workers or employees. Prosecutors generally must prove the defendant intentionally threw, expelled, or caused a bodily substance to come into contact with a protected public safety worker and the public safety worker was acting within the scope of official duties. Possible defense arguments. The contact was accidental rather than intentional. The defendant lacked the intent required by the statute. The alleged victim's account is inconsistent with the available evidence. These were hypothetical defenses. Not saying his defense argued any of this. Just want to clarify. The next one is battery or threat to judge, prosecutor, or Leo. Class H felony. Prosecutors generally must prove the defendant intentionally made a threat or committed a battery prohibited by the statute. The alleged victim was a judge, prosecutor, law enforcement officer, or other protected official identified by the statute, and the defendant acted under the circumstances required by Wisconsin law. Possible defense challenges. A defense attorney may challenge whether the statements were protected speech rather than criminal threats. And y'all did say threat cuz you y'all were like, "Are those threats?" over because there was so much bleeping. U but the other thing they could have argued was the alleged battery never occurred. The prosecution cannot prove the defendant intended to intimidate or harm the protected official. He got those six years. So yeah, some things were proven. 0.2 anything is crazy work, right? How was he standing and driving? Oh my gosh, it's so many people that by the grace of God, their lives were not taken with him behind the wheel. Yeah, I'm glad they charged him with that bodily fluid, too. Noir, that's crazy. He had a valid license, Jacqueline. That's crazy. Okay, no echo this time. We're going to do the lawyer's advice with no echo. I am so sorry about that. I suspected because I figured it out when I used to play my song, it was echoing, but I wasn't sure. All right, so here we go with the lawyer's advice one more time and then we're going to be out of here. But you know, I'll see you soon. >> What is one piece of advice you'd give every client? >> Shut the [ __ ] up. >> Should you delete texts after getting arrested? >> No. >> What is the biggest mistake people make after an arrest? >> They talk to the police. >> What's something people think is illegal but isn't? >> Not talking to the police. >> What is your favorite part of being a criminal defense attorney? >> Standing up for people. >> What's one legal television show that gets it right? The wire. The wire. The wire. >> Would you prefer a high-profile case or more of a low-key case? >> You know, low-key because high-profile, they're going to see how the sausage is made. And I'd rather just get a phenomenal result for a client and then no one knows about it. >> What is the fastest way someone ruins their own case? >> By talking to the police. [music] >> Yeah. Yeah. Yeah. [music] >> Grab the couch. Got your name on the screen. You send me that link. I say, "Girl, [music] let me see." >> Yeah. You laugh. I lean in close. >> We already know the vibe.
