Okay, mic check. Looks like I'm getting the the good feedback. Let me see here. Okay, mic check. Looks like I'm getting the There we go. All right. I am going to give it a second for YouTube to notify people cuz, you know, lives. But if you're watching the replay, I will try to make this the intro and just timestamp you to when we actually start for real for real. Hold on 1 second. Okay, sorry. Sorry about this. Get this going. Okay, hey y'all. I see you coming in. Okay. So, I am going to go ahead and give you kind of the a little bit of the outline we're doing and but it's it's mostly freestyle on this one. So, but I do want to go over the article that was for now the most detailed I saw, which was USA Today's version of it. So, I'm going to read that article first. Um Disclaimer now. I don't think there's ever enough justice for victims. Like whatever they have suffered because they've already now had to suffer it. You know what I mean? Like they're already it's it's going to be long-lasting for them no matter what. So, when you see me celebrating, I'm just glad something happened. I just want you to know that, but I know it doesn't make up for the fact that one young lady is dead and he has five other victims, which yes, one of those victims was his daughter and I feel like I thought somewhere they mentioned that another victim was his son, but I'm not sure. So, I didn't want to like just be like for sure I know that, but I feel like two of those five other five victims was his son. So, yeah. Um so, article that we're going to look we're going to listen again if you happen to stay around after that and I give my thoughts on the article and everything. If you have to stay after that, we're going to watch again his attorneys try to argue the semantics of penetrating his daughter, number one, and I think there might be one other thing they try to argue. So, so if you are not familiar with this case and they talk about these minors, including one being his daughter, you will understand the attitude that most people will have in here because F him. Oh, okay. So, let's go ahead and go over the article first. All right, y'all. So, um I see y'all. Thank you for uh So, yes, red. >> [laughter] >> Thank you. Thank y'all. All right. So, let's start with So, today it was announced. That's what I I found out in most of the things that I saw um when I took my screenshot, it had come out about 45 minutes beforehand and thank you to the person that went under my video, older Nezzyah Harris Jarvis Butts video, and they said, "Hey, did you hear that he's dead?" And I was like, "No." So, I I Googled it and I was like, "Oh, okay. All right." So, and then thank you for the uh emails I got asking me um like D, thank you D, uh for asking if I'm going to go over it. Bam bam, thank you. Um okay, so here's the article. Just 2 weeks after he was sentenced to decades in prison, a man convicted of killing a 13-year-old Detroit girl was found dead on March 26th, 2026, the Michigan Department of Corrections confirmed. Jarvis Butts, 43, who pleaded guilty on February 12th to second-degree murder in the death of Nezzyah Harris, was serving a 35-to-60-year prison sentence in the case when he in the case when he was found dead. MDOC spokesperson Jenny Riel told the USA Today Network in an email. He was in a cell at the Charles E. Egeler Reception and Guidance Center near Jackson, Michigan. The facility is about 75 miles west of Detroit and about 35 miles south of Lansing, the state capital. Uh Riel did not immediately confirm who found Butts's body or his suspected cause of death. MDOC staff provided life-saving measures, which were unsuccessful, Riel said, and officials, including Michigan State Police, were called to the scene to investigate. The man's death, the spokesperson said, was reported as possible suicide. An autopsy will determine Butts's official cause and manner of death. During his March 12th sentencing, Butts Butts was also sentenced to concurrent prison terms of 10 to 15 years on five counts of criminal sexual conduct involving Okay, it's only females. Involving females between age 4 and 13 years old. The Egeler facility is where state prisoners are held for a time after sentencing before they are sent to another state prison to serve their time. So, he was just in the interim. That wasn't even where he was going to be. Okay. My thoughts really fast. A few things I have. To the person and I'm so glad YouTube blocked your comment. Didn't even make it through. I just went to like where it filter out some comments and see if you actually like, "Oh, no, that wouldn't you know, that's nothing offensive. That's nothing like that." And you have to approve the comment to show up in your under your video. I'm so glad YouTube blocked you. Um a person left a comment under one of my videos about Nezzyah Harris, probably about the the one where we were listening to the text messages being read out by the detective. Um I'm putting it on. Sorry. Okay. So, they said, "I know this is going to sound effed up, but she was speaking like a grown woman." Why do people not understand what grooming is? She became hypersexual because she was exposed to a grown-up that groomed her and she used the language she thought would a unfortunately attract him cuz she thought they were boyfriend-girlfriend. They were in a relationship. That's that's what she thinks in the text messages. I don't care how grown a child sounds, I expect an adult to not entertain it. Even if it's because they were exposed to social media and that's why she had the grown language. I don't care. Why is it always the child sounded grown instead of the adult didn't control themselves and not touch the child? Like I don't I do not ever care how grown a minor sounds. Why do you as an adult still choose to violate a child? So, never ever are you going to convince me that you are an advocate for children or victims in general. Don't ever go to a outing with you cuz okay, apparently because of what I wore or whatever, if I get roofied, it's my fault because whatever. Or if the child was fast, it's their fault. So, whoever you see commenting that, please never be around them. And I hope your I hope your friends and family or you probably hopefully you don't have no friends. You shouldn't have friends acting like that. But hopefully they see how you're acting and they choose to never deal with you again. Because what the hell? You just took out the whole element of who had the ultimate responsibility to not create a victim. So, with all disrespect, F you for saying that and blaming a child that is also a murder victim on top of that. Or any of the children that survived. Was his daughter grown when she was laying in the bed and he decided to violate her? Were the other minors grown? And and mind you, one of them Oh, and give her an STD. Give his own daughter an STD. Was she grown then? What the hell? I I I promise you, show yourself so I know not to ever deal with you. I I can't do it. Oh, they were already blocked, GG. They YouTube blocked it for me. Didn't even have to do anything. I was just looking to make sure uh cuz sometimes it'll over block and it's not nothing like that. So, I go make sure those comments can come through, but mm-mm. YouTube already let it It's all Y'all never had to deal with seeing it. So, now what we're Oh, let me make sure I went over all my things. Again, I want to say there's never enough justice because they already created the victim. So, all they can hope for at this time is therapy, good therapy, time to pass to hopefully not be a victim again because unfortunately, once you're a victim of that kind of act, I um I don't I don't know the psychology behind it, but a lot of a lot of um minors and adults that are victims of rape or sexual assault become a victim again. And it's So, it sucks because that's the the statistics are it's more than likely to happen to them again. So, now you've also and you've altered their mind and if unfortunately, they're in contact with adults that just think, "Oh, they're grown. They deserve whatever." I just I don't understand. I don't understand. It's it's the same It's not the same cuz they're kids, but I I want to say that just like um I I read the whole case against for instance Charlamagne and what he allegedly did to this girl. I don't care what someone's when Oh, oh, oh, and she said that he treated her They were supposed to have a big brother little sister relationship. That's what they were supposed to have. If you look up his case or if it's still um on my channel, which I wouldn't have taken it down, so it's it should still be there. Um he and I think others violated her. Um and it's alleged, so I'm not I'm not going too hard cuz it's alleged. I don't This isn't like where we saw everything with this one. Um but a lot of people are just they're taken advantage of whether they're drugged or they think you are a safe space because again, another thing is victims of sexual assault and rape normally know they're the person that did it to them whether it was a co-worker, family friend, family unfortunately, whatever it is, a lot of times they know of that person and you should you should not they That should have been a safe space. Now, he shouldn't have been around the little kids at all, especially Nezzy. He ain't got no blood relation to her. That's the other thing. These adults that allowed her and um even the his daughter, I would at least check in. I I see if you don't know someone's history. Their own daughter, you're not going to suspect I can't leave them with their dad. I I I do get that. Um but you still have to ask your kids questions. But for letting Nezzy, who had no blood relation to this man, her aunt just happened to have dated him. She should never have been allowed to be alone with him and go clean up the shop and all this other stuff. Give her another way to get an allowance and earn money. They said they found a mattress in that shop, too. Um But yeah, it Oh, I think it also has like a separate shower in there in there, too. I I feel like that's something that they named when they went through the more tedious parts of the I think it's called a pre-pre-trial cuz I kept calling it a No, it's called a preliminary hearing. I kept calling it a pre-trial. Um Ask questions. Don't blame the child. >> [laughter] >> I don't know how else to put that. Oh, the adults. Back to the adults around her. Yes, the grandmother Annette and that aunt Was it Shannon that was the one that was dating him? I still say investigate them. Audit their phones. Audit their digital footprint. Please. I feel like they did know some things. I'm not all the way there of them helping him cover up her being murdered. I didn't reach that. I'm not saying it can't be true. I just I'm not there on that. But I do know or I'm sorry, I believe in my soul that there were things that they knew and they still enabled it or um just something. I just feel They should be investigated. I I just really feel like that. Um All right. So, now trigger warning. Trigger Well, this whole thing's been a trigger warning, but even more trigger warning cuz this will be a little more detailed in arguing the semantics of penetrating your daughter. So, there's his daughter. There's that. So, I'm telling you now, but I just want you to anybody to understand if you see me celebrating I'm so glad he's dead. I'm Now, my little sis here for hot tea, I agree with her. She was like he should have should have had to suffer some more before before, you know, he he's not here anymore. But and I agree. I wish also all of that. I wish he had have suffered more. I wish he had a long time to suffer. Um Mel- Melanin Blend said, "I believe without a shadow of a doubt that they knew." I do, too. I do, too. Even the way that they got on that stand and they that grandmother had Both of them had no feelings. The times that Shannon and it was another woman and you can't convince me differently. If you go back and watch it, it was Shannon and another woman that seemed more upset that he was This is so weird to say because she was a minor, but that he was communicating with another female. That's how I'mma put it. They Their body language changed when the when the Well, the first one the body language Shannon's body language changed when they did the text part. But it didn't seem like it was because you're disgusted that he did it. Um Then there's another woman and I think it was his ex-fiancée. I can't remember it was the one that um he he borrowed everybody's car. He was a bum. He was a dusty bum. So, I can't remember whose car at that time he borrowed, but I remember her face. And she when she was asked, you know, did you think he might have been seeing somebody else and all that stuff, the only time she seemed upset and they had heard the news by now. Nobody was untouched by the news of Nezzy Harris at that point. She was upset for the cheating. She was not upset that a child had been violated. So, and then the grandmother waiting the next day even though that child has a regular schedule. And even she didn't. I don't understand how you don't call the police the night the the the time you find them missing and you go to their normal places like maybe they were lingering a little bit and you go to bed. And then you wake up. You don't call 911. You mosey on to the school. Now, I think it was after dropping the other kids off possibly. And then you report it to the school. You So, I I when when when I saw the little clips of the grandmother speaking and I didn't get to hear Shannon speaking um uh but when I saw the grandmother speaking and she was like, you know, this has ruined our lives and all this other stuff. Two hands up and shoulders up. I I'm so sorry for you. I don't know what to tell you. Yeah, the school Melanin Blend Well, the school reported her missing cuz she went up to the school the next morning. So, it it the source was the school because she the grandmother went to the school and found the like school resource officer or whoever. So, it did come from the school in that way the next day. Sleeping comfortably in her bed. All right. So, now I've done my talking. I'mma let this play. If you decide to stay and if you decide to leave, I totally get it, but I just need for people that did not hear this and people that need to be have a reminder how what he did to some minors. This is not the one for Nezzy. It's in my playlist if you want to hear the detective read those texts and everything. This is one for his daughter and I can't remember if there were other victims that they also argued the semantics of certain acts that he did. So, all right, here you go. Again, thank you. So, your honor, I have a motion to quash for relating to case ending in 6232. Um for the sake of privacy, I won't mention the complaining witness's name. But you know, there was a pre- Well, a preliminary examination held in this matter. Um there was one witness called. The complaining witness was the only witness called. She testified that at the time of the at the time of the incident, she was 4 years old. At the current at the time of the hearing, she was 13. So, there had been a substantial pass of time. You know, her testimony was she was home with Mr. Butts and Mr. Butts' girlfriend. At the um at some point the girlfriend left the bedroom. Mr. Butts was in bedroom. She was on the couch. Mr. Butts summoned her to the bedroom, at which point she was ordered to take off her clothes. Her testimony was she took off all her clothes except her underwear. She took off her clothes. Then Mr. Butts touched her. I believe the order of touching her was he touched the top of her thigh. Then he touched under her breast. And then she said he touched her where she peed. Okay? Um That was the sole testimony of this witness. Um at the end of the proofs, prosecution moved to bind over on an original count of criminal sexual conduct in the second degree and added a count of criminal sexual conduct in the first degree because of the statement of Miss I'm sorry, because of the statement of complaining witness. You know, we believe that is an abuse of discretion. The only thing that we have on the record is she said she touched where she used the restroom. And the only clarification we had was she said this is where she peed or she urinated [snorts] from. Excuse me, those were her words. Um from that, we had the prosec- um prosecution postulating that that meant that there was some penetration. Except there was no penetration mentioned. There was no penetration discussed. We know from case law for a CSC 1 to happen, there has to be some form of penetration, even the slightest. Case law also tells us if she testified that he were to force her underwear inside of her, that would be sufficient for penetration. You know, we don't have any of that. We never have conversation or we never have any testimony about her panties being pulled aside. We never have any testimony about her panties being forced in her. We never have any testimony about anyone penetrating her. Now, that is given the fact that she was 4 years old at the time this happened. Granted, 4 years old. I just want to make sure that's heard. 4 years old. But at the time of [snorts] the hearing, she was 13. Surely, she could testify. I believe she was actually on direct that she remembered the events and she said she remembered the events. None of that was testified. I think to say that there was sufficient evidence on the record that says that there was a penetration for the purpose of a CS1, it's an abuse of discretion and we believe that should be dismissed. Thank you. And counsel, your your respective motions, they're similar in nature in that you're you're arguing issue of uh whether or not there's sufficient evidence on the issue of penetration on both your motions across, right? Correct. Okay. Do you want to Why don't we have them argue his on on the second matter and then we'll hear one response from the people if you're okay with that? That's fine. Okay. Okay. So, this is then with regard to the case ending in 24101. Um and Okay. And this is Lori Beth PA8126 again. Thank you. Um so, first to overview the facts from that case, I want to emphasize that this is only with regard to one of the two instances described. The complainant described two instances, but only one of them has been charged as first-degree and I am only arguing for regards that and that particular charge. So, at the preliminary exam for that instance that was described, the testimony included wearing panties. So, again, that is similar. She never described those being removed. She did not describe any instances of penetration and only described light touching while wearing panties. The prosecution had the burden at the exam of establishing evidence of every element and that included penetration. And again, the case law is clear on this. In particular, the case I cited in my motion, People v. McQueen, while that is unpublished, it is particularly relevant because it highlights this um distinction where it needs to be more than just it uses very similar language to that used in the exam here with this emphasis on touching the vagina, rubbing the vagina. That's not enough for penetration. I I am going to interrupt sometimes, but I just won't try to interrupt too frequently. Leo Libra Love said, I could never be a defense attorney. Imagine trying to justify these atrocities. Couldn't I couldn't I couldn't I could not do it. I couldn't do it. Um Jacqueline said, "Disgusting." There was something I saw. Miss Queen Liz said, Wait. You had more than one comment. She said, "You call as soon as they're missing. The police will still still help look out. They just cannot file a missing report um person report for 24 hours or longer, I think in some cases, but they will begin to at least look and call friends." Yes. And I said before, the grandmother is not should not have been on the same clock the police would officially file something. That's your your granddaughter. You you should be looking for her immediately. You're not you don't have a clock of, "Okay, we'll wait 24 72 hours and then and then we'll figure it out." Um there was something else I wanted to say about I It's all disgusting. I don't even know what else I'll let it keep playing. Um and there there was even a specified um testimony about under the uh underwear and over. And yet, even with that fact, the court still held that this was not penetration. And that's similar to what we have here, this description of some degree of touching in that area, but that alone is not penetration. It also relies on published case law, People v. Payne, rubbing one hand where it concludes that rubbing one hand's over another vaginal area does not qualify as penetration. And I'd also like to address the response from the prosecution to this motion because the um argument they're making was not reflected in the preliminary exam testimony. Specifically, there was no testimony about inside the vagina. So, while they are now arguing that that is possible, it's not the testimony we heard. We didn't hear this contrasting of the labia and the vagina. And this diagram that is now referenced in the motion was not used at the exam. So, in conclusion, the prosecution did not meet the probable cause standard for first-degree criminal sexual conduct because there was no evidence of penetration and by no means it over was not proper specifically as to that charge. Thank you. All right. Who's going to take the lead from the people? That's you, Judge. All right. Very good. So, I'll All right. What I'm going to do, just because I know most people in here that if y'all are in here with me, you already watched this with me for most of y'all. So, what I'll do is I'm going to link this video again in my description box and you'll hear the prosecution argue but about it. The judge does end up counting it as penetration. I don't want to leave you hanging. And you know, he's dead now, whatever. But there was a description that his daughter also gave about it was like as if someone was playing in your ear. And that was enough for the judge to be like, "Well, that means, you know, for a child's description, that's as close as you're going to get if they don't know the language or you know, like that." So, he did rule it as penetration. Just wanted to let y'all know that. Um Yeah, I couldn't I could not be I couldn't be a public defender defense attorney cuz they can't choose who they represent. And if you're the just a defense attorney and representing this, I don't know what to tell you. Um but I do wish she had suffered more. Agree again with my little sis, Hot Tea. Here for Hot Tea. Um I don't give I have nothing. I don't care. He's dead. Oh well. Um I just hope that his victims that are still here get the therapy that they need and the the most closure that one can hope to get when you're a victim of something like this. I hope they are not re-victimized. Um cuz it's the I can't get the word out. Statistically, it could happen. So, I definitely hope that that does not happen to them and they just fall into the hands of other predators. Um shout out to the aunts. Not not her aunt that lived with her, but the aunts that did report to um child CPS. They reported to CPS earlier when Neziah was still alive. They observed something that he did with that with Neziah and another child that made them immediately go to CPS and they did report it. Detroit PD, they failed because they didn't investigate it. They didn't even look to see Neziah was also um a victim in that circumstance. So, yeah, but >> [sighs] >> this is it. I um I don't know. It's like it's not closure because Neziah is not here anymore and then he has victims that are always going to be changed because of this. But don't come over here and ever tell me that a child participated in their own grooming because they were acting grown. You're not going to get it from me. No. Mhm. To the pits of hell you should go, in my opinion. Um Put my kicks up said, "Sorry, I'm late. What happened and did he tell where her body was?" Well, what happens he's dead. They're going to do an autopsy. They think it's a possible suicide. I I I hope he didn't die by suicide. I I hope they got him in prison. I I do. Um and then the only thing I ever saw in an article about him telling where the body was, that was part of his plea agreement, is that he said, "I dumped her in the river." That's the only thing I ever personally saw. So, if anything else was seen, I didn't I didn't see anything else on my end. So, all right, y'all. I have to go study. Thank you for stopping in to hear my thoughts cuz I know you already heard the news. Most of y'all had already heard the news, so I do appreciate y'all stopping to hear my thoughts as well. And I do hope y'all have a good evening and I will see y'all at least by Saturday morning if not earlier. All right. Talk to y'all later. Bye.
