taking this way out of hand no I'm not cuz I know my rights all right someone sent me this video this was uh posted to YouTube by lwig lwig Von jackhole probably his real name and this comes to us from Baxley Georgia involving the Baxley Georgia police department and this is what the description says happened on November 5th 2022 at around 10:30 p.m. Lawrence Walters was working late at the gaming store that he owned he took a break after a long day to walk to a local convenience store 1/10th of a mile away to grab a late night meal when officer Leon McKinny of the Baxley Georgia Police Department arrived on the scene Mr Walters cooperated in giving his name and business name to the officer but he refused to give his date of birth as is his right Sergeant Terry Reynolds then arrived on the scene and ultimately well you'll see what happens if I see somebody coming from behind a building t i I have then I can walk stop and and ask him what they're doing and I told you what I was doing okay and I told you who I was but I don't know who you are I'm just date of birth what's your name I'm not giving you my date of birth I gave you my name you have no suspicion that I've committed any crime you're behind a building you're pring okay you're and pring we'll s this right now we'll sell this right now I'm not going nowhere with you right now how about we go over to my let me tell you something my business open up the door I believe you now but I'm telling you I do have a right to stop you am I free to go no because I want to know your name and that b so I can make aort already gave I already gave you I'm going to make a report of this do what you got to do I already gave you my I'm going to make a report of this all right so there's been no call for service here nobody is in distress nobody has reported a crime being committed we just have a police officer observing the who is apparently the owner of a business walking behind his own business and then takes it upon himself to investigate further and these two are arguing back and forth about Reasonable Suspicion and probable cause and they don't quite understand it reasonable suspicion and probable cause are not the same thing the police officer needs Reasonable Suspicion in order to detain this individual in order to detain anybody reasonable suspicion that some crime has occurred now that isn't a free pass or a blank check to then hold the person as long as possible and do whatever you want with them it depends on the circumstances so if the reasonable suspicion that would justifi detention here is that this man appeared to be a Prowler then here is the problem for the police officer the police officer just admitted that he was now satisfied that this guy was the business owner and not a Prowler yet he wants to continue to detain the guy even though the original reason Reasonable Suspicion assuming that was enough has been alleviated he's caught on his own body cam footage admitting that the Reasonable Suspicion if it existed no longer exists see if yourself I believe you now but I'm telling you I do have a right to stop you am I free to go no so for that reason I don't believe any further detention is Justified here under the Fourth Amendment but let's continue to watch and see what happens next I already gave you my name do what you got to do I'm going to make a report at this point I answer no no more questions all you had to do is say yes sir uh I I already told you that I said that when my bu no when I first pulled up when I I said you don't have no reason to stop me and I do no you don't you're wrong because it's not trespassing WR it takes someone from one of these business it takes either Miss moody or Wayde Moody they're own this they own that right to either trespass someone or owner of the business to trespass someone I know what George law says let me tell you this ain't you glad I'm checking on these businesses it's fine you're checking but what I'm telling you is you you you're hindering me from what I'm going to do I want to go get something to eat cuz I I've worked 18 hours today and I haven't had nothing to eat and all you had to do was be polite and talk to me nicely I was polite I didn't cuss at you the first thing that you said to me you have no right to stop me you don't yes I do I'm telling you look under the OC I I don't have to look under no law I do this constantly year after year that doesn't make it right is what I'm telling you it does not make it right listen what's your name you still haven't identified yourself to live I live in ubal okay that's that's the most you going to get out of me okay cuz everything else you can pull up my City License through the city of back I'm not saying nothing I'm not trying to question you about nothing like that you can pull up Department I see him walking behind the building here I just pulled in here I said come here a minute I talk to you and he said you have no reason to stop me I said yes you do out of business and you're be you're coming behind but now I ask what dat of birth he says I'm not giving you my date of birth but this is his owner of the property I am a business owner that to him but now you won't give him his date of birth and here we've identified the problem the sergeant shows up Sergeant Terry Reynolds the sergeant is told that officer McKenna had seen this guy walking and the supervisor the sergeant immediately says yes he can hold you he can detain you he's been told nothing that could consist of reasonable suspicion sufficient to satisfy the Fourth Amendment if we want to stop you and we want to detain you and get your ID get your date of birth whatever we want you are going to respect our Authority y'all say all the businesses are closed they're not my business ain't closed so there you go he don't know you man it doesn't matter I already told I give him my name it does matter any it doesn't matter it doesn't matter to me it might matter to you it matters to it matters to state of Georgia no it doesn't you better go look up at the code I know what the code says then they show me the code don't tell me show me the code I ain't got to show you nothing they arrest me then put your about you arrest what under arrest for you have a charge for obstruction obstruction you know that's not going to stick right ask I did I did you'll see the birthday no he won't give it to me Jes birthday that's not complying I gave him my name that's not complying I don't have to comply cuz I did nothing wrong she know you you in a place your business is closed no my business is not closed your business retro d games it is not closed I am open for business it doesn't matter we don't know that your business is closed because you're not there no it's not how do you know I don't got an employee there I don't that's what that's why which one is it it's retro de gangs come on I I'll pull out my it doesn't matter business if the business is not closed it won't be locked it's locked because I locked it it's not closed but that's not my hours operation but I can pull my keys off I asked him to walk with me when you review that body I asked him to walk so he was arrested for obstruction and I'm on the cusp of being suspicious that this could be some sort of skit it almost is too ridiculous to be real I do take the word of lwig Von jackhole here I believe that this is real he finishes the story here to explain what happened next so he got arrested Mr Walters was arrested for obstruction he then went to City Hall to discuss that arrest with the chief of police Jeffrey Taylor Chief Taylor's response was then to threaten to arrest Mr Walters again stating to him you do not have a First Amendment right to argue with the police then according to Von jackhole the city of Baxley obstructed his and Mr Walter's request for body Camp footage of this arrest fortunately he says the case was dismissed earlier this month leaving the department no choice at that point but to released the body cam footage from that night which is why it was just released shortly after this incident Von jackhole further explains officer mcken left the Baxley PD to become the chief of police of Odum Georgia Von jackhole um closes the story by stating that as a result of this arrest Mr Walters lost customers and eventually had to sell his business at a loss due to bad publicity and repeated harassment from the city well it's great that the charge was dismissed because there was no justification under the fourth amendment to hold Mr Walters at all the arguing back and forth is absurd while there could theoretically be some limited Reasonable Suspicion um sufficient to briefly detain somebody depending on the circumstances at the point at which it was clear to them that he was not committing a crime that he was claiming to be the business owner they did no further investigation to establish whether or not he was the business owner he identified himself I mean he for the most part did cooperate with them and he was arrested for obstruction for what for arguing with them really this is a um Not only was the fourth amendment violated here because this man was detained um without Reasonable Suspicion much less probable cause to arrest him for anything but really the real reason it appears to me that they arrested him was in retaliation for his protected First Amendment speech so this was first amendment retaliation because he asserted his rights because he criticized them because he challenged their Authority because he questioned their Authority that is the real reason that he was arrested that's also the real reason why they couldn't continue the prosecution they had to drop the charges because he did nothing wrong what can you do spread this footage of how they do things in the city of Baxley Georgia maybe they'll change their ways probably not but anyways thanks for watching um and please continue to
