all right i'm about to show you a violent use of physical force by police officers against my client michael payne who is a local track and field and soccer coach at a high school so this was at a high school basketball game between two rivals things got heated people came onto the court and my client being a local coach came out there to try to help resolve things and and tried to convince one of his friends to not get herself into trouble but here come the comes the princeton police department and who do they choose to grab and violently throw on the ground that's my client who had done nothing wrong he had threatened nobody he had committed no crime yet he is violently thrown to the ground in such a manner so as to fracture his knee to put him out of work for an extended period of time did he commit any crime no he wasn't charged with having committed any crime but he was the one that they chose the princeton police department to slam him on the ground to forcibly escort him out of the building and no criminal charges um nothing at all so i was able to get the surveillance footage from the school i did have some footage that were taken by some people in the stands so take a look at it yourself here we have it from several different different angles and see for yourself whether or not you think that mr payne is committing any crimes or whether there's any necessity at all to engage in a violent use of physical force against him right now what you're seeing is the end of the basketball game both sides are shaking hands and i'll go ahead and play this first one straight through so you can see that i didn't cut and paste it at all the events as they actually occurred the first go around then we'll see it slow motion a little bit and from a couple different cameras you'll see here that a shoving match breaks out on the court and this is not where our incident happens it actually happens after this one finishes so the people involved in the shoving match were escorted off the court as you can see right there and now you'll see there's mr payne right there where the arrow shows you'll see a princeton police officer boom take him to the ground right there we'll watch it again and in slow motion all right here it is from another camera in another angle from this clip that you can see that the actual sheriff there in the county saw what happened and sort of came to the rescue and grabbed mr payne and escorts him off the court and away from this police officer who attacked him but you'll see that the police officer follows up and he tries to get his hands on him again and takes him out of the building here's a yet another angle right here you can really see this one the best so here you see mr payne being taken down right there and the sheriff comes up and others were aware that this this guy was a teacher there he had done nothing wrong and the sheriff you can see right there sort of escorting him off the court and away from this police officer but here comes the officer you see in the black right there following up getting his hands on him again and making sure that he drives him out of the court really for no good reason and a lot of people there knew that mr payne actually is suffering from bone cancer so he's not a threat to anybody so that was the footage were mr payne's civil rights violated well it's a violation of our fourth amendment rights if the police use excessive force against us now he wasn't an arrestee he wasn't in police custody therefore the fourth amendment applies we have where known as the graham factors so really the first thing we look at is was he suspected of having committed any crime and if so was a serious crime or something minor well he wasn't even suspected of having committed a crime was there any physical threat had he been threatening anybody police officers anyone else did he pose a threat was he armed no no to all of those so i think under the grand factor review he wasn't resist again he wasn't resisting arrest or fleeing arrest or anything like that because he had committed no crime so under the grant factors it's going to be very difficult to justify a use of force against mr payne [Music]
