accordingly this situation was first covered by the YouTube channel the random Patriot several of you sent me links to this footage I reached out and received his Blessing to use some of his footage he also reached out to the homeowners here and got me the thumbs up to do a video on this and check out his channel apparently he got arrested today I haven't been able to watch the video yet but this footage comes to us from a rural County in Northern Arkansas called sharp County and sharp county is home to a sheriff named Shane Russell I already introduced you to him this happened in January of 2023 the sheriff and several of his underlings show up at this private residence there's a noise complaint the allegations are that the homeowners here were revving engines on their own property oh I'm sorry going thousand in America I'm sorry law enforcement shows up they have no warrant of of any kind homeowners are inside locked in their house that door right now you want to step out here and talk to us why you don't have to what have I done now look here who was driving the maroon dodg few minutes ago me I went to the Dollar Store and I came back home open the door you're coming out why take care I've done quite a few videos where similar things have happened way too many as far as criminal charges go what almost always happens is the same thing that happened here from my understanding the criminal charges were thereafter dropped they were dismissed most likely because as soon as they got in the hands of the individual responsible for prosecuting the case with ethical obligations to the court and so on due to the blatant and glaring constitutional violations that occurred there can be no prosecution so the charges almost always have well always have to be dismissed and it's really not even necessary to get too bogged down in the facts here it doesn't even matter if the engine revving occurred or whatever it doesn't matter show me the warrant show me the warrant the pertinent facts here are that law enforcement officers showed up at this home's front door without a warrant of any kind to investigate criminal allegations those allegations were relatively very minor harassment is the word that was used minor misdemeanor allegations so the first thing that I notice here is that the home's front door was closed and the chain was locked what now you step out here and talk to it why you to what have I done now here then the sheriff who's speaking to the homeowner he's asking questions who was driving the maroon Dodge a few months ago me I went to the Dollar Store and I came back home open the door you're coming out this indicates that this isn't something that just happened that he witnessed and then he followed the person into the house this isn't a traffic stop where the person parked on their driveway and ran in the house this is police officers going up to a front door conducting a criminal investigation they don't even know the facts they're asking very basic questions now generally speaking there's nothing out there saying that police off officers can't walk up to your front door knock on it and start asking you questions this is referred to as a knock and talk which is a consensual encounter now a consensual encounter occurs when police officers approach a home knock on the door without any show of Authority or restraint that would suggest that the homeowner is not free to end the conversation and order the police officers off the property so the homeowner is free to speak with the officers or not speak with the officers or end the conversation at any time officers can can ask to enter the home but they have to have voluntary consent from the homeowner and if consent is not given they can't enter the home unless they come back with a warrant but if police officers are asserting their Authority like here they're ordering the homeowner outside of the home in a display of authority with multiple police officers in uniform the homeowner isn't being given a choice me I went to the Dollar Store and I came back home open the door you're coming out why because you're going to go with me why you're under arrest that's not a consenual encounter that implicates the Fourth Amendment and a warrant is required under those circumstances even if that individual committed a crime and the police officers have probable cause to make an arrest of that person for that crime if that person's in their home police officers must have an arrest warrant to arrest the individual The Only Exception here that would apply is exigent circumstances that would be like an emergency situation such as as do a domestic violence situation where police officers have to act immediately and they can articulate the reasons why they don't have time to go get a warrant and come back none of that would exist here this clearly was not a concentral encounter this became a seizure from the very first second and if there was no warrant this absolutely was a violation of the Fourth Amendment as it pertains to the mom being arrested and then there's the arrest of the son the arrest of the son son is even more egregious because there's no way in hell you could even argue this was a concentral encounter he is lecturing the sun while standing on the front porch this is not in any way a consensual conversation and the sun is not even under arrest he's just saying are you listening to me this crap out here is going to stop I don't understand are you two kids and an old person he's basically threatening him with an arrest in the future if the son engages in what he believes is Criminal conduct in the future so that the future hasn't even happened yet and he's just not happy with the son's lack of response to his lecture so he decides he's just going to cross the threshold of the home go inside and arrest the son without a warrant come on you're going I don't have to talk come on when he wasn't going to arrest the son 5 Seconds earlier but because the son didn't a knowledged the lecture he was giving him now he is going to arrest his son so he doesn't have a warrant and there's no way he could even argue consent or exent circumstances because there were no exent circumstances 5 seconds before the son not acknowledging the lecture he's being given that cannot be exigent circumstances additionally there may be a claim of First Amendment retaliation there but the fact that he arrested him just like his mother in the absence of an arrest warrant I don't see any possible defense to that if a lawsuit was filed frankly this would be an easy case if a lawyer wanted to file a lawsuit for them here wouldn't have to charge them anything and you would get reasonable attorneys fees and expenses paid here because there is no more clearly established violation of constitutional law that police officers can engage in than going in somebody's house without a warrant and arresting them without a warrant it's very very simple no search or seizure in the home without a warrant that is the default rule let me know in the comments what you think are you willing to disregard the Constitution just by virtue of allegations of revving engines is that the hill that you want to throw away your constitutional rights on because apparently that's the hill that sheriff Shane Russell is willing to throw away your constitutional rights on which means throw it away on any Hill any allegation who cares about the Fourth Amendment if it's something that pisses him off guess what you have no rights you get arrested so he's on video here trashing your constitutional rights if he's your public servant maybe you want to get involved politically and get this guy removed maybe you want to make sure that your neighbors and your friends is aware that they have a tyrant as a sheriff who completely spits on on your constitutional rights so as always I'll put all of the relevant contact information in the
