officer has been suspended criminally charged fired and then brought back the defendant used coar language through a food bowl across uh a kitchen he escalates everything even the mayor his own boss admitted that do you think he understands deescalation oh um no I don't so why is he still there that was my question in the last video why is this guy still there he seems like a complete narcissist which in my opinion is what's causing the problems so picture this this mom Alicia cook is parked in her car outside a school she's waiting for her daughter's cheer practice she has two young children in the car with her suddenly Lieutenant Matthew Ferman with the Melvindale Police Department pulls up behind her in the school parking lot and he performs a traffic stop due to an expired registration sticker on the car Lieutenant Ferman Melvindale Police Department I'm a traffic enforcement officer uh your plate CAU my attention it's expired it expired in March also when I run your plate the government shows there's no insurance on the vehicle at this time the state of Michigan tracks that through your license plate so was your plate expired you don't have any insurance this is not my car but if you're driving it you're legally responsible for everything but I don't I don't know why his how are you related to him he's in a hospital who is he to you my best friend okay you have your driver's license ready card Mama M I need your driver's license ready card you're on a traffic stop don't tell me one second hold on sir I'm giving you a lawful police order inside of a school Public Access parking lot I have full jurisdiction just like I do that roadway so lose the attitude and do as you're instructed sir m64 dispatch I'll have traffic 19615 Allen Road I'll be in the rear parking now things escalate fast he demands ID he demands that she get out of the car when she doesn't immediately do so Ferman then resorts to violence he ends up tasing her in the car right in front of her two young children and in front of other people and parents who were in the parking lot you just pull me over inside of a school parking lot damn right I did that's my job C give me your identification now and the vehicle key now oh my God okay next thing is you go on handcuffs I've asked you nicely you're escalating this for no reason es stop yelling back at him he is a cop okay I ask for your ask your mom to come here right quick please give me your ID no I'm not giving you ID you off get he to P me school I don't understand what's going on I got one resist and he trying to make me get out the car asking for the keys multiple times stop my key out I don't understand I'm conf you're going to be treasured oh down to the ground I can't move I don't T are deployed down to the ground hands behind your back hands behind your back step out of the vehicle out of the car now by the way the mom is already on the ground outside the car so at this moment he's actually yelling this at these small children out of the car confused out of the car up there out of the way I told you numerous times give me the key and your ID no I told you to give me your key and your ID and you said no no I didn't yes you did it's recorded I was you weren't trying to do anything you were not trying to do anything when I tell you to do something you do it I told you you're making me concerned now we play games yes you did female subject Tas her twice resisting now he's going to say that she wasn't being cooperative he ordered her out of the car and she refused he asked for her ID and she refused you were told to get out you were told to give me the key you were told me to give me ID and you said no and refuse question No I gave you a Direction me over in a parking lot I didn't understand and I told you it's a public assess parking lot your plat expired you got no insurance got it I got a Cher don't make a difference this was Miss Cook's explanation for why she didn't immediately comply I had just got bad news saying that um the person that the car the name was in um just had heart surgery at the time my mind was in a thousand places he wanted me to think like that wouldn't escalated as bad you know if you're a police officer and you have the unfortunate occasion to tase a mom in a school parking lot while her children are literally inside the car with other parents watching you really ought to get a conviction on that Mom for whatever crime hopefully serious that she's committing what happened here well the Wayne County prosecutor's office after seeing the footage dismissed all the charges cook would be hit with a civil infraction and four misdemeanors including resisting arrest interfering with a police officer and driving on a suspended license but after reviewing the body camera the city attorney's office dismissed everything Ferman thinks that he is so smart other than his apparent narcissism do you want to know why he kept saying that he was terrified or or he was afraid she was making him scared I give you a lawful order and I'm worried about my safety because you're not doing what I told you when I tell you to do something you do it I told you you're making me concerned for my safety I was terrified from you my hands were up you terrified me you scared me have anything in my house you scared me he did that because he's been taught that that is one of the necessary elements if you're going to order the occupant of a vehicle at a traffic stop out of the car as I've explained generally police officers can order you you out of the car during a traffic stop that doesn't mean they get to Frisk or search you or extend the length or scope of the stop that doesn't mean they're allowed to punish you or go on a fishing Expedition officer safety has to be the reason that they're ordering you out of the vehicle they're allowed to just engage in a traffic stop with you outside of the car now if they have reason to believe that you're armed or dangerous then they get to go even further they get to perform a Terry Frisk of you to patch you down for weapons maybe even put you in handcuffs that's the game that Ferman is playing assuming this was a valid traffic stop and I don't see any reason to dispute that it is he said he encountered this car with an expired sticker I haven't seen where she disputes that he says there was no insurance on the car according to his records okay fine valid traffic stop was she compliant with what he was ordering her to do no she was not completely compliant did that justify her being tased no the problem here is not that he ordered her out of the car the problem was is when she didn't immediately get out of the car his solution was to basically taseer first and ask questions later give me your ID no I'm not giving you you have to you're going to be treasured help Melvindale Michigan is within the sixth federal circuit a good case to look at that applies to this specific situation is Browning versus Edmonson from 2021 in that case qualified immunity was denied to a police officer for tasing the occupant of a vehicle during a traffic stop just like here it was a minor traffic offense just like here the individuals at best were engaging in passive resistance or non-compliance with verbal commands and just like here the officer escalated straight to violence in response to that the court made clear in the Browning case failure to exit a vehicle is not active resistance and does not justify the use of a taser there has to be some more serious crime that's alleged to have been committed or some serious threat to officer safety such as the person is actively fighting with the officer police officers can't just say you're resisting by not getting out of the car when I tell you to or not turning off the car we're not handing over ID those things are all passive resistance and the courts have made clear that alone does not justify the use of a taser can't say get out of the car and when you don't get out of the car T you that may work well for police officers but it's unconstitutional because it's unreasonable it's excessive it's excessive force so why is Ferman still there apparently he's still on administrative leave from another tasing allegation that I covered in the last video it's under investigation at this time and uh it will be continued to be investigated and thoroughly done it sounds like there's some possibility that there could be criminal charges arising from that and sadly that wouldn't be the first time that he's had criminal charges filed against him can anybody deny that this guy has to be one of the worst cops in the country our other top story at this hour a Melvindale police Sergeant pleading no contest to a charge of willful neglective Duty Sergeant Matthew Ferman made The Plea during an arraignment this afternoon you Sly swear and affirm that the testimony you're about to give concerning this case will be the trth so help you got yes sir the defendant used course language through a food bowl across uh a kitchen and acted in an unprofessional manner set free on personal Bond he will be required to serve a year of probation attend anger management classes pay fines and restitution his formal sentencing date has not yet been set he was then fired however an arbitrator later overturned the termination now Ferman is telling the news media that he has now withdrawn that no contest plea to that conviction it's not even really a city it's just sort of a part of the outskirts of Detroit I looked it up on Google Earth and it's actually a very very small area it's almost just like a neighborhood it's like one of these little police departments for a specific neighborhood if they want a guy like that there policing their streets okay fine but what about if other people have to drive through that area that don't live there and and they don't have a say politically in that area that's really no different than some small town somewhere setting up a speed trap to catch the rest of us just driving through the fact is is Ferman is rude to people he escalates routine traffic encounters into violence when I tell you to do something you do it end of story sit the step out of the car turn around hands on the hood hands on the roof sit down and shut the up it's completely unnecessary
