what the problem is i'm doing everything to say i know but tell me what i'm saying is you told me there's a guy in there so i don't want you going in there please okay that's fine please good supervisor okay right now you have your insurance no i'm supervised we can get one out here just take a seat out here all right all right just take a seat right there model is this rolls royce doesn't matter let's get a supervisor so we can expedite this huh okay uh this is the report number here for insurance make sure you give them the entire number here that's interesting okay yep all right so make sure you give you give them the entire uh case number okay all right do you have um do you still have progressive of course okay all right cool because it came up on the computer huh all right so this is yours um let me just watch the video huh well since you're telling me one story and he's telling me the other thing well he's saying that you went into him so this is where we're at keith this is where we're at so it's uh thank you i'm gonna be honest here you need to do the right thing you gotta bring it right into me okay well unfortunately i didn't see the crash so i can't take just like i can't say i can't take your store i can't take his side i can't take your side all right all right so what's going to happen is both insurances are just going to battle it out you're going to pay your deductible he's going to pay his deductible and then that's we're going to be at all right let me just make sure i got your input that's wrong the guy invited me he's a clown dude he said you never was four or seven i'm just a nice guy like i can't believe you did that all right yeah and then you said the opposite so i can't pick such so i mean it is what it is it has a copy of four years way before you were all right all right so the crash is complete i'm here because i'm going to do a changing of the hats because we're going to conduct a dui investigation okay why because we may believe that you're under the influence of alcohol not at all okay i'm going to read you something before i start questioning or ask you anything like that okay you have the right to make sally do you understand words okay anything you say may be used against me in court do you understand absolutely you have the right to talk to a laura before and during questioning do you understand absolutely if you cannot afford a lawyer and what one will be provided for you before questioning without charge do you understand yes has anyone threatened you or promised you anything to get you to talk to him he threatened you he promised you because of this accident they hit me uh-huh and now he's got you here uh-huh so i'd like to film you with john moore who's on the phone right now okay the reason is because what happened is now i feel intimidated well what happened you do your thing i know well what happened because i don't tomorrow you're gonna wish you didn't do this okay in fairness okay so what happened because i i don't really know i just know that there was a crash but what happened no this guy ran right into me where were you guys at uh we were at uh south street okay um he ran right into me right here right over there i'm trying to use a bathroom and it was locked and he walked up and we talked and i was like delighted to tell him what happened and okay where were you coming from downtown downtown do you remember where exactly you were that's cool do you remember where you were yeah where were you at okay did you have anything to drink i did how about how much one beer do you remember what type of beer you had uh a corona do you remember around what time that was three hours three hours ago okay you just had the one drink what time did you leave downtown [Music] hour how long were you there for two hours where'd you go after you left downtown to get from downtown to right here and i know you're [Music] what do you do for work i don't know i own half the money oh wow you're important some of my buildings okay like office buildings are like uh wow good for you that's awesome you're willing to do the field sobriety exercises absolutely awesome all right before we start i'm just going to ask you a few more questions assignments what are we doing do you want any questions yeah it's not gonna work okay um do you wear prescription contacts or glasses i just have that i have a bad eye what's wrong with your eye it just has a stagnance okay so it like it's like a lazy eye okay so it has no smooth pursuit how do you know um that you have nystagmus like has a doctor told you that or did you just diagnose yourself for 20 years for 20 years were you born that way or did something happen to you uh actually it was a something's wrong when i was playing baseball it actually hurt me when i was like trying to like hit the ball what hurt you the i couldn't hit it and the doctor was like you have a problem with your eye what'd they tell you was wrong with your eye it was something was there's like a stagnance it's like a slow movement okay um do you take any prescription medication no no do you do any illegal drugs no when's the last time that you ate six hours ago you remember what you had what's up from subway or something downtown no it's jersey my okay um have you suffered from any recent physical injuries let's get to it okay can you take your sunglasses off for me all right do you mind sitting on the hood of your car why because you're a lot taller than me so it makes it difficult for me to see your eyes have you ever have you ever been through field sobriety exercises before you have no you haven't how do you know about uh horizontal gaze and stogmas you've heard of it okay i'm not doing that i'm sorry i'm not doing that you refuse to do the horizontal gaze of sacrament okay will you participate in the other two exercises okay awesome we're gonna go back here okay yeah i heard okay i'll do it if you want me to that's great you will do the you will do this tag with yourself because i have my bad eye okay will you participate in the walking turn sure awesome is it 10 seconds it is so just hang out right there for me yep just hang out right there for me right now no you don't need a right turn at this point can you just stand on the sidewalk for me sir thank you i need your help thirty nine no two stop stop rubble cut that piece off okay just hold on [Music] what's his name keith yeah okay all right keep can you do me a favor walk up to the line for me i need you to place your left foot on the line followed by your right foot directly in front heel to toe touching just like mine with your hands down by your side you're gonna stay in this position the entire time i explain the exercise okay if for any reason you stumble or you set your foot to the side just go right back to this position okay i'm going to explain the instructions and i'm going to demonstrate for you and then you're going to begin okay all right when i tell you to you're going to take nine heel to toe steps down this line okay on this yes sir you're you're going to take nine heel to toe steps down the line on your last step you're going to leave your front foot on the line you'll take a series of small steps to turn around you'll take nine nine heel to toe steps back okay so it'll look something like this one two three can you get back in the position for me four five six seven until you get to nine once you get to nine you're going to leave your front foot on the line take a series of small steps like this to turn around and you'll take nine heel to toe steps back so one two three four five and so on until you get to nine okay all right during this exercise i need your eyes on your feet the entire time your hands down by your side just like they are now i need you counting every number out loud and if for some reason you step off the line or you feel that you forgot just finish the exercise until it's completed okay of course okay do you have any questions for me okay you can begin whenever you're ready sorry i go to the kill 16. okay one more exercise all right anything you want all right both feet together just like this hands down by your side you're going to stay in this position the entire time while i explain the exercise okay all right when i tell you to you're gonna lift either foot of choice left or right approximately six inches off the ground so let's say about the size of a soda can okay okay you're gonna have your foot lifted up with your foot pointed and you're gonna count out in this manner one thousand one one thousand two one thousand three until i tell you to stop okay all right during this exercise keep your foot pointed have your eyes on your feet your hands down by your side for any reason you put your foot down or you hop just continue the exercise until i tell you it's completed okay done okay which ex uh which foot would you like to lift your back left string your left one [Music] [Music] four five six no i said to cancel i tell you you were done oh that's okay all right last exercise have your hands down by your out like an airplane close your eyes keep your head
