police in Frisco Texas held a black couple at gunpoint and handcuffed their minor child earlier this month after police mistyped their car's license plate into the cop system leading them to falsely believe that the car that the family was driving was stolen welcome back to the civil rights lawyer Channel this is not the only sort of incident like this that I have covered but let's go over this once again like we have to do with a lot of these issues is it constitutional for the police to screw up and think your family vehicle is stolen and then order you out of the car at gunpoint and humiliate you whatever is in your hand put it on the roof that's fine open up the car from the outside yes this incident occurred on July 23rd on the Dallas North Tollway as this family drove to a basketball tournament while running their car's license plate officers mistakenly told their system that the plate was from Arizona in reality the Family's car had an Arkansas license plate leading the system to tell the officers that the car was stolen now first question is is why did they run this family's license plate in the first place but first I want to thank the sponsor of this video Aura have you ever Googled yourself and you were shocked to see your personal information Exposed on one of those public listing sites one of the first things that I do when I start investigating a new case is to Google the people involved and many times it's crazy what I end up finding and this is especially true in civil rights cases where the usual defendants tend to have either no online the description thanks again to Aura for sponsoring this video body cam footage shows an officer holding the family at gunpoint officers ordered the family to show their hands and commanded the driver to exit the car face away from the officers lift up her shirt while spinning to reveal her waistband and walk backwards people hey move your car back move your car back bro I don't want them to hit me open up your car door and step out of the car unlock your car unlock your car do it now unlock your car slowly exit the vehicle face away from us face away from us face away turn around turn around it's okay turn around do not face us everybody in the car heads outside the window hands outside maintain your hands outside driver slowly lift up your shirt only for us to see your waistband slowly spin around you can lower your shirt a little bit lower your shirt lower your shirt we do not need to see your bra okay that's fine slowly start walking backwards walk backwards keep walking keep walking backwards keep walking keep walking keep walking walk a little faster the tollway is shut down keep walking backwards keep walking keep walking keep walking keep walking backwards keep walking stop stop Direction somebody else whose hands the woman repeatedly told the officers that her car belonged to her and even clarified that she's from Arkansas not Arizona come on sit back here come on is this your car is this your car yes come back here what happened is that your tag on the vehicle yeah I'm from Arkansas A Little Rock I'm a nurse I've never done anything in my life to work so did you where'd you get the tag from is that always been the same tag on the vehicles so you always had that time ma'am I've been out ever since I've had my car okay I'm from Little Rock Arkansas I've never been in trouble oh man I have daddies look at my baby as long as your kids I need you to talk to me my son and my nephew we're on the way to a tournament okay where the woman became increasingly concerned after seeing the officers handcuff her son rear passenger behind the driver's seat open up your car door and step out of the car slowly step out of the car face away from us face away thank you with one hand lift up your shirt so we can see your waistband now slowly spin around slowly spin around higher lift your shirt higher lift the back of your shirt higher turn around now turn around that's fine occupants in the car leave your heads outside the car we know there is a gun in there if you reach in that car you may get shot so be careful do not reach in the car all right sir that is on the roadway put your hands up great shirt great shorts slowly step backwards start stepping backwards to our car start walking keep walking keep walking keep walking keep walking who's on hands stop stop hey we need more officers after officers realize their mistake they acknowledged it to the family this was an honest mistake an officer told one of the boys in the car another took responsibility while speaking to the parents that's on me he said a bat in a basketball tournament yeah my son that's my son I don't know about it listen bro we just here for a basketball tournament bro we just learned we just learned right now that's why we stopped bro I'm coming out bro come on out I don't know come on out please fit that way or no we ran attack the attack came out stolen but it was the wrong State yeah not too long ago bro we put her we didn't we're careful that's a that's a terrible experience though I mean I understand y'all got to do your job man but we all legit bro I know we all legit bro hey man listen this is a it was an honest mistake okay listen we didn't want to do this like if there's a long haul we didn't know okay so all right yes sir so it came and we thought it was a stolen vehicle when we ran the information it came back stolen to us and so um this is the normal way we uh pull people out of a stolen car okay it just came back to us that it was not stolen so that's why we stopped everything in the middle otherwise all four of y'all would have came out of gunpoint right so as soon as it came into the system that's when we yeah time out time out time out you understand okay we're so sorry that you got to go through that come on up we made a mistake Frisco police chief David Chilson said in the Department's later statement our department will not hide from its mistakes instead we will learn from them oh really the very problem is is that they do not learn from these mistakes because they're not held accountable for their mistakes I just did a video on this happening in Lehigh I believe that was Colorado but it's also happened elsewhere Aurora Colorado it happened Raymore Missouri Fairfax Virginia Norwalk Connecticut and that happened to the general manager of the Yankees Brian Cashman and I detailed in that Lehigh video that I did so what is the law in regards to this okay when the police through no fault of the motorist think that the car's stolen can they order them out at gunpoint like they do all over the country and they seem to get away with it well there is some case law out there on this actually and generally this is what it says is that if the officers have some reason to believe that the people inside the vehicle may be dangerous then they can order them out at gunpoint however if it would not be reasonable for police officers to think that there was some sort of really serious safety threat then that very well could be a Fourth Amendment violation just like any Fourth Amendment case you have to look at the totality of the circumstances was it reasonable for a police officer to believe that this vehicle was stolen hear no because the vehicle only came up as stolen due to the complete gross recklessness or gross negligence of a police officer who typed in the wrong state from the license plate and that also begs the question like I said of why the police officer did that so we're given no information that there was any reasonable belief that a crime was being committed by the family in this car necessitating a police officer to run the license plate in the first place as far as we know and they're leaving this open to speculation it was just because they didn't like the color of their skin when they when police officers leave that to leave it to us to guess or to speculate then that might might as well be our conclusion so here we have no evidence of any crime being committed not even a traffic violation we have complete negligence or recklessness on behalf of the police officer who ran the plates we have no information at the scene indicating that it was a dangerous situation they didn't know who the occupants of the vehicle were they didn't observe any Firearms they didn't observe anything dangerous about the situation there was nothing there was nothing being said by the individuals in the car or actions being performed by the individuals in the car that would have given any police officer any reasonable police officer any indication that these people were armed or dangerous justifying them to be held at gunpoint so this is just another one of those situations where probably this police department has a policy to perform these so-called felony stops on any vehicle that is suspected of being stolen because that would be a felony so that is bad policy if that's the case so like a stolen vehicle this is called a high risk no it's kind of high risk every any stolen people hiding person that left the scene of like a robber like with guns involved right right you always like we don't ever go up to them we always call them out to us because I seen it with the gun I'm like damn what the [ __ ] we do I just ate breakfast police officers Can Only Hold people at gunpoint if they have some reasonable belief that the person might be armed and or dangerous in this case no nothing so as always I appreciate you watching and going over these sorts of incidents and the applicable constitutional law so don't forget to subscribe so that you don't miss future videos not just here but at the blog at the Civil Rights lawyer.com where you'll
