officer I work graves shift day and how long have you been with me just a little under two years do you ever your Commission date it was February 17th of 2017 2017 okay and before you were a police officer what is your background I've been with Army Reserves Military Police Corps were approximately since 2011 and currently still in current title is Captain prior to that I worked the security job so were you working as a patrol officer it was gruesome I did yes okay so let's start from the time of dispatch do you remember what the time in dispatch was yes sir I was approximately 345 hours explain to me what was dispatched and your mother's house at the venue on August 23rd 2018 approximately 1:03 45 hours what lawful performance my duties in uniform display my badge office within the city of Las Cruces County governance in New Mexico while in a marked unit I was dispatched to 1316 please read and reference to a domestic disturbance the domestic disturbance was called in by a 14 year old girl who that residents she stated that her mother and father got into an argument and at the there had been his loaded weapon in the house the reason why she caught in is because she thought her father was actually going to use the weapon as a mother as a central dispatch needed that the male subject was currently outside and there was no description of the male okay and just for clarification I know you said August 23rd that this happens camera teaser because part of me both know I just I just want to make it clear for okay um 13:16 leaves is that within your district your beat yes district foursome and we're used to Zoey dispatched it or was somebody else dispatching you officer vernalis she was dispatched as well as myself okay you know many of their officers just Bachelor responding officer Jesse Gonzales special number eight three three was put himself on a cart as well okay and when you guys are right was it you was it a riot you guys stagger your arrival would you ran off together house we pretty much arrived all at the same time I was going south my lovely drive and that's where I notice officer when Alison and officer Gonzales they came off of the intersection I double went self out of that lease and I fell right in behind them as I was going southbound on these yeah so just so I can clarify it was also an ALICE than Gonzales and then you on these three yes okay and when you guys are right did you or where did you guys park we part approximately two houses north of 13 16 please so right right at the intersection of coming to swim with some of these okay um and then after that happened officer and we ran Alice get some of her vehicle officer Gonzales it's other vehicle and I'm the last to get out of my vehicle they take the sidewalk you're walking and approaching my sidewalks up now and I'm in the middle of the street or probably yes I would say middle shriek walking towards the residents okay well when you guys were doing this did you find yourself or what position did you find yourself in and relative to where the hospital I was to their left and they were to money right and when you got where you guys equally parallel were you in front and back or something different all I remember is that they were somewhat right I feel I was a little bit more forward and as you're approaching that house did anything stick out one house the house just north of 13 16 and we didn't have a visual as there was a van blocking my view at least Katrina heard the rack of again and in the in my mind I didn't hear what I heard and from what she stated to kind of put me a little bit more of alert based off the fact that the call was were no subject that didn't have a gun that's what we heard one block or one house just north of that location okay um I think say Katrina heard it too cheap breakfast that to you guys yes she said did you guys hear that I wish I guess kinda brushed it off a little bit yeah okay did you hear anything or I believe it I heard it but once again it's 3:00 in the morning and I in my mind I was like I really didn't hear that okay so then as we're continuing to walk southbound I had a better angle I believe behind the van where I saw Mel subject he was wearing a white button-up shirt tan khaki pants and he was barefoot and immediately I put on my weapon and turn my light on and I told him to let me see your hands the metal subject and his left hand in front of them as such in his right hand at the small of his back which appeared to me as if he was selling something or hiding something in particular a weapon okay um just to back up just a bit you said that when you saw him and recognized that he was a male you described his dress you pulled out your fire yes what was the rationale the rationale was the call it was a 14 year old girl that said her father was outside racking and loading again and possibly and she was afraid that he would use it when Katrina stated that she heard the rap in a slide and once again like I said it was something not brushed off it just kind of fell in together with those I guess those two aspects and I felt that with the male subject placing his left hand on the right hand behind his back that's pretty much three cues or if not clues that the possibility of a weapon was there okay and then I mean he gave some commands that something let me see his hands let me see your hands let me see your hands and instead of doing so he turned back around and it appeared that he tripped and kind of did a bear crawl bear crawl a motion back to the front door and with his left hand he jiggled the door violently to try and get into the house oh god after he failed to get into the house I saw him sprint or he was sown a bear crawl type motion on his way of standing up he went towards the front of the vehicle and that's where I noticed in his right hand that there was a black object his back was turned in at that time and then to my knowledge began yelling out you know let me see your hands and then he began to rotate towards me with his left hand resting on the front left of the panel the vehicle and I saw a gun pointing my direction and what will only keep this sequential but we'll come back this in a second so you said you saw guns right hand pointing at you explained to me like describe to me what you saw yes so after once again after he tried to get in the door like I said it was a bear Carl motion with his left hand he jiggled the door trying to get it he then he then was barreling towards the front of the vehicle that was sitting in the driveway and in his right hand I saw a handle of the gun it was a gun black in color and as he was going towards the vehicle he wrestles left palm on the front left fender and he turned he turned to his right he was at this point crouched towards the front of the vehicle and I saw the weapon went in my direction and did he have the gun out aimed was it and we call it a rock a lot but that's a cop term did he have it by his body or something different yes so when he had his left hand on the panel I remember him turning it was probably about waist-high once again he was crouched at this point as well alright and you said you'd given command to show him I'm showing you his hands yes I believe about summer shoe yes did he complied that one he did not comply he did not comply and then as I saw what weapon rotate towards me in the final rounds fuckery what I believe that that time to be two rounds okay um when you fired a round do you know if you hit me or was he struck himself when I fired the first round I believe that score against the back left panel of the vehicle and the second round I went through the back window of the vehicle that's what I remember so okay and then what happened then I mean at this point I'm right behind the vehicle and I come up through central dispatch shots I heard and I had my flashlight trained through the back window to see if I'd notice anything in particular or just see if I see them scramble on the ground and after I didn't hear anything I decided to duck behind the vehicle and I was going to run out and look underneath the vehicle to see if the subject was behind the vehicle but at that time the female subject was in that residence came outside and I was peering from the left side of the vehicle and I saw him with his head peering up from the side of the vehicle with his hands up looking up anyway I started giving him commands and he was not listening just step saying you shot at me but as the fimo got closer he then just pruned out on the front lawn and did you help take him into custody yes I remember places on my weapon back into my holster and I know Katrina was first I have hands on with them and then I assisted with their officers for months and in what did you do so once other officers got seen we ended up picking them up and try placing them out to the vehicle sergeant Mack betcha number 638 he then s who got into position and I was alone of course being pointed out at that point neat so I'm gonna go back to my vehicle okay oh and from the scene where you taken somewhere else yes from the scene I was taking that 281 Wester this station here my buddy officer was officer smellsearch number 9 0 Lee um were you contacted by a detective from our agency in how's that agency specifically say please contact I'm sorry like wow that station yes sir yes sir and they did a assessment of your equipment at that one time yes assessment of my equipment indeed the a secure it they did secure they secured my vests amongst my duty belt as well thank you and did they particular whether those money they took yes Vanya my sign weapon my Glock 34 generation four in addition to my 11 26 which was my backup duty one them as well it took my ass they also took my teaser that's okay the firemen that was used was your Glock 31 the firearm used was my Glock 34 sir what caliber is that it's a nine millimeter so um in between the scene and here you said you security your holster did anybody else ever no one else maneuver or nobody else had hands on my um in an on-scene let's go back a little bit on scene you said you know maybe two shots something different here in a seconds once the shots were fired did you do anything with the shell casings the rounds in the windows or glass or anything you know if any of the other officers did did me bleep no sir the media focus at that point was the male subject getting him secured and as well as the female subject who was now coming in on the house that was the primary focus to get them separated and to sit here at the scene do you know if any of the other office the other two officers Oscar Katrina when Ellis or Jeff Stevens always did they fired away it's a mine that which now so I said go back to shooting that I'm gonna ask you some questions about you yourself all right and insisted and then you say he kind of brushed off or put it the back your mind what Katrina said the gun racking but once she saw this guy how are you feeling my stomach immediately dropped to me a reasonable on a prudent person wouldn't you know at the sight of officers and they would show their hands but for him to have his left hand forward and his right hand at the small of his back I would say like any movie scene that's where people in particular have weapons or start weapons you know in a personal level when I consumed here and usually carry on my hip or carry a pecs so that's the only thing that I thought for him online that he actually had a new weapon especially with the credibility of the daughter fourteen-year-old daughter calling it in and once again Katrina Singh well he said that he did a bear crawling check that the door she's my girl back what were you thinking when this was happening Wow as he was a bear problem to the front door I remember calling up through Central Dispatch that ten three later clear there what I thought was he was going to try to get into the house barricade and possibly have hostages that's what I was singing it through my mind at that time but that's that's what I thought they got that door was locked that's what I was thinking right after okay and when he was posted up or was by the front of the car to spawn Ronny examine car tell me what were you keep good feeling so I saw ended up seeing once again the hand over the gun as he was making his way to the front of the car and it just pretty much confirmed everything at that point that he had however he was renewing it at a time he didn't have entry into the home and he was pretty much cornered and so though it was pretty much in the driveway of the home where appeared to be no Anson's so at that point that's where I decided to stall a little bit because nothing was actually there was no weapon pointed at me but as he started to rotate I was thinking he was looking for a fight as he the front of the vehicle and especially with him at the it was clear that he was looking for a position of cover and he actually had a handgun so that's what it would you recognize the gun as it gone and pointed in your direction yeah remember sidestepping moving to the right and uh firing once again the two rounds that's what I particularly remember I moved out in a way so I wouldn't get hit and then while I was moving out of the way that's my fire two rounds or what I remember - two rounds all right I'm gonna take us out of this incident really quick um jump to somewhere else man do you know what happens like fire lit again I have no idea what happened to that fire what you apprehended him in the lawn did he have it on he did not have it on this person do you remember telling any officers what you thought every department so I'm just going to go over some things could you describe the lighting conditions yes Alyssa it's pretty dark especially from the residence of a star my only illumination that I had on scene there was the so light on my firearm okay um do you remember any any ambient lighting coming like the moon or anything like that not in particular sir street lights or the neighborhood uh maybe one house so the north I believe they may have had a life okay so due to the nature of this call anesthesia progress now armed with the weapon do you have capabilities of pumpkins rifle shotgun yes we did have the capabilities um do you know if anyone utilized those during the sensor during that incident no sir okay and just speaking for you personally white it white could use the decision not to not to you to myself in particular ceremony there's no reason why and as you were approaching the house I know that did you hear an incoming in terms that would make you believe a domestic was was happening from my residence no it did not sir the only thing I was to tree that telling me she ever did slide of Iraq and me faintly hearing and discarding it that's all I remember from that okay so as you're approaching in to know that she said that you're walking pretty much in the middle of the street yes I'm coming into the context with the male white button-up khakis she was where does he standing when you first make contact with him yes sir he's on the front lawn just probably say about I'm negative judgment he's just near the sidewalk on the front of the lawn yeah I wish I said walk to the street or the driveway he was if you're looking at the house just east of the house prior to the sidewalk okay so I'm sorry if it helps you can actually point if you need to open there's no so approximately like right here this is where he was standing and I was in the middle of a street right here sir okay so I know that she said then you give him commands and see your hands in this your hands he turns away from you on stumbles Falls and crawls to the front door tries to get into the residence yes the residence is locked so that he crawls back to the vehicle yes posts with his left hand on the car and then you see the weapon in his hand black object in his hands which unit by a firearm at that point how I just want to reiterate how exactly he's holding the firearm is he holding it by the stock the but how how was equal what I remember he was holding it but I had no okay so and from your vantage point where are you standing during this time yes nervous time so the vehicle was here and he was here I was somewhat at an angle right here and I started to move towards the vehicle as it was my only sense of cover okay and as I was here and he turned towards my end up once again firing what I believed to be two rounds and then sidestepped I was in motion as the side was firing I ended up being behind the vehicle right here I once again using a flashlight to see if I saw anything and then I eventually took it Neal okay so the guns in his right hand he's on the car mmm and heat how does he turn it so so as he's going I'm sorry no that's okay so as he's going back to the vehicle her vehicle after he jiggled the door he's kind of like an affair promotion pretty much coming up and that's when I saw the hilt of his gun and then he closes his hand here and he kind of crouches down and the gun has pointed towards me at this time I end up firing arrows around so I sight set on fire and from there I didn't have a good visual because I ended up being behind the vehicle okay so I know that you said that you're kind of looking seeing if he if he's injured hit at all and then what happens at that point yes so I was end up : shots fired I had my weapon pointed through the back window with my light and I then decided to duck down and then I was going to look underneath the car but then the female subject came outside the house and she was like what's going on I have kids in the house that's what I remember in tonight about Hurst night and then he ended up hopping else or coming from the side of the vehicle he had his head out and his hands out like this and he's you know yelling why did you shoot at me why did you shoot at me and then as I'm trying to give him commands oh he's not listening and then that she became she kept closer he just prone down against over the lawn okay isn't it officer Willits puts him in handcuffs you this is yes why you were securing him did you place him in the back of any units or there was a unit that pulled up right in front of the house or yes in front of the residence myself and officer Ellis were escorting him over to the vehicle he as we actually had him on the ground he began to disorderly as well say more did you shoot me I don't even have a gun I don't even have a gun he kept kicking speed and trying to get officers off of them and we're telling them you know stay there calm down end up taking them over to the vehicle and tried to have him sit in the vehicle but he did not comply and during during that time when you guys were securing him did he appear to be under any substances at that time the only thing I was really smelling your only thing that was really no listening because I was pretty focused up sticking in the environment so officer Gonzales trying to calm the female down I remember here it is gathered behind recording or trying to record with the phone and saying don't you don't shoot me I'm just recording I remember smelling the Gunpowder that's what I remember from that point as far as maintaining my focus on him it was just keeping my knee on him so he wouldn't move around I was just kind of taken in the rest of environment treci or other officers and based on your training experience did it appear that he was suffering from any mental illness at that time I tell you sir yeah you know I think the situation I felt that it was a high-stress situation for everybody I came to a new level yeah I can't tell you how and you joined individuals as far as his name or just from your your interaction with them do you recall having any previous interactions with him in that's I hadn't had to my knowledge have you ever responded to this residents in Pakistan and he calls for service or or anything in general necessary okay on what about the female did you identify the female that was in the residence I did not act into fire today have any previous interactions with her as well and the weapon from the incident your cloth very poor are are you certified I am certified with that weapon okay what about recording devices where you're going to be recording devices yes I was utilizing my ex on camera I did have it on my person cocaine's um did you have any other forms of doctor
