have there been any arrests of mr dewitt lately involving funeral escorts no there has not have you still been receiving complaints of this escort service operating the way it is yes we have we were given very clear and direct instructions to uh have no involvement with mr duet unless he was committing a capital felony the entire motor unit was told also at the same time one more time the entire motor unit okay do you know who posts those to the internet for uh metro state well i'm just i i guess you can say i'm assuming that mr dewitt did because he's the one stating that you know living the life of and you asked me to post this so i'm posting it so yeah he's made that comment multiple times okay now you you want to see what it's like to for me to go through starbucks so here it is and jennifer's the one who's posting those on behalf of mr dwight you know exports that have zero problems whatsoever that have zero incidents uh of any time does not so that wasn't him on the video screaming at those people and using their vanity repeatedly and directing people off the road that wasn't him that's not what i'm saying oh i'm sorry because that's not a legal analysis he has had so many days of doing such wonderful legal activity that the illegal activity he committed on a particular date shouldn't count not that's not what i need to do and why okay well that's what i got out of that well let me let me do a good job good i'm sure they support you care less about my so that witness's testimony was just not credible that's what you're asking the court to find insofar as that's concerned absolutely the dv case that we your honor is faced with today that happened on april 7th and now there's a new warrant which your honor has which is the failure to report case from osceola county that was served on him a couple weeks ago why wouldn't his bond revoked until baines revoked it on the tv there's been an attempt to unwind that and turned it into a foot slammed in a door and then there was the failure to register arrest i think council completely misinterprets and misreads this court so i'm going to continue on that i i can tell you the state is ready on those cases who judge first just for the courts awards [Music] 911 call and the testimony of that witness who had little to no credibility frankly whatever is going on behind the scenes is of no moment to the court's conclusion after viewing the videos that this defendant has been and with the kind of temperament that was displayed in this volatile highly charged atmosphere that exists in all of our communities now a danger you may cont continue when you're ready i think you're on it uh corporal ramsey i think where we left off was um you were talking about the encounter that you had where miss burton approached you to express her concerns about mr dewitt and some things that she said that he said um is that correct yes sir okay um and is that where the bulletin that's where the source of that bulletin was that you discussed earlier correct yes sir she comes she had uh contacted the windermere police department when she realized that they had arrested him for impersonating a police officer and uh detective allen had contacted me knowing that i was part of the investigation into metro state and asked that i meet with him with her because she had multiple concerns about her safety and uh mr dewitt being out okay and so i guess whether what she says is true or not is that something that you would have to take very seriously correct yes okay um yes [Music] um for identification do you recognize what it is i do um is that the bulletin that went out based on this conversation that you had yes and it's the same one that's still posted in many of our substations in the main sheriff's office so it's still posted yes sir right at this time i would um move to interstates into evidence of states one at this point i don't think we have anything energy council yeah sean i don't found the jedi with this asset that he provided to me at some point from the state i've yeah and this is the first copy i received i can provide another copy okay good idea yes yes so please no process and kpis is 44. according that could be wrong but that's my account for identification do you recognize this composite yes i do recognize these and can you um describe is it how many photos it's five okay um can you describe each photo in turn and and let us know where it comes from yes so the first photo is of the uh the weapon that i recovered from mr dewitt when i arrested him october 30th of 2019. it's the weapon that he had on him which is a looks like a glock firearm with a magazine that's taken out of it and the slide is pulled back and locked back on this particular picture on this one also at the bottom there's a screw piece which is where you would put like a co2 cartridge because this is actually a paintball type gun the next picture is the weapon that was taken off of him on march uh 23rd 2021 this is a replica of a glock has a light on it like the same as what we carry in our law enforcement weapons as a matter of fact this weapon looks just like mine has the same magazine style at the bottom as mine has the same style grips and this also turned out after it was um the slide was pulled back and the magazine was dropped that's when it was turned out that we knew it was not a firearm it was a another pepper ball gun a what gun a pepper ball gun and it was not loaded it's just a super ball gun in a a law enforcement style holster on a law enforcement style belt that's the one that was taken off just recently the next picture is uh of the seminole county funeral escort that he was doing that's the one with all the motorcycles the buffalo soldiers it was for a correction officer and is this one is that from a video that was published to the court today yes it is this is when he's approaching the car that he was beating on and screaming at to pull over uh as he's walking up to the car you can see and the reflection of the car him holding his with his right hand he's holding the top of what looks like a firearm the next picture is a more clear picture even of him with his index finger and ring finger pointing downward his ring or middle finger his ring finger and pinky finger appears to be clasping under like gripping the handle as if he was getting ready to draw the weapon as he's walking up to this individual screaming at him and giving him orders and direction to stay where he was the last picture is a picture of while he was on this particular funeral escort he was running out of gas and he was able to coast into the gas station and uh when he pulled out his wallet you could clearly see with his body cam his driver's license uh there's other parts of this but that's his wallet his credit cards and it happens to be the same wallet and credit cards and badge that's in there that i confiscated from him when i arrested him back in october 30th of 2019. okay um and these are uh fair and accurate depictions of these items and these screenshots um that you took yes sir at this time uh the state would move to enter state c into evidence uh states too i'm not going to get to these okay be admitted yeah is that all on one page or multiple pages okay yeah it's a composite and before you give it to jill you need to turn it over and and mark it a b c and so forth you do that oh did you okay just want to make sure we know what we're talking about yes it's one through five c one through c five [Music] yes [Music] i can't really see anything there [Music] [Music] uh okay for identification do you recognize what that is i do um man what is that this is a uh i print out a youtube page and the highlighted part on the front of the page is metro state vpu and it is a arrest warrant for a victor lopez who was one of the employees for mr dewitt who also wound up coming to the sheriff's office and uh asking to be a witness and has now been a witness in multiple cases uh against mr dwight is this the name again please i'm sorry victor lopez is this um like a still shot from youtube correct yes it's a still shot of a uh arrest warrant page with mr lopez's face on it and uh his basically his demographics his date of birth his race sex height uh his weight is is this uh still shot from a video that's posted yes it is is this a video that you've watched on youtube i i've seen parts of it yes sir okay and you've accessed it on youtube yes i am do you recognize who um do you know how youtube works generally usually you have like a individual who creates the account and then uh they put it's like blogging they blog with it uh it can be profitable so the more you get uh viewers the more money you can make do you recognize the the user or the youtube handle that posted this video yes it's uh a day in the life of jeremy dewitt and uh this is something that mr dewitt has been doing for the last several months he's been putting out these videos almost on a daily basis he's been putting out these videos on a daily basis basically showing content for anybody who's not for him is it jeremy dewitt that speaks in these videos yes it is it's it's a video of him riding around uh continuing to do the same uh funeral escorts and other escorts uh the way you know breaking the law basically he's video recording himself doing it and in this particular video that was posted on under that channel um what is the title of that uh posting midler snitch what time i'm sorry viddler viddler snitch two and that would be for uh sergeant keith fiddler who's the other detective i guess you can call on this case okay um does victor lopez appear in this video uh in a couple of spots he does and you've spoken with him before yes i have multiple times you recognize his voice in that video absolutely okay um and do you ever see his face in that video uh yes i think in one of one of the spots do you have a camera view that uh from what i remember seeing of uh him being in front of i believe mr dewitt's office building okay and and the video is are they having any conversations i don't recall that you don't call it conversation okay um but as to this screenshot it is a fair and accurate representation of a still photo taken from that web page correct and i know the context of the uh of this was uh mr dewitt's upset that uh victor is one of the ones who is uh you know become a witness for the state against him uh to the point where the last time i interviewed him on march 23rd he told me during the interview that he had things that uh videos and other stuff that would stop anybody at least what he called our snitches from uh testifying that he would release it if they thought they would testify and as far as you know that video is still available today on youtube yes if you want to watch it okay um at this time around the state would move to have states e moved into evidence at states three council yes just as a a matter of um i think we could do this now or later but i did have a mark at state's f the records of what has been the new arrest warrant affidavit there is also the arrest report for 21mm two three nine seven that was the case on april 7th where mr dwight got arrested uh there's some supplemental reports in there this is another composite you're on this one's also one side i take it back it's not a composite but i can announce at least substantively what they are there's also the vop affidavit that was filed in his case 2005 cf-394 that was back in 2009 are you finished with this witness uh not just yet your honor and then there was um just wondering why you're wandering i just want to um make a motion to move this into evidence and see if defense has any objection of 2018 cf-4906 it's another vop affidavit and um the state would move to have these entered into evidence will show he has copies oh okay so what it what if anything is your objection i don't have an objection judge i think you can take judicial notice of any of the court files and the documents contained there okay they'll be admitted thank you thank you thank you um just a few more questions here um corporal ramsey have there been any arrests of mr dewitt lately involving funeral escorts no there has not or any citations issued no there is any what any citations issued no sir have you still been receiving complaints of this escort service operating the way it is yes we have um is there a reason why he has not been cited anymore since he was prior or arrested for the same actions well it's about my pay grade but we were given very clear and direct instructions to uh have no involvement with mr dewitt unless he was committing a capital felony and then we would take action that's very weird so you've been told by superior officers that you are not allowed to arrest jeremy unless he's committing a capital offense yes sir and were there other officers present for this yes sir on one occasion it's probably close to 40. deputies present on a second occasion myself and my lieutenant was there any indication why nothing that was shared with us there is uh it would be appropriate to say was it ever said that what he was doing was legal and okay no just the opposite no further questions cross yes afternoon sir good afternoon when you begin testifying this morning you mentioned that the videos that were presented to the court today were obtained at the time of mr dewitt's arrest by windermere as well as by search warrant were you involved in the warrant request for the warrant which one the ones that ultimately led to the videos that were obtained for today's appearance by the way it might be confusion on your part the mahoney case was provided by the defendant so that was not gathered from a warrant uh although there are other videos that uh came from a warrant that uh that supported what he gave us the windermere videos i was not part of that warrant that was the windermere police department that submitted that warrant the second warrant i was directly involved with the warrant on his business okay so of the videos that were presented today um and i don't believe the numbers of the video so to speak were put on the record we need to make sure the record is clear on that which of those videos were you personally involved in obtaining through a search warrant the only one that i was not personally involved in obtaining the search warrant was the mr rogers i believe and that was the uh what we call is like the blue car and that incident uh was partially in osceola county and then in orange county uh that was the only one that was obtained from his uh his body cam that he was wearing the day he was arrested in windermere all the other videos uh were all obtained i believe from i know they were obtained from the search warrant on his business on his office you just testified a moment ago before i began cross-examining you that you've been directed to stand down if you will that's not the first time that you've been directed to stand down is it me direct me individually or me as in the sheriff's office you personally in mr dewitt's case personally right uh and are you referring to 2015 yes sir okay in 2015 the entire motor unit was told also at the same time one more time the entire motor unit the entire motor unit we were all instructed to leave him alone okay when you answered the prosecutor's question you said there was nothing that you could present that would be appropriate so are you indicating that there's something that is secretive or otherwise not uh that you're not permitted to share in a court hearing about what we were told no i just think the verbiage was probably not appropriate for in the courtroom crash language no just the verbiage okay so the photographs that you were presented um there were i believe five in total the picture number two or what i'm calling picture number two you testified was a march 23rd arrest for what you phrased as a replica of a glock correct okay that's the case that your legal department filed a unarrest affidavit prior to the initial appearance on that case correct i'm aware that they had filed something to that effect i'm not sure why you're also aware that as a result of that what your sheriff's office determined to be an unlawful arrest that sergeant viddler was investigated and is under investigation by your ia department correct uh i don't i don't know if it's for that specific incident or totality okay or what totality the overall every everything to do with uh any of the cases with mr dewitt were you involved in that internal investigation as well i am so the photograph of the replica glock in your words was something that you took off of mr dewitt's person at the time of that arrest no i was not present okay when he was arrested so how did you come into contact with that particular pepper ball uh when mr dewitt was brought into the station i was directed uh by our captain our acting captain i was given a direct uh i guess order to do the interview with mr dewitt because i've interviewed him in the past during that time when when uh sergeant miller brought the i was in our traffic section part of the office and sergeant viddler brought the gun belt in with the gun in it i actually thought it was our other deputy that was with him i was trying to figure out why he was carrying his gun belt but it turned out it wasn't it turned out it was mr dwitz now you've testified that you've been on some type of task force ish thing uh since seven years ago involving metro state and mr dewitt is that right not not continuously no okay but it began seven years ago approximately yes 2015 and then we were told to stop and then and i believe towards the end of 2018 it came back up and i was directed to assist uh sergeant midler in that investigation because of my past experience with it and have you known since 2008 [Music] i guess it was that mr dewitt is a convicted felon no i did not know until i believe it was i want to say it was december 23rd or 21st of 2014 i believe is when i stopped uh i can't remember this last night but ken i know he goes by ken stopped him on a motorcycle that i later found out was owned by him personally but just dressed up like metro states and uh after making that interaction there and then later on talking with my lieutenant who brought me in and wanted to know what was going on with that that's when i found out through our intel section more history about mr duet okay so that was december of 2014. i would say probably because remember that's we're right at the christmas time uh so i was doing all these escorts for the football teams and stuff so i it would would have been the following year probably january february okay when i received that information and can that you refer to someone that would ride on these funeral escorts for metro state correct and he worked for mr dwight and the incident that you testified to earlier about uh involving uh someone that had multiple tags on their motorcycle was actually ken wasn't not correct right it wasn't mr dewitt no um and ken was also the person that ultimately actually carried a firearm on his person um in a case involving the sheriff's office ken yes sir nothing i'm aware of okay have you ever seen mr dewitt carry a firearm i've seen him carry a weapon that looks exactly like a firearm i understand that that's why you claim to have arrested him in march i'm asking have you ever known him to carry a firearm i've known him to carry a weapon that looks like a firearm he's not been checked every time we've seen him to verify whether it's a real firearm or a pepper ball gun you know he's a convicted felon correct you know he's registered as a sex offender correct you know that uh you guys have full access to all of his records you you don't deny that you've never seen him with a firearm do you you're asking me a hypothetical i can't i'm not i'm asking if you've ever seen him with the fire have i ever taken a firearm off of his person no okay so that's how you need to phrase the question for yourself that's fine but that's not my question well i mean i'm answering the question right the the seven year history you have with mr dewitt you don't think that has anything to do with what i've asked you to stand down no was anyone else specifically targeted in the stand down order other than yourself i i myself personally was never targeted okay so the stand down order was a blanket order for everybody to stand down correct every yes okay i want to turn your attention to state's exhibit number one which was this um bulletin that was just brought to my attention today for the first time that bulletin was put out in what year i believe 2019. okay that's that was the one from the sheriff's office there was one put out by the city and and i can't i mean i can get it for you but uh that might have been put out just prior to that or the year before so roughly two years the current one bulletin yes sir right have you ever heard on any of the videos that you've seized any of the phone calls that have been made from the jail any conversation that came out of mr dewitt's mouth anything from him that would indicate that he intends to commit suicide back up not the word suicide no but he did do in february of uh 2021 he did post one of his living the life of mr dwight or however he puts it that uh he was not going back to jail and he made it clear that without going through it and seeing exactly i can paraphrase he made it clear that he was not going to go back to jail okay well mr dewitt's gone back to jail in march he's gone back to jail again since then and yet here we sit so um when it comes to the youtube things that you've watched do you know who the author of the videos is on the youtube videos of mr dewitt standing there talking mr dewitt okay do you know who posts those to the internet for uh metro state well i'm just i guess you can say i'm assuming that mr dwight did because he's the one stating that you know living the life of and you asked me to post this so i'm posting it so yeah he's made that comment multiple times okay now you you want to see what it's like to for me to go through starbucks so here it is so it would pretty much make sense that it was him posting it okay he might have somebody who physically uploads it right that i can't say i don't know that nothing that you've done during the course of the investigation would lead you to have personal knowledge of who's actually posting to the website correct i have not investigated that that's what you're referring to sure and and you continue to see posts on that website even while he's sitting in here in jail do you not uh a few have been sent to me but i try not to watch them because they're a little disturbing okay so there are posts being made to the website that you're attributing to mr whit while he's in jail that somebody's posting well the ones i think that you're referring to that i've seen have been uh like jail phone calls where he's on one side of the phone and jennifer's on the other and they're having a conversation is that what you're talking about that's among them yes yeah and jennifer's the one who's posting those on behalf of mr dwight and i and i've heard the conversation that uh you know he's asked her to put out stuff to make sure stuff's put out so again you're you're here before the court testifying about mr dewitt doing this and mr dewitt doing that and really these are assumptions that you're making based on how it's presented to you not based on actual knowledge well i mean somebody printed the money but i know it's good money because i can spend it and and you haven't investigated who's posted any of these things so you are making assumptions about that too i'm not making assumptions i mean it's i guess it's common sense i mean either he's doing who's having somebody do it but when he says this is what you wanted to see me doing i don't think he's recording it just to hold on to it okay um the pictures that have been introduced there are two pictures that you're saying are of him with his hand on top of what you're calling a firearm or weapon and then one where he's gripping it how do you identify the person in the screenshot or the still shot if you will um of those photographs are you talking about the ones we just looked at the five yes sir oh you must have missed when i talked about the last page i'm asking how you identified the stills that were taken as it being him yes sir okay when he's walking by the car you can see his reflection there if you watch the entire video there's not a break in the video anywhere up to the point where he walks up to that car so when he's on the side of the road he pulls his wallet out you see his badge you see his id you see the credit card the citibank credit card that he loses with his name on it then he drives to the pump there's never a break in the video he pulls out he's mad now because he can't find a credit card he just lost pulls out another one uses it which you can see his name and then he continues on leaving the the store and goes yells at the guy in the black truck and then starts yelling at that individual my experience with mr whit and and several hours of talking to him i recognize his voice and of course when he's walking by the car and you see his hand placed on the weapon the way it was uh you can see an image of his face there as well and i've seen it enough where i could recognize that that was him so the stills from the car the reflection in the car and the and the last photograph of the wallet are all from the same video that you have personally watched in its entirety and you're indicating that that's how you can identify mr duet as being the person in those photographs correct as it relates to what you're referring to as the weapon how do you know what he's putting his hand on based on the videos does it show what it is in the video you say and it shows what you mean so i'm assuming he's got his right hand on something based on the reflection in the glass so how do we know what that something is how do you know what that something is i mean like the same way how would i know if it's a firearm or a weapon i wouldn't unless i was there to pull it out of the holster okay so i wouldn't i wouldn't be able to tell you exactly what it is whether it's a firearm or a pepper ball gun that would be my next question my question is actually broader than that in the beginning but that would that would have been my follow-up question so my question is he's got a tool belt right that he's wearing with with various items on it how do you know what he has his hand on based on that photograph i believe this other body cam video that we have uh uh reviewed from that same uh funeral escort and if i'm not mistaken we do see a picture of him but without that being that was not presented today just past behaviors past what i can see in the reflection as he's walking up on it to me it looks like the top of a firearm okay it looks like the top side of a holster with the handle grip of a firearm did did the individual in that video ever speak with you the one from seminole county yes sir no we identified him and turned that over to seminole county okay you have a moment garner sure thank you rhonda that's all i have for the students redirect just briefly um so to be clear there's been since 2014 a couple different stand down orders yes sir one in 2015 and now another one yes sir um and you're experiencing 14 or 15. um you started off starting from 14 you said it but it was 15. it's actually 15 19 and then just recently okay and we talked about how you were initially talked with mr dewitt in 2014 2015 your experience with these processions is that they became more aggressive over time his experience uh with these processions became more aggressive the funeral processions escorts sorry became a more aggressive in nature is that correct yes sir do you believe that these stand down orders would have something to do with that i do believe that it empowered him has mr dewitt ever mentioned that he's aware of these orders yes he has as a matter of fact uh he constantly mentions it and the different interviews i've had with them and and also on the videos from 2015 that he recorded has he ever produced any kind of document showing that he's allowed to do this no and he said that the judges have told him he could do this as well and we've asked him if he could provide some type of documentation that says that he he tells us we can go pull the records and hear the judge say it but there's no written documents for that it's about fact just the the contrary i know in 2015 the sheriff's office sent him a letter uh telling him what he could and could not do and made it clear it was uh certified it was sent to him certified and uh when windermere interviewed him he acknowledged it when i interviewed him uh i believe it was october 16th i believe or they're about maybe the 26th of 2019 we discussed that letter and he acknowledged receiving it as well and regarding the pepper ball gun that he carries which looks like a glock um has he made public comments about the fact that he always carries this and that he's allowed to yes he has as a matter of fact uh when after the the march 23rd arrest when he left when he went to pick up his motorcycle from the tow yard he was on the news doing a news story i guess he wasn't doing a funeral escort or anything so i'm not sure why but he was wearing the same or similar weapon and a paddle holster not like the utility gun belt like what we can wear but it was just a holster slides in the belt with a badge right next to it so i'm not sure why he would need to wear that for self-defense but he continues to wear him and the problem is we don't know what they are he we could stop him in five minutes from now he can go change that and have a real gun and we wouldn't know it um so in march of this year when he was arrested and he had it he would have also been out on bond in all of these cases correct correct as a matter of fact the mahoney case he somehow convinced the judge that that was a prior uh case and uh that we were using his body fire yes ma'am it was a prior case and that we were using his body cam to make that and his his lawyer made the argument to the judge as well but what it really was is it was a a case that had happened after the fact after he was already out on bond um does he also wear handcuffs he does he wears uh well this will help understand how he's become more aggressive when i stopped him and spoke with him in 2015 he had an ask and ask is our metal sticks basically this was a gutted asp it was only the handle inside the belt he claims to have had a uh his weapon then but he did not and it's based on his own video he doesn't have it carries pepper spray carries handcuffs uh he carries a uh a tourniquet does he wear a bulletproof vest he does he wears a bulletproof vest and he states because he would never ever go out and get on his motorcycle and do this without it because it saved his life however he drives around in his car all day wearing the same vest and [Music] no further questions jonah may this witness stand down unfortunately ronald i have to ask a couple questions oh okay i usually don't allow reef cross but if you didn't know that i will allow this one time i appreciate your honor um they also elicited additional testimony that was speaking well i didn't hear any objection from you no your honor thank you for the accommodation judge you're welcome in march when you arrested mr dewitt was he wearing handcuffs or when he was arrested and you interviewed him was he wearing hands house uh well he had a mom when he came in that's cute you said it was he wearing handcuffs did i misunderstand the question uh no i think you're being sarcastic your your testimony was he has continuously escalated the level of whatever you perceive this danger to be and that you know he had this weaponry of some sort now and now he carries something else are you just are you asking me what he had on his uh as you described a tool belt what we call a utility belt his gun belt yeah okay so that day he had a a uh a weapon that uh looked just like a glock right which was what again which was what what was it march 23rd no what was the weapon it wound up uh after the fact it became a less lethal or a pepper ball gown no actually it was a less lethal what pepper ball gone the entire time you just didn't know it until after the fact according to your testimony so other than the pepper ball gun what else did he have on his utility bill he had a can of pepper spray that was empty he had a fully functional asp he had a tourniquet he had uh ammo pouches but he called them utility pouches it took several tries of talking to him before he would call them what they really are ammo pouches for holding magazines they were empty he had two handcuffed cases on both of them were empty he called those utility pouches now in the past when i've come in contact with him he's had handcuffs in them but this particular day did not and he told me this is what he keeps his uh cpr mask in his gloves you know those type of protective things however that day they were completely empty in the middle of his back he had a hand a glove case which is kind of like a case that folds over you stuff your gloves in uh when i opened that up and he did not have any gloves in that either i think the only thing that he really had that was legitimately there was probably the tourniquet and the gun okay oh and any i believe you have flashlights too flashlights two flashlights so an arrest is made based off of an assumption that he's carrying a weapon that turned out to be false correct no arrest was made because he was stopped uh from what i understand uh he was thought to be one of the metro state employees because he was not wearing a uniform that he normally would wear because of the stop for openly carrying a firearm we know that he's not a security company he has never has been a security company so nobody in in his employee dressed in his uniforms can be out openly caring and they didn't have fishing poles with them and they didn't look like they were going hunting so he was stopped for that purpose after it was determined that it was not a firearm it was determined that it was a pepper ball gun he was charged with carrying a concealed weapon by a convicted felon because you could not tell it even once you took it out of the holster until you went to clear it by dropping the magazine or racking it that's concealment if you cannot tell it what it is that the average person on the street cannot tell what it is it's a weapon uh or a firearm that's concealed okay i i appreciate you trying to justify the the arrest that was coming up i'm not just you asking you asked why the arrest was paid i just told you i'm not justifying anything i wasn't there to make the arrest okay what illegal item amongst the half a dozen or more things that you just rattled off did mr dewitt that he's not permitted to possess what was on that utility belt of all the things you listed that mr dewitt is not permitted to possess not permitted to discuss possess possess yes your honor i'm sorry these masks are awful i apologize that's okay well for example he had the pepper spray if he had the pepper spray in his pocket that would be a felony for him but you're asking me kind of like a trick question you know okay of the items that were taken from his utility belt that you just described in detail which of those is he not permitted to possess in the manner that he possessed it at the time of his arrest okay that makes sense i'm sorry uh the uh the weapon that he had the the the weapon that resembled the firearm and what florida statute was he violating by possessing that weapon uh carrying a concealed weapon by a convicted felon okay i'm sorry i didn't mean to talk over you i'm sorry i i believe that's what he was charged with so the weapon that's on the utility belt on the outside of his person you're saying was concealed is what the the pepper ball that was on the utility belt on the outside of his person you're indicating was the concealed weapon it was concealed to the point that the law doesn't say it has to be completely concealed this case law supports that [Music] in this case it was concealed to the point where you could not tell what it is it looked like a firearm anybody who saw it whether you'd be law enforcement for 50 years or a civilian walking down the street would think it was a firearm and then when you put that in the totality of his uniform and everything else that he was wearing and riding with all the lights it gave the full impression that there was a firearm okay i understand that's your opinion i'm i'm trying to understand what the statute is that you're referencing do you know what the statute is do i know the number no i don't know the number off hand all right but it's the care and concealed weapons statute by convicted felon okay i don't have any further questions thank you for the indulgence your honor i appreciate it okay may this witness stand down now thank you deputy thank you ma'am my wife will thank you too pardon me so my wife will thank you too because we were supposed to go camping so we held up a little bit i appreciate it thank you yeah i can understand why she would thank me call your next witness oh no no further witness if you're on okay does the defense wish to call any witnesses no you're wrong okay so this is the defendant's motion for a bond and i'll hear your argument yes are you from council table yeah um all of these foreign were cases where was either out of a bond or oral art by your honor for pending criminal charges including some of those that were presented piecemeal to the court today um it wasn't until his arrest in this what was originally coined a domestic violence agreement which precipitated uh a victimhole being placed on mr goodwin and then him appearing to the ia the next day that judge bain uh revoked all of the bonds and all wars causing mr dewitt to be incarcerated since that time mr dewitt has been fully cooperative with me as it relates to keeping in contact with me he has what was at one point a viable business that still is ongoing struggling without his direct involvement [Music] arrest and he has voluntarily surrendered himself multiple times when he's been found to have a newborn he's not a flight driver well he had the lovely rors on all those kps's he's not a flight risk your honor he's never been shown to be a flight risk there's nothing of record to see where he is he was very candy with the court about what he did 20 plus years ago in reference to the passport issue that is not any kind of current uh concern or constraints that he would have any issues with so there really isn't an issue with flight risk i think that the the focus of the state's presentation uh seems to be the danger of the community argument which according to their own testimony they're saying it's still ongoing while mr dewitt is incarcerated so i suppose their argument is going to be the metro state as an entity does business in a manner that they feel endangers the community but i don't know that that's something that should be improved on my client what your honor is not seen and what exists in real world or thousands and thousands and thousands of funeral exports that have zero problems whatsoever that have zero incidents of any kind we have a track record of years and years of providing these funeral escorts without issues mr dewitt is not so that wasn't him on the video screaming at those people and using profanity repeatedly and directing people off the road that wasn't him that's not what i'm saying oh i'm sorry because that's not a legal analysis because he has had so many days of doing such wonderful legal activity that the illegal activity he committed on a particular date shouldn't count not that's not what i need to do okay well that's what i got out of that well let me let me do a job the the fact that there are incidents that are before the court is uncontested and i've seen the videos of the videos however this is a business that provides the service and it has at one point quite a few funeral homes and organizations that utilize them for these escorts without incident so my point is not that that in some way negates what the courts saw but that mr dewitt is fully capable of exercising good judgment and operating in an appropriate way good because i really do not want to see weeping former customers talking about what a grand and helpful person he was when their loved one passed that's never happened the issue for your honor is really a matter of whether the given appropriate constraints um while out in the public so that there is not an ongoing concern for the safety and welfare of the greater community and i think that the court has every ability to do that mr dewitt will comply with those constraints and if details you could buy with those constraints he understands where that's in the land so we'd be asking that bonds be reinstated i understand that's a bit unorthodox where the bonds have already been you know discharged but the bondsman is willing to rewrite that no it happens um and the the purpose of that uh with all due candidates according to the state is mr dewitt is is suffering financially and so bonds of some large amount was guaranteed sitting in jail um and for what it's worth i'm sure you know report could care less about my financial on multiple companies that's correct originally said if the rors are not sufficient for the force of field there's some kind of state starting to be released on if gps monitor is something that the court wishes to oppose mr dewitt indicates that he is more than willing to comply with that um if there's any other special conditions it publishes to public sector did you mention the testimony about threats to law enforcement officers threats of violence to law enforcement no i asked there was a bulletin put out claiming that my client was going to go in and commit suicide by confidence i had asked if he ever actually heard that right the only source of that information was a conversation somebody had apparently with vince burke or something we've got countless audio and video recordings so that witnesses testimony was just not credible that's what you're asking the court to find insofar as that's concerned absolutely i mean that's fine that's a legitimate position today i mentioned my clients here two years after the supposed bulletin went out has been confronted by law enforcement officers in the last two years god knows how many times and it's not it looked at a hand let alone ever faint some you know shoot out at the okay corral so that's just nonsensical there's no evidence of the support he is not a threat to law enforcement so we'd be asking for sponsored statements understood uh mr moore yes yeah your honor this really is kind of the first time a court has been able to look at all of these cases um when mr dewitt is re-arrested and re-arrested they're you know what not re-arrested arrested and arrested and arrested correct and he hasn't been rearrested until his at all on these charge on the charges for which he's now seeking god he was only arrested once he was roared then he was arrested on a domestic violence charge and at ia's his bond was revoked that wasn't all right i mean i wish it was that simple there really is a long history to this because it dates back to that first windermere case that happened in september 7th of 2019 so you're saying he was arrested on let's say that charge before this court signed a capis on him no that was the first arrest in september i can't wait to hear how he's been re-arrested not to split hairs but i i i'm arrested again arrested on different charges yes okay that's not a re-arrest that's another arrest correct the tv case that we are on is faced with today that happened on april 7th and now there's a new warrant which your honor has which is the failure to report case from osceola county that was served on him a couple weeks ago those are the fifth and sixth new cases that happen from criminality that would have occurred after the initial so my point being he has come before courts on several cases with new criminal charges not things that proceeded he has also come before the court with several cases that preceded that that original arrest and that's what really constitutes the 12 total cases between orange and osceola why wouldn't this bond revoked until baines revoked it on the dv your honor there is actually still pending motions to revoke bond that the state filed back in february on some cases that were just never heard why because there was so much confusion at the ias about when things happened and judges would get flustered with what's going on we'll all let that yeah i i was personally covering this case for mr miller here in orange county was supposed to be for ptc and mr dwight had just gotten arrested in osceola county for that failure report and judge barber did not want i asked her to revoke the bonds and she said i'm not going to take that action today and then nothing happens for conduct that occurred after he was arrested on that windermere 2019 yes okay yes and i can detail each case how that happens if you're honored once but that's what's been kind of the confusion in all of this um and that wasn't really made clear because the court didn't understand that from the evidence but the court did understand that there was a dv arrest that's you know there's been an attempt to unwind that and turned it into a foot slammed in a door and then there was the failure to register arrest for conduct that occurred after yes and the failure to report cases while they are different in nature from the personating officer cases they still fit in this category of deceptive practices that mr dewitt engages in what do you say why do you feel that you have to respond to that i mean doesn't the law say that if someone is arrested while they're out on bond the court has the discretion to leave them on a no bond status when the bond's revoked it doesn't matter what kind of case it is right and i think that's what's been done why are you making that argument already why are you saying that it's the same type of case well i just mean to say i i think some people some judges maybe were rory and thinking that these were not significant cases and i and when we talked to the bench you had mentioned these are non-violent cases and i did want to make sure that this court was aware because like i said i don't think many courts before have had a chance to at least experience what is going on in these processions these funeral processions that these aren't necessarily non-violent cases they do involve some um serious behavior that is concerning i think council completely misinterprets and misreads this court so well your honor i am asking you to keep him no bond because of the new arrests of course that that's first and foremost if your honor was thinking of releasing him i was presenting the court evidence that i believe his behavior and conduct is dangerous in the community there has now been evidence of other types of dangerous um threats in terms of um you know potentially causing harm or making threats to witnesses and and and based on those things i do think it's still appropriate to hold a new bond until we can get these cases um heard and resolved council um this the failure to register case is going to be tried next week and it may be tried by this court it's it's on the topic next week you're on it right and is the state prepared to go forward and prove that case we can your honor yes so that's a yes yes okay because i there are four cases that have been assigned to this court so we're not quite sure yet which one will go yeah is there a minimum mandatory on that charge i believe there is isn't there failure to register no the failure to register um oh phil so what is this charge failure to register as a sex offender so he has uh one initial count and then two more registrations where he still omitted um to register uh a vehicle that belongs to his wife so so no minimum mandatory not on a failure to register no but he does uh i think i don't have a scoresheet in front of me but there's a minimum guideline sentence and then we did also file a habitual felony offender notice in that case as well as all of these others okay anything else no okay counsel the crux of our argument is this the the courts have heard um every time mr dewitt's been arrested arguments from the state that his bond should be revoked and they have declined to do so for whatever their individual reasons and rationales were of the arrests that have happened subsequently one was what we believe to be an unlawful arrest in march that the sheriff's office legal department unarrested my client the very next day prior to the initial appearance and what case was that the one involving um this witness from march 23rd of this year which was what charge the carrying concealed weapon oh right the court's not considering and and your honor i i'm sorry to butt in but i did not include that in my list it's not considering that okay okay i know you're not considering it from that perspective but i do think it's relevant as a relationship this particular witness and some bias that's going to exist between them that's one the domestic violence case that was then re-categorized as a battery that was then ultimately null crossed which is why his bonds were in this case for both initially uh-huh i think there was actually another one where um a warrant was sought and then ultimately quashed by the state attorney's office uh involving the allegation where ms burton had testified that she wanted to file a criminal complaint against an assailant at the office from last year and they opted to pursue my client for that charge um so mr dewitt it is clearly capable of exercising with the judgment he needs to stay out what about the failure to register charge i'm we're litigating that judge i mean i i i don't understand that the new one that we just got the copy of well the one that's i don't are there more than there's more than one there's a brand new one that they've just the one that was just served a week and a half two weeks ago your honor in osceola county okay is is alleging a phone number that they're saying wasn't properly registered that's the newest of the charges [Music] so my understanding of the case that's been set for trial next week is a case involving my clients wife's vehicle where the vehicle was known by law enforcement and it was registered but i guess the tag was changed at some point or renewed by the dmv and it may be that that specific tag was not properly registered it's a it's a pretty venomous violation it's not the kind of case in a normal circumstance that mr dewitt was joe schmoe and not mr dewitt i suspect that we would have a reasonable plea offer and and the case would be resolved but because mr dewitt is mr dewitt that's a tougher nut to craft so to speak your honor so that it's not a case i would normally want to try nor would it necessarily need a truck so that's the predicament we're in on that case um i don't know if your honor wants to address that case at this time or not but um council and i had been talking about it and i had indicated there might be some value in continuing that case that he and i might have a more thorough conversation about if there's a path to resolution in these cases uh you can have a prior complete offer tendered by a fire prosecutor that was rejected uh but there there may be an opportunity for us to revisit this file your motion and and so your owner's aware he does have his osceola cases set for trial um i believe judge carson has already denied a motion to continue on that i i can tell you the state is ready on those cases who judge first just for the court's order is that that's after judge carson needs to know my last request okay is that it yes okay the motion for bond is denied and the reasons for that are numerous the first being the um arrests of the defendant while out on bond uh at least twice and so far as this um domestic violence case that was either null process or no infoed or died of natural death whatever it was that led to a lawful arrest it survived survived initial appearance scrutiny and frankly after hearing the 9-1-1 call and the testimony of that witness who had little to no credibility frankly uh and the court is uh not prepared to say that that was some trumped up frivolous charge and that 9-1-1 call was alarming and together with the absence of credibility of that witness and the court would base its ruling on that and then the subsequent failure to register case in addition to those things whatever is going on behind the scenes is of no moment to the court's conclusion after viewing the videos that this defendant has been and with the kind of temperament that was displayed in this volatile highly charged atmosphere that exists in all of our communities now a danger to the community uh and for those two primary reasons the motion for bond is denied so i will look forward to seeing you on wednesday morning be ready for trial i don't know if i will get to you but maybe i will you should be ready [Music] i need someone here immediately my uncle was trying to attack me he ran me out of the house he was trying to attack me i need nothing right here immediately okay where is he
