you may have seen the video that i previously posted showing the off-duty bluefield west virginia police officer going on an absolute rampage at my client's bar located in bluefield west virginia and if you haven't seen it i will put a link to that in the description now what i'm posting right now happened about a week prior to this event so here's what happened about a week before the off-duty officer rampage incident there had been a shooting outside greg's sports bar and the bluefield police department showed up and they saw that there was surveillance footage potentially and here's how they went about trying to get that footage yep cameras out here yeah okay listen it's always my fault when i call i didn't call i ain't gonna say you might go right here okay you're cold call when you need us even when i said it when nothing y'all jump on me i'm not doing this michael right here i need you to pull your camera for me give me a copy the video all right huh afterwards i had to work what [Music] you don't listen to me i'll take your ass with me tonight do you understand this is your establishment so you're part of my investigation right now can you open the door no are you going to open the door he's standing there hold on like i secure evidence don't get a warrant so he gotta come out i said i can secure evidence he gotta come out then we're not always being friends we're not walking i came down here like a week ago and tried to talk to him about the video about a week [Music] congratulations [ __ ] i'll call fire marshall or the abc guy yep so already here what you see is that this particular officer is already saying he's going to call the abc which means he's going to try to get his greg's license taken away to be able to run and operate his bar and ultimately if you've been following this you know that that's actually what ended up happening so they went and got a search warrant and now they're arriving at greg's house and they want him to go open the door pursuant to the search warrant but they don't offer to drive him and even though he said he's had some drinks they want him to drive here you need to let us in so we get video so we get the video can i see a search yeah sure [Music] hey that's actually your copy i've got my copy yeah y'all yeah okay so what you need me to do uh we need you to go down and open the door for us i'm gonna do that let me know how you gonna do that with the key okay huh you want me to yeah find the plenty of them around here i'm not driving i i had i had a drill okay well we can get in i'm just trying to let you let us in easy way so if you want to do that then call you call your supreme officer the superior officers down there waiting on us okay call them okay i don't need it i don't need to call them so here's my final question greg are you going to go down and unlock the door with your key and let it see i'm not driving to my bar have a good day you can't ask me you cannot ask me to physically drive and i told you today all right [Music] all right you know he was reading that damn part where you check all the shits you know i believe property you know select whatever stolen embezzled kept concealed all that [ __ ] that's what he was reading [Applause] i gave it to him he's got i got my copy he's got he's already got his top and it says you're good to go get the dvr right i mean any video recording devices electronic digital media storage devices computers and computer systems [Applause] so here's the search that you're going to see through the officers body cams and i'll just point this out so the search warrant that they're searching this this business pursuant to here is what it authorizes the officers to search for quote any video recording devices electronic in digital media storage devices computers and computer systems and the the warrant application describes that they're trying to get the surveillance footage so that's what it says not evidence of of any other alleged wrongdoing not um other contraband that they think might exist on the premises [Applause] i got it [Applause] uh [Applause] [Music] [Applause] [Music] i got some firearms downstairs i got one it's all downstairs like camera system and [ __ ] it's all it's all down here i mean you could check in he might have another one but i'm pretty sure it's downstairs he's got he's got a big monitor and [ __ ] there's a laptop and everything hooked up says there's some guns laying down here too there's a gun watch this step because i've about died right here fam there's this camera system or the cameras [Applause] [Music] [Applause] [Applause] foreign so is the screen going dark up here the only thing was on it was a power cable the cameras and the hdmi cable so i think it's all contained in this yeah you'll have to get the camera i've got a hdmi cable i ain't got no reason i guess to take out the gun laying there and ain't gonna pour it but uh i mean if if we can't if he won't come down here to secure his door oh can they put a lot back in i will say because wrong one is a you got a property received laying on your cushion downstairs yeah what a property receipt showing these two items we took we've got the serial number did you take it it contains video evidence of what uh the incident happened out here last night your detectives have that that evidence already oh there's let's go we've no need to talk about hey you can't no you guys searching to take my personal property yep all right i'm gonna shoot you and you okay see what that box was checked oh this is battery back up oh six so so did the officers have a search warrant to search this business yes they did can the police do that even if the business owner or the homeowner isn't personally suspected or alleged to have committed any crime or engaged in any wrongdoing can they do that yes they can do that under current federal case law however there is a requirement that when police officers are executing search warrants that they not exceed the scope of that search warrant and what you could see you know i read to you what they were allowed to look for and that was basically the surveillance footage in any storage devices or cameras or dvrs that were connected to where that's that footage can be found but you can see in their own body cam footage that they're going in refrigerators they're looking around in closets it's almost like they're searching a business where they think that they might find that there is something more going on that there's drug activity or something like that and isn't that just the kind of thing that you would need if you were going to get the business owners shut down so are they allowed to do that no if if they're if they're only allowed to look to go get that surveillance footage now there's going to be some degree of leeway there and how they go about finding that or or or whatever but is does that include going into refrigerators does that include looking into cabinets i'm looking you know in in places where either they can't find or they're not going to find these sorts of things or even continuing to look and rummage around his place after they've found what they're looking for so there's this thing called the particularity requirement and that is federal uh constitutional law fourth amendment that ensures that a search being executed by law enforcement officers is confined confined to the scope of particularity described um in the search warrant and that's the specific crime alleged for which that there is probable cause so they're not allowed to engage in these exploratory searches where they're just generally searching for evidence of criminal activity for instance to get a bar owner shut down now why this just goes to the heart of why we fought the american revolution in the first place it was the opposition to these sorts of general warrants that caused really the american revolution it was one of the guiding principles of the as a the federal courts have noted many many many times british colonial governments had these things called ritz of assistance and they could just allow the government to go into your business or into your home and just perform a general search for contribution these were general ritz that's why in our constitution our bill of rights it was made to be no specific okay this has to be for specific probable cause searching for specific items of contraband for which there's probable cause to believe that it might be there that is part of the foundation of our country but here it appears that what you see is despite a very narrow narrowly written in authorized search warrant for surveillance footage you see officers performing just like the british would have done a general search for contraband and isn't it always so ironic when you see law enforcement in 2022 who probably has you know all sorts of patriotic bumper sticker uh bumper stickers at home acting like really the colonial british in america it's just one of those ironies which exist so if you haven't watched the rest of the video footage about what happened a week later i really recommend you watching that and as far as an update on what's happening in this situation this officer was charged far as i know the only thing he was charged with was domestic battery for pushing his significant other which you can see from several different angles from several different cameras wasn't charged with physically assaulting greg the bar owner which he did twice was it charged with committing battery on his fellow police officers multiple multiple times which you can see on the other videos as far as i know the special prosecutor in that case is only is only charging or trying to convict this guy of domestic battery and there was a shooting there was a shooting and we know nothing about that because the state police still hasn't released the investigation report in that case so that's about all we know and it's actually coming to a hearing sometime this week so hopefully we'll have more information on that soon so stay tuned [Music]
