show me the paper warrant I don't need a paper warrant do you want to be detained imagine this you're sitting at home one evening with your two young kids your girlfriend's brother from Hawaii who's on parle is visiting on a fishing trip but he's not supposed to be fishing an ex-girlfriend turns him in basically the cops want to arrest him so they come to your house but they don't have a warrant they go ahead and kick the door in anyways you begin to film them this officer just kicked open the door need open and she they say they don't need a warrant they walk right in your house where's your warrant I don't need hey you know what you don't need it come here kid please no that's not how this works in real life do I need to come in there and arrest you in front of your kids on please don't come out here Jericho come to the sound of my voice I know my law sir yeah do you because there's a fell a felon in here with a warrant I know you can't step foot in here without a warrant paper warrant Jericho I'm recording this all yeah so are we dude yep that's exactly what happened to Kyle Adams and his girlfriend and his children did they need a search warrant for the house do they care I talked with Kyle about what happened they had ARS they had he pulled his gun out on me in front of my kids oh I'll tell you what the law is and whether or not this Police Department even cares at all spoiler they don't come here you're bothering me come here you're a safety issue now how am I say come here you know when police step over the line and violate your rights what makes it so egregious is the imbalance of power you simply can't do anything to stop it at that moment just like that you're up against a giant that you cannot fight alone that's exactly what happened to a man in Florida who broke his back and became paralyzed in 2021 instead of the government he found himself fighting his own insurance company who only offered him $20,000 but this man did not settle for only $20,000 for his injury instead he called today's sponsor Morgan and Morgan and they were able to help him win over $120 million the reason I like Morgan and Morgan is that they fight for their clients just like I do as the nation's biggest personal injury Law Firm they have the Firepower to take on insurance companies and win the best part is that you don't pay anything unless you win your case if you or someone you know has been injured and needs help you can start your claim now at forthepeople.com thee civil rights lawyer found in the description and filling out the simple form or by scanning the QR code on the screen from your phone's camera now let's get back to the video and welcome back to the channel this video comes to us from Idaho Falls Idaho Idaho Falls is the fourth most populous city in Idaho in the county seat of Bonville County as of the 2020 census the population of Idaho Falls was 64,8 18 this video involves the Idaho Falls Police Department this took place at the house where Kyle Adams lives with his two young children and his girlfriend they had done nothing wrong yet the police showed up at their house the reason was Kyle's girlfriend's brother was visiting and had only been there for a couple of hours he had been on a fishing trip but apparently he was on Parole and was supposed to be in Hawaii but he was an Idaho fishing a fishing pick was posted on Facebook an angry ex-girlfriend called the cops the cops arrive but they didn't arrive at the brother's house they arrived at Kyle and his girlfriend's house although they had a warrant SLC court order to pick up the brother for apparently a parole violation they did not have a search warrant for Kyle's house but if you've seen many of my videos you know that that doesn't necessarily stop the cops I mean the fourth amendment is just a suggestion right Kyle shared his footage with me and I got to talk to him about what happened before and after the video turned off uh got a knock on the door because the brother's friend was supposed to come over and knock on the door she sees that it's cops so she goes outside and I didn't know any of this until afterwards because I mean I just knew my perspective and so when she shut the door behind her the cops asked if uh Jericho's inside and she said yes but wait there's kids like she's going to comply they didn't even let her wait and they just kicked the door open and um I just instant kicked in and started recording you're under arrest that's that's not Jer I'm not Jericho this officer just kicked open the door and she had the opportunity to open and she ref she no that's not where's your warrant who's the cop the primary cop that you're talking to in this video his name is David Shanner if 40 is his badge number I just got that yesterday as far as you know they did not have a search warrant for your house oh absolutely not they I I asked for it they said they didn't need one where's your warrant War get where is your paper warrant officer I don't need hey you know what you don't need itain I'm being detained reason my kids are right here no that's not how this works in real life and I'm staying out of the way my hands are upk you then sit down and be quiet I'm recording this whole thing though okay he has a warrant for it doesn't matter where's your where's your uh paper come here right now do I need to come in there and arrest you in front of your kids hold on please tell come out here show me the paper warrant I don't need a paper warrant he has a warrant fell in in possession of the firearm which is my my gun was out I promise it's Fourth Amendment 101 that searches and seizures inside a home made without a warrant are presumptively unreasonable even if police officers have a arrest warrant for a third party if they have no reason to believe that that third party lives in the home which is the case here they must also have a search warrant to be able to to enter it doesn't matter if they think somebody inside has committed a crime if they think that's the case they have to go get a warrant first the only exceptions to that are consent in exigent circumstances just because they think somebody's a fugitive or wanted from a crime in 2015 or a parole violation thereafter that's not in and of itself exigent circumstan there has to be some sort of active emergency occurring as for consent the video footage shows a total lack of consent then I looked at 9th circuit case law Idaho is in the ninth federal circuit so that's where you look other than the Supreme Court 9th circuit case law says the government may not show consent to enter the home from the defendant's failure to object to entry here there's no indication at all that the officers even requested consent they just asked if the individual was inside and when the girlfriend said yes they literally kicked in the door that is the opposite of consent the only thing that they could rely on is exent circumstances but there cannot be exent circumstances here I'll tell you why in a few minutes do you want to be detained don't do this please okay knock it off please Kyle Jericho kle come to the sound of my voice I need you guys out of here because he's dangerous I'm going to come in and get you he not dangerous no weapons I promise I'm going to come and get you in a second unless you come to me right now I promise there is kids here they're right I know my law yeah do you because there's a a felon in here with a warrant are the kids right here you're going to detain me for holding next to my kids no I'm not I'm not I'm not stopping you from what you're doing but I know you can't step foot in here without a warrant paper warrant Jericho I'm recording this all yeah so are we dude yep yep come here you're bothering me come here you're a safety issue now how am I say come here that was the end of Kyle's video which he put up on Tik Tok and went viral so I asked Kyle what happened after the video shuts off so he started coming towards me started to grab me and I just I don't trust officers and so it looks worse than it is on the video um but or or yeah so I shut the recording off and threw my phone to my boys because I didn't want him to grab my phone and destroy it or something so that's why it was like I it looks like they took me to the ground they didn't but they were really rough about it to get me out there and um but I threw my phone I turned it off stopped recording and threw my phone to the my boys because it was just Instinct I didn't want them to take my phone because the D knew I was recording this all so at that point he physically took you outside like he physically put his hands on you and took you outside yep at what point did he put you in handcuffs uh when I was outside by out front but he had my hands behind my back and walked me outside I was complying I'm not going to my boys were there I'm not going to take the risk of going to jail because but I still was standing as much ground as I could they did everything like they had ARS they had he pulled his gun out on me in front of my kids oh so at this time the brother or brother-in-law Jericho was not residing at your house no he was here for like less than the story I put on uh Tik Tok and uh YouTube I guess I put two hours but I mean that whole day was a mixup he was only here for about I guess 30 minutes before we showed up he just got back from fishing but still he was here not in sight of anyone sitting inside the house and because she said yes they kicked the door open they had I would say at least six to eight patrol cars and I was outside detained for 30 minutes I mean I had no shirt no shoes and it's 35 degrees in Idaho at 11:30 at night and I asked them if they had any blankets in their patrol cars and not one of them they said no we don't carry that I'm like you're telling me an Idaho are six months out of the year there's snow you guys don't carry blankets and they just kind of laughed it off I sat there with in handcuffs and I was just like I'm a law-abiding citizen like I'm just asking and then officer just Chuckles they forced you out of your own house yep and my kids were in here defenseless wait so they made you go outside and they left your kids inside until after I was out there and then they finally got the kids out how long was it until they let you go back into your own house I'd say about 30 minutes I was out there detained and what were what were they doing as far as you know inside your house for those 30 minutes the I mean they were only in the house for probably five to minutes not not even five minutes after they detained me they brought him out uh let us hug him um I got to hug him with me and handcuffs too and then that's just it took him 30 minutes to get him in the cop car he brought uh my girlfriend and the kids inside the house and tried to sit there I don't know what was said but tried to uh sit there and explain how everything that they did was right and then they tried to come and talk with me that same officer tried to come talk with me and I just said please unhandcuff me and get off my property you anything you say is not gonna make anything right you said they made you go outside did they make your girlfriend go outside as well they made everyone leave the household I also asked Kyle about the backstory of how as far as he knew the cops ended up at his front door this is what he said so brother 2015 that's what the charges that they say in the video guns and drug related charge that's what this is about it's 2015 there's no there was no warrants so he served six years in the boisey prison and then got out on parole and they transferred him to Hawaii because his mom lived there so it was like had someone to take care of him there make sure he stayed clean so he he'd been living in Hawaii and got a hold of sister asked if he wanted to come uh go to the Vikings game on the 24th of October Thursday and so asked if she could fly him there and also fly him to Idaho to do some fishing so they did that flew from Hawaii to California nothing flagged up about no warrants he didn't get in trouble there for four days flew from California to Idaho still nothing no no pickup in the airports anything and the Sunday after a week before the third I don't know what day that is but uh she posted a picture on Facebook of her and him at Snake River fishing and one of his exes tagged the Bonville County uh Most Wanted and apparently picked that or we had no idea about any of that and apparently there was he was wanted because he left Hawaii or something like that we so she deleted the picture but they already had that hunch that he was here with her and so um leading up to that talking to the neighbors after the officers left uh the cops had been going up and down the street for a couple hours and so they were waiting for her vehicle her Jeep to show up there because it was only 10 minutes out he he had been sitting in the house for a while like they had no idea he was even in here they could have gotten him while we were gone but they waited for her Jeep to pull up and they even asked her like and that's once they said uh as Jericho inside they were waiting for us to show up even if they saw two people get out of the Jeep it was me and her that got out of the Jeep not him he's been he was in the house and uh I mean yeah she said yes but that doesn't give you the right to kick the door down Kyle actually complained to the leadership in the Idaho Falls Police Department the next day but they apparently did not even care they didn't care about the unconstitutional entry into his home without a search warrant and they didn't even care that they made him and his two young kids and his girlfriend stand outside for like 30 minutes forced out of their own home illegally and weren't even provided with a blanket or means to even stay warm and then I asked about the front door and because then I started bringing up the case and he's like oh well everything from what I read was justifiable and I asked about the front door about how that gets replaced and he says that basically so the only thing I can do is file a torque claim and it might get replaced so they actually they actually busted down busted in the front door before you turned on the camera yeah they kicked it open so they busted down your front door and they're not even gonna pay for it nope well they weren't and but the city they called yesterday because I mean my Tik Tok and everything it's gone viral and the city and actually called my girlfriend and wanted to talk about the front door and I just I took the phone and said I I'm advised not to talk to anyone from the city right now because I'm not going to let them try to make it all right how old are your boys nine and 10 what was that experience like for them seeing the you know the police come into their house and take their dad outside horrified I like we slept on the couch all night they fell asleep at 6:00 in the morning because every noise they heard cuz the door I mean the dead Bolt's the only thing holding it shut and so it's open closed and so every time they heard a little noise or if I got up they just wide awake and they still do that even at their mom's where this didn't even happen what happened with Jericho yep they put him in uh the solitary where you he hasn't even gotten a phone call did they charge you with anything nope because I didn't know what to do and that's like I'm gonna put it on blast and I know I have 180 days to file a torque claim so that gives me 180 days to figure out what I need to do and uh I after that I know I can go longer but it's like I just don't know my next steps I just I I want to make these guys pay like not MoneyWise that's nice too but no these guys need like they're hiring the wrong people to serve our community and it's scary I told you I'd tell you more about exigent circumstances they can't claim that here there was actually a US Supreme Court case in 1981 that said exent circumstances to enter a home do not exist merely because the police know the location of a fugitive even if they possess an arrest warrant for that person that's steal versus United States from 1981 I mean there's literally a US Supreme Court case on point and this this ignorant police officer does not care his supervisor the next day does not care if he even knows but yet this guy Kyle just randomly having the police bust in his house he happens to know what the law is but the cops don't these cops don't care enough to know not even the supervisors what a disgrace they have no excuse for the illegal entry into this house we saw that there was no consent the US Supreme Court said under these circumstances there's no exent circumstances these guys violated the Constitution they did it on video brazenly and they don't care they haven't apologized they don't care about you they don't care about the people they are charged to protect they don't care about our country you want to talk about anti-American these should be cops in Singapore these should be cops in Saudi Arabia these should be cops in any authoritarian regime in the Middle East or the Far East these are not good cops in the United States of America if these are your public servants I will leave their contact information below so that you can reach out to them and express your first amendment speech and if you're a lawyer in Idaho who wants to take a very clearcut Fourth Amendment lawsuit they cannot find a lawyer to represent them if you want to reach out to me I'll be happy to put you in touch remember our rights don't end where your fear begins freedom is scary deal with it
