I'm surprised they shut all the barbershops down pretty much and salons and everything I will not give you any names but I will tell you that yesterday I cut 10 officers here yeah ten and I will not reveal their names oh I do I look do I look like I want to know in April of 2020 a 72 year old combat veteran himself a retired law enforcement officer was arrested in his barber shop for refusing to close his business during the lockdown ordered by our governor the criminal case is long over the civil lawsuit that I filed is over also at this point but the footage is a good reminder about your government those of you with The Thin Blue Line Flags next year Mullen Lobby Flags watch and learn government employees will follow orders law enforcement will follow orders constitutional or not doesn't matter whether they have an American flag tattoo or sticker on their truck it doesn't matter whether they spout off on the interwebs about patriotism and the Constitution they'll follow orders for a cool gift help support the channel by supporting our sponsor the ridge wallet perfect gift for the guy in your life Les Jenkins AKA The Outlaw Barber owns and operates less's Place traditional barber shop located in Inwood West Virginia he's a Vietnam combat veteran and later was employed as a deputy U.S Marshal for 27 years he learned the barbering trade while in the middle military and has now been a barber for over five decades on April 23 2020 two police officers with the Berkeley County Sheriff's Department arrived at the barbershop he operates at the request of Chasity Kinser an inspector for the West Virginia Board of Barbers and cosmetologists she complained to them that Mr Jenkins had opened his Barbershop during the governor's lockdown and cut the hair of several people including ironically several police officers she wanted the officers to force him to close here's their Exchange they have um I have to you know so I knocked on this door and asked him come outside the shops are closed so I'm doing my job by asking you to close down you don't want you don't want other people sick or anything you have the two deputies then go inside the barber shop initially when the inspector first arrived the door had been locked it was now unlocked which would come up later in the Civil Rights litigation hello sir what is her face the woman out there from the state board yes I did okay you know you have to shut it down there now I told her she arrived here at 9am armor board inspector came to the shop and stated she had received a complaint and then it was open for business bless his place unlike worthless state government bureaucracies when the phone rings in the barbershop you answer it because you actually have to satisfy customers and provide service to the community just pointing that out okay bye you said that she had to shut me down I stated that I needed her order in writing and signed she agreed to do that I stated that I would contact my attorney Mr Jenkins explains to the young Stormtrooper that he didn't outright refused to close his business but that he wanted something in writing I mean is that too much to ask for really how do you then get due process if they won't give you anything in writing I asked her if this was tried in court and she said no I stated that her order was not legal and went against my constitutional rights she was told to phone me later today and I would inform her of my lawyers advice she said that the board would find me now it's an opinion that our government has the right to recommend that businesses closed down but the government does not have the right to require any of you back the blue types who are still holding out hope that the people you trust aren't going to obey future unconstitutional orders just take a look at this deputy's face as he's being schooled on the Constitution by a wise Elder but it's just a Blank Stare he might as well be speaking French I shut down the businesses the government attempts to rob my rights but the female Deputy isn't having any of it she walks back outside to speak with the inspector surely an agent of the state there to enforce the order of the governor to lock down a private business without due process of law has some sort of written order with them to give to the man hey man hey do you got the order yeah do you have it on you because we I don't have yes the governor's orders him give me a second any other complaints I've gotten they have been closed by time I've gotten out so I'm like oh no what do I do now by the way what she's talking about here is how she ended up at Les's Barbershop a jealous hair stylist apparently dropped a dime on him she's saying that usually when the informants sell out the rivals the suspects have already closed and sadly deprived her of the pleasure of personally punishing the suspected domestic terrorists do you have a hard copy of it not a hard copy now my office is in Charleston all right um this and then the next one too okay apparently yeah are you Kool-Aid yes my husband is Joe Kinser oh okay I took uh numbers of your car so I'm like this tall skinny guy and this small blonde lady showed up he's like Ah that's Kool-Aid okay yeah that's me did you catch that so the inspector's husband is a local prosecuting attorney she called him he told her the nickname of the female Deputy then she name-dropped her husband to the deputy before she heads back into the barber shop to be the governor's tip of the spear protecting the public from dangerous Barbers so what you're seeing here is the digital version of the governor's lockdown order which by the way says nothing about enforcement of the order or criminal charges those gray are areas those gray areas are being filled in by these government employees with no actual paperwork of course there you go okay I need something right here so you're good thank you yeah stating that you need to I completely understand I mean if so if someone's just coming knocking on your door and being like hey you got to shut down you know I mean this is your livelihood I'm sure she is from Charleston so all she has is that on her phone yeah and uh how I asked her to do let's just provide that please provide me a letter and I certainly will comply immediately yeah absolutely um I'm gonna see if she can maybe get a copy for you yeah um yes but she's the rep yeah let me see if that's possible because I mean there's if she's out there but I understand everybody's doing it it's illegal it's unconstitutional and that's why I want the letter I want the letter because when I turn it over to the lawyer and we file suit I need backup now I wasn't representing Mr Jenkins at the time that came later they never did provide him with anything in writing so now the male deputy comes back in and says that the inspector is now going to her office to bring back something in writing generally I'm surprised they shut all the barbershops down pretty much and salons and everything I will not give you any names but I will tell you that yesterday I cut 10 officers here 10 and I will not reveal their name oh I do I look do I look like I want to know you will see that a governor of a state has a right to recommend the shutdown during something like this but does not have the power to enforce it unattended by The Barber Board did not have the courtesy to send to my knowledge any person to own in a shop whether it be a salon or a barber shop a letter stated you had to shut down nor did the Barber Board ever give a phone call I mean it would have been good to get a heads up of it especially from the board itself and they're going to run me out of business so here they turn their body cams off for some reason and that's all there is but here's what happens the inspector finally brings something back but all it is is just a printout of the governor's executive order it mentions nothing specific pertaining to Mr Jenkins it's just the quote stay-at-home order it mentions nothing about enforcement of that order so Mr Jenkins looking to seek due process of law and to challenge the forced closure of his Barbershop asks the inspector to at least sign the piece of paper she printed out but of course she refused when she refused Mr Jenkins likewise refused to close his Barbershop at that point now with the body cams off they physically arrested Mr Jenkins in his barber shop and I wish I had video footage of it because it should be seen but they had them all there was no warrant what was his crime obstruction of an officer refusing the officer's orders to close his Barbershop this is problematic legally speaking on several different levels so when it goes to court eventually it's dismissed by the Magistrate Court as unconstitutional and this is at the criminal level government being government The Barbers board administratively was still coming after Mr Jenkins they were trying to take his license and his livelihood away from him eventually the West Virginia attorney general got that dropped the Federalists gave some national coverage to this dumpster fire of government-red tape here in West Virginia so the criminal and administrative portions were over I filed a section 1983 civil lawsuit against the inspector and both police officers alleging several constitutional violations including the Fourth Amendment as well as first amendment retaliation the defendants all asserted qualified immunity as well as argued that the government just had the power to do what they did by the way throughout this time period I attempted several times unsuccessfully to sue the government over the violations that were occurring this is one of those cases but it was made very clear that the Judiciary was not going to help during that time period at any level relief unfortunately the federal court agreed with the officers and the inspector and dismissed the loss despite the fact that the state-level Magistrate Court found constitutional violations resulting from the arrest the actual federal court found none I'll link the order at the blog at the Civil Rights lawyer.com what was wrong with the Fourth Amendment claim here there was no arrest warrant the man was arrested in his own Barbershop again without a warrant the Court held that he had no reasonable expectation of privacy as it was technically open to the public the door was unlocked and he was polite so he never asked him to leave they're in fact Fourth Amendment protections that are applicable to private businesses but that's a rabbit hole for another video and I think I've done some on it before the more important thing here is that this man was arrested in the absence of probable cause that any actual crime on the books has passed by the legislature had even occurred a Governor's executive order does not create West Virginia law that would be unconstitutional at the state level our state constitution provides that statutory crimes must pass both houses of the legislature and be signed by the governor can I just do it himself with a stroke of a pen and he did not so how did they get away with it good old obstructing an officer the officer said that they were enforcing the governor's executive order he interfered so probable cause therefore existed to arrest him for obstruction and that was just a total cop-out which is why the criminal prosecution had to fail they couldn't charge him with violating the governor's executive order which was the real reason they arrested him because why it wasn't a crime so they had to resort to the vagaries of obstruction good old obstruction I'll ask you this as I asked the court in this case to no avail how does one obstruct the police officer by declining to close his Barbershop the officer is was obstructed how by the man not closing his Barbershop this was just a stop Gap charge to fill in where no crime even existed there were no customers even in his Barber Shop what are his restrictions is he allowed to be in there is he allowed to answer the phone with the door locked what about sell coupons over the phone what about cell hair products VIA mail order what about make YouTube video videos about being a barber I could go on and on with the failure in common sense and logic here but you get the point and the point is that here in this footage is concrete proof that it matters not whether your local police officer is a nice guy or patriotic or whatever they will follow order they are agents of the government if they don't do it they'll be replaced with someone who will but they will do it I assure you even if they don't personally agree with it it would be a tragedy to lose your pension your dental plan all that of course and don't get confused about the difference between an individual's personality their personal beliefs whether they're a nice person whether they're friends like them and their status as an agent of the government when they're wearing that badge there are countless examples of this going all the way back to the beginning of our Republic don't get caught ignorant of this basic truth as always thanks for watching you can find more detailed information on this at the blog at the civil rights lawyer com I'll post a copy of the court order here that dismissed the case if you really want to depress yourself please make sure to subscribe if you like this type of content which really is the best way in my opinion to learn the law you use specific facts and then you try to apply the law to those facts when it comes to suing the government many times the cases that you lose are the most instructive for the future freedom is scary deal with it I'll see you next time foreign
