i would like to go off and go do some work too but i'm still dealing with you because you're pulling this anti-government stuff on me tell me it's not anti-government this is my place okay prove that to me by telling me your name i don't know what your hatred is for the police of the government but telling me your name would have only confirmed who you were and i was left that's all i needed get ready for this story and watch until the end because every bit of what you're about to see is important and is really a great example of the routine injustice that government and their police officer henchmen put people through every day from being harassed and arrested on your own property to being drugged through a kangaroo court in retaliation for your free speech everyone should see this video so that they know what we're dealing with and what can easily happen to them make sure you spread it around in the early morning hours of october 12 2021 corey jones got up early to work on some property improvements at his home clearing brush around his acreage he got out there early because he had to take his kids to school since it was dark outside he used a headlamp unbeknownst to him at the time the horse owning karen next door called 9-1-1 on him complaining that she saw a guy in the woods on her neighbor's property she did this despite the fact that she had no idea who her neighbor even was officers from the pope county arkansas sheriff's department arrived they listened to her explanation and then trespass onto corey's property confronting him and then arresting him everything that happens here is outrageous but also instructive corey is a subscriber to my channel and he has graciously allowed me to share what happened to him let's begin with the initial caring call hope county discussions angela where's your emergency i'm at 419 caravella road and i went to feed my horses i'm working nights i went to feed my horses and i heard something on the other he's right on the other side of my fence line and he's got a light and i hollered out i got back in my car and hollered out what are you doing because he's like scaring my horses but he's like picking up sticks and he's acting very erratic and he's got a flashlight yeah he's got a flashlight it's like a light on his head but uh he hasn't come on to our property but is he a white man i can't tell if he's white or not oh got a white t-shirt on okay now i can't i can't see him now he's coming back because he's got a light but it's like he's he's searching in one small area looking on the ground i don't i don't know what he's doing do you know who lives over there in that area but i don't know who really owns the property that he's on okay have you ever seen him before well i've got a some of my officers heading that way when the officers arrive this is sergeant damon mcmillan and deputy hayden saffold both of the pope county sheriff's department the karen again tells them the same story of particular importance here is the fact that she clearly does not allege that corey has trespassed on her property she's claiming that she was subjectively scared of someone she saw on someone else's property which in fact was the property owner she admittedly has no idea who owns the property she makes no allegation of any crime other than her just expressing her own fear himself wouldn't tell us what he was doing here freaking the horses out saying yeah i pulled up i worked nights and i pulled up to feed the horses and i was all the way in there i heard a crackle and he was over a guy in a white t-shirt and he was back over there like with the t-posts they're right up back over there and he was there for probably 10 minutes and i hollered out the window after i got in and locked the car and i followed out the window what are you doing what are you doing and he said something and then i watched he went back and forth then like was shining and back and forth and then and then i think it went back over there and i don't know whether he went along the fence line there was he in there with your horses no he wasn't right on the other side of the fence but i heard a is that your property no it's an oil company or something or other oh okay well is there an access to get it is there an oil well up there there's oil thing right there but all you can see it it's all brushed okay sorry about you guys oh you're not bothering me we're here all the time he uh it was just right right there and he was like going around in little circles like with but he had one of those lights on his head okay oh i think i'll see you what are you doing get over here you don't want me to see you might want to turn the light off so please come here but it's hard to tell i mean like when i was just talking to the dispatcher it's really hard to tell whose property that is he's not over there he just ties a lot to a tree they're kidding looks like it there's a lot on the tree so i'm sure that's probably what he did what the heck did he do and i mean it's fine it's not our property but it was so close and it well it just scared me well it probably scared him that i'm here but i'm sure he's going to pop out of the wood line during the day and i'm going to get a call on him walking down the road i couldn't tell you know his race there could be somebody camped out there i i don't see a camp but i'm sure that he's going to pop back out or he's going to be walking down the road somewhere this is this kind of thing something you have happened frequently homeless people living in the woods okay yeah unfortunately within the last year it's kind of a thing worse it has we never really had that problem before but over the last year or so yeah things have gotten so bad here lately i mean there's just there's homeless people everywhere we've never had that problem here well that you know my heart goes out to them i just rot and i don't have a problem even helping them as long as i don't feel threatened or something right it's a common theme with karen's that they really like to lick the boots of the police officer they love sending police officers to a cost innocent citizens when they get scared because freedom is just really scary well we appreciate your support sir no legitimate pro certainly appreciate your service and i don't think you guys get enough credit for what you do well we do that when we take the job so it's no surprise like i said it's it's probably some homeless person out there well no yeah there it is that's the same thing there it is i thank you now the officer notices cory on his property he now becomes the one trespassing as he confronts corey of course he's got to have that id like an addict does he care that he's on private property and he has no idea who the owner is of course not what are you doing you live out here what are you doing i know you hear me yeah i hear you um i'm just hanging out you know i'm not trespassing right here you're not whose property is this this is my property right here it is yes sir okay what are you doing here scaring this old lady at five o'clock in the morning well i just figured you know it'd be a good time to get started get started doing what on my work what work i'm working right here you are yeah uh-huh yeah and you live here right uh-huh what's your address yeah um we're just trying to figure out what's going on i understand what what's she saying somebody's trespassing do you live out here yes sir i do okay what's your what's your name badge number i can't quite see it it's hayden saffold 1602. you live out here in these woods or the house what's your name and badge number what's your house where's your house i i was curious of you i mean well you don't understand that i'll tell you in a minute okay i know you're recording me but you got to understand i'm asking you a question do you live in these woods or do you live in a house you guys approach me i mean you could you could tell me right now i believe you're trespassing until you prove otherwise you are committing a crime well is this america are we innocent until proven guilty you're telling me i'm guilty of trespassing right here i'm asking you your address because i want to know if you live on this property because you could just be telling me that i have a fifth amendment right i don't have to answer any questions i would like to alleviate you guys as um worries so you can't prove to me that you live on this property sure i could okay well then you probably need to do that or you're going to arrest me might have to yeah i mean can you not see that i'm out here doing work we can see that but she called because she's saying that you're on her property and i've been out here for 30 minutes yelling and you didn't come out until now well i've got to get my kids off no i didn't i've been back and forth i've carried some stuff up here to get ready to work you live here you live in the house right what's your address sir honestly i don't want to answer any more questions because you understand you've been accused of trespassing now if you can prove to me you live here then i'll leave well whose property is this that's what i'm asking can you maybe you should ask the complaint that you haven't even given me your your name or your badge number did you do all this at five in the morning to get me out here no i did not get no i didn't i think you might have no i don't even intend to post this unless it goes the wrong way i mean so if you get what you want you won't post it but if no i'm not said well he refused to tell me his name you'd be happy with that right i don't know this is your problem what i would suggest what i would suggest is maybe maybe you get with her one of you guys and if you want to hold me here and detain me i understand if you want to get with her and just make sure that this isn't her property and maybe you're on the wrong prove it's yours i can prove it's mine then tell me i don't intend to answer any questions right now you're detained until i figure out who you are are you going to release me if i give you my name well i've asked you how many times you've reviewed well you're not going to ruin your fingerprint i've also asked you your name your bad member no laws does have to give you my name it'll be on your restaurant is it not in your policy no it's that i'm going to have to run your fingerprints and it takes a couple of hours so after you sit there for a couple hours waiting on your fingerprints to come back yes i don't care what you ask me i'm asking the question it's not you you need to lay it off then the youtube stuff with all the students making it worse man when she said he was acting blended well well she heard him when he stepped on his wig and she yelled at him she's like hey what are you doing so that's that's not their property that probably belonged to the gas well over here they skipped and he just kept looking at her and then i went over there my secrets at the light tied to the tree but i couldn't find him i come back and that's when you showed up and he's like i'm going to take him somewhere to identify him no i haven't gotten anything yet corey ends up being arrested for violation of section 5-54-102 obstructing governmental operations under arkansas law which provides that a person commits the offense of obstructing governmental operations if the person won knowingly obstructs impairs or hinders the performance of any governmental function now the arkansas courts have defined governmental function as quote any activity which a public servant is legally authorized to undertake on behalf of any government unit that he serves thus the arkansas obstruction statute does not specifically provide a mandatory requirement to provide an id to a police officer rather it criminalizes the providing of a false id however it does criminalize obstructing any activity which a public servant is quote legally authorized to undertake arkansas rule of criminal procedure 3.1 provides that a law enforcement officer lawfully present lawfully present in any place may in the performance of his duties stop and detain any person who he reasonably suspects is committing or has committed or is about to commit one a felony or two a misdemeanor involving danger of forcible injury to persons or of appropriation of or damage to property thus it appears that the officers in arkansas may detain individuals if they suspect that individual that individual committed a felony or certain dangerous or damaging to property misdemeanors it would be a stretch in my opinion to even include trespassing into that category especially where they have no complaint from the owner about the property owner of the property and they're actually themselves the police trespassing and confronting the actual property owner the footage in this case was very clear that the property owner who did identify himself as owning the property as you saw in the footage expressed that these officers were not welcome i really don't see any basis for the officers having any reasonable suspicion of any crime having been committed here nor does it appear that if they had such suspicion of trespassing simple trespassing that their actions would have been justified the officers are clearly worried about ending up on youtube ironically or in the media as well as the fact that they suspect corey of being anti-police which is ironic under the circumstances a solid case could be made here that what they are actually doing is retaliating retaliating against cory in violation of his first amendment rights here's a discussion which took place after the arrest indicating that this is likely true anymore don't know yet he won't tell me his name so we're going to finger print look i can't release you until i know who you are when i figure out who you are i'm probably just gonna write you a ticket and shoot you out the door okay that's a lot for obstructing government operations for not telling me your name and you wouldn't be here in the first place that you simply just hold your name all i was going to do is run your name get your address and i was leaving your name and you never gave me a query right here too my name will be on your arrest report okay you haven't also never gave me a clear answer it's not in my habit to be answering your questions you need to ask mine i simply ask you do you belong on the street if you give me your name and i'll run your driver's license and it gave that address i would have left all you're doing is trying you're trying to get anywhere because i think what you're trying to do you got what you wanted you've been taken to the jet now we're going to fingerprint you i'm sure that the video and whatever else you've got you're going to try to get on the front page of the newspaper and try to make it into a big deal good for you but you're not going anywhere until i know who you are whether that takes 6 hours or 36 hours you can sit there so the quicker you tell me your name and i can look at your dl photo and make sure it's you then you're just gonna have to sit here i'm trying to help you get out of here quicker you'll just simply tell me who you are so you're a lazy i'm tired to talk to you one last time yes or no are you going to tell me your i don't have to tell me my name it's my civil rights michael dude i don't know i want to stress that i'm wishing so he didn't live nowhere he does yeah matter of fact he was probably on his own property he just wouldn't tell him and he was wandering around carrying these people at six o'clock this morning and wanted to pull the whole government i don't have to identify myself so i didn't let him go or something it could have kind of looked like he might have been looking in the woods and i'm like yeah i was wanting for something without wood yeah all i really got i didn't just say whether that was really his property and i don't know but he needed well this is going to turn into immediate i mean they're going to want to if you don't talk to them you know so it's going to turn into a media therapy shouldn't start at the like if you don't cross it and make me look like i realized i'm in shape when i got here and let me get you told me that first place you wouldn't be here okay i can't leave you out the middle of nowhere not knowing who you are it's not like i wanted to do this now i got to do a new report i don't know what your hatred is for the police of the government but telling me your name would have only confirmed who you were and i was left sadly part of the story here is what happened afterwards i'd like to tell you that the charges were dismissed but apparently corey ended up being convicted of the obstruction charge on what basis i really don't know but i do know that the judge who convicted him i'm told was judge don bourne of pope county arkansas a little over a week ago our old friends at kark in little rock reported that the arkansas supreme court officially suspended judge don bourne without pay for ethical violations including mistreating litigants in his courtroom and failing to appoint lawyers for criminal defendants basically for running a kangaroo court i also found this gem on youtube where k-a-r-k showed footage of judge born threatening a defendant with prison rape among other things it was only a two-week suspension or is only but thankfully after his term expires in 2024 he will never again be allowed to serve as a judge in arkansas so why even allow him to go back or remain on the bench at all hopefully an arkansas lawyer can swoop in here and save the day i wish i could help i'd be happy to to the extent that i can but i'm not an arkansas lawyer perhaps there's more to the story i don't know but the footage shows what the footage shows i trust in the footage and i really feel bad for corey jones he was mistreated by his government by a couple of tyrant thugs egged on by a despicable karen i'd love to see a civil lawsuit here usually however you have to win the underlying criminal charges which is probably why officer king george iii is pushing them he wants to know why anyone would be anti-government or anti-police because of swamp creatures like you a few weeks ago i posted a video of my clients in the mcdowell county west virginia case encountering a similar type of tyranny within the cartilage of their own home the point was in that case that you can't be on my cartilage of my home without my consent and then demand my id even if you have reasonable suspicion here however it looks like we're not dealing with cartilage of a home but rather what the courts call open fields generally unfortunately there are no federal fourth amendment property protections like for your home for open fields the line between a home's cartilage and the adjacent open fields still part of the same property can sometimes be a gray area however that does not mean that state arkansas trespassing and criminal procedure laws aren't applicable i see no arkansas law that allows police officers to trespass on your private property against your consent and demand your id to ascertain whether you're trespassing on your own property or not quite the opposite federal fourth amendment protections will always apply to the person federal law prohibits an investigative detention i.e give me your id or i'll arrest you in the absence of reasonable suspicion the karen neighbor who alleged that a crime was committed she alleged only her objectively unreasonable and irrational fear there was no allegation of trespassing a police officer's own irrational subjectively unreasonable fear that someone theoretically could
