and uh how long have you worked for
homeland security uh
transferred over here in february no
january 3rd 2010.
eleven years okay any other law
enforcement
uh part of that i was uh i
crowned border patrol okay and
probably that was a probationary
what happened today um so uh
let me just let you know that this
interview is totally it's voluntary you
don't want to you're not compelled to
say anything to us
this is just to uh basically talk to
witness witnesses
in any fashion however they were
involved okay so
doors closed for privacy purposes uh
anytime
you can terminate the energy okay okay
uh but before we go any further did you
find
any of your duty weapons today no okay
um so uh sir i mean
if you could if you can just kind of uh
tell us your involvement
with what happened today so um
i was the uh backup uh undercover agent
in this case i was backing up the
primary
agent richard davis
okay and
i mean that's pretty much it um i know
we got
there had a surveillance at the first
house
and they let us know and then i think
they made some communications
with him undercover their primary
encouragement did okay
and i was just pretty much
if there was anything significant now
that uh
the other the cover team and
the arrest team and all i know what was
going on
oh we already
we spoke with the agent yeah there was
like i guess there was some something
uh abide that happened last thursday
were you a part of that yeah how was the
uh
backup page okay um and
the uh the target on this from last
week's
and today's deal do you know the name
who was slipping in my mind right now
but yeah i know we
you know he's like you know him or just
know that i can if i see his face
have you dealt with them before no not
before last week not before lesson
no i was yeah did you have any uh
communication with with the target no no
i didn't i was just
my my i was just like uh like i said of
the backup
undercover agent okay and uh i was just
like
turning over the money and picking up
the drugs kind of deal
so you know to avoid a rip and that kind
of stuff
okay did you hear any uh communication
between
especially uh tears and the target
today yeah yes can you kind of stop it
yeah it's
and i don't i'm gonna say i remember
everything you know it's just
very general um i know uh
when he called and
we already knew those in the world
because i called this and told that he
was on a
9 10 right then he uh
he called and uh
something to the fact that he had gotten
stopped but he
didn't he didn't give him a chance to
figure out what was going on
okay and uh during that time
so they had the conversation and then
you know that he said he was on his way
to las cruces
that he had a head start whatever um but
uh and then during that time i asked him
did he just see
somebody and right about that time i got
a text message too that he had shot
somebody
but we didn't know what was going on i
was like what the hell's going on
um and just just the way he said it made
me think that that he had shot because
he said i didn't give him a chance to
find out what's going on
and uh yeah because we knew he was uh
dude
well i mean uh and i'm not familiar with
like uh you know
how you guys look obviously look like
the backup uh the backup uc's i mean
are you part of any type of operations
planning like
calling units for uh like surveillance
or
it was uh
i would have given the takedown signal
okay
if he made it to so i think the the
whole the way it was set up was um
when he left deming if the opportunity
arose and they could do a felony traffic
stop
with assistance from state police state
police would initiate a felony
uh traffic stop okay and it was our
understanding that we're gonna have at
least uh
two vehicles because uh we we had uh
we had uh expressed that this guy was
dangerous and always armed
so uh the
if the felony stop could could be
affected on i-10
and it would be that if he they didn't
see him or somehow he made it to las
cruces
then we would go to the second part of
the operation which would be at the tna
and he'd park right next to us
something like that and then our
primary uc would engage him and i would
be
i'll go to the back of the vehicle uh
try to you know like him have a
compartment and pull out the money then
we're gonna
call him out of the vehicle to go look
at the money and stuff like that and
bring the dope with him
and when when he would make it to the
rear of the vehicle
we would kind of step away a little bit
to give the uh
and we'd give the signal and step away
so the
takedown team could arrest us so that
was kind of in general over the time
so i just want to make sure i heard you
right um
so between demi and cruces if the
opportunity arose
so to come to somebody traffic who is
going to make that call
to to make a stop order uh
i would assume uh state police if they
had the opportunity to make that call
so was state food support of uh like the
briefings or like
do you know if anybody was in contact
with them i'm trying to figure out
like someone was trailing him or
something like that
um there were i think
state police i was i think him and uh
some of the demons
briefed separately from from the group
over here okay
because we had two groups like uh the
one that would if there was a felony
stop and then
i know our srt team had a couple of
developments that were going to go out
and meet qrf if there wasn't any
traffic stop that would respond to
assist
and then we briefed everybody that would
have been part of the uh
plan over here here in las vegas so
i had a briefing over there with the
state police and some of the dimming
ages
we had a briefing over here but
between hsi and state police there was
communication at different rooms okay
there's a separate
group of agents yeah because
okay that was part of it was like uh
if part one if part one of the plan took
place then they would address it over
there
yeah and part two then we would come
into the picture okay two parts to that
plan
just a back up kind of deal see uh
you know how we could arrest this guy
um who who uh what what agent contact
where
we're just trying to find out how many
people
we need to interview and like we need
like we're trying to compile this
amazing stuff yeah you mentioned that
you got a text that yeah
somebody was shot yeah yeah
andrew and drew what was the last fight
fy f-i-e i believe
yeah he texted me and said that uh
officer had been shot
gotcha right about the time we were
talking to him that
that he called in and was telling us
that
that he had been stopped and uh he
didn't give him a chance
to uh to fight to figure out what was
going on
so he said something to that effect that
came to the exact words but he says
something to that effect
and uh right about that time i think
within a minute or two i got the text
message
okay because i was next to uh the
primary you see talking when he was
talking to the
perp on the phone because you know
listening and stuff
and trying to advise people you know
andrew's uh an agent special agent with
okay
um when you were communicating with uh
jim brazilian being omar with the
with the target omar okay um
what was he speaking uh spanish spanish
yeah he was talking to spanish okay
i didn't i didn't really talk with him i
just listened to your listening
as far as what you heard that's okay
perfect
okay um
like i said i was just like right really
it wasn't the primary
agent i was just trying to there i was
there for supporting that you know
the deal went down in the morning did
you guys do briefing in el paso as far
as when this was set up no we did it
here in australia
um nothing i can think of right now
okay um i think uh we are all aware of
uh
that this individual was pretty
dangerous but
i don't know i don't know how did you
know that one how did you know that he
was dangerous aside from
yeah it served twelve years that's our
tours and then uh
the last meeting he had uh he was armed
he was armed yeah
well i'll give you uh leave my card okay
