I have no weapon. I told them I'm not resisting. They kept tasing me. This is going to be a problem for you in the climate, dude. I don't know. They jammed my face in the ground when they tased me. >> Okay. Why don't I just open up your jacket and see if they >> What's your name? >> I'm looking at the probes here, so >> They tased me in three places, I think. I want to go back inside. I wasn't even in town. >> Sorry to hear that, man. >> Yeah. So, why are you doing this? I'm going through the worst day of my life. I found out yesterday about 13 How do you feel? I had a wife I trusted in my life, and I found that out. >> Those ones in the >> Are you guys happy you tased me? Did that help you make you feel safe? Cuz it hurt the out of me. And I told you emotionally, my brother died 13 years ago after being tased. He lived 2 days in the deserts of Arizona and died. He had a heart condition. Tasing is not to be taken lightly, guys. This is the fifth time you've come for me. I'm good. But, I don't need an ambulance. I'm fine. >> Well, you're cut up a little bit. >> No, I have a dry nose. I got a dry nose. I don't have a knife. I'm just here to make sure you're in good health. That's my job. >> You guys are all hurting me right now, emotionally and physically. And I don't think I deserve to be tased to get out of my lawyer's office. And I came over here thinking it was a safe place. >> Okay, bud. Have a seat right up here. >> How can I sit Can you take I'm not going to sit. >> If you work with us, we'll get the we'll >> I don't want to work with you. >> Maybe work something out. Try it. >> You pull those cuffs in tight. >> Sir, I can't do it. >> Pull them out here. >> You're going to hurt me. I got both my knee and my ankle on my left side hurt. >> I'm not here to hurt you, okay? >> I'm I'm already scheduled for surgery on my knee. >> We're going to help you here, okay? >> You're not helping me. >> Let's take the cuffs off. >> Am I going to hurt you guys or >> No, not yet. >> Am I my words hurting you? >> Like I said, we're >> Are you realizing >> Are you realizing you guys maybe you're compromising yourselves? 1 2 3 4 5 6 7 8 >> What's your name? >> Ben. >> Let's get you Let's have a seat, Ben. Let's have a seat. >> I can't. My hands are behind my back and my knee is surgically >> We're we're going to help you get settled. Let's just get >> Yeah, can you just help me? >> I can't help you. >> Why do I have to cut myself? Do I look dangerous to you guys? >> Let's have a seat. >> I have no weapon. >> Let's have a seat. >> The only time I ever cut myself >> Let's have a seat. >> Can you take the cuffs off? >> The cuffs off? No, I can't >> Can you get my knee up, you guys? >> Yeah, we got you. Sit down. >> Can you get my knees up? Can you GO SLOW, YOU MOTHER Go slow. >> Stop yelling at me. >> Does that hurt you? >> No, I just don't want >> If I say something honest to you and you don't like it, is that hurting you? >> Try to work with us, bud. Which knee is is the bad one? >> Yeah, this one this one already had surgery. This is the bad one. >> Okay. >> And that ankle is a bad ankle. >> Okay. >> And I've got a torn meniscus And I've got high blood pressure They've got high blood pressure >> This is ridiculous. Is somebody speaking stupid or what? >> Jesus, guy, I can't even sit back. It's you're tearing into my wrist. No, you're not taking me to the hospital. Jesus, dude, I could outrun you 10 times. I'm 68 years old. You're a MF. You're a MF. Good luck with your next job. Have fun at McDonald's. I don't think they'll hire you. Take that police hat off. You're not a cop. You don't have an ID. You are a cop. >> You know that's the proof of the pudding. I like you. Okay. You're a good man. >> I appreciate that. >> I'm not getting another one blood pressure. I'm fine. I've never had a heart problem. >> Okay. Well, your heart pressure is really elevated. You could have a heart attack if it continues to elevate. >> Dude, if you got tased with your eye problem Get out of here. You're an idiot. >> I'll go tell Anna that. Yeah, you're welcome. Get him. >> I'm going to get out of here. >> We'll be leaving soon. They got to They got to get your paperwork. >> There's going to be a problem. >> They They just got to >> There's going to be a problem. >> They just got to get your discharge paperwork. >> Get him. >> I the >> Post-tased. >> Sir, it's a full ER. They're working on it. >> care what they're doing. >> That's great. Okay. >> for 40 years. My wife, I found out yesterday, she didn't tell me, I found out all three of my kids are not my kids. Okay? My wife called you and told you a lie. And you responded, and you didn't even ask me about the story. >> When was that? >> This morning when you tased me. >> And all we did We weren't there cuz >> Oh, I thought it >> We haven't talked to your wife at all. >> Well, no, she was the one that That's the reason that you guys were there. >> Oh, I see. We got a call from um Department of Human Services for They're They're saying, "Yeah, he was making statements and stuff like so >> Statements? >> like, "Can you go and do welfare check? Make sure he's okay." We're like, "Oh, yeah, sure. We'll go." >> arrest a guy for statement? >> No, they we >> I didn't have any. >> No, we had to make contact with you, and then the whole thing at the law office happened, and that that's how we got to where we are. >> Yeah. >> I >> You know my story, dude. I know I You told me before. It's a >> But, because we have to transport you in our squad car, by our policy, you have to be in handcuffs. But, you're being cordial with us, so >> now? They had them on both. They had a set on either hand. >> But, like I was saying, if you're being cordial with us, >> How do I look? >> Uh it's a little it's a little bit >> only thing that hurt. Did didn't hurt. The tasing didn't hurt. This hurt. The handcuffs hurt. >> That's why if we put them on the front, >> That's fine. You don't You don't do two sets of >> No, here. >> The two set and you put them so tight on my >> And then then what we'll do is we like that. >> That's good. >> All right. >> Yeah, they were too tight. >> Okay. And then what I'll do is I'll end up They have a double lock system on them, so then they can't tighten up anymore. >> My hands like this way. >> There you go. All right. So, fill me in. What happened? >> My wife lied to me for 40 years is what happened. >> You see You did a reverse look up like timeline-wise? Okay. >> Yeah. I took the date of birth, and then went back to conception. >> Mhm. >> I wasn't even around. >> Okay. It What You said something happened yesterday. She like closed up the cats. Was there something that >> Thursday. >> Okay. Was there something that that sparked it all? Or she just out of the blue? >> Well, I she Well, I I I started divorce proceedings, and she was paranoid. She was real I don't care about money, but she cares a lot about money. >> Mhm. >> So, she started to hide money. >> Okay. >> So, I couldn't get it. And I don't care. She can have I'm giving her the house, 100%. I got my business. >> Uh you were just telling me you just bought a farm up in Sheboygan. >> Yeah. >> There you go. It's a nice little plot of land up there. >> But, I I I probably will buy it. >> Um >> I got Yeah, I got 10 siblings, so I have some of my sib- they're all doctors and some of them have money, so I'll be able to buy it, but I hate to ask them. >> It's always weird asking your family for money, isn't it? Um >> Cuz people really value money and I like I don't have it, so I can't value it. But I don't know what it is. I mean, I know what it is. >> Right. I hear you. Yeah, but you you look at it differently. Yep, we're going to just slide back there. I'm going to put this key in Oh, yeah, here. >> I got it. >> What do you got? Uh we just have your Have your keys, though? >> Oh, they're they're in the this pocket. >> Okay. Uh the jean pocket, right? >> Yeah, right there. >> Yeah, all right. I'll grab those for you. >> Yeah, I was keeping them in that pocket. >> All righty. >> I tried to, but they were in here. I don't know where they were. It was my wallet and stuff. >> Do you have your wallet and cell on you? Your phone? >> yeah, wallet's here. >> All right. I'm going to cuz basically what is going to happen is when we when we get to the jail, they just got to do the whole booking thing and then, like you said, then then I don't >> to be put in jail? >> No, you go through the jail, but if you like you said, if you can bond out or they when you get there, you can you can call whoever you need to call and kind of get things going. >> dude. I'm not joking. I got nobody to call. I got one friend in the world and he's working today. He's a lawyer. He was going to drive up to the farm with me, but then he got a He's got some litigation deal. >> There you go. I'm going to We'll we'll slide your hands through. That tends to be the best route. All right. Are you um Is Benjamin your father? >> Yes. >> Yes. >> Okay. So, you are his biological children? >> Yes. >> As far as I know. I mean I think so. He's trying to sell me off as his as yesterday or three days ago. >> Okay. Uh and how old is your son? >> 26. >> No, three. >> Seven. >> Yeah, seven. >> And your son's name? >> Benjamin >> Okay, so he's a junior, okay. Walk me through your relationship with Benjamin and where things >> Well, you know, again, we've >> kind of fell apart. >> together forever and I've lived with him through other manic episodes. >> Okay. >> Um and some very depressed episodes where he's almost probably is in his head. >> Sure. >> Um This this time it just it just peaked and it's it's gone on way too long. He went off medication. >> Okay. >> He had shock therapy therapy about 8 years ago. >> Okay. >> Um he was so depressed and he shrunk at the time couldn't get him out of it medication or any other kind of therapies. >> I just want to kind of get a really good understanding of who he is and who the family is. Um obviously some of the stuff that we talked about earlier is concerning. I think it's extremely concerning for you to be put in that situation. Um for you guys to have to deal with it. >> You know, and and she has it on her back and arm punches here, too. >> Okay. >> We had her. But this one looks awful. >> Okay, that I absolutely That is >> I >> I am so sorry to to >> I The thing is, you know, he don't feel it when you're so You know, but I was trying to walk out of the door and he grabbed me. And then he he did punch me in the back while I was in the living room trying to get to the front door. And then he went back into the family room and threw me in chair and that's when >> Sure. >> Um he wouldn't let me go to the bathroom, he wouldn't let me get water, he wouldn't let >> He throws you in the chair. >> Uh-huh. >> What does he say at that point? >> I mean, he's screaming. He's irrational. Um It it was just just just all stupid stuff. You know, again, it was about about him not being the father of her kid, and how um lost must have been and how you know, if I want to sleep with anybody Wait, anyway, I don't know if you know some of the circumstances of being manic cuz you're very promiscuous >> Okay. >> um in most cases. And I think that I think he's just got sex on the brain right now, Austin. >> And I also think he is projecting his own sexual deviancies with like onto her. >> Okay. >> And yeah, and cuz you know, he's naming names of people that's in the sex ring with me. >> [laughter] >> That That I haven't She hasn't talked to in like 35 >> Yeah. >> Okay. Um you're in the chair at this point of time. Can you leave? >> No. >> Okay. >> No. He was leaning At one point he was leaning over to me. We were face-to-face and he told me he was going to break my nose, cut off a And um And then he changed his thing to I'm just going to cut your toenails off until they bleed. And he let me keep First he did have a knife. And he approached me and let me put it down. >> Okay. >> He told me that. And then >> god. >> Can you Can you describe that knife for me? >> Uh yeah, this was like a $5 knife from Kohl's Department Store. >> Oh my god. >> Is it a >> It was a stainless steel, a smaller chef's knife. >> Chef's knife. Okay. >> Like a paring knife. Now that you know, it's a little bit medium-sized knife. >> When he had the knife in his hand, how close did he come to you with that knife? >> He was He was right here. >> Right in front of you. >> Yeah. >> Did he ever touch you with that knife? >> No. >> Okay. Did he ever say what he was planning on doing with that knife? >> to cut off my >> Okay. Okay. Um so in this This seems kind of like a goofy question, but through all of this, did you ever give him consent to grab onto you, to punch you, to hold and >> One second. One point, um I had a perfect chance to kick him in the crotch. >> Okay. >> But I was too afraid to. >> And I'm it >> You know, and >> Honestly, it's probably better you didn't. Cuz >> It would have pissed >> I mean, cuz he was straddled over me, you know, right in my face. And then but he, you know, I was kind of I was kind of like this on the chair. And he was standing over me, and I could have done, "Boom." >> Okay. >> But I controlled myself. >> I just worry what would have happened if you did that. I I that is and that is such a scary situation to be in. After these 72 hours are up, it's kind of up to the court what they decide to do with him. Um he still has his due process, um still has the right to you know, to defense. He has the right to bail out. But what you can do is you can go to the court. It's going to be the clerk of courts, exactly where you were this morning, and you will ask for a TRO. So it's a temporary restraining order. >> Okay. You have it. Okay. >> You have that. Um and then that, I think I believe they give you 15 days, and with that there's a mandatory court appearance, and then at that court appearance what they'll do is the judge will decide. So they'll hear kind of all the facts, everything that's come into play, and then they will say, you know, 30 days, 90 days, whatever it is. That's not something I can do. I don't have the power to do it. Um but I do think that's important kind of based on where we are. Um I think it would be worth your time to at least get that. >> Mhm. >> Cuz I I I truly I can feel the fear off of you, I worry for you, and I'm sure your daughters do, too. >> Yeah. >> So is that something you guys could maybe help her out with if she decides to go that route? >> Perfect. So again, that's going to be the clerk of courts through Osage County. As far as today, um I wasn't here this morning. Uh I think they made contact with him at the attorney's office. >> Oh, wow. >> Oh, he's in the right living lobby. >> Yeah. Um I don't know exactly what happened. There was some disagreement, and he ended up getting charged with disorderly conduct, and I believe it's going to be assault on law enforcement or fighting with law enforcement. So that did happen. >> Okay. >> Um and that's what he originally went up for. That's kind of why he went up with. So, I I don't know how it all played out, but I know that they did have to kind of go hands-on with him and it turned into somewhat of a scuffle. >> Yeah. >> Right. Five visits to >> Do you know >> Yeah. >> Yeah, that's interesting. >> And again, I wasn't I wasn't I only came in at 3:00 and when I came in at 3:00, um we kind of got to the point where we thought there could be a bit more to this, especially with with what did happen. And I gave you a call and here we are. So. >> Do you Do you happen to know did um did the police go and visit him at the attorney's office in response to our call this morning? >> That's very likely the case. I don't know why else they would have just showed up there. I I think the way it started was it was like a welfare check on him. Or is that what you guys called in? >> Yeah. Well, yeah. >> has to be would do that. >> Yeah, but then it was kind of like, "Well, let's see what what DHS does." And then So, that's what I wasn't sure about. >> know the timeline, but they did make contact with him I believe at the attorney's office. And then whatever transpired with him and them, that was a first shift thing. Yeah, I'm I'm guessing there was they weren't he wasn't cooperating or whatever the case was. That I can't speak to. I honestly don't So, that's what he went up on. >> Okay. So, he's facing those charges then, too, which could mean that he's facing time. >> Yeah, I mean >> really. It just depends. I doubt it. >> When the mental health plays a big part in the rulings that the judges do. >> Mhm. >> Um sometimes everything gets thrown out and they say, "Well, you know, the what attributed to that was the mental health." A lot of times it doesn't. And I I don't know. It just kind of depends on what the facts of the case are and who the judge is. And then the big thing is going to be My understanding right now is that he was actually taken on a chapter. >> What does that mean? >> So, this morning you guys did a three-party petition, and that was for mental health, correct? I don't know if he was chaptered based on your petition or if he was chaptered based on behavior that he exhibited once he was in the jail. That I don't know. All I know is that Ozaukee County took him to Aurora Grafton for a uh >> Oh. >> Um So, yeah, that's my understanding. >> Chaptered means he goes to a hospital. >> Right. And with that, I believe there is a 72-hour hold. >> Okay. >> And you can >> It It varies. >> Okay. >> So, it's it's 72 hours or until um evaluated by the uh uh >> Okay, so it could be more than the 72 >> be more, but it could be less, too, if they approve like competency and things like that, but they're They're They're sound. >> Mhm.
