Hello, I'm Cop with Sheriff's Office. >> Hi there. >> Hey, how are you? >> Good. >> What's going on today? >> So, we had a selection on this gentleman. He selected his merchandise. He went back and forth. He hovered there at the door and then he walked out the door. Uh my uh partner stopped him about there. We identified ourselves as AP. He has not paid for any of the merchandise which we have back at the office. >> Okay. >> Once he came back to the office, he refused to give us our his ID or told us who he was. >> I said I wanted to pay for this stuff. >> Once you get I was too late. >> I wasn't trying to steal. I'm just >> I'm just reading and crazy. >> I'm going to read you something. Okay. >> Uh I'm going to read you something. Okay. You have the right to remain silent. You understand the rights that I just write to you? >> Most of them. >> What don't you understand? >> I don't understand why I can't pay for this. >> I'm going to read this to you again. >> I'm going to read this to you again. Okay. You have the right to remain silent. Anything you say can and will be used against you in a court of law. [music] You don't answer that. Can keep your hands out of your pockets. >> You have the right to remain silent. Anything you say can be used against you in a court of law. Do you understand the rights I've just read to you? >> Yes. >> Okay. >> So, you walked out of the store with all that stuff and you pay for it, right? >> I have gotten old and absent- minded. >> Is that correct or not? >> I guess so. I got to about here and I was getting ready to turn around and go back in cuz I realized I hadn't paid for it. >> Okay. Um, the other way. >> Okay. So sir, you are detained for a shoplifting investigation. Do you have your ID on you? >> Do you have any weapons in your pockets or anything like that? No. >> I really am absent minded. I've done this a couple of other times and I've turned around, walked back in. >> Okay. >> Cuz I'm >> So why didn't you provide them with the information and you guys could have squared this away if you would have been willing to talk? >> Well, I I I said >> let's come over here. out of everybody's way. >> So, what are you you saying? You're not going to call the police and you'll let me pay for this? >> And they said, "Well, I didn't have just gone with a trespass warning had you had you done that." >> They probably just would have trespassed you here from Home Depot rather than calling us. >> Well, no. The reason for at that point I said, "Well, you're going to call them no matter what." I said, "Well, I don't know what to do." I said, "Well, then of course I felt like leaving." So, >> okay. >> But, but I said, "If that's all they were going to do, of course, I give them their trespass." and all they said what he started off by saying was I just won't be able to shop at Home Depot for 3 years I think it was >> and I said well if that's it you're not going to call the police then fine I mean then that's good and then all of a sudden they so well I didn't say that >> I said well then we write the trust >> why are you saying we write trespass normally they just call us for that ride it up and call it a day >> now I don't know what they want to do cuz they walked away so my partner's going to go find out but we'll see what happens now I probably aggravated them because I wouldn't do what they wanted. But well, like I like I said, sir, I mean, >> I really am. I've gotten old and absent minded and >> whatever. Anyway, but um if I known it, that's all he was going to do. >> But when I said, well, you're saying that you're going to do this call trespassing and not >> I understand that you thought that if you weren't going to get in trouble, you would have complied, but you already stole from the store >> at the point that you walked past all points of sale, you committed the crime of shoplifting. >> Well, I didn't realize that, and I didn't mean to. You did do it though and they didn't mean to do it cuz nobody just walks out of the store with items in a cart and don't stop at shop at cash registers that are all the way at the end other end. >> You understand this is the ent door. That's the exit door with the registers over there, right? Have you shopped here before? You ever been to Home Depot before in your life? >> No. >> Okay. So, that's how that works every single time. It hasn't just changed today just because you decided you want to steal, right? You came in, you exited through the enter door cuz you're trying to get past everybody and not get in trouble. Well, what what can I do to go back to >> I don't know. He said we could bring him back to the office. >> All right, let's go back. >> He's out of this room. >> If he if he hadn't said that, >> she's getting an amount. >> She's giving you an amount. You want me to grab your NCA and trespass? >> Oh, no. No. No. >> Just trespass. >> Yeah. >> What? Oh, Dixie. Right over there was a brown chair. >> Eugene solid plastic virus. >> So, Eugene, we're both adults here, right? You know, you left the store without intent. >> Feeling like an adult. >> Well, I I can understand that, but you know, we both know that you left the store on purpose, those items, right? >> Yeah. might this won't make any sense to you, but my thought was >> I've got all these different possibilities and I want to I don't know which one to get and I'm tired of buying stuff and and then bringing it back and going through all it takes I spend my life bringing stuff back. >> You just wanted to go over there, test the stuff out at your house and then bring everything else back. Is what you're going to do? >> Yes. Then >> so that makes sense. >> I mean that was the thought which is stupid. It's still a stupid thought. I know. But just so you know that's what I was thinking. Okay. >> So, a total at the bottom. >> No, but the total is 190 and 25. >> 19025. >> Do you copy this? You have your own? >> I have my own. >> Perfect. >> I have BL. >> Yeah. What would you guys like to do? >> We want to prosecute. >> Yeah, if if we have to call you guys out, but >> I'm 100% with you. >> Quite frankly, they have $100 for you anyway. But >> we were trying to work with them. >> No, I I understand. >> Yeah. I just find something for you. So, I find you guys. >> Yeah. >> Just doing a little bit of plumbing work, huh? plumbing on the traffic hazard from 20th and 50th. >> How much is that worth? >> That's got to be something expensive, huh? Yeah, that's a that's a popular one, especially for the uh it's the rage now, I guess, to cook your drugs with a low shot. >> Uh 27. >> Wow. >> Really? Yeah, that's a good deal. >> I always thought it been way more expensive. [laughter] >> I was getting You can see multiple um >> different sizes. Yeah. >> Some have different fittings. >> So, what were you working on? >> It's a pump. It's a what do you call it? Shut off valves. >> Yeah. and for so you can have female male fittings blah blah and I wasn't sure if it needed to be soldered [music] or not. That's why it said that's why I got the blow torch at the last thing. I said, "Oh Jesus, I don't know what I'm getting it done anyway." >> Yeah. >> And it's it's actually for insurance, you know, when you when you get insurance every year. I didn't realize this, but they you take pictures of different things and they sent back these pictures and said, you know, fix fix that because it looks like it's rusty. It looks like it's possible that it might break and leave to pay insurance. That's what I'm trying to fix. This is my third trip here. >> Well, I went to Lowe's two other times. So, >> that's sir, it's not like I can't afford it. I mean, that's why I'm sitting there going, I can afford this. It's just >> Yeah. >> Dumb dumb. >> Yeah. >> I agree with you. >> You need a size? >> Yes. So, if you can print your name up here first. >> All right, Eugene, here's your driver's license back. >> So, this is a trespass warning. Okay. What this means is that from today going forward, you cannot come back to this Home Depot. Okay? You can go to any other Home Depot in any other town, just not this Home Depot. Um, there's one in Sebastian. You can go to that one. Um, this does not expire. Okay. So, if two years goes by and you're wondering if you can come back, the answer is still no. If you >> How long? 3 years. >> No, it it does not expire at all. >> Um, >> you said 3 years. >> Yeah. No, does not expire at all. Um, if a couple years goes by and you want to come back, you'd have to call them, speak to a manager, and see if they would get rid of the trespass. Okay? But otherwise, if you do not call, this does not expire at all. Okay. >> I mean, I won't come back, but what happens if I did? You'd arrest me. >> You'd be under arrest for trespassing. Okay. >> So, if you could just go ahead and sign here. It's just acknowledging what I told you. Okay. >> You good to go, Mark? >> Uh, I need one minute. >> All right. Just wait one minute. All right. Trans back. What am I? You're under arrest for shoplifting. What? I thought it was >> I'm going to put a second set of handcuffs on you. Okay. Just don't move for me. See, my shoulders are a little tight. I don't want you to get hurt. Turn this away a little bit for me. I'm going to search you real quick. Am I going to get stabbed, cut, poked by anything? >> I've got a a little a little knife in my >> So when I asked you if you had any weapons on you, why didn't you tell me weapons? >> That is insane to me. You had all the money to pay for everything. And I was just going to show you that >> for me. I can go to Lowe's. I got >> refund that I can use. So >> So I was telling you the truth. That's why I brought it out for you. >> Putting all of this into your wallet. >> Is this yours? Did you bring this with you or did you take this? that looks like the one has been used. >> Yeah, cuz I I was buying a one that's got >> Okay. So, this one's yours. >> Yes. >> Okay. I'm going to check the other one. Just make sure that it's not open. >> Yeah. >> This will have to go into safekeeping at the sheriff's office. We are not going to allow you to take this into jail. Okay. >> Start walking this way. Um, Corporal Evans will be back in just a second. Okay. We go secure him. Right turn, sir. >> All right. All right. We're stopping right here. Before I take you in, I have to let you know one time before we go there, if you bring anything that would be considered contraband to the Indian River County Jail, it will be a felony charge. You don't have anything on you that I need to know about. I see two pens right here. I'm just going to grab these. Okay. >> Not that these are anything bad, but >> go ahead. Hop on it for me. Take it very slow. If you need to need help, I can give you some help. There you go. All right. Were you filling it out or was the other jam out? Okay. See, >> it doesn't have to be anything crazy. I'll stay here till you're done. That >> way. >> What? What happened? How come I couldn't >> You committed a crime? >> I mean, they said just trespass. >> Uh, they didn't say just. They They wanted you to be trespassed from the store, and they want to prosecute for the crime of shoplifting. Uh, do you live alone or do you live with anybody? >> With my girlfriend. >> Your girlfriend? Okay. Um, do you know her phone number or do you need it off your phone? >> I don't know her phone number by heart. >> So, when we get to the jail, I'll let them know you need to get a phone number off of your phone to see if you can't bond out. Um, misdemeanor charges are a standard $500 bond. Um, and if you if you call her as soon as they start getting you processed, once they allow you to make that call, you could be out before I'm done even typing up the arrest affidavit. So, just let them know. Do you plan on I mean, you may have enough if you call a bondsman in your pocket. How much money did you have with you? >> I think maybe $200 can. >> Yeah. So, if you if you talk to a bondsman, you have enough money to cash out. So, um it is their their minimum is $100 uh or 10% of the bond. So, uh, you could you could definitely bond out with that. Uh, you'll just need to call her to come back get your car and everything. Um, and speaking of your car, uh, it's here in the parking lot, I'm assuming. Okay. What kind of car is it? >> Okay. [clears throat] >> Are you going to plan on bonding out today or you going to stay in jail? >> Oh, yeah. No. >> Okay. I I have to ask. >> And I And I want to try to do it myself, too. We just [clears throat] got just got back from Washington DC. >> Wow. >> What'd you do up there? Just vacation. >> Yeah, we both I'd had a contract up there for a few years, but all I did was go back and forth and make sure everything was going all right. >> Never got to see sites. >> Yeah. And she lived in uh somewhere in Maryland. And she used to work in DC for I don't know 15 years or something. Wow. She did the same thing. Never went to visit anything. >> Wow. So we said, "Why don't we go on vacation and go up there and go see stuff?" So we spent seven days going in and out of everywhere we, you know, until we got tired and couldn't walk anymore. We did that. So >> that was fun. I mean, we had to get a what do you call it? A letter or something from the congressman to be able to get a tour of the White House. >> Wow. All that stuff. >> So So I I assume there's nothing I can say to them or do to stop. >> No. So, >> what was I mean to them or were they going to do this? >> At Home Depot is kind of finicky. It depends on the the value of the things you took >> um for their uh their policies and everything if they're going to prosecute. I think it's over $100. They prosecute no matter what. And then if you are uh >> complant, you're you work with them. You do whatever they want to do. You know, you give them your information, they get you trespass, and they may that may be >> under $100, you know, but it's >> it's their choice. you you commit the crime, they decide if they want to prosecute. If they don't want to prosecute, trespass at the end of the day, >> they wanted to prosecute today. >> Um, yeah. >> And like, we both said I mean, we both said I known that was what they were going to do. Of course, I would have >> Well, yeah. I mean, but they they're not going to threaten you. >> Sorry. >> Yeah. If you need to lean over a little further that way, too, you can, but yeah, they're not going to threaten you with non-compliance, you know? They don't want to they don't want to spark something because they never know who you are. They never know if you have a knife or a gun or something like that. >> Oh. Um, so they they try to work with you. If you're compliant, they bring you back to the office and they work on stuff there. If not, then they just call us immediately and we try to pick you up at the parking lot. >> To it and sign and all that stuff. Perfect. >> You want me to just turn it? >> Uh, I got to type it word for word what it says. Unless you want to take a picture of it, send it to me. All right, sir. Stick your leg in there. Only thing you got to put on there is just >> Gotcha. >> Okay. >> He was charged with retail theft. >> He was sentenced to 12 months of probation, 25 hours of community service, and ordered to complete an anti- theft course.
