She dipped it or she tossed the product into an aisle and then she just started eating it and everything. >> Okay, but we can't prove that, right? >> Yeah. Yeah, we we just have for sure ticket switching. And concealing it. And concealing it, yeah. And then she grabs whatever that is right over here and then conceals it in her purse. And is the part of her concealing it on video, too? Yes, I You'll see right here real quick. And she had like a knife, too. That's why we also called you guys or switch blade, whatever it is. Yeah, she'll go to clearance and you know the yellow tickets that are marked down or whatever. >> Yeah. She'll go to clearance and then get a couple items from clearance and then she'll walk around to take that ticket off and then when she gets a chance put it on stuff that she has in her cart. >> What items has she done that to? She has like this box thing. I don't know where she got it. Do you have the video of that of her grabbing it and putting it on? It should be on 26. Yeah. [Music] Hey, what's going on? Put your arms behind your back. What What did I do? Put your arms behind your back. >> What's happening? Pick this up. Excuse me? Pick it up. Put your hands behind you. Why? You're being detained right now. For what? Excuse me? >> That's what you're being detained for. Theft. Full data, can you please help? For theft? He literally just paid for everything. Excuse me? [Music] So, we'll see what they Do you guys need anything? Yes, we'll take all We'll take everything. Why? I don't [Music] Yeah, she was We'll just double check these before you sit down. [Applause] Have a seat right here. Sure. Take a step forward. Mhm. Wide step apart. Mhm. So, I did put more things in my bag. You did? I'm sorry. You can just take them out, right? And then it's fine? Okay, no, no. I don't go to jail for that. Have a seat. I'm I'm Have a seat and if she if if You don't go to jail for that. >> what if I pay for them real quick? Why didn't she pay for them? Because I'm I didn't ask. I'm sorry. You committed a crime. But he can pay for them. No, he can't. He can't pay I'll pay for whatever it is. If she had the chance to pay for it. >> That's just I'm sorry. I'm sorry. I mean, I didn't take nothing, so Yeah, she scanned it for 94 cents. It was $94. So, it cost $94, but she scanned it as 94 cents. She put this on. That's like saying, "Yeah, I killed him, but I'm sorry about it now." I mean, literally Okay, just cuz we're sorry about it doesn't make you not guilty. No, you can't. I have the money, dude. I wouldn't even All right, so this is one thing that's scanned. Did you pay the full price for everything? I mean, we got clearance stuff. Were the clearance tags on them already when you picked them up? Yeah, we went shopping in the clearance lane, all the different clearance lanes. >> Wait, hold on just a second. I'm going to explain something to you guys real quick, okay? The officers got to question both of you about everything that happened today. Before you give the answers, I want you to stand up. You stand up. Come over here. Look at all these cameras. Okay, we've been watching you the entire time. Have a seat. So, before these officers start asking you questions and before you answer, keep in mind that that's all those cameras. You've been watched the whole time. So, before you give answers about tags were already on things and you just paid clearance items for them, you might want to think real long and hard about the answers you give, okay? All right. Yes, we're good. Wow. All right, so this is I would have just paid for these things, man. I'm sorry. It's all It's all right, man. No, this stuff I took I didn't mean I'm sorry. I was going to pay for I mean, it's not I mean I know. I'm sorry. That's what I'm trying to say. Stupid stupid stuff. Like I mean, I didn't even [ __ ] realize. This is I'm I'm cuz you did I guess I was seeing what's going on. You obviously clearly see I didn't do anything. Can I The officer's going to talk to you about all that. >> Okay. What's your ID, sir? I don't have any ID. You don't have any ID? Yeah, it's in my wallet. In your wallet? Which Which one's your wallet? Right there. All right, yeah. It's really uncomfortable for me, you know what I mean? Well, when you are privy to crimes being committed, I Listen, I didn't do I'm not privy Listen, I did not have nothing to do Okay. I promise you, dude. I don't even believe you. He's going to talk to you about it. Don't worry. I'm talking to you. Am I going to jail, too? I don't know. I can't answer that. I literally paid for my stuff, dude. How'd you guys get here? Right. Uh vehicle. Vehicle? Who drove? Huh? Who drove? Did you have a valid license? Uh yeah, which I don't have any I'm sorry. My record or anything. I just don't know where it is. This is the Which is I don't have a problem in another state. Everything that's right here is all in her purse. I I would have paid for it. Dude, I don't know what you're talking about. I went back there and bought me a tire. I mean, like I'm doing like I got a couple things. She got a couple things. I paid for them and that's the end of it. I mean, you come snatch me up and I'm like, I don't I don't even like I don't give a [ __ ] I mean, I don't know what I did. I don't know what I did. I I didn't came out of prison in my life. I did like two years ago, but I don't want to go back there. I mean, I'm a good dude. I don't know. What are you in for? Huh? What are you in for? Well, it was in for from my baby mother and me. I was with her for 13 years. It was burglary, but it wasn't It wasn't a real burglary. I was my own house. I was with my baby mother 13 years. We had three kids together. And I was 30 with my oldest son. That'd be 18. My other son's going to be 13. And my daughter My daughter is um 10. You know what I'm saying? Me and her still all right to this day, but she just You know, we're going through a separation and she's a little psychotic. But if you look at the police report on that, it's not even It's not actual burglary. I think baby mother drama and all that crap. I think it's baby mother drama, not baby mother drama. So, was he with her at any time when she switched tags? >> No, near the end in the sense and this area. But the whole time it was just her doing all the stuff while he was in this area in the auto section doing whatever he was doing. No e. [Music] Is there a monetary value for a theft? Obviously, if it's not a felony. >> Not a felony. Okay. And I don't think they reached the threshold. I don't think they're at 750. If they're not at 750, they would have to add them subtotals for This one's 48 bucks. This one's 143 bucks. So, I don't think they're too much. Excuse me for a second. So, you live all the way in South Tampa, why you coming here to shop? I had to get a tire. They don't They They don't have ti- They don't They don't They don't Okay. Okay. I came down here cuz I don't think so. I don't I don't have a problem waiting out there. All right, so go sit up for me. Face the wall. [Music] [Music] Remember that uh the guy off of future 50 caliber and actually needs you guys. I wasn't here to switch the tags. So, you were. Who's at the DUI? Nope. So, for right now, I just need you to collect your stuff. You're more than welcome to wait outside to see what happens, but for right now, you are free to leave. Okay, I mean is there any is there any possible way that she would be free to >> We'll talk about that outside, okay? Yes, sir. I mean I I guess I would be I'm more than willing to pay. Okay, yep. We'll talk about that stuff outside. >> Whatever the cost is, Yep. I'll I'll pay it. All right, if you just want to wait outside and give us a few minutes, I'll be out to talk to you, okay? So, this is going to happen, ma'am. We have a program that's called APAD. It is for first-time offenders. So, if she's a first-time offender in theft, Yes. she'll be APAD eligible, means she's going to get almost like a court date for community service. Okay. Uh and as long as she fulfills all her obligations, uh it won't count against her record. So, she won't be arrested today, then? But if I'm waiting for dispatch to confirm. So, I'm assuming you guys came here together in a vehicle. You want to wait in your car? You want to wait out here? I'd like to wait to see what happens. >> Okay, I'm going to close this door, then. Is there any way I mean Hey, ma'am. That's something you guys should have talked to her before this [ __ ] happened. All right. I mean I'll pay I'll pay Bro, this ain't my store. I I get it. This ain't my store, you know what I mean? That's That's That's Walmart. Walmart wants to continue, so we're going to Yeah, but cuz they're I mean do they want they're not willing to take >> That's what we're That's what we're going to talk about, all right? Just wait right here. Did you pay is this stuff he paid for? I mean I paid Yes. I'm going to double check with her, but I'm pretty sure. Okay. Ma'am, I have to read you something, okay? No, don't read it. He'll seriously literally pay you everything. All right, ma'am. You have the right to remain silent. Do you understand? I need a verbal yes or no. Yeah. Yes? Yes. Having these rights in mind, do you wish to talk to us now? Do you wish to answer any questions? I mean if you have questions, yeah, but I'm pretty sure you just already decided what's going to happen, so So, he just needs a verbal yes or no if you're willing to because Yeah, that's fine. I don't care. Well, you know why you're here. You know why you're in handcuffs, okay? Um we have reason to believe that you committed theft here at the Walmart. There is There's video evidence of of you putting an item in your purse. >> I did. There is video evidence of you putting tags on merchandise that did not belong to that merchandise. I paid a cheaper price. I did switch that. He didn't know about that, honestly. And that's why he's in handcuffs. Okay, so then it was this a spur-of-the-moment thing? Did you plan to do this? Uh no. I just I just You saw somebody else do it before? You're like, let me try this out. I I had a friend who had done it and it seemed like a phenomenal idea, which I'm sorry, that's ridiculous. I'm sorry, but it I did It's obviously not a phenomenal idea. No. I won't do it anymore ever again. That's crazy. >> So, when you walked into the store today, was that your plan? To switch Not really, no, but once when I hit the clearance aisle, I kind of just I remembered that. Okay. I'm sorry. This sound That just sounds ridiculous when you say it. I'm sorry. So, you you went to the clearance aisle, you saw hey, these prices are a lot cheaper, let me take these stickers and put them on higher-priced items. Is that correct? Yeah. Okay. Yeah, I guess. It's not like I had a conscious straight-up conscious regular straight-up consciousness about it. I just kind of I was like, oh yeah, she did the thing. I wonder if that would work. How'd that work out for you? No, it has not yet. Okay. Don't plan on trying it again. I am Have you been arrested before for theft? Yes. However, it was um I forget the word for it. It was Dropped? Adjudicated? >> I don't I'm not Was it in Hillsborough County, Pinellas County? >> It was Hillsborough. Okay. The security guard at the Walmart down there we went to the same high school and they he had a picture of me looking at something that I later bought, but because I bought it later, the receipt didn't help me. I had a I was window shopping one day for it and then I went back and I Anyways, it's a long story. Hillsborough I ended up paying the restitution of $20 for the bicycle headlight that I had already purchased. >> What How long was this? Few months. Few months back. Okay. That was a whole headache. I guess it's kind of like So, as of now, you guys good? Are you sure that he can't pay for everything? We're waiting just to find out what happens. We got you. So, as of now, you have you put $48 worth of merchandise in your purse Holy [ __ ] that they scanned. I had no idea. I'm sorry. And you switched tickets and scanned items that are worth $143.98. Okay. That you uh Can he just pay that? >> That is not up to me. Okay, that is up to the store. They They are the victims. >> I'm so sorry. I literally will never do it again. I swear to God, he'll pay you back. Total was like less than $200 No. Is there anything that I can do? Anything at all? You grab I feel like there's got to be something. Huh? Like I'll make a Walmart commercial or something. What was that? What was it? I grabbed the They have her for the the tinks, the folding knife, Yeah. the off, and the clear view. The off and the purple one. Yeah, so that's that's what they scanned. So, that's $4.98. I'm sorry. $4.98. [Music] I mean that people don't >> Did you guys look at her items to see if you grabbed all the stuff that she Yeah, yeah, we went through them. Yeah. You grabbed the other item? I didn't see it. So, this is what's going to happen, okay? We're waiting for confirmation from You guys can't have anything to do with my paperwork or not and they can't say anything whether I paid for it or not. So, like who is that up to? That is up If that's a Walmart If it's a Walmart policy, Is there an actual policy about it or do you guys just not want to let me do it? Okay. This is I'm not trying to be a I just really don't want to go to jail for this. >> Well, this is what's going to happen, okay? I'm checking with dispatch. If you have no prior theft convictions, we have what's called an APAD uh program. It stands for I don't know what it stands for, but it stands for something. It's a diversion program, okay? Cuz the jails are full and they want to have one-time offenders learn their lesson. It's pretty much community service. I will tell you I did go to jail for that theft I told you about, but it was dropped. Okay. Did you Do you have her name? Yes. Yes. [Music] So, APAD is only for prior theft, so it has nothing to do with her new one. No, it has to do with all these thefts. I don't have any of those. Well, Not no charges. April And they What's to do with the drug drug stuff, then? It was all dropped. Everything was dropped. So, there's no case There's nothing outstanding. There's nothing that tells us the status of the case. What? Yeah. I literally was in jail for it and it was dropped. Like it was it literally was I was um I was at a park and the police came up on me and my boyfriend at the time and there No, no. There was paraphernalia around us and they tested it and it tested positive for whatever. And so they arrested us for the stuff that was around. It was at a homeless camp. So, like there's a lot So, here's what's going to happen. You're going to be trespassed from the store and this parking lot. If we see you anywhere in the store or near the parking lot whatsoever or in it, we're going to call PD and they're going to have to see what happens. Okay, I understand. Do you have one? I do. Yep, and it's going to be indefinite, by the way. I understand. They call, we spot you here, we're going to check it, you're going to get arrested for trespassing, okay? So, don't Do not come back here. So, now I'm Dispatch is going to check cuz Tampa doesn't tell us the disposition of that felony. Yeah, it's really everything is dropped. Okay, well If they can't confirm it, I can't take your word for it. >> How would they not be able to confirm that? Cuz Tampa doesn't talk to the rest of us. So, what if what if that you're going to talk to Tampa, right? Like They're They're doing all the talking, yeah. Dispatch is trying to figure out the disposition. >> like get a hold of Tampa, is that what you're saying? Correct. Tampa can kiss my So, they're they're going to figure out Well, you wouldn't have gone to jail if you didn't push your new Sorry? Oh, no, no, no. I mean when I went last time, I I was there You got her info? Okay, so I bailed out on the um the Let me explain the program Sorry, yes. in the event that you are eligible for the program. Okay, uh and let me get this out of the way. I get no pleasure in taking people to jail. I get I get paid the same whether I'm drinking a coffee or I'm putting you in jail, all right? Putting you in jail is more paperwork for me. I don't want to do that to you, honestly. Well, okay. Well, you shouldn't have shoplifted. I should not have. You shouldn't have walked in my Walmart. Uh so, the APAD program, they're going to check if you're eligible. If if you're eligible or not and and we figure that out, it's almost like a community service. You are agreeing to present yourself to court. >> You're You're You're um telling the courts that you're going to show up when they tell you to show up and you're going to do whatever they tell you to do, whether it be clean up a highway, do whatever you got to do. Mhm. And then this charge does not stay on your record because you fulfilled your APAD uh criteria, okay? Um I don't want to have a record. If you are not eligible, then you're going to be charged with theft, you're going to go straight to jail. Right, right. So, I have zero record. I know this for a fact. Like it was Everything was completely dropped. They couldn't They There was no weight. I didn't have any drugs on me. It was just paraphernalia that was at the place where I was. So they couldn't there were no nothing they could actually charge me with. You know what I mean? Cuz I didn't have anything on my person. Yeah. I didn't have any there was like a baggie they found next to me. >> Yeah, something. >> Something. Oh, you ate pet chee chee? My little ate pet chee chee. Uh so >> so familiar. I'm sorry. I'm I'm like weirdly looking at you. I'm not trying to. I'm sorry. Convictions must be reviewed to determine eligibility. No misdemeanor convictions within 2 years. No felony convictions within 5 years. Withhold of adjudication is considered a conviction. No disposition will require or further investigations and no sexual offense. None of that. What's withhold of adjudication? What's that? Like that they decided pretty much like not to prosecute. They got you. They're like, "Hey, we're not going to do we're not going to do charges." So like the charges aren't dropped. It's like I don't know. It's kind of like it's weird to explain. >> So it's like not a dropping? Yeah, pretty much. It's like keeping like the history. >> arrest? It's like keeping the history. And then but >> But it's like saying like, "Hey, like we can put this on your record but we're like pretty much like not going to." It's like the court like almost like doing you like a favor in a way. >> That's a get out of jail free card literally. Yeah, pretty much. Could you explain more of that? You said that does not count or that does count? >> Does count. So you can be in the program if you No, so if you have a withhold it's considered a conviction by the program. >> think that's what happened with me. I'm pretty sure everything was just dropped or released. What is what is released? They let go of you. Is that No, I'm sorry. I'm just trying to remember what it said on the the thingy in the the You're good now. I'm right here. Okay. Um I was trying to get her clerk of court her misdemeanor shows that no prosecution. So but in the uh but the felony one doesn't say anything just says released. So I'm going to try to put all your stuff back in here, okay? All right. Do you know anything else? Say again? Are you still waiting to hear back from them? Just cuz it's Tampa that's holding Really? It sucks so bad. Why don't they talk to you guys? Everyone is so much nicer here, really. I'm missing Well, it's like they do but it's a different uh district court so they type things up a little differently. Yeah, we're not waiting on Tampa PD. When I say Tampa I'm waiting on the courts. >> I got you. >> Yeah. It has nothing to do with Tampa PD. >> don't like sync up. Tech I'm going to put them in my car in my window right here to get last minute info. Get them in and just wait to see what's going to happen. >> What's all that for? This? I'm going to have to Is that like a deadly weapon type stuff? Yeah, this is going to get yeah. Got you. It's weight. The bag stuff. Yeah. Creams and sprays. No go. Okay. Um so if you want to leave the bag I'll >> Some of them are were already mine. That's fine but they can't go. >> can't take them. I got you. You can't take them. All right. I'm yeah, I'm I like I don't like the way it's >> You want to be ready. So in the event that you do have to go to jail this is already out. You're gone. Better get out. In the event they say, "Hey, you're you're good. You're going to get A padded." >> Which is totally what's going to happen. >> We just put this in another bag. Now you have two bags to take off. That's totally fine. That's what's going to happen. I'm going to >> I'm going to I'm going to take you outside with me. Uh I'll put the truck out. Okay. Yeah. >> also I need you to put the trespass paper that you took from me. >> Yeah, I'll I'll fill this out for you. Yeah, okay, cool. I just don't want to be No, no. I'll fill this out for you. All right. Peace, guys. Okay. I have to I'm sorry. Yes, sir. Yeah, just cuz Um do what's what's Where'd Steven go? Do you know? I couldn't tell you. Okay. >> know what he I don't know What does he drive? And there's a big trailer on the back of that. I'll tell you that much. Pickup truck, SUV? Oh, Land Rover. Why would he just leave like that? No, he wouldn't leave. He couldn't. He's probably waiting. Yeah. Oh, I mean if you do see him would you let him know what's what's going on? I mean I hope he doesn't see me getting put in here right now and freak out. I hope I don't freak out right now because I this is >> I'm going to be in here with you. Oh, good. Thank you. >> Yeah, so it's not it's not just the You good? I have shorts on under here so I'm You good? Yes, thank you. >> Okay. She was charged with theft and ordered to pay a $550 fine.
