good afternoon this is Daniel with cops and cons TV just want to welcome everyone into our live show we're going to go over some of the most interesting and important cases in policing that happened within the last week so as I'm going through these stories definitely put your thoughts in the comments if you think I'm right track wrong track definitely like to do some back and forth with everyone while we're going through this show and again just want to welcome everyone in looks like we have a couple people watching or one person watching from from Oakland County Michigan we've got someone from Germany and uh let's see uh from Florida and Missouri it looks like great well thank you all for thank you all for being here like I said as we're going through these stories definitely go ahead and put them in the chat so the first thing that I want to say right off the bat um there's been someone who's been asking us to uh talk about a case or look into a case that really hasn't gotten any national attention you know being where where we're at um is I've said this before that some stories are National stories and some stories are local stories and this just happened to be a local story out of Cherokee County in North Carolina that it was must have been a local story because at least I followed these issues pretty closely and just haven't seen this on the national level so someone has asked us the last couple weeks to to talk about it and we are absolutely going to uh we are absolutely going to get into that later on here in the story officer blue gone good afternoon I know we were going to talk about this this one yes absolutely because you remember last week where someone was getting irritated with me that we I haven't gone through it yet but I promise we're going to get to it today I absolutely looked into that case um again make sure to follow our channel here at cops and cons TV and almost as important as that if you want to share this uh share the channel share the live feed um with anyone just so just so you um we can get as many people in here as possible and again my name is Daniel if you want to go ahead and follow me you can follow me over at police law news really everywhere um that's pretty much where I do my Social Media stuff on all right so the first case that we're going to talk about today and really this is this is a tragic case but the first case we're going to talk about is the mass shooting that happened at Michigan State University so earlier this week at Michigan State University there was a mass shooting essentially an individual he's a 43 year old with no real ties to the university a name Dwayne McRae uh he was 43 years old he walked he has a he did have a history of mental illness and he did go into the he did go into the into the school and he shot eight different people he killed three students and he wounded five more uh after that he left the scene and he left the scene and police officers were able to hunt him down pretty quickly now we've talked a lot about we probably in the last year we've probably talked about uvalding literally more than any other police case out there which is probably the right thing to do and the main reason is because obviously that was such a poor response from police this was a good response from police So within minutes of 9-1-1 calls starting to pin reference an active shooter hundreds of police officers from many different police agencies local County state federal all descended on the scene in order to try to make this scene safe they ended up finding uh this this the the offender they ended up they ended up finding him uh holed up in a house um it kind of like a coward he was cornered like a rat and as the police officers were closing in he did the Cowardly thing into the Cowardly thing and he killed himself um but that was uh that was a a tragic case that happened um looking at this guy's history because that's only always one of the things that we look at and I should just say that you know when this mass shooting was going on it was an active shooter situation that social media was filled with students sharing videos um of being locked down and you know essentially the idea of hide run fight uh that was uh reiterated by by the school and by law enforcement experts everywhere that that's what you should do in a situation like this and whenever something like this happens it's reasonable to look at the person's history just to kind of see as a as as law enforcement as as family members as friends as acquaintances or neighbors was there anything that was missed how is there anything is there any process is there anything in this system that's already built in where something like this could have been prevented so when it comes to this case uh Mr McRae in 2019 he was charged with a felony when it comes to a gun and essentially what that charge was is uh in 2019 he was stopped by police officers they searched him and they found a concealed weapon now in Michigan carrying a concealed weapon without a concealed carry permit is a felony so he was charged and he was arrested for that felony the maximum penalty was five years in prison now because he didn't have a big criminal history just to be as transparent as I could be it's unlikely that had this case gone to trial he probably wouldn't have gotten five years but that is the legal potential of what he was facing was five years in prison however instead of it going to trial or being stuck with the felony charged the D.A played it down to some misdemeanor negligent use charge he actually didn't serve any jail time and he had 18 months of Probation and he was let out now have he been convicted of the felony even if he didn't do any jail time had he been convicted of the felony at least well at least on paper he would have been barred from possessing you're owning any Firearms now we say that you know I say on paper because well I mean you know legally he's actually it's against the law and he's barred from killing people and you know that law didn't seem to bother him uh didn't seem to bother him um anyway so uh you know it just seems like those who violate our murder laws you know really probably aren't going to follow our gun control laws but he did have a gun charge from 2019 um it really wasn't taking all that serious and you know we can talk about gun crimes and these gun charges and these concealed wet carry weapon charges you know maybe they might seem silly but if the laws are in place they should be enforced if the the state or the county um or or the federal government if everyone votes for politicians and decides we don't want these laws great but if they're on the books they should absolutely be enforced that's my opinion on that let's see if we have any let's see if we have any comments here on this uh let's see rotten apple news good afternoon I'm not far from MSU and a train derailment and the Palestine train Ground Zero I could do a correspondent report for you yeah that would be that would be nice there is a whole lot going on there of that part of the country I absolutely agree collection of cells hello how is it going um let's see uh rotten apple news it would have been a drop to felony firearm that was mandatory two years um and here we're gonna we have the the law um on that uh when it comes to the Michigan law for concealed carry it's under a state code um 18 uh for firearms and weapons um it it basically says that individuals who don't have Concealed Carry Permits who are concealing firearms you know that is a that is a felony charge um all right let's see if any comments uh Steve Ladner do you consider the Constitution to breed the to be the supreme law of land first of all Steve me and Steve go back and forth all the time on comments and um uh so I want to say good afternoon Steve uh yes I absolutely do consider the Constitution to be the supreme law of the land and the the court system are the ones who are who are supposed to um and those are the the courts are the ones who are supposed to interpret whether or not it's within the Constitution or not um let's see Fred says if a crazy person wants to get a gun he will same as criminals the laws will not stop this I agree with you a hundred percent Fred that's kind of why I said that you know if he had been convicted of a felony that you know technically on paper he would have been prevented from getting a gun but again that what what would that actually do we have laws we have things on the books that you're not supposed to kill people or should people and that didn't didn't prevent him from doing that so the idea that this person who went in who had a history of mental health problems who went in and shot eight people at MSU was gonna say oh well I'm technically not supposed to own a firearm so I guess I'm not going to be able to do it this way like that's not reasonable so Fred I think you are a hundred percent uh correct there uh let's see um okay uh let's see the Constitution affirms our god-given rights absolutely okay um Johnson William uh god-given rights all right okay so the next case that we're going to talk about and this one is this one is really strange I haven't seen the case like this I don't know ever so I think we know a lot of strange things happen in jails and there's a lot of reason because of that so you have people in jail who are who are mentally ill the a lot of times they're in there for long sentences or even for life and they just don't have anything to lose you know you put that in with Corrections Officers where I honestly I I couldn't imagine being a correction officer and if we have any correction officers in here I'd be really curious um if you agree with me if you could um if you could put in the comments some of your thoughts on this so when I was in college doing my undergrad I did something called the corrections Club but it sounds like a lot of fun right essentially what it was is once a month we took a a crazy bus and we toured prisons all around the Midwest which I thought was kind of cool um but that made me realize something that I had already known I would not want to be a corrections officer because the the 40 hours or 60 hours a week because they're so short-handed that you're there you're in prison too that seems absolutely miserable so I know it's a miserable place to work and there's absolutely no excuse for this but this happened in a County Jail in Alabama it was a 33 year old Alabama man who was in the county jail um he had been there since the middle of January and he froze to death he froze to death in the jail I mean and again this is something that typically doesn't happen there's been a lawsuit that was filed on behalf of his family um and essentially what the lawsuit alleges is that this 33 year old man was placed inside of a walk-in freezer naked or some other really cold area in the jail as some type of a strange punishment for bad behavior in jail um so again the the lawsuit for the man and his name was Anthony Mitchell alleges that more than a dozen officials at the jail um this is Walker County Alabama um abused him and then essentially covered up the mystery treatment that caused his death so he was arrested on January 12th and I mean the the facts around his arrest aren't great I mean he deserved to be arrested from everything we know um essentially his family members called for police officers assistance because he was threatening some of the members of his family um deputies from Alabama arrived once they got there he allegedly fired shots at them eventually they were able to get him into custody without shooting back without injuring him or any use of force they were able to get him safely and reasonably into custody which is always the goal even if someone shoots at police officers this is the goal no matter what and police officers at least the deputies who went to his house that day were able to do that they got him into custody and then he went to the jail um during a subsequent search of the house kind of you know during the arrest deputies um found meth heroin and also a handgun from the from from the location kind of confirming that you know just one piece of evidence that he had he had fire shots uh he had fired shots at police officers um eventually so he was there on January 12th and he died on January 26th after he died on January 26th on the allegation because all of this is on video and the attorney for the family has seen a lot of the surveillance video is that it what they are alleging is that after he died or looked like he was in like really bad shape again being naked in a really cold area some type of a strange punishment that he was actually multiple different officials from the jail would like walk in check on him and then leave um and it actually took five hours from the time that he looked like he was in really bad shape five hours to get medical personnel there um he ended up dying when he got to the hospital finally when he was the rescue was called and he was transported to the hospital he had a body temperature of 72 degrees um and again that's absolutely crazy no matter what someone does no matter what type of bad behavior they have this is obviously unacceptable so you have to think about well is this just you know one person at the jail well no because there's not just one bad strange person who works at the jail I mean people who work at the jail would be multiple different people who are Corrections Officers supervisors people who watch the cameras so I mean there had to be all kinds of different people who had their hand in this who you know maybe didn't have it in the intent to kill him obviously but knew that this poor treatment was going on in to think that Mr Mitchell is the only person that this happened to that's going to be real hard for me to believe this seems like it is a systematic problem and my guess is that we're going to get a Memphis style parade of victims who luckily didn't die but had similar treatment and this County Jail is going to go through some pretty some pretty rough times there's gonna there should be some pretty uh severe reform there um just curious if we have any Corrections Officers or anybody with correction experience who has any has any comments on this uh let's see uh the maxo correctional is one of the undervalued jobs so it's that since it's difficult and harsh anywhere oh that that is such a great point because it so correctional officers you know typically I guess it could change different places but typically Corrections Officers aren't paid as much as police officers um typically the requirements to get hired aren't as high so the pay isn't as high and again you're in jail too and at least if you're a police officer you know maybe in your 10 hour shift you know nine and a half hours you're not doing much or you're dealing with either nice people reasonable people people who are victims of crime you know and really it's just a small amount of time that you're actually dealing with like really bad people but when you have people in prison uh and these there are innocent people who are in jail but when you're working in a prison like that really doesn't exist like you're in there with people who have been convicted of crimes or are awaiting trial on serious crimes and um yeah you're in jail too you are in jail yourself that seems miserable so it's a miserable job it doesn't get paid well but it's important we absolutely need it you know so um yeah I mean obviously there could be people in there who are framed uh framed for their crimes like Andy Dufresne in the Shawshank Redemption which is one of the absolute greatest movies if everyone in the prison was like a Brooks uh red and Andy Dufresne Corrections Officers would be okay and fortunately that isn't the case uh all right let's see uh Mark Shire says he was murdered happens all the time yeah it seems like there should be some criminal charges against people for this case I absolutely believe that 100 uh goofy says uh they're supposed to steal your money uh in time for punishment not your life 100 no this it seems like that just seems like I mean it it it well I don't know if there's another word for seems it appears like this was criminal in nature so not only is there an administrative investigation there's absolute criminal investigation this seems like the kind of thing that the federal government is probably going to get involved in for some type of consent decree um because again my guess is that because so many people kind of like The Tyree Nichols case in Memphis so many people were involved that the idea that this was just a one-off one time thing that's not a reasonable way to think about a lot of these things um rotten apple says happens all the time I know some pretty heinous actions to expose uh from Oakland County Jail deputies yeah again I I can't say enough I think there's a lot of problems in jails um it's a bad place to work and um uh it's a bad place to work you're full of uh full of there with criminals and um it doesn't pay very well so yeah that is a recipe for disaster Mark Shire wasn't Shawshank fantastic all right um okay so that was that case and again that's just that's just a tragic case no matter what someone does or how much of an [ __ ] someone is being in jail um there's absolutely no excuse for this this is this is a p appears to be 100 criminal nature there should be an exhaustive and an extensive investigation anyone who's a part of this should be terminated lose their job and or be charged with uh state and federal crimes okay so the next case that I'm going to talk about and I I always say this that you know a lot of these cases they're not one-off cases that you know a lot of times there's a case that happens in Michigan and it's it's a similar case that happens in Texas and you know these cases kind of thread together because if you can imagine that you know if something if a police officer is in a situation in one city the chances that you know the plea a police officer in a different city is also going to have a similar experience uh I mean that's a reasonable thing to think and this is the case that yeah the facts are going to be a little bit different but the reason for the use of force is essentially the same something that I've been arguing for a very long time and essentially this has to do with someone taking the taser of a police officer and a police officer utilizing deadly force now before I get into the facts of this my stance and my opinion on this and definitely put it in there if you think that I'm Incorrect and more importantly put in why so I think that if you take a taser from a police officer and then if there's any threat that you use are going to use that taser against the police officer that's a deadly force situation and it's reasonable and objectively reasonable people for police officers to use deadly force in a situation like that so here we go this happened in Somerset Texas um uh so the officer is a Somerset Texas police officer which apparently is a little town or suburb not far from San Antonio so this police officer was working an off-duty security job over at the Twin Peaks restaurant in San Antonio which isn't an uncommon thing to do so a lot of people let me just explain how this works a lot of the time so a lot of police officers a lot a lot of a lot of a lot of police officers what they do in these side jobs is a lot of times that um the the private businesses contract with the city and let's say the the charge is 75 an hour so this the city takes a cut of that um and then the uh officer takes the the rest of it usually it's at whatever their whatever their typical overtime rate is a lot of times these programs are called like Chiefs overtime programs but usually they are designated by the city um not all the time but usually so because it's designated by the city the city is getting some financial compensation business are getting an actual police officer so even though they're not technically on duty they are on duty in the sense that they are in uniform they have a badge of office they're working in the same jurisdiction that they otherwise have a police officer license in um so you know the business is essentially getting being able to pay for in such a private security officer who you know and depending on the state doesn't have a whole lot of power um they are paying for an actual police officer there are other states where these off-duty jobs have nothing to do with with the police department and actual police officers aren't able to wear their Police Department uniform that can't take a police car um there they are essentially serving as private security so this goes a couple different ways so this was an off-duty security job again a Somerset Texas police officer um he was doing an off-duty security job over at the at the Twin Peaks restaurant I'm in San Antonio and you know these are actually the only the only mountains that you're going to see in San Antonio are right here at this restaurant um and you know when officers work these off-duty jobs you know uh the best way that I can explain it is they typically want less action for these off-duty jobs most police officers have a stressful job and they're not looking on their day off to work a really difficult or or a strenuous or if there's going to be a lot of paperwork or if something's a pain in the ass they're not going to do these jobs a lot of the time because you know overtime is typically something that's easier that's how police officers mostly see it so you know the idea that the officer is looking for a fight or something off duty is absolutely not the case not what police officers are looking to do so in the Twin Peaks restaurant there was a couple individuals who were causing problems and staff wanted them to leave well they have their hired armed police officer security working there so the the police officer did make contact with this uh 34 year old individual this male who was intoxicated he was belligerent who was causing a problem he had been asked to leave and he refused so what happened then is the the the the the police officer um you know started to escort him out he resisted during this resisting and during this struggle he actually grabbed the taser from the police officer he grabbed the taser from the police officer and he actually fired the taser at the police officer in response the police officer pulled out his firearm and he shot the man one time in the chest um the man didn't die in critical condition um however um that's what happened uh so the police officers on typical normal administrative leave while this is being investigated and um it's being being investigated and uh yeah so it's a little bit controversial but not as controversial as other cases where police officers have have shot someone after they had taken a taser I'll get into that in a second I'm really really curious to see to see what uh comments people have about this let's see Fred says uh that's true a taser is considered a weapon so the police officer at his or her discretion can use deadly force absolutely 100 percent uh Mark says police need retraining they do not know the First Amendment nor it's five elements uh sure I'm always good with always good with police training um yeah so the reason I think that it's a deadly force situation that kind of talked about it earlier so the cases that I always point to are the Garrett Rolfe case in Atlanta um charges were filed against that police officer and then for killing rayshard Brooks in the Wendy's parking lot that Wendy's was later torched because for some reason anti-police Maniacs were mad at the Wendy's store um so but those charges were dropped in the one case that's still pending that I talk about is the Christopher sure case the officer involved shooting with the the the criminal Patrick Loyola in Grand Rapids Michigan officer sure is facing second-degree murder charges that case as I said last week has been extended and will go to trial um supposedly in October but you know just like with that case so if someone takes the taser from a from a police officer and if they take the taser and they throw it well that taser wouldn't be a threat anymore right so a police officer shouldn't be shooting people who are throwing a taser away however if someone takes a taser from a police officer and looks like or seems like or tries to fire the taser at the police officer that's a completely different story and the reason is it's not because of the shock it's not because of the five seconds of or so of pain that the taser causes because think about it most police officers before they're able to carry a taser in order to get certified they have to be tased themselves um not all the time but that's what happens most of the time so if it's something that's going to kill you well then obviously you're not going to do it to police recruits in the police academy to get trained that wouldn't make sense so you know okay we're gonna tase 30 police recruits and recruits in a 15 die oh well no I mean tasers do not kill the vast majority of people otherwise they wouldn't do it to police officers in the training process so it's not this actual shock of the taser the 50 000 volts that's not the danger the danger is is if you shoot a taser at a police officer they are incapacitated for five seconds every time you pull the trigger you can add five more seconds onto that so a police officer is incapacitated while incapacitated the individual who just tased them could take their gun and shoot them they could take a rock and smash them in the face or they could just Stomp the officers head in with their boots so it's reasonable a police officer would want to avoid a situation like that and since the likely outcome is death it's reasonable police officer would utilize deadly force in order to avoid that otherwise what you're asking a police officer to do here's the what you're asking a police officer to do you tell me if this is reasonable so hey police officer you have a person who they just committed a crime they fought with you then they took one of your weapons then they used the weapon on you and now you have to trust that that person isn't going to kill you once you're incapacitated uh that isn't a chance I would take with my life most reasonable people wouldn't take that chance with their life so um but the good thing is a situation like this is just really easy to avoid all you have to do is not steal a weapon from a police officer so most people are able to be decent humans and comply with that all right so let's see if we have any comments or questions on this uh Mark Shire know a de-escalation is is practice not deadly force um yeah a police officer should de-escalate until there's a deadly force and then they have to respond with deadly force that's completely reasonable uh officer blue gone they've got a good question for Mark what's your definition of non-lethal Mark uh let's see the maxo in my opinion de-escalating is the real Jew uh real dual duty of policing I agree it's engaging and has great effects on people to be professional and humble it is difficult but definitely possible I agree with you 100 of the max of police officers should de-escalate they should de-escalate as much as they possibly can until they are posed with a deadly threat and then they should protect their own lives and the lives of other people that is a reasonable thing to do so that's that's that question there um that's that case there like I said it kind of I say a lot of these cases are related because we had the Garrett Wolfe case and then the Patrick Loyola case which is actually still going on with officer Christopher shirk um Dad definitely go ahead and follow that hashtag stand with sure over on Facebook I'm pretty active over there talking about that case because um it is the number one uh case that's going on right now where a police officer is being maliciously prosecuted and they absolutely should not be so um stand with sure hashtag on Facebook find that group it's real real important the next couple cases I'm going to go through are not only are they examples of self-defense I'm gonna talk about self-defense here in a second but not only are they examples of self-defense but there are examples of just badass women so here we go the first one and let me do a little thing on self-defense here real quick so we're going to talk about just regular citizens aside from being a police officer let's talk about regular citizens so regular citizen can use self-defense you are able to defend yourself against a threat so a person in general can use reasonable force in order to protect your life or to protect the life of someone else now once that threat ends and your life is no longer in danger then your ability and your privilege to use that Force well that ends too so first case that we have about self-defense and about a badass female so this happened on January 17th of this year and this happened in Chicago so there's an off-duty Chicago female police officer and she breaks up a fight between four individuals here we're gonna have a we're gonna we're gonna put a picture of her on the screen now let me just say this way so if you're a police officer and you're on duty you're in uniform you have your badge you have your your gun your taser your shotgun your your AR are whatever you have all of your tools you have a radio to call for help even in a situation like that it is almost never advisable for a single police officer to try to break up a fight by themselves of four individuals that's why police officers typically travel in pair so again one person trying to do this is extremely dangerous so here we have an off-duty police officer she doesn't have all all of her weapon systems on her she's not in uniform she doesn't have a radio to call for help but she sees four males engaged in in a fight outside of a residential area and she decides that she's going to break it up she's going to do the right thing and she's gonna she's gonna be a badass and she's gonna break it up and great so she does she breaks up the fight and she's successful meaning that three of the four people leave they they leave and they walk away and they go in different directions which is the objective that's what she wanted to happen that's great maybe she prevented a shooting maybe she prevented a stabbing maybe she prevented someone from just getting their ass kicked by three other people who knows but good for her right so she breaks this Up 3 three people leave they comply and they just they leave she's not trying to arrest anybody or hold anybody against their will she basically tells them get the [ __ ] out of here you need to leave and stop fighting again three of them do one dozen one guy doesn't Levon Smith he decides I'm not going to be a decent human I'm not gonna just leave so as the police officer um starts to walk away um he basically [ __ ] around and he [ __ ] finds out so as the female police officer is walking away he attacks her from behind he attacks her from behind and he starts to grab her gun and she tells him and this is on surveillance video she tells him that she's going to use deadly force she says I'm gonna shoot you I'm gonna shoot you stop attacking me he doesn't listen he keeps trying to grab for her gun while he's grabbing for her gun they start to wrestle and they actually end up on the ground while they're on the ground and he's wrestling trying to get the gun she shoots him three different times after she shoots him three different times he says damn baby I'm sorry I didn't want to die and then she has and then then after that she she responds you thought I was playing I told you I'd shoot you and um yeah he ends up he ends up dying not that I don't want anyone to die but the idea that you are going to not only get a man not only are you going to attack a female but you're gonna try to disarm her and take her gun this is the exact kind of thing that is gonna happen and that that dialogue that they had between themselves so I'm originally from the south side of Chicago I lived there for 22 years that that uh that Chicago Trash Talk of damn baby I'm sorry I didn't want to die and she says you thought I was playing I told you I'd shoot you you don't [ __ ] around with Chicago women and um yeah so he he ended up dying but it's one of those things he's not going to commit any more crimes um the type of person who is going to attack a female and try to take a firearm from her even after they know that that she is a police officer um 100 appropriate thing and I'm glad that she ended up on top uh let's see uh let's see the maxos says you want to fight you're going to get one yeah absolutely uh let's see um she sounded like a gangster and she and [ __ ] around as though the encounter officer blue gun absolutely um yeah so uh let's see and uh yeah there's a couple things about um percentages in in Chicago so Michael Jordan had a great shooting percentage in this female police officer did too so um kudos to her that was an absolutely um a good way for this for this case to end though again no police officer wants to be involved in a shooting especially a shooting off duty just like the last case but um but uh yeah this is this is one of the one of the situations that you absolutely can't avoid um the next case that that we're going to talk about that also has to do with a badass female this isn't a police officer but you know what it doesn't [ __ ] matter this lady is is so unbelievable so this happened in Florida so she she is a 24 year old and she was um working out in the the gym in her apartment complex while she's working out a man who she doesn't recognize but a man and knocks on the door um he's banging on the door and and she lets him in she lets him in and she walks back to the weights that she was lifting we have the video up here um as she walks away um then he approaches her and he you can see what he's doing so he he approaches her he attacks her I'm at one point they kind of run around of where they kind of run around uh he's chasing her around a bench um eventually um you know she is able to escape and she runs into a different room in the gym he chases her he follows her they end up wrestling on the ground and she fights for her life just like she absolutely should this is this is absolutely horrifying this is everyone not just females this is everyone's worst nightmare that you are doing your own thing just being a reasonable person existing in society and the scum of the earth comes and tries to hurt you and sexually assaults you and that's exactly what this guy did what he didn't know is that the woman that he attacked was a 24 year old professional bodybuilder um her name is uh uh nationally Alma and um it turns out that that the offender actually lives in the apartment complex as well his name is Xavier Xavier Thomas Jones after he did this she was able to to escape because she fought I mean what I want to say is if you watch the whole video after the fight and she runs away he is he is breathing heavy he is breathing hard he is so much bigger than her but she fights for her life and she kicks his ass which is absolutely a great thing to do um she's able to get away he ends up going causing a disturbance at a different apartment apartment a different unit in the area and then after that he actually is arrested the next day by police officers which is good you don't ever want someone like this like this to get away so the next day he was charged with a bunch of felonies some kidnapping false imprisonment burglary and sexual battery and that is that is absolutely um the appropriate thing hopefully he'll be going away for decades because a person like this does not need to be with the rest of us in society who are just trying to live our lives doing the right thing working out trying to stay healthy and this is an absolute um uh crazy thing um uh let's let's see we have do have a statement from the from the sheriff who says uh Sheriff uh Chad chronister in the area said I was disgusted by the suspect's actions how he prayed on this young woman This Woman's strength courage and determination are inspiring and they absolutely are which is why I wanted to highlight this story because it's unbelievably important now now uh Miss Miss Alma she was able to fight off this attacker but whether you're male or female that might not be the case so um I always talk about you know having a Concealed Carry um being trained and knowing how to use different things she was unbelievably smart and she was unbelievably aware of of what what was going on and um uh unbelievably smart unbelievably uh uh uh in this situation the reason she came out on top is because of her level of awareness her level of fitness and her just willingness to fight and to not lay down and that was absolutely great um you know I just I should point out that in Albuquerque New Mexico there's actually just a case of a guy trying to defend a lady who got killed at a gas station um yeah this happened in Albuquerque maybe we could cover a little more detail next week but yeah um a crazy individual um was in Albuquerque New Mexico I say crazy because he's literally been the the reports are he's literally been a a mentally ill homeless person causing disturbances and crimes for the last 20 years in in the Albuquerque area um and he started to attack a woman at a gas station one of the gas station employees I'm a 24 year old man a younger guy tried to step in and do the right thing and try to protect this woman who is being you know um assaulted um in this horrible crazy person um he actually had did have a concealed gun and he shot the 24 year old and um he killed him shot him in the stomach he died just absolutely horrible and and tragic thing but this kind of thing does happen with mentally ill people just attacking people for no for no real reason so um I know I always talk about concealed carry and and being armed um it just I think it's something that is so important so definitely look into courses in your area let's see if you have any comments on this uh Fred Cavallari uh cavallario if she identified herself as a police officer someone attacks her from behind she's just fighting shooting him we are talking about the last case a hundred percent uh she might get investigated but she'll come through Fred yeah and uh Fred just like with every case the case absolutely 100 should be investigated um she shouldn't get any special treatment um but the evidence that we have and we have a video which is not perfect but it's pretty good um it's a decent amount of evidence you know um the video so yeah I don't think she's going to be in any trouble because there was obviously a deadly threat that she uh responded to um let's see uh goofy says I was raised to never hit a woman no matter what uh they are always options like running away yeah yeah 100 um and and again this wasn't like a this wasn't like either of these women went and picked these fights these are um horrible violent and disgusting men who are trying to victimize women for absolutely no reason and they both [ __ ] got exactly what was what was coming to them all right now is the case that everyone wants to hear about I'm not sure if the individual who keeps asking us about this case um is on today that they can watch this over on replay over on our Channel cops and cons if they want but this when I started to look into this case okay like listen I get it I get why someone has messaged us like the last three weeks or so asking us to talk about this case because it is a really interesting case and like I said at the beginning this isn't hasn't been a national story like I follow these you know I I do a lot of social media content on on police related news you know I'm here at cops and cons TV where you know we really always look for the most interesting you know body cameras and surveillance surveillance camera footage to put out for our viewers and we didn't know about this case I didn't know about this case but here it is so this happened on December 22nd of this past year in Cherokee County North Carolina so here's how police officers got involved in this case in the first place so this happened at a trailer in in the pictures looks like kind of a remote area it's definitely not in like the middle of a big city kind of like a remote area where there aren't a whole lot of houses around but this happened inside of a mobile home so um a neighbor called a neighbor called and said that the individual who was shot by police officers his name is Jason culpfer individual a neighbor called and said that there was a disturbance going on at Jason's house here's what the neighbor reported to 91122 police officers and I listened to to the 911 call so I know what this guy said he said that over at the trailer uh the mobile home that Jason owns or lives in with his wife that they were arguing Jason and his wife were arguing for about 45 minutes and there was like loud arguments going on then he said he heard 10 shots being fired he said he heard 10 shots being fired and after that nothing radio silence he no longer heard the wife screaming and yelling like she had been for the 45 minutes prior also the neighbor says so the neighbor says hey I actually have most of this on cell phone video so I have the evidence of this like you know I'm not just a crazy person trying to call in something that didn't happen like hey I've got evidence of this so um you know there's there's some credibility to what the individual is saying so obviously police officers go out there like they have to do it would be weird if they didn't right so police officers went out there they tried to make contact at the door um no one answers so essentially they're not able to make any contact with um Jason or his wife they're not answering the door okay fine they're not answering the door um so police officers as they're kind of looking around they're getting ready to leave they see evidence that a gun has been fired so they they see some they see some casings on the ground so now we not only have what the witness says um we have um uh we have cell phone video from the witness who you know some evidence of what happened and now we're seeing that we have some casings on the ground so the police off officers are obviously thinking okay so we have a situation where it's possible that the wife is dead inside the house um and that he's you know holed up in there or maybe he's left the scene and you know that she's either dead or needs help inside the house um so it's again so this part is reasonable from the police officers this is what a normal invest even though this is North Carolina right this is normal for investigators to want to do um so they call the district attorney tell the district attorney what they have which is a good thing to do the district attorney helps the detectives um they get detectives involved and they write a warrant that's signed by a judge for the house based on the facts that they have So based on everything that I said so far I don't think the police officer did anything wrong and if you disagree please put it in there and put why you think the police officers did something wrong and what they should have done instead so that's what we have um up up to this point um so then now they do have a warrant for the house so they call in the SWAT team which is reasonable they have a high risk Warrant Where it's possible that someone you know is going to be armed inside that's the reason for the warrant right that there was a a violent felony you know and someone might be armed inside so they call they call on the SWAT team um eventually while the SWAT team has surrounded the house eventually and so the thing about this is that Jason and his wife have a surveillance camera inside their house pointing at the front door so we can see everything that happens so um you know SWAT team is making noise outside trying to get a hold of them you can see Jason and his wife emerge from a bedroom and walk towards that front door and they kind of say like who's there what's going on um Jason has a black camera in his right hand it's not like a small camera it's kind of like a like I gotta say like a mid-sized camera a black mid-sized camera in his hand this is real close to five o'clock in the morning so it's still dark outside right so Jason exits the house he exits the house with the black camera um a black camera uh it looks like it's a DSLR um is is the kind of camera it is so um he's holding he's holding the the camera in his right hand and he kind of has hands up like this and his left hand he has that up as well and him and his wife both start to exit the door so now they're in the doorway they actually did Jason actually takes about one step out again holding the black camera in his right hand and his other hand is up as he exits he's almost immediately shot by police officers and he shot a couple times he falls back the wife the wife goes you shot him I can't believe he shot him and he ended up dying um police officers then you can see this from the surveillance camera video from inside the residence right so police officers come in and the wife says you shot him you shot him and one of the police officers says it's a camera like questioning like [ __ ] it's a camera so let's talk about what happened here so I I don't have any of the interviews for so this case is still under investigation I don't have any of the interviews from the police officers you know I haven't seen any of their attorneys make any statements but I I think we know what happened here is that as Jason exited the police officer whoever fired the shots thought that that wasn't a camera they thought it was a gun and that's why they fired the shot so that's obviously what happened that's a mistake effect now I'm not saying it's not criminal I'm not saying it's not justified but it's absolutely 100 important to know what the facts are and why someone did what they did was this a police officer being uh malicious in any way were they trying to punish Jason were they trying to murder Jason or did they have an honest reasonable belief that it was that it was a gun instead of a camera well I mean again that's going to be something for a jury hopefully they wear body cams out there if they do we have we haven't we haven't seen it yet but um so we have to talk about this so it was a mistake effect so now that we hopefully we agree it was a mistake effect right because if you don't think it was a mistake effect what you're saying is the police officers in the moment they knew that Jason had a camera and they just felt like murdering him anyways because they wanted to go to jail for a couple decades and ruin their life and lose their lose their pension so so either you think that or you think yeah this was a mistake by cops now again for like the third time a mistake by police can't absolutely 100 be criminal so just because it's a mistake doesn't mean it's not criminal I just want to put that out there so again I hope I can get everyone on the same page to agree it's a mistake of fact once we agree there that it's a mistake effect then we can say whether or not it was criminal here's what we would have to go down here's the legal analysis so the mistake effect was it reasonable was it a reasonable mistake effect if the answer is yes then the officer is probably either not going to be charged or more likely charged but not convicted or if you say no it's not reasonable so the way that you look at this like through the lens of the court case Graham versus Connors what a reasonable police officer um in a similar situation act the same way if that and and how you go well how do you know what's reasonable you go okay well let's look at law let's look at training let's look at the circumstances let's look at the tactics all of that combined is it not is this it's the the standard isn't did this officer perform perfectly like a robot no no it's what a reasonable police officer in a similar situation make that same Choice again if the answer is yes then he's probably not going to be convicted if the answer is no then he probably will be convicted well let's talk about some of the different factors so uh you know so a couple of the factors so you know the officer is saying he thought that it was a gun okay well what evidence do we have that an officer would think that well this case involves a gun right I mean they have evidence that he fired 10 Rounds evidence that you know know possibly he used that gun on on the wife which is why there was a call for service in the first place so so it's not like there was no gun it's not like it's not like this call was about a samurai sword right um or like like Bruce Bruce Willis in in Pulp Fiction you know it's not like this was in reference to a samurai sword you know um I mean like the call was literally about someone with a gun so there was information evidence that there was a gun at some point you know the the caller had had the shots being fired on on on video recording um so then he exits the house and then when he exits the house he does have something black in his hand okay it's black in his hand but a camera isn't a gun but it was dark it was dark outside so you know based on the what the officer saw is it reasonable that in the dark with the knowledge that the guy had a gun prior is it reasonable that you know in a split-second decision that in that moment the officer honestly believed that it was a gun um that's not something that I can answer that's a question not even for prosecutors it's a question for the jury so that's going to be the question in this case again I'm not making a determination whether or not it was technically whether or not it's guilty or anything yet because there is so much more information um that we're going to have to see because we haven't seen the body camera footage what if there's an officer who's two officers down who says okay look it looks like he had looks like he has a camera or what if like four cops yell gun Gunner say hey he's got a gun so that that that would maybe put evidence in One Direction or another this is an interesting case I think it's a complicated case um it's tragic either way because Jason didn't have a gun he was holding a camera either way Jason does not deserve to die and obviously Jason didn't kill the wife because the wife was in there with him so one of the questions we have to ask is why didn't they just answer the door for the police officers the first time and again you know you typically don't have an album especially if police officers don't have a warrant you don't have an obligation to answer the door talk to police officers but it's one of those things I would rather have Jason and contact police officers even if it's over the phone even if you don't want to open the door for police officers just call the non-emergency number and say hey this is Jason I live here cops are trying to contact me me and my wife are here and listen we are not interested in talking to police get a warrant listen if he had done that um and they had police officers had proof of life of the wife um it's very unlikely that they would have gone down this whole rabbit hole and done a warrant and then have a SWAT team come so again I understand constitutional rights I think those are absolutely important but what my goal is in all of this and what I think the goal for police officers should be and any decent person really is how can we make it so there is not only less use of force but less death and tragedy and violence between citizens and police officers so what can we do so maybe there was something in policy that police officers didn't do did they break a window and throw dude what a lot of departments do is during a SWAT call is they will break out a window which I get I get is irritating right fine but they'll break out a window and they'll throw in a cell phone in case the individual doesn't have a phone or doesn't know police are trying to contact them then at least if the police officers can talk to the individuals they could try to de-escalate over the phone they could give instructions they could say hey enter Because if they had given instructions and maybe they did instructions would have been hey exit the house with your hands free and clear that's literally the instruction police officers give on every single time that police officers have an individual exit a house or walk backwards towards them from a vehicle it's exit with your hands up and empty up and empty this is why this is absolutely why so again I I is the tragic tragic uh situation Jason obviously did not deserve to die but we have to think what could have been done on either side to avoid this in the future I think it's important to ask those questions you know whether or not the officers are going to be charged or prosecuted it all depends on how reasonable this was and I think we need the body camera footage and the statements from the police officers to really see what happened there also let's see officer blue gun did you also notice even after the the hail a gunfire he never dropped the cigarettes uh God God among men in the trailer park oh my God uh that's interesting comment thank you officer blue gun Reds did General District Court I'm going to try my question from the other week again uh 200 character limit kills me uh okay on January 15th I was in downtown Austin when the cops uh shot a guy uh to death nearly the block I was walking on uh can I offer to join in next time um I left talk to our producers to see if we um do that kind of thing and um but definitely again if you have questions or a specific case or you have body camera footage that you want to send us um definitely send over we'll look at it just like I did with this case we got this case because this case in North Carolina again wasn't a national case it was a local case I didn't know about it until people actually contacted us uh let's see uh blue collar POV uh let's see uh we have any other comments on this case uh let's see if we have any other comments on this case going up a little more um uh okay I don't I work with the Department of the 120 sworn um I worked in the department let's see uh don't don't really see if we have any other comments on this case someone said trigger happy cops I mean it could be I want I want to see the body camera footage again if he entered if he exited the house with nothing in his hand um what could we say trigger happy cops okay okay fine but like he had something in his hand that at night could reasonably look like a gun like it's not unreasonable for the human eye to to and for the brain to process that in the moment that isn't completely unreasonable uh let's see officer blue gun the camera was a police remote uh control wheel drone wasn't it and it had a flashlight on it so it could have easily looked like a handgun with a lot yeah I agree I think this absolutely could look like a handgun um especially at night especially from some distance away um I I don't think that is that it's unreasonable um you know it's just it's just one of those things where it's um it's um yeah I mean we have to look at it's what's reasonable in the situation uh let's see um no other questions on that but that was a case that definitely wanted to go through all right so that's going to be those were the cases that I wanted to get through today I just want to thank I just want to thank everyone for being in here uh for the for the good questions um I really enjoyed the the back and forth and like I said if there are any other cases that you think about like like Red's General District Courts um uh even if you wanna Reds even if like I said the comments throughout the week I check those on this feed so put it out there throughout the week um I know there's a character limit but you know um doesn't have to be in the moment but when you have time definitely put it out there a whole paragraph in there I promise you I will go through it and read it and if there's some body camera footage um I can look at I absolutely will I want to thank everyone else for being in here and again definitely go ahead and um make sure you like subscribe and share our Channel um uh cops and cons then please go ahead and follow me um over Everywhere YouTube Tick Tock um over at police law news and one I hope everyone has a great weekend thanks
